AND WI1ERIIAS, it is necessary to conserve ancl protect the area, the extent and bor-urdaries of which are specifiecl in paragrapli I of this notification arouncl the protected area of the Mookanibika Wildlife Sanchrary as Eco- sensitive Zone frorn ecological and environlnental poirit of vierv and to prohibit industlies or class of industries and their' operations and processes in tlre said Eco-sensitiye Zone.

NOW TIIIIIIEFORE, in exercise of the powers conlelred by sub-section(1) ancl clauses (v) and (xiv) olsub- section (2) and sub-section (3) olsection 3 of the Environrnent (Protection) Act l9B6 (29 of 1986) read with sub-r-Lrle (3) of rule 5 of the llnvironrnent (Protection) Rr-rles, 1986, the Central Government hereby rrotifies an area of the Moolcambika Wildliie Sanctuary in fhe State of as tlre Ivlookanrbika Wildlife Sancflrary Eco-sensitive Zone (herein after referrecl to as the Eco-sensitive Zone) details of which are as under', namely:-

(l) Mookarnbika Wildlife Sanctuary is situatetl at I(undapur Taluk of district in the State of l(anrataka and the Eco-sensitive Zone is spread over an area of 319.86 square kilornetels (excluding revenue enclosures) with an extent varying fi"orr zero (Sharavathi Valley Wildlife Sanctuary ancl Sorneshwara Wildlife Sanchrary adjoin on nortl.rerl sicle and sonthem sicle o1'the Mookanrbika Wildlife Sanctuary consequently, uo Eco-sensitive Zone has been proposed on these sides) to 10.80 kilornetres fiom the bounclary of sanctuary and the boLrndary descliption of sucli Zone is given in Aunexure-I. (2) The list of 41 villages falling witl-rin the Eco-ser-rsitive Zone along with co-ordinates o1'prominent points and the details ofthe Reserve Forests are appended as Annexure-Il. (3) 'fhe rnap of the Eco-sensitive Zone along with borurclary details and latitr,rdes ancl longitudes is appended as Annexure- III. (a) The Geo Coordinates of n.rajor points on the Eco-sensitive Zone boundary as well as on the sanctuary boundary are appended as Annexure-[V.

2 Zonal Masfer PIan tbr the Eco-sensitive Zone.- (l)TlreStateGovernrnentshall,forthepulposeof tlieEco-ser.rsitiveZone prepare,a ZoralMasterPlan,r.vithin a period of trvo years liom the date of publication of final notification in tlie Official Gazette, in consLrltation with local people and adhering to tl.re stipr-rlations given in tliis notification for approval of Competent Autl'rority in the State Covernrrent. (2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepaled by the State Covenunent irr such rnanller as is specilted in tliis notification and also in consonance witli the relevant Central and State laws and tl.re guidelines issLred by the Central Govemrner-rt, if any. (3) The Zonal Master Plan shall be plepared in consr-rltation with tlie following State Departrnents, for integrating the ecological and environmerltal considerations into the saicl plan:-

(i) Environrnent; (ii) Forest and Wildlife; (iii) Agriculture; (iv) Revenue; ql{fl ']lllTt]I{rl 25 Iqn tI-@rs 3(ii)] "5T {S[1 :

(v/ Urban Development; (ri) Tourisrn; (vii) I(ural Development; (viii) Irrigation and Flood Control; (ix) Municipal; (x) Panchayati Raj; (xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing lancl use, inliasttucture and aclivities, unless so specihed in this notification and the Zonal Master Plan shall factor in irnprovement of a1l infrastructure and activities to be tnore efficient and eco-friendly.

(5) l'he Zonal Master Plan shall provide for restoration of demrded areas, conservation of existing water bodies, rnanagement of catclunent areas, watershed management, grorindwatef n]anagetuent, soil and moistnre conservation, needs of local comrnnnity and such other aspects of the ecology and environtucnt that need atter.rfion. (6) The Zonal Master Plan shall dernarcate all the existing worshipping places, villages and ttrban settletnents, tyytes and kinds of forests, agricultural areas, fertile latids, green area, such as, parks artd like places, horticr-rltural at'eas, orchards, lakes and other water bodies and also with supportirrg maps and the Plan shali be supported by Maps givirrg details of existing and proposed land r.rse features. (7) The Zonal Master Plan shall regulate developrnent in tlre Eco-sensitive Zone and aclhere to prohibited, regulatecl activities listed in Table and also ensure and promote eco-f iendly developnrent for livelihood security of local comrnuuitics (8) The Zonal Master Plan shall be co-tenrrinus with the Regional Developn.rent Plan. (9) Tlre Zonal Master PIan so approved shall be the refelence ciocument fbr the Monitorirrg Conrmittee for' carrying out its functions of r-nor.ritor.ing in accorclance with the provisiorrs of this notification.

