Not to give effect to marriages unless parties are competent to contract marriage. Every law made or to be made by the legislature of any such possession as aforesaid for the purpose of establishing the validity of any marriage or marriages contracted in such possession shall have and be deemed to have had from the date of the making of such law the same force and effect for the purpose aforesaid within all parts of Her Majesty’s dominions as such law may have had or may hereafter have within the possession for which the same was made: Provided that nothing in this law contained shall give any effect or validity to any marriage unless at the time of such marriage both of the parties thereto were, according to the law of England, competent to contract the same. 2 Definition of “legislature.” In this Act the word “legislature” shall include any authority competent to make laws for any of Her Majesty’s possessions abroad, except the Parliament of the United Kingdom and Her Majesty in Council. 2 Colonial Marriages Act 1865 (c. 64) Document Generated: 2021-05-20 Changes to legislation: There are currently no known outstanding effects for the Colonial Marriages Act 1865..

    IMPERIAL LAWS APPLICATION BILL NOTE THIS Bill is being introduced in its present form so as to give notice of the legislation that it foreshadows to Parliament and to others whom it may concern, and to provide those who may be interested with an opportunity to make representations and suggestions in relation to the contemplated legislation at this early formative stage. It is not intended that the Bill should pass in its present form. Work towards completing and polishing the draft, and towards reviewing the Imperial enactments in force in New Zealand, is proceeding under the auspices of the Law Reform Council. It is intended to introduce a revised Bill in due course, and to allow ample time for study of the revised Bill and making representations thereon. The enactment of a definitive statutory list of Imperial subordinate legis- lation in force in New Zealand is contemplated. There is firstly listed links to websites and then scanned volumes of collections of statutes. For up to date legislation it is best to check the relevant website. The links to collections of statutes are mainly to those provided by Google Books., the Hathi Trust (those with a university name shown) and the Internet Archive. As far as the scanned volumes are concerned, Google Books and the Hathi Trust do not automatically provide access to books published 140 years or less ago to non-US IP addresses because of copyright worries although this is over-cautious if reproducing just the text of the UK and Irish legislation is concerned. In 2020 both seem to become more relaxed. For US IP addresses, the period used is 95 years but links to items only available in the United States are not included in the links shown. The Internet Archive is more relaxed and odd volumes to 1908 are available. More than one link may be shown, (although once one link has been found, others have not been deliberately looked for) as defects in one copy of a book may not appear in another and, even if the same copy of a book or even scan has been used to provide scans for the different providers, the formats available may differ. As far as the scanned volumes are concerned, for England & Wales there are initially listed links to the Statutes of the Realm, which aimed to be comprehensive to 1714.

THE BRITISH INTERPRETATION ACT Sir Noel Hutton * In his recent major work, "The Interpretation and Application of Statutes", Professor Reed Dickerson included a final chapter dealing with legislative control. Here he postulated that every provision of the typical interpretation act is designed to serve one or more of eight distinct purposes and went on to consider how far those purposes are both legitimate and attainable. The illustrations which followed were mainly taken from the Uniform Statutory Construction Act which, as he observed, followed the English pattern originally laid down in "Lord Brougham's Act" of 1850 and subsequently crystallised in the Interpretation Act of 1889. Since the British have just replaced the Act of 1889, this may be a suitable moment to consider how the new Act matches up with Professor Dickerson's analysis. The process of preparing the new Act, the Interpretation Act 1978, took a long time. Not comparable with the 27-year period of gestation which preceded the birth of the Uniform Act in 1965, but still substantial in relation to the objective, which was consolidation with only minor amendments.
