1. MAYOR’S ACTIVITY UPDATE:

Mayor Antonio Martinez recognized Ms. Cecilia Balli, whom was honored by the Brownsville Independent School District Hall of Fame, a 1994 Valedictorian graduate from in which he also noted that she was writing an article of the City of Brownsville for the Texas Monthly Magazine.

2. COMMISSIONERS’ ACTIVITY UPDATE:

Commissioner John Villarreal announced and invited the community to set a Guinness World Records Title for the largest Huapango Dance to be held on Saturday, April 22, 2017 starting at 5:30 p.m. at the Brownsville Sports Park. Commissioner Deborah Portillo invited the community to attend the AARP event to be held on Thursday, April 20, 2017 from 8:30 a.m. to 5:30 p.m. at the Brownsville Event Center. Commissioner Jessica Tetreau mentioned that the Annual springtime Graffiti clean-up was held on April 15, 2017, in District 2. Commissioner Tetreau also reminded the public that early voting would start on Monday, April 24, 2017 and encouraged the community to vote.

6. Public Hearing and ACTION on a Substantial Amendment to the Program Year (PY) 2014 One Year Action Plan, specifically to the Emergency Solutions Grant (ESG) Program.

Ms. Marina Zolezzi, Grants Director, introduced Ms. Julia Lash, CDBG Manager, whom delivered a PowerPoint presentation in regards to the proposed substantial amendment to the Program Year (PY) 2014 One Year Action Plan, specifically to the Emergency Solutions Grant (ESG) program. Upon motion by Commissioner Jessica Tetreau seconded by Commissioner Ricardo Longoria, Jr., and carried unanimously, the public hearing was closed. Commissioner Jessica Tetreau moved that the Substantial Amendment to the Program Year (PY) 2014 One Year Action Plan, specifically to the Emergency Solutions Grant (ESG) Program, be approved. The motion was seconded by Commissioner John Villarreal and carried unanimously.

7. Public Hearing and ACTION on FIRST READING on Ordinance Number 235-2017-018, to rezone from General Retail “F” (4CF) to General Retail “H” (4CH) for 0.137 acres for Lot 5, Block 246, Brownsville Original Townsite, located at 1114 E. Ringgold St.

9. Consideration and ACTION on Resolution Number 2017-025, in support of Transportation Network Companies in Brownsville.

Commissioner Deborah Portillo gave a brief explanation of the proposed Resolution of the Innovative Transportation options also known as Rideshare Companies for the City. Commissioner Ricardo Longoria, Jr., reminded the Commission of the ordinance that is in place in regards to taxi drivers which are prohibited in parking in front of bars and needs to be followed. Commissioner Longoria, Jr., requested that the item be placed as a public hearing so taxi drivers are able to express their concerns/opinions as well. Commissioner Portillo clarified that the resolution was only to let the people know that the City of Brownsville was business friendly and see what they have to offer and then the Commission can make a decision. Mayor Antonio Martinez, expressed his concerns in regards to the proposed resolution.

Commissioner Jessica Tetreau moved that Resolution Number 2017-025, in support of Transportation Network Companies in Brownsville, be approved. The motion was seconded by Commissioner Deborah Portillo and carried as follow: Ayes: Commissioners Tetreau, Portillo, Villarreal and Mayor Martinez Nays: Commissioners Longoria, Jr.

PURCHASES/BIDS/CONTRACTS:

10. Consideration and ACTION to award a contract for the purchase and delivery of replacement vehicles for various City Departments.

Mr. Jose Perez, Assistant Purchasing Director gave a brief explanation of the proposed contract, noting that the purchase of vehicles would be for various City Departments. Commissioner John Villarreal moved that a contract for the purchase and delivery of replacement vehicles for various City Departments, be awarded to Tipton Ford of Brownsville, Texas, Grapevine DCJ, LLC Dodge of Grapevine, Texas and Caldwell Country Chevrolet of Caldwell, Texas, for a grand total of $631,051.00. The motion was seconded by Commissioner Jessica Tetreau and carried unanimously. 11. Consideration and ACTION to approve the purchase of a New Model 2017 Heavy Haul Lowboy Trailer for the City of Brownsville Public Works Department.

Commissioner John Villarreal moved that the purchase of a New Model 2017 Heavy Haul Lowboy Trailer for the Public Works Department be awarded to Holt Truck Centers, of Pharr, Texas in the amount of $103,745.36. A RESOLUTION OF THE CITY OF BROWNSVILLE, TO APPROVE APPLICATION TO THE AUTOMOBILE BURGLARY AND THEFT PREVENTION AUTHORITY GRANT APPLICATION AND TO ACCEPT THE TERMS AND CONDITIONS OF THE GRANT APPLICATION.

