CHAPTER ONE DUTCH ART AND THE HUDSON VALLEY PATROON PAINTERS Louisa Wood Ruby One of the earliest "schools" of American painting, the Hudson Valley patroon painters, has often been considered to have derived from seventeenth-century English portraiture. Portraits of English aristo- crats appealed to Dutch patroons as displays of the kind of social status they aspired to in their new country. British mezzotints after original paintings by Sir Godfrey Kneller and others provided the patroon painters with readily available models on which to base their portraits of wealthy Dutch Americans. Unfortunately, this convincing analysis vastly underestimates the influence of Dutch art and taste on the development of these paintings. Frequently overlooked in the discussion of the appeal of British portraiture to Dutch patroons is the fact that English portraiture of the seventeenth century was, in fact, a direct descendant of the Netherlandish portrait tradition. Kneller, the main source for the mez- zotints that flooded New York, was trained in Amsterdam. Sir Peter Lely was born in Holland, and of course Sir Anthony Van Dyck was from Antwerp. Wealthy Dutch families in New York would have been aware of the Netherlandish tradition through works of art they brought with them from their homeland. Indeed, the first paintings produced in New Amsterdam and early New York were essentially Dutch, since no other tradition existed here at the time. When British mezzotints finally arrived in 17 10, they did indeed appeal to the patroon families, most likely because they were works grounded in the Dutch tradition, then overlaid with elements of British culture and style. -

GOULD1 INTRODUCTION In February, 1966, my wife and I began a study of the economy and technology of the aborigines of the Western Desert of Australia. Field studies started with a week-long visit to the Aboriginal Reserve at Wiluna, Western Australia, followed in March by a three-month period of study at the Aboriginal Reserve near Laverton, Western Australia (including visits to the nearby Mount Margaret Mission). In June, 1966, we settled at the Warburton Ranges Mission, using it as a base for studies carried on continuously until June, 1967. Despite the large size of the Western Desert, which is an area of roughly 250,000 square miles encompassing the Great Sandy, Gibson, and Great Victoria deserts of Western Australia and adjacent areas of South Australia and Northern Territory, the aborigines show remarkable uniformity of language and traditional culture throughout the entire region. The term, Western Desert Language (Douglas, 1964), has gained widespread acceptance among scholars working in this region to denote the numerous mutually intelligible dialects that occur in this area. At Wiluna the dialect encountered most often was Katutjara; at Laverton, Mount Margaret, and Warburton, the predominant dialects were Ngata- tjara and Nyatunyatjara. CRAMER1 & JOSEPH EDWARD OLSON2 There is a vigorous debate under way about the scope of the Second Amendment. What are the limits of that right? What “arms” does it protect? Does it protect an individual right to possess and perhaps to carry firearms? The District of Columbia, in its attempt to defend its 1976 gun control law, has argued that the widespread possession of handguns (“pistols”) represents an especially serious public safety hazard, and that even if arguendo, the Second Amendment protects an individual right, it would not extend to pistols, which the District of Columbia characterizes as “uniquely dangerous weapons” that present “unique dangers to innocent persons.”3 This paper examines what was likely the Framer’s original public meaning of the Bill of Rights provision that protects “the right of the people to keep and bear arms,” with no apparent limitations concerning handguns. We do so by examining what the history of pistols in early America tells us about foreseeable technological developments. I. GUNS, ARMS, FIRE-ARMS, PISTOLS: SOME DEFINITIONS A few definitions are appropriate because there have been a few subtle changes in the meaning of some of the terms over the last two centuries. “Gun” had a more restricted meaning in the eighteenth century than it does today, referring in some contexts to privately owned cannon,4 but most often to what today we call long guns: 1.