3. Measures to be taken by State Government.- The State Government shall take the followiug nteasurcs for giving effect to the pr"ovisions of this notification, nalnely:-

1. Landuse.- (a) Forests, horticulture areas, agricnlfirral areas, parks and open spaces earnrarked for lecleational pulposes in the Eco-sensitive Zone shall not be r-rsed ol convertecl into aleas for major cot.nrnercial or tnajor residential cornplex or industrial activities:

Providecl that the conversior.r of agricultural and other lands, for the pnrpose other within the Eco-sensitive Zone nray be pemitted or.r the recommenclation of tlre Monitoring Comn-rittee, and with the prior apploval of the competent authority under the relevant State laws and other rules and regr-rlations of CentraliState Govetntlent as applicable and vide provisions of this Notification, to meet the residential needs of tlie local residents such as.- (i) widening and sfrengthening ofexisting roads aucl construction ofnew roads; (ii) consh'uction and renovation olinfiastructure and civic arnentties; (iii) srnall scale industries uot cattsiug pollution; (iv) cottage industries including village inclustries; convenience stores and local amenities supporling eco-touristr including home stay; and (v) promoted activities and given under para 4:

Providecl further that 1ro use of tribal land shall be permitted for corulelcial and indr-rstrial development activities witl.rout the prior approval of the cornpetent authority undel the relevant State laws and other rules and regulations of State Govemment aud rvitirout compliance of the provisions of article 244 of the Constitr"ttion or tl.re law ibr tl're tirre being in force, ir-rcluding the Schecluled Tribes and other Traditional Folest Dwellers (Recognition of F-orest Rights) Act, 2006 (2 of 2001)',

Provided atso that any error appearing in the iand records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining 1he views of Monitoring Comrr.rittee, once in each case ancl the correctior.r of said eror shall be jntirnated to the Central Governrlent in the Mrnistry of Environnent, Forest ancl Climate Change: Provided also that the correction of enor shall not include change of land use in any case except as providcd under this sub-paragraph. (b) Efforts shall be made to reforest the nnused ol unlrroductive agricultural areas witl'r afforestation and habitat restoration activities.

(3) Tourism/Eco-tourism.- (a) AII new Eco-tourisrn activities or expansion of existing tourisrn activities within the Eco-sensitive Zone shali be as per the Tourism lvlaster Plan for the Eco-sensitive Zone. (b) The Eco-tourism Master Plan sl-rall be preparecl by Deparhnent of ToLrrisrn in consultation with State Departmer.rts of Environment and Forests. (c) The Tourism Master Plan shall fonn a component of the Zonal Master Plan. (d) 'Ihe activities of Eco-tourisrn shall be regulated as under, narrely:- (i) No new constrLrction of hotels and l'esorts shall be allowed within 1 krrl florn the bour-rclary of the I(Lrrclapur Wildlil'e Sanctuary or ullto the extent of tl.re E,co-sensitive Zone whichever is nearer and beyond the distance of I krn. from the boundary of the Wjldlife Sanctuary till the extent olthe Eco-sensitive Zone, the establishnrent of new hotels and resorts shall be allowecl only in pre-defined and designated areas for Eco-toLrrisrn facilities as per Tourisrn Master Plan.

(il) All new toLrrisrr activities or expansion of existing foul'ism activities within the Eco-sensitive Zone shall be in accorclar.ice rvith tlie guidelines issued by tlie Centr-al Covernrnent in the Ministry of Environment, Forest anr'l Climate Change and the eco-tourisrn gtiidelines issued by the National 'Iiger Conservation Authority (as anrended frorr- tinre to tirrre) witlr ernplrasis on eco-tourisrn. (iii) Urrtil the Zonal Master Plan is approved, developrnent for tourisrn ancl expansion of existing tourisrn activities shall be perrnitted by the concemed reglrlatory authorities based on the actual site specific scruLtiny and reconrmenclation of tlie Monitoring Committee and no new hotel /resort or commercial establishnrerit construction is perrnitted rvithin Eco-sensitive Zone area. (4) Nahrral I{eritage.- All sites of valuable natnral heritage in the Eco-sensilive Zone, such as the gene pool l'eserve areas, rock fonnations, rvaterfalls, springs, gorges, groves, caves, points, wall

(5) Man-made heritage sites.- Ruildings, structures, artefacts, areas and precincts of historical, architectllral, aesthetic, and cr-rltr-rral significance sliall be indentifiecl irr the llco-sensitive Zone ancl helitage conservation plan fbr their conservatior.r shall be prepared as part Zonal Master Plan.