WHEREAS, under the provisions of the Texas Revised Civil Statutes Article 4413(37) and Texas Administrative Code Title 43; Part 3; Chapter 57, entities are eligible to receive grants from the Automobile Burglary and Theft Prevention Authority to provide financial support to law enforcement agencies for economic automobile theft enforcement teams and to combat motor vehicle burglary in the jurisdiction; and

WHEREAS, this grant program will assist this jurisdiction to combat motor vehicle burglary and theft; and

WHEREAS, the City of Brownsville has agreed that in the event of loss or misuse of the grant funds, the City of Brownsville assures that the grant funds will be returned in full to the Automobile Burglary and Theft Prevention Authority.

NOW THEREFORE, BE IT RESOLVED and ordered that Charlie Cabler, City Manager, of the City of Brownsville is designated as the Authorized Official to apply for, accept, decline, modify, or cancel the grant application for the Automobile Burglary and Theft Prevention Authority Grant Program and all other necessary documents to accept said grant; and

BE IT FURTHER RESOLVED that Henry Etheridge, Commander, is designated as the Program Director and Pete Gonzalez, Chief Financial Officer, is designated as the Financial Officer for this grant.

BEAUTIFICATION COMMITTEE

AUTHORITY FOR CREATION AND OPERATION: The Beautification Committee was created by Ordinance No. 91-1234, amending Chapter 26 the Code of Ordinances by adding Article X, establishing a Beautification Committee, and amended by Ordinance No. 2001-1234-A.

COMPOSITION: The Committee shall consist of eleven (11) members:  One (1) City Commissioner to serve during the Commissioners term of office  One (1) member from the Tourism Industry  One (1) member from Chamber of Commerce  One (1) member from the Brownsville Natural Resources Committee  and seven (7) additional citizens

METHOD OF APPOINTMENT: Each member shall be appointed by the City Commission.

TERMS OF OFFICE: Each appointed member shall serve a two (2) year term, and the City Commissioner shall serve during the term of office. No voting member may be appointed to more than two (2) consecutive terms full or partial. Said limitation shall not apply to City Commissioner representative.

GENERAL POWERS AND DUTIES: The purpose of the committee shall be to: A. Prepare a Five (5) Year Plan for the Beautification of the City through planting and landscaping; and present it to the City Commission prior to July 31 of each year. B. Develop an Annual Plan outlining the Committee’s recommendations for the upcoming fiscal year and present it to the City Commission prior to July 31 of each year. C. Perform any additional City Beautification duties as determined by the City Commission.

MEETING TIME AND PLACE: The Beautification Committee shall meet the first Wednesday of every month, at 12:00p.m., at different locations.

A quorum consists of six (6) voting members.

WHEREAS, the City of Brownsville is a home-rule city incorporated under and operating under the general laws of this State; and

WHEREAS, Texas Transportation Code Chap. 311.007, as amended, authorized any such city or town to vacate, abandon, and close any street, alley or easement in such city or town; and

WHEREAS, Walter Roy Morton, property owner adjoining the alley described above, has petitioned the Brownsville City Commission to abandon and close said 18’ alley adjacent to lots Twenty-One (21) and Twenty-Two (22), Block 4, Riverside Park Addition, in the City of Brownsville, Cameron County, Texas, according to the map recorded in Volume 8, Page 4, Map Records of Cameron County, Texas;

WHEREAS, Walter Roy Morton has agreed to pay adequate consideration in the amount of $3,780.00 for the alley to be abandoned and closed, as determined by an independent certified appraiser, and with said alley described in exhibits A & B attached to this ordinance;

WHEREAS, the City Commission believes and so finds that it would serve the best interest of the City of Brownsville, Texas, to abandon and close said 18’ alley (exhibits A & B) for adequate consideration to be paid in the amount of $3,780.00 to the City of Brownsville by Walter Roy Morton. The City of Brownsville will retain an utility easement over the entire property to be abandoned and closed;

WHEREAS, the City Commission called a public hearing on the proposed closing and abandonment of said 18’ alley, to be held in the Commission Chamber at City Hall.

NOW THEREFORE BE IT ORDAINED BY THE CITY OF BROWNSVILLE:

Section 1. Under and by virtue of the powers vested in it by the Constitution and laws of the State of Texas, hereby abandons and closes a 18’ alley adjacent to lots Twenty-One (21) and Twenty-Two (22), Block 4, Riverside Park Addition, in the City of Brownsville, Cameron County, Texas, according to the map recorded in Volume 8, Page 4, Map Records of Cameron County, Texas, and more fully described in exhibits A & B attached to this ordinance.

Section 2. The City Commission finds and declares that it is in the best interest of all the citizens of the City of Brownsville that said 18’ alley be abandoned and closed.

