NOTICE OF CONFIRMATION OF AN ORDER (OTHER THAN AN ACQUISITION EXTINGUISHMENT ORDER) HIGHWAYS ACT 1980 – SECTION 119 COUNTY COUNCIL PUBLIC PATH DIVERSION ORDER 2012 FOOTPATH 4 MESSING-CUM-INWORTH IN THE BOROUGH OF

On 23 April 2012 Essex County Council confirmed the above Order made under Section 119 of the Highways Act 1980.

The effect of the Order as confirmed is to divert a part length of Footpath 4 Messing-cum- Inworth, commencing at its junction with the metalled track approximately 700 metres north east of the property known as Harborough Hall Cottage, Harborough Hall Lane, CO5 9UB proceeding in a generally westerly direction across the field to rejoin the aforementioned metalled track further west, to an alternative route 4.8 metres in width (being the width of the metalled track) commencing from the aforementioned junction proceeding north easterly along the metalled track for approximately 40 metres to the field corner, then heading westerly along the same metalled track for approximately 300 metres where it continues westerly as the unaffected part of Footpath 4 Messing-cum-Inworth..

A copy of the Order as confirmed and the Order Map have been placed in and may be seen free of charge at Colchester Borough Council Offices, Angel Court, 136-137 High Street CO1 1SP and at the Public Library, Market Road, CM1 1QH during normal working hours. Copies are available on request from Chelmsford Library at a charge.

The alternative route comes into force on 22 May 2012, and the old route shall be stopped up with effect from 29 May 2012, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 03 May 2012 make an application to the High Court.
