The Waveney District Council (Reorganisation of Community Governance) Order 2017

Made 25th day of January 2017

Coming into force in accordance with article 1(2)

Waveney District Council (“the council”), in accordance with section 82 of the Local Government and Public Involvement in Health Act 2007 (“the 2007 Act”), has undertaken a community governance review and made recommendations dated 16th November 2016:

The council has decided to give effect to those recommendations and, in accordance with section 93 of the 2007 Act, has consulted with the local government electors and other interested persons and has had regard to the need to secure that community governance reflects the identities and interests of the community and is effective and convenient:

The council, in accordance with section 100 of the 2007 Act, has had regard to guidance issued under that section:

The council makes the following Order in exercise of the powers conferred by sections 86, 98(3), 98(4), 98(6) and 240(10) of the 2007 Act.

Citation and commencement 1. (1) This Order may be cited as the Waveney District Council (Reorganisation of Community Governance) Order 2017. (2) Subject to paragraphs (3), (4), and (5) below, this Order comes into force on 1st April 2017. (3) Articles 12, 13, 14, 15 and 16 shall come into force on the ordinary day of election of councillors in 2017. (4) For the purposes of: (a) this article, (b) articles 7 and 8; and (c) proceedings preliminary to or relating to the elections of parish councillors for the parishes of Corton, , and , to be held on the ordinary day of election of councillors in 2017, this Order shall come into force on 26 January 2017. (5) For the purposes of article 9 and Schedule 6, the balance of funds from the Lowestoft Charter Trustees shall transfer on 8th May 2017.

Interpretation 2. In this Order— “district” means the district of Waveney;

“existing” means existing on the date this Order is made;

“map” means the map marked “Map referred to in the Waveney (Reorganisation of Community Governance) Order 2017” and deposited in accordance with section 96(4) of the 2007 Act: and any reference to a numbered sheet is a reference to the sheet of the map which bears that number; “new parish” means new parish constituted by articles 4 and 5 and “new parishes” means both of them; “ordinary day of election of councillors” has the meaning given by section 37 of the Representation of the People Act 1983; and “registration officer” means an officer appointed for the purpose of, and in accordance with, section 8 of the Representation of the People Act 1983.

Effect of Order 3. This Order has effect subject to any agreement under section 99 (agreements about incidental matters) of the Local Government and Public Involvement in Health Act 2007 relevant to any provision of this Order.

Constitution of new parishes 4. (1) A new parish, comprising the area outlined with a blue line on the map referenced as ‘Map 2’, shall be constituted within the district. (2) The name of the new parish shall be Lowestoft. 5. (1) A new parish, comprising the area outlined with a red line on the map referenced as ‘Map 3’, shall be constituted within the district. (2)The name of the new parish shall be Oulton Broad.

Calculation of budget requirement, and funds and balances to be transferred or ring-fenced for use by new councils 7. For the purposes of regulation 3 of the Local Government Finance (New Parishes) () Regulations 2008 No. 626 there is specified in relation to the parish of Lowestoft the sum of £1,392,280.00. 8. For the purposes of regulation 3 of the Local Government Finance (New Parishes) (England) Regulations 2008 No. 626 there is specified in relation to the parish of Oulton Broad the sum of £176,720.00. 9. The funds and balances referred to in Schedule 6 shall be transferred to the new parishes or held by Waveney District Council and ring-fenced for use by/in consultation with the new councils, in accordance with such Schedule 6.

Parish council for the parish of Lowestoft 10. (1) There shall be a parish council for the parish of Lowestoft. (2) The name of that council shall be “Lowestoft Parish Council”.

Parish council for the parish of Oulton Broad 11. (1) There shall be a parish council for the parish of Oulton Broad. (2) The name of that council shall be “Oulton Broad Parish Council”.

Election for the parish of Corton 12. (1) The election of all parish councillors for the parish of Corton shall be held on the ordinary day of election of councillors in 2017.

(2) The term of office of every parish councillor elected on the ordinary day of election of councillors in 2017 for the parish of Corton shall be two years.