Section 3. That the City of Brownsville, Texas, hereby expressly reserves and retains an utility easement over the entire alley to be abandoned and closed (exhibits A & B) for utility purposes located over, under and across said 18’ alley to be abandoned and closed which it now has, together with the right of ingress thereto and to replace any and all pipelines, electric lines, gas lines, sewer lines, and all other facilities relating to or connected with said 18’ alley for utility purposes, as aforesaid.

Section 4. Said 18’ alley is not needed for public purposes, except for the retained easement as described in Section 3, and it is in the public interest of the City of Brownsville to close and abandon said 18’ alley (exhibits A & B) in exchange for consideration totaling $3,780.00 to be paid to the City of Brownsville by Walter Roy Morton, adjacent property owner. The abandonment provided herein shall extend only to the public right, title and easement in and to the tract of land described in this ordinance and shall be construed only to that interest the governing body of the City of Brownsville may legally and lawfully abandon.

Section 5. That Charlie Cabler, City Manager, is hereby authorized and directed to convey by quitclaim deed all of the interest of the City of Brownsville in and to said 18’ alley (exhibits A & B), except for the retained easement over the entire portion of alley to be abandoned and closed as described in Section 3 of this ordinance as per exhibits set forth as A & B, attached to this ordinance.

Section 6. This Ordinance shall be in full force and effect from and after its final passage, approval, and publication, as provided by the Charter of the City of Brownsville and the laws of the State of Texas.

Brownsville Metro is requesting consideration and action for the City Manager to file the Fiscal Year 2017 grant application with the U.S. Department of Transportation, Federal Transit Administration (FTA), for the Section 5307 and Section 5339 funds. Partial funding for the 5307 Urbanized Area Formula Grant was released in March 2017. This funding is given to public transportation systems based off of a formula. The City of Brownsville is submitting this application for Fiscal Year 2017 Urbanized Area Formula Funding (Section 5307). Funding from this grant will be used for operating, capital, and planning assistance for the City of Brownsville, Texas' municipal bus system. Non-federal match for this grant will be coming from the City of Brownsville, Texas General Fund as well as funds provided by the State of Texas for public transit assistance.

On March 25, 2017, Brownsville Metro posted Public Notices of Section 5307 Program of Projects in the local newspaper - the Brownsville Herald. In addition, public hearing for this program will be held on the next available commission meeting being May 2, 2017. We anticipate a resolution number will follow as a result of this meeting.

Capital projects include preventive maintenance and construction costs associated with the completion of the Brownsville Multimodal Terminal (La Plaza at Brownsville). Charges to this grant will include reimbursement for costs incurred prior to grant award and are covered by a Letter of No Prejudice issued on 04/16/2010 (attached).

Federal apportionment stipulates that $1,435,538 federal dollars are available for FY 2017 for the City of Brownsville.

In order to continue providing efficient and reliable service, we are seeking federal funding to replace transit buses that have exceeded their minimum useful life. This in accordance with the FTA's established policy on vehicle useful life, which states that vehicles proposed to be replaced must have achieved at least the minimum normal service life. The age of the transit vehicle to be replaced has exceeded its years of service or mileage at the time of the proposed new/replace vehicles is introduced into service.

Project Benefits As a result of this project, the general public of Brownsville, Texas will greatly benefit from having reliable and efficient transit service. SERVICES TO BE PROVIDED

Services to be provided by the ROW Consultant

1. Initial Appraisal a. Appraiser shall have prior experience and the credentials necessary to perform his/her duties in accordance with federal and state regulations. b. Secure written permission from the owner to enter the property from which land is to be acquired. If the ROW Consultant, after diligent effort, is unable to secure the necessary letter of permission from the property owner, a waiver must be obtained, in writing from City. Maintain permission letters with appraisal reports. c. Prepare and conduct personal pre-appraisal contact with interest owner(s) for each parcel using acceptable City forms. d. Contact property owners or their designated representative to offer opportunity to accompany the appraiser on the appraiser’s inspection of subject property. Maintain record of contact in file. e. Prepare complete appraisal report for each parcel to be acquired utilizing approved City Forms. These reports shall conform to City policies and procedures along with the Uniform Standards of Professional Appraisal Practices. (Prices reflect Summary Report in Narrative Format) f. As necessary, prepare written notification to City of any environmental concerns associated with the right of way to be acquired, which could require environmental re-mediation. g. All completed appraisals will be administratively reviewed by the City and recommended for approval by the City. h. As necessary, the appraiser will coordinate with review appraiser regarding revisions, comments, or additional information that may be required.

2. Initial Appraisal Review a. Review Appraiser shall have prior experience and the credentials necessary to perform his/her duties in accordance with federal and state regulations. b. Review all appraisal reports for each parcel to determine consistency of values, supporting documentation related to the conclusion reached and compliance with City policies and procedures and the Uniform Standards of Professional Appraisal Practices. c. Prepare and submit to City a “Tabulation of Values”, for each appraisal.
