Daniels In my dissertation I conduct an inquiry into the legal phenomenon of pregnancy-specific crime. I discuss my theory of pregnancy exceptionalism in US jurisprudence, explore whether these laws are applied evenly in the population, and if not, why, and ultimately ask how, when, and if the law matters in practice. In order to answer these questions, I analyze pregnancy related US Supreme Court opinions to understand the court’s interpretation of the constitution as it relates to pregnant or potentially pregnant women. Next, I conduct a systematic analysis of state bills and statutes creating pregnancy-specific crimes, with an emphasis on the prosecution of pregnant women for crimes against the fetuses they gestate. Then, I examine arrest cases of pregnant women for crimes against their fetuses in the three states where such crimes have been officially codified: South Carolina, Alabama, and Tennessee. Next, I present my analysis of interviews with prosecutors involved in developing these punitive policies, in order to understand their motivations for doing so.

INTRODUCTION The conference theme-Lawyering at the Edge-evokes images of lawyers ensnared in legal scandals, lawyers testing the boundaries of the ethics rules, and lawyers at their moral and emotional limits. Lawyers at the edge labor under psychological and social pressures. They are tested and tempted. They are under pressure and under attack. The scandals threaten to overwhelm them. I will focus on two kinds of cases where lawyers face those pressures. One kind involves lawyers caught up in controversies where the tactics veer toward the vicious as opponents "fight fire with fire"- cases we often describe as "spiraling," or "out of control," or having "a life of their own." Lurking behind those phrases is the notion that rationality no longer reigns. The second kind involves those public controversies where large numbers of the public use the dispute as a vehicle for vindicating private prejudices and venting personal frustrations.

    A Velvet Hammer: The Criminalization of Motherhood and the New Maternalism Eliza Duggan* In 2014, Tennessee became the first state to criminalize the use of narcotics during pregnancy. While women have been prosecuted for the outcomes of their pregnancies and for the use of drugs during their pregnancies in the past decades, Tennessee is the first state to explicitly authorize prosecutors to bring criminal charges against pregnant women who use drugs. This Note suggests that this new maternal crime is reflective of a social and political paradigm called “maternalism,” which reinforces the idea that women are meant to be mothers and to perform motherhood in a particular fashion. This concept has developed from the “old maternalism” of the nineteenth and early twentieth centuries to the “new maternalism” of the late twentieth and twenty-first centuries. The new maternalism is developing in a modern world, finding its voice through both liberal, mother-centric organizations like MomsRising and conservative individuals like Sarah Palin and her “mama grizzlies.” While new maternalism is developing in a modern context, it still upholds motherhood as the prime directive of women. This Note first tracks the history of policing pregnant women, with an eye for the effects this history has had on women of color and poor women in particular. Next, it describes the progression of maternalism and how it has shaped American politics and culture. Finally, it proposes that the new law in Tennessee criminalizing the use of drugs during pregnancy is reflective of new maternalism. Through the criminalization and policing of pregnant women’s behavior, women’s reproductive freedoms become increasingly constricted.