(3) The next election of all parish councillors for the parish of Corton shall be held on the ordinary day of election of councillors in 2019, and every four years thereafter.

Elections for the parish of Lowestoft 13. (1) Elections of all parish councillors for the parish of Lowestoft shall be held simultaneously on the ordinary day of election of councillors in 2017.

(2) The term of office of every parish councillor elected on the ordinary day of election of councillors in 2017 for the parish of Lowestoft shall be two years.

(3) The next election of all parish councillors for the parish of Lowestoft shall be held on the ordinary day of election of councillors in 2019, and every four years thereafter.

Election for the parish of Oulton Broad 14. (1) The election of all parish councillors for the parish of Oulton Broad shall be held on the ordinary day of election of councillors in 2017.

(2) The term of office of every parish councillor elected on the ordinary day of election of councillors in 2017 for the parish of Oulton Broad shall be two years.

(3) The next election of all parish councillors for the parish of Oulton Broad shall be held on the ordinary day of election of councillors in 2019, and every four years thereafter.

Number of parish councillors for the parish of Lowestoft 15. The number of councillors to be elected for the parish of Lowestoft shall be 20.

Number of parish councillors for the parish of Oulton Broad 16. The number of councillors to be elected for the parish of Oulton Broad shall be 12.

Wards of the parish of Lowestoft and numbers of parish councillors 17. (1) The parish of Lowestoft shall be divided into 7 wards which shall be named as set out in column (1) of Schedule 1. (2) Each ward shall comprise the area designated on the map referenced as ‘Map 2’, by reference to the name of the ward and demarcated by orange lines. (3) The number of councillors to be elected for each ward shall be the number specified in respect of the ward in column (2) of Schedule 1.

First annual meeting of parish council 18. The annual meeting in 2017 of the Council of any new parish shall be convened by the Chief Executive of Waveney District Council. The meeting shall take place no later than 14 days after the day on which the councillors elected to the new parish councils take office.

Alteration of parish area of Corton Parish Council 19. (1) The areas coloured dark green and designated by the letter “A” on the map referenced as ‘Map 4’ shall cease to be part of the and shall become part of the parish of Corton.

Electoral register

20. The registration officer for the district shall make such rearrangement of, or adaptation of, the register of local government electors as may be necessary for the purposes of, and in

consequence of, this Order.

Transfer of property, rights and liabilities 21. All interests in the land, property, rights and liabilities described in Schedule 2 (subject to any existing leases or licences in respect of such land or property) shall transfer from Waveney District Council to Lowestoft Parish Council on the date specified in column (3) of Schedule 2 and it is a condition in respect of the specific property indicated in Schedule 2 that there will be a leaseback from Lowestoft Parish Council to Waveney District Council simultaneously with the completion of such transfer. 22. All the interests in the land, property, rights and liabilities described in Schedule 3 (subject to any existing leases or licences in respect of such land or property) shall transfer from Waveney District Council to Oulton Broad Parish Council on the date specified in column (3) of Schedule 3 and it is a condition in respect of the specific property indicated in Schedule 3 that there will be a leaseback from Oulton Broad Parish Council to Waveney District Council simultaneously with the completion of such transfer. 23. All other interests in property as described in Schedule 4 shall transfer from Waveney District Council to Lowestoft Parish Council on the date specified in column (3) of Schedule 4. In respect of the ‘Lowestoft Collection’ as detailed in Schedule 4, ownership of the collection will transfer on 1st April 2017, however the collection shall remain subject to a current loan agreement with the Lowestoft Archaeological and Local Historical Society which will expire on 31st May 2017, and it is a condition in respect of the ‘Lowestoft Collection’ specified in such Schedule that Lowestoft Parish Council continue with the loan agreement to the Lowestoft Archaeological and Local Historical Society for at least one year from 31st May 2017. 24. In accordance with paragraph 7 of the Local Government (Parishes and Parish Councils) (England) Regulations 2008 No. 625 Waveney District Council is transferring the benefit, burdens, rights and liabilities to either Lowestoft Parish Council or Oulton Broad Parish Council (as the case may be) of several contracts details of which are listed in Schedule 5 and this Order gives effect to such transfer. 25. The allotments located within the new parish areas will transfer in accordance with legislation from Waveney District Council to Lowestoft Parish Council or Oulton Broad Parish Council on 1st April 2017, as listed in the explanatory note to this Order.

