PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, 20, 2020

The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:30 p.m. in the Government Center, Board Room 201.

3. APPROVAL OF MINUTES - , 2020, Regular Council meeting. MOTION by Councilor Bender, seconded by Fennessey and carried, to approve.

MOTION by Councilor Sutherland, seconded by Fennessey and carried, to suspend the rules and consider item 10.3 immediately.

4. PRESENTATIONS AND PUBLIC HEARINGS 4.1 Kathy Ronchi, Douglas County Health Officer, providing update regarding COVID-19.

6. MAYOR’S REPORT

6.1 They Mayor’s Report.

6.2 Recommending approval to re-appoint John Vaski to the Liability Claims Committee for a term expiring October 2023; and to re-appoint Gene Rosburg to the Parks and Recreation Commission for a term expiring October 2023. MOTION by Councilor Bender, seconded by Elm and carried, to approve.

7.1 Finance Committee Special Meeting, , 2020 1) Chair’s Report. 2) To approve the 2021 Landfill Budget. MOTION by Councilor Ludwig, seconded by Elm and carried, to approve.

7.2 Finance Committee, October 8, 2020 1) Chair’s Report. 4) To approve the Equipment Transfer Agreement and the Amendment No. 5 between Sailboats, Inc. and the City of Superior for a 50-ton travellift. 5) To approve budgeting $10,000 for library late fees. 6) To approve the 2021 Wastewater Budget. 7) To approve the 2021 Stormwater Budget. MOTION by Councilor Elm, seconded by Ludwig and carried, to approve.

7.3 Finance Committee Special Meeting, , 2020 1) To approve the 2021 Health and Dental Plan renewals with HealthPartners Group Insurance. MOTION by Councilor Bender, seconded by Ludwig and carried, to approve. Councilor Fennessey abstains.

7.4 Human Resources Committee, , 2020 1) Chair’s Report. 4) a. To approve the revised Health Savings Account & Health Reimbursement Account policy #11.01D. b. To approve the revised Library Emergency Closing policy #13.07. c. To receive and file the Monthly Personnel Report for , 2020. MOTION by Councilor Ludwig, seconded by Bender and carried, to approve.

8. SPECIAL COMMITTEE REPORTS

9. OLD BUSINESS

9.1 R20-13528 Resolution of the Common Council of the City of Superior, Wisconsin, to call on Burlington Northern Santa Fe to resume payments of claims submitted for abatement of dust residue. Councilor Van Sickle provided an update, read a letter is support of the resolution from Barbara Fellbaum, and a Superior Telegram article from , 1970 regarding a meeting related to taconite dust. UPON UNANIMOUS CONSNT, the council considered Resolution #R20-13528 which passed.

10.1 City Clerk Kalan recommending approval of Miscellaneous Licenses. MOTION by Councilor Bender, seconded by Dalbec and carried, to approve.

10.2 Information Technology Director Shea submitting the Professional Service Agreement with North Point GIS for a variety of GIS services through 31, 2021. MOTION by Councilor Bender, seconded by Ludwig and carried, to approve.

10.3 City Attorney Prell seeking council approval to pursue injunctive relief against Karen Strewler, 2344 Lackawanna Avenue, under Wis. Stat. sec. 62.23(9)(a) to aggressively enforce the removal of junked vehicles and debris from the exterior of the property. Scott Craker and Rhoda Nogorski spoke in favor of allowing enforcement by City Attorney Prell. MOTION by Councilor Sutherland, seconded by Bender and carried, to approve.

10.4 Public Works Director Janigo recommending approval of the agreement with the Western Lake Superior Sanitary District for providing services related to disposal of household hazardous waste to an anticipated cost of $34,000. MOTION by Councilor Dalbec, seconded by Kern and carried, to approve.

10.5 Matters to be Referred: Liability Claims Committee, Claim #20-19. MOTION by Councilor Ludwig, seconded by Bender and carried, to approve.

10.6 O20-4221 Ordinance introduced by the Common Council of the City of Superior, amending City Code Chapter 112 – Traffic Code, Schedule J, Disabled Parking Zones, by adding 1904 Baxter Avenue (both sides). MOTION by Councilor Ludwig, seconded by Elm and carried, to adopt the ordinance.

10.7 Collection Systems Engineering and Operations Manager Abramson and ESD Director Roberts recommending approval to award an emergency contract for Cured-in-Place Pipe rehabilitation of sanitary sewer main MH060188-MH060189 as an emergency service. MOTION by Councilor Bender, seconded by Ludwig and carried, to approve.
