RE: VOID DIRECTOR OF HEALTH ORDER REGARDING COUNTY FAIRS Representative Smith, T. moved to amend the title as follows: Add the names: "Representatives Koehler, Smith, T., Jones, Kick, Stoltzfus" Representative Jones moved to amend as follows: In line 2 of the title, after "fairs" insert "and create the Agricultural Society Working Group for 2021" After line 5, insert: "Section 2. (A) The Agricultural Society Working Group for 2021 is hereby created to study and recommend protocols for the safe and hygienic operation of agricultural society fairs, and for festivals held by other organizations. (B) The Working Group shall meet periodically and shall conduct its initial meeting not later than fifteen days after the effective date of this section. The Working Group shall publish initial recommended protocols not later than April 10, 2021. The Working Group may update its recommendations at any time prior to the working group's termination. In line 256, after "evidence" insert ", subject to division (D)(2) of this section," In line 262, after "(D)" insert "(1)" After line 277, insert: "(2) If a person described in division (C) of this section raises the matter of the person's serious mental illness at the time of the alleged commission of the aggravated murder and, prior to, on, or after the effective date of this section, the person has or has had an evaluation performed other than pursuant to a court order issued under division (F) of this section, the person shall provide the results of the evaluation to the prosecution at least thirty days prior to the pretrial hearing. If the person does not provide the results of the evaluation to the prosecution at least thirty days prior to the pretrial hearing, the results of the evaluation are inadmissible at the hearing." In line 303, after "division." insert "If the person refuses to submit to an evaluation ordered under this division, the court shall issue a finding that the person is not ineligible for a sentence of death due to serious mental illness."