Charter Trustees of the Town of Lowestoft 26. (1) Any powers to appoint local officers of dignity exercisable by the charter trustees immediately before the date of dissolution shall be exercisable by the new parish councils. (2) Any functions which would have been exercisable in relation to the account of the charter trustees or as the case may be their responsible financial officer if the charter trustees had not been dissolved shall on and after the date of dissolution be exercisable by the new parish councils or as the case may be the parish councils’ responsible financial officer. (3) The Mayor of Lowestoft in office immediately before the date of dissolution shall, notwithstanding the dissolution of the charter trustees, continue in office until the election of the chairmen at the first annual meeting of each new parish council in 2017.

Charitable property 27. (1) Waveney District Council is the charity trustee of the charities and the charitable property described and indicated in Schedules 2 and 3. (2) The charitable property indicated in Schedule 2 shall vest in Lowestoft Parish Council (on the same trusts) in its capacity as Charity trustee from 1st April 2017. (3) If sub-paragraph (2) does not apply or does not give effect to the proposed vesting, Waveney District Council and Lowestoft Parish Council shall take steps to execute the necessary documentation to complete such vesting subject, if required, to the approval of the Charity Commission. (4) The charitable property indicated in Schedule 3 shall vest in Oulton Broad Parish Council (on the same trusts) in its capacity as Charity trustee from 1st April 2017.

(5) If sub-paragraph (4) does not apply or does not give effect to the proposed vesting, Waveney District Council and Oulton Broad Parish Council shall take steps to execute the necessary documentation to complete such vesting subject, if required, to the approval of the Charity Commission.

Order date 28. 1st April 2017 is the order date for the purposes of the Local Government (Parishes and Parish Councils) (England) Regulations 2008 No. 625.

EXPLANATORY NOTE (This note is not part of the Order)

This Order gives effect to recommendations made by Waveney District Council for the creation of new councils for the parishes of Lowestoft and Oulton Broad.

The parishes of Lowestoft and Oulton Broad will be created with effect from 1 April 2017. The electoral arrangements apply in respect of parish elections to be held on and after the ordinary day of election of councillors in 2017.

Articles 12, 13 and 14 provide for parish elections in the parishes of Corton, Lowestoft and Oulton Broad in 2017, and then to continue according to the established system of parish elections every four years from 2019.

Articles 15 and 16 specify the numbers of parish councillors for the new parishes of Lowestoft and Oulton Broad.

Article 17, Schedule 1 and the map referenced as ‘Map 2’ establish the names and areas of the wards of the new parish of Lowestoft and the numbers of councillors for each ward.

Article 20 obliges the Electoral Registration Officer to make any necessary amendments to the electoral register to reflect the new electoral arrangements.

The maps defined in article 2 show the new wards of the parish of Lowestoft, the boundaries of the new parishes of Lowestoft and Oulton Broad, and the changes to area of Corton Parish Council. They are available, at all reasonable times, at the offices of Waveney District Council.

Articles 21, 22, 23, 24 and 25 contain details of land, property, rights and liabilities described in Schedules 2, 3, 4 and 5 that shall transfer from Waveney District Council to Lowestoft Parish Council, and to Oulton Broad Parish Council, on 1st April 2017.

Under Regulation 9 of the Local Government (Parishes and Parish Councils) (England) Regulations 2008, land held or used in Lowestoft and Oulton Broad for the purposes of the Allotments Act 1908 – 1950 will be automatically transferred from Waveney District Council to Lowestoft Town Council and Oulton Broad Parish Council respectively. Article 25 provides that the transfer of allotments applies on 1st April 2017. The allotments to be transferred are detailed below:
