July 2020 Advocating for Safe Abortion project SHARING BEST PRACTICES The Advocating for Safe Abortion project (ASAP) has just entered the 2nd year of implementation and we want to celebrate the achievements so far. It has been a year full of action that has seen all 10 member societies setting up their Project Monitoring Units (PMUs), strengthening their capacities in project management and advocacy, and beginning the implementation of their action plans. The year ended with the unexpected outbreak of COVID-19, a pandemic that has changed our ways of working and some of our plans for the future, but that has also thought us more than ever the importance of adapting our work to a constantly changing environment where women’s right to safe abortion remains a priority. This newsletter has the objective to bring the 10 countries involved in the project closer to each other and ensure that they have the opportunity to share their work and to learn from each other’s experiences. This newsletter is in no way attempting to be comprehensive and to represent all the aspects of the work done by the member societies involved, but hopefully it will bring to your attention some interesting examples of what has been done so far. Also, the way the information is presented for each society is a bit different since the best practices have been extrapolated from different activities. Some of them have been shared during the regional learning workshops in the form of Power Point presentations, and some were more extensive documents or reports. So if at any point you would like to learn more about any of the featured examples, feel free to get in touch directly with your colleagues within the relevant society. -

HAMMOCK* Abstract In 2015, a woman known as “Mary Doe” challenged a Missouri abortion restriction requiring her to wait seventy-two hours after receiving certain “informed consent” materials before she could obtain an abortion. Mary Doe challenged the restrictions in federal and state court on religious grounds as a member of the Satanic Temple. This paper examines the Satanic Temple’s litigation through the lens of parody—a literary technique that involves repeating another text’s form or content in order to critique it. Mary Doe’s litigation mirrored that of Hobby Lobby v. Burwell, in which a for-profit corporation claimed a religious accommodation from the ACA’s contraceptive mandate. The litigation forces two comparisons—between mainstream religious beliefs and other strongly held matters of conscience, and between abortion and other constitutional claims—and illuminates the “distortions” that often appear in reproductive rights litigation. INTRODUCTION In 2015, a woman known as Mary Doe challenged an amendment to Missouri’s statute governing informed consent for abortion. The amendment instituted a seventy- two-hour waiting period and required providers to distribute printed materials stating that “the life of each human being begins at conception. Abortion will terminate the life of a separate, unique, living human being.”1 Doe’s lawsuit took a unique approach to challenging Missouri’s abortion restrictions. Instead of alleging that the law violated Equal Protection or constituted an “undue burden” under Planned Parenthood of Southeastern Pennsylvania v. -

Mizuko Kuyo and Japanese Buddhism Anne Page B r o o k s INTRODUCTION As a result of historical crises, overpopulation, and shifting values within at least the last two hundred and fifty years, the Japanese have practiced both infanticide and abortion, but not without bad feelings and concern for the souls of their babies.1 In an effort both to resolve those feelings and to do something for their babies, the Japanese have for at least two centuries practiced mizuko kuyo.2 This article is the result of field study I did in 1979 in Japan. Many people helped to provide a foundation for my understanding of what I observed. I have quoted some of them in this article; other helpful sources were Mr. Ueno Hiroshi, Chief of the International Cooperation Section of the National Diet Library, and Professors Fujii Masao, Hoshino Eiki,Takenaka Shinjo, and Yanagawa Keiichi. Moreover, Professor Saeki Shinko of Sagami Institute of Technology shared with me all the materials he had acquired on mizuko kuyo. I am grateful for the materials and insights provided by these persons even though I must take final responsibility for the interpretations I have made of them. Theoretically, at least, all Buddhist countries accept the anatman doctrine, the absence of a permanent, unchanging self or soul. ABORTION, EUGENICS, AND CIVILIZATION: CATHOLIC ANTI-ABORTION ARGUMENTS DURING THE GREAT DEPRESSION by Kate Hoeting Advised by Catherine Brekus and Natalie Malter A Paper Submitted in Partial Fulfillment of the Requirements for the Degree of Master of Theological Studies, Harvard Divinity School, Cambridge, Massachusetts May 10, 2021 During the Great Depression, financial pressures forced the birth rate so low that the population of the United States declined for the first time in American history.1 This drop may have been due to the increase in abortions despite the procedure’s illegality in every state. It is impossible to accurately determine how many people self-induced, but estimates suggest that the number of abortions at least doubled during the early 1930s.2 Researchers at the time estimated that as many as 40% of pregnancies ended in abortion.3 As gynecologist A.J. Rongy wrote in 1933, “It is common knowledge that abortion has become a widespread feature of American life.”4 To some Catholic theologians, this prevalence of abortions signified the impending downfall of American society, which they characterized as a descent into “paganism.” In articles published in Catholic journals like Commonweal, America, and The Linacre Quarterly, these Catholic men became prominent voices in the American discourse on abortion. Because the need for abortion care increased, the Great Depression sparked a period of revived interest in reproductive healthcare.5 In the early 1930s, three American physicians published the first monographs arguing -

Further, in certain contemporary contexts, Buddhist practices exist to miti- gate the sufering experienced by women who have lost an unborn child, whether through abortion or miscarriage. In modern-day Japan for example, many Buddhists practice mizuko kuyō, a set of formal remembrance rituals, which provides struc- tured support to families in their eforts to mourn, to remember the departed, and to celebrate the redirection of human potential. This contemporary practice is con- sistent with aforementioned tenets of early Buddhist thought. Although seemingly oxymoronic, the Buddhist view of abortion and the mizuko kuyō rituals are human- centric, not only for the families but also for the redirected. Other societies, cultures, and theological perspectives have and may further beneft from reframing any inter- pretation of abortion, not as an inherently moral or immoral act (i.e., a binary), but rather as an act overwhelmingly characterized by the complexity of human emotion in the face of unimaginable loss. This humanistic conceptualization of abortion is manifested by the modern Buddhist practice of mizuko kuyō.