(6) Noise pollution.- Prevention and Control of noise pollution in tlie Eco-sensitive Zone slrall be complied with in accordance with Noise Pollution (Regulation Ancl Control) Rules, 2000 under the Environrnent (Protection) Act, l9B6

(7) Air pollution.- Prevention and control o1'airpollution in the Eco-sensitive Zone shall be con.rpliecl rvith ir-r accorclance with the provisions of'the Air (Prevention and Control of PollLrtion) Act, l98l (14 of l98l) and rules rnade thereunder.

(8) Discharge of ellluents.- Discharge ollr'eated effluent in the Eco-sensitive Zone shall be in accorclance witl.r the plovisions of tl.re General Standards forDischarge of Envir-onrnental Polh"itants covered rLnder the Environmental (Plotection) Act, 1986 ancl rlrles rnade thereunder or standalds strpLrlated by State Government.

(9) Solid wastes^- Disposal and Management of solid wastes shall be as under:- (a) fhe solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste lvlanagement Rules, 2016 and publislied by the Governrnent of India in tlie Ministry of Envirorulent, Forest and Climate Charrge vicle notification number S.O. 1357 (E), dated the Sth April,20l6; the ir.rorgar-ric material may be disposed in an environmental acceptable lnarner at site identified outside the Eco-sensitive Zone.

(b)No buming or incineration of solid wastes and establishment of landfilis shall be pennitted in the Eco-sensitive Zone

(l0) llio-medical lvaste.- Bio uredical waste lnanageurent shall be as under: (a)'fhe bio-n'redical waste clisposal in the Eco-sensitive Zone shall be carried out in accordance witli the Bio-Medical Waste lvlanagernent Rules,2016 pLrblishecl by tlie Govelnnrent of lndia in the Ministry olEnviroruuent, Forest and Clirrate Change vide Notillcation nurnber CSR 343 (E), dated the 2Bth March, 20I6. (b)No cornrnoll treatlnenl I'acility or incineration shall be permitted witliin the Eco Sensitive Zone.

(ll) Plastic Waste Manirgement.- The Plastic Waste lr4anagernent in the Eco-sensitiveZone shall be canied orlt as per the provisions of the Plastic Waste Managernent Rules, 20 l 6 published by the Govelnrnent of lndia in the lvlinistry of Environnrent, Forest and Clin-rate Cliange vide notification number G.S.R. 340(E), dated the l8th March, 2016,.

(l2) Construction nnrl Denrolition Wastc Nlnnagemcnt.- The Constrr-rclion ancl Den-rolition Waste N4anagenrent iu thc llco-sensitive Zone shall l>e carr'ied ou1. as per the pr.ovisions oi'the Constniction ancl Denrolititlu Wastc )VlanagenrenL Iqrr lt-Ere 3(ii)] ql{fl E;l {clIfd : .]Iflqlr.q 27

(13) E-waste.- The E- Waste Managernent in the Eco-sensitiye Zone shail be carried ollt as per the plovisions o1 the E,- Waste Managen:ient Rules, 2016 pLrblishecl by the Governrlent of India in the Ministry of Environtlent, Forest and Climate Cliange.

(14) Vehicular traffic.- The vehicLrlar movement of traffic shall be regulated in a habitat friendly lnanner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till sLrch time as the Zonal Master plan is prepared and approved by the Cornpetent Autliority in the State Governrnent, the Monitoring Committee shall rnonitor compliance of vehicular lrovement under tlie relevant Acts ancl the rules and regulations made thereLtnder.

(15) Vehicular Pollution.- Prevention and control of Vehicr-rlar Poilution shall be cornplied with in accordance with applicable laws and the efforts to be rnade for use of cleaner frrel for exarnple CNG, LPG, etc.

(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polhrting indr,rsfries shall be allowed to be set r"rp within the Eco-sensitive Zone. (17) Protection of Hill Slopes.- The protection of hill slopes shall be as under:- (a) The Zonal Master Plan shall indicate areas on hill slopes where no constructiorr shall be pelniitted. (b) No constmction on existing steep lrill slopes or slopes with a high degree of erosion shall be permitted. (1 8) The Central Governrrent and the State Governn.rent shall specifu other additional nreasures, if it considers necessary, in giving effect to tlre provisions of this notification.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.- All activities in the Eco sensitive Zone shall be governed by the provisions of the Environnrent (Protection) Act, 1986 (29 of 1986) and the rules urade there under including the Coastal Regulation Zone (CRZ),2011 .and the Environmental Impact Assessrnent (EIA) Notification, 2006 and other applicable larvs including the Forest (Corrservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1921), the Wildlife (Protection) Act 1972 (53 of 1972), and arnendrnents rnade thereto ar.rcl be regulatecl in the rnanner specified in the Table below, narnely:-
