While I have relied on numerous sources and materials to develop the main argument presented in the thesis, all the materials and sources used have been duly and properly acknowledged. _________________________ _____________________ SIGNED DATE ii ABSTRACT State practice and literature suggest that devolution of power can address the main challenges of underdevelopment, internal conflict and abuse of centralised power in developing states. However, this thesis advances the argument that the design features of devolved government for these purposes are not always compatible. Accordingly, while there are complementary and neutral design features in the three designs, trade-offs have to be made between the unique design features in order to ensure the effective pursuit of the three purposes through a single system of devolved government. Kenya, the case study for this inquiry, confirms the international trend as its major challenges over the last 50 years have been underdevelopment, internal conflict and abuse of central power. As such, development, ethnic harmony, and the limiting of central power featured prominently throughout the entire constitutional review process as purposes to be pursued by means of devolution of power. To this end, the devolution of state power is one of the central elements of the current constitutional dispensation in Kenya. There are trade-offs made in Kenya‟s devolution design in order to accommodate the three purposes of devolution. However, the overall result has been that the emphasis falls on development at the expense of conflict resolution and limiting central power. Nevertheless, regardless of the trade-offs and nature of the final design, the design‟s effectiveness or lack thereof may depend very much on factors external to the design. Lack of political will to make devolution work can negate the effectiveness of even the most perfect design; by same token, political will could make an apparently bad design effective. In practice, therefore, effectiveness depends on an array of other context-specific factors. iii ACKNOWLEDGMENTS “It takes a village to raise a child”, so the old African adage goes.     KENYA ELECTION HISTORY 1963-2013 1963 Kenya Election History 1963 1963: THE PRE-INDEPENDENCE ELECTIONS These were the last elections in pre-independent Kenya and the key players were two political parties, KANU and KADU. KADU drew its support from smaller, less urbanized communities hence advocated majimboism (regionalism) as a means of protecting them. KANU had been forced to accept KADU’s proposal to incorporate a majimbo system of government after being pressured by the British government. Though KANU agreed to majimbo, it vowed to undo it after gaining political power. The majimbo constitution that was introduced in 1962 provided for a two-chamber national legislature consisting of an upper (Senate) and lower (House of Representative). The Campaign KADU allied with the African People’s Party (APP) in the campaign. KANU and APP agreed not to field candidates in seats where the other stood a better chance. The Voting Elections were marked by high voter turnout and were held in three phases. They were widely boycotted in the North Eastern Province. Violence was reported in various parts of the country; four were killed in Isiolo, teargas used in Nyanza and Nakuru, clashes between supporters in Machakos, Mombasa, Nairobi and Kitale. In the House of Representative KANU won 66 seats out of 112 and gained working majority from 4 independents and 3 from NPUA, KADU took 47 seats and APP won 8. BLOOD AND SOIL ISSUES IN THE KENYAN RIFT VALLEY PART 1: The passion with which millions of citizens valued their presidential vote in the stolen 2007 presidential elections can be reflected in scenes of the bloody post-election clashes today that engulfed Rift Valley, Nyanza, Coast, Nairobi, Western and to a less extent in other parts of the country. Nakuru was the latest epicenter of inter ethnic murders. The violent reactions to rigged elections may reflect the pain of deep and historically rooted injustices some of which predate Kenya’s independence in 1963. They are in fact motivated and exacerbated by landlessness, joblessness, and poverty believed to be heavily contributed towards by the prevailing political status quo that has dominated Kenya since independence. This is a system that has continuously perpetrated, in successive fashion, socio- economic injustices that have been seamlessly transferred from one power regime to the next. The Land issue With a fast growing population in Kenya, limited resources including land and jobs, have severely been put in extreme pressure. Responsive political operatives cognizant of this reality have appreciated the importance of incorporating progressive policies that seek to aggressively address poverty, landlessness, unequal distribution of resources and unemployment, as a matter of priority (in their party manifestoes) if any social stability is to be maintained in Kenya. Without doubt, the opposition party ODM sold an attractive campaign package that sought to address historic land injustices, unemployment, inequitable resource sharing and poverty through a radical constitutional transformation, under the framework of the people-tailored Bomas Constitution Draft.

Since independence, the racial and ethnic antagonism among them has weakened a united Muslim’ voice whenever political issues concerning the community arose. As Kenya was preparing for independence, a section of Muslims (Arab Muslims) living at the coast agitated to secede from the rest of Kenya. This demand for secession led to a hostile relationship between the Arab Muslims and other non-Arab Muslim leaders in the country. One effect of this political development is the lasting impact it had on post-independence Muslim politics. The events set a pattern for mistrust between the Arab Muslims and non-Arab Muslims in Kenya. This absence of unity has influenced the way the political elites in Kenya perceive the Muslim community in general. Politicians in Kenya are known to have capitalized on the disunity among Muslims to prevent any united political front from the community. As a result the Muslim community has felt politically marginalized. It is this perceived marginalization which Kenyan Muslims are presently striving to overcome. 3 Introduction In this article, I would like to bring forward the argument that within Kenya’s political scene, racial and ethnic identities play a crucial role in creating division in Muslims’ political engagement.

Based on results from a national probability sample survey conducted in the first week of December 2007, this article shows that, while ethnic origins drive voting patterns, elections in Kenya amount to more than a mere ethnic census. We start by review- ing how Kenyans see themselves, which is mainly in non-ethnic terms. We then report on how they see others, whom they fear will organize politically along eth- nic lines. People therefore vote defensively in ethnic blocs, but not exclusively. In Decem- ber 2007, they also took particular policy issues into account, including living standards, corruption and majimbo (federalism). We demonstrate that the relative weight that individuals grant to ethnic and policy voting depends in good part on how they define their group identities, with ”ethnics” engaging in identity voting and ”non-ethnics” giving more weight to interests and issues.

Pandora Papers: The Kenyatta’s Secret Companies By Africa Uncensored President Uhuru Kenyatta’s family, the political dynasty that has dominated Kenyan politics since independence, for many years secretly owned a web of offshore companies in Panama and the British Virgin Islands, according to a new leak of documents known as the Pandora Papers. The Kenyattas’ offshore secrets were discovered among almost 12 million documents, largely made up of administrative paperwork from the archives of 14 law firms and agencies that specialise in offshore company formations. Other world leaders found in the files include the King of Jordan, the prime minister of the Czech Republic Andrej Babiš and Gabon’s President Ali Bongo Ondimba. The documents were obtained by the International Consortium of Investigative Journalists and seen by more than 600 journalists, including reporters at Finance Uncovered and Africa Uncensored, as part of an investigation that took many months and spanned 117 countries. Though no reliable estimates of their net worth have been published, the Kenyattas are regularly reported to be one of the richest families in the country.
