Bill Seeks to Curb Polluting Mexican Trucks Vehicles would not be allowed to travel in California unless they met U.S. standards. By Miguel Bustillo and Marla Dickerson, Times Staff Writers L.A. Times, June 22, 2004 Concerned that a U.S. Supreme Court ruling this month clears the way for thousands of smoke- spewing Mexican trucks to enter the country, a California lawmaker has introduced legislation that would bar them from traveling throughout the state unless they met federal air pollution standards. Supported by environmentalists and California truckers, the bill, by Assemblywoman Fran Pavley (D-Agoura Hills), is sure to rekindle a decade-long dispute over the North American Free Trade Agreement's contributions to pollution in this country, an issue that has ruffled U.S.-Mexico relations. The measure would require that Mexican trucks meet the same federal air pollution standards for their model year as their U.S. counterparts in order to come through California. Mexican trucks, like those in the United States, typically run on diesel fuel, but many are older and have less- sophisticated pollution controls. Pavley said she would not attempt to require the trucks to meet California's tougher state air pollution standards, which could make the legislation vulnerable to legal attacks. But legal experts predicted that a law requiring Mexican trucks to meet federal pollution standards would also face legal challenge. "We're doing everything we can to reduce air pollution in this state, and these [Mexican trucks] could really set us back," Pavley said. "They represent a huge public health risk. -

The Privacy Panic Cycle: A Guide to Public Fears About New Technologies BY DANIEL CASTRO AND ALAN MCQUINN | SEPTEMBER 2015 Innovative new technologies often arrive on waves of breathless marketing Dire warnings about hype. They are frequently touted as “disruptive!”, “revolutionary!”, or the privacy risks associated with new “game-changing!” before businesses and consumers actually put them to technologies practical use. The research and advisory firm Gartner has dubbed this routinely fail to phenomenon the “hype cycle.” It is so common that many are materialize, yet conditioned to see right through it. But there is a corollary to the hype because memories cycle for new technologies that is less well understood and far more fade, the cycle of hysteria continues to pernicious. It is the cycle of panic that occurs when privacy advocates repeat itself. make outsized claims about the privacy risks associated with new technologies. Those claims then filter through the news media to policymakers and the public, causing frenzies of consternation before cooler heads prevail, people come to understand and appreciate innovative new products and services, and everyone moves on. Call it the “privacy panic cycle.” Dire warnings about the privacy risks associated with new technologies routinely fail to materialize, yet because memories fade, the cycle of hysteria continues to repeat itself. Unfortunately, the privacy panic cycle can have a detrimental effect on innovation. First, by alarming consumers, unwarranted privacy concerns can slow adoption of beneficial new technologies. Non-party Subpoena to Consumer Watchdog & Jamie Court Dear Mr. Sletten: We write in response to Defendants’ January 8, 2020 deposition subpoena directed to Jamie Court, President of Consumer Watchdog.1 As we have informed you in our numerous conversations, the documents and testimony sought from Consumer Watchdog and Mr. Court are protected by the First Amendment journalists’ and other privileges. Taking into account the extreme burden already imposed by the seven non-party subpoenas Chevron and Exxon have collectively served on Consumer Watchdog since 2009 (accounting for approximately 500 hours of attorney time in just the last 18 months), it is clear that the purpose in seeking to depose Mr. Court now is simply part of a larger strategy to harass, intimidate, and inconvenience the organization as punishment for its investigative reporting into the oil and gasoline industry over the last 25 years. The sheer breadth and intrusiveness of Chevron and Exxon’s three most recent subpoenas, dated September 6, 2018; July 24, 2019; and January 8, 2020, leads to no other plausible conclusion as to the basis for the subpoena now directed to Mr. Court other than to muzzle a long- time critic of the industry, and is a clear abuse of discovery. We are sure of this because Google recently admitted it has collected large quantities of internet data from houses all over the United States. One of these houses may have been yours. We know this because we recently performed a simulation of Google’s operation and sent “packet sniffers” to the neighborhoods of several Members. In several locations we found unencrypted networks, including in the vicinity of your residence in Washington, DC. Of course, we did not examine or store any information other than basic information about the networks, but we can’t say the same about Google. Attached and available on our InsideGoogle.org web site are pictures of your residence taken by Google Street View cars. We know now that Google not only took pictures of your home, the company also attempted to record your wireless Internet data. We call on the House Energy and Commerce Committee to investigate and hold hearings on these privacy invasions by Google. Recently Google admitted its Street View cars were not just taking photographs but snooping on countless private WiFi networks over the last three years as they prowled streets in thirty countries around the world. We have duplicated Google’s method of locating networks, but unlike Google, we scrupulously avoided recording “payload data.” We found that some members may have open WiFi networks that Google likely spied on. -

Executive Summary At the beginning of February 2015, Tesoro shut down its Martinez refinery in the face of a steelworkers’ strike, rather than let it run at less than full capacity during planned maintenance. Just a few weeks later, Exxon’s refinery in Torrance had an explosion and fire, hobbling its ability to make gasoline. In the space of that month, California gasoline prices spiked by more than one dollar a gallon, even though crude oil costs remained low and national gasoline prices rose only moderately. Californians have perennially experienced steep gasoline price spikes since 1999 when California’s Attorney General formed a Gasoline Pricing Taskforce that identified market consolidation and limited inventories as causes of prices spikes. Consumer Watchdog’s president Jamie Court represented the California Assembly on that taskforce along with leading industry and government representatives. “Price Spiked: How Oil Refiners Gouge California and What It Costs” analyzes gasoline prices during the last decade and finds the forces identified by the Attorney General’s taskforce fifteen years ago have intensified due to the lack of government action. During a gasoline price spike, the persistent gap between what Californians and Americans pay for their gasoline typically grows larger. This analysis shows that California’s oil refiners profit greatly from these price spikes and California drivers pay a huge price. In this analysis, Consumer Watchdog utilized government and private data from sources including the Energy Information Administration, GasBuddy.com, the California Energy Commission, and the California Board of Equalization. We charted the difference between the average price of gas in California and nationally over the last decade and uncovered the reasons for the gap. -
