    CRIMINAL INVESTIGATIONS IN JAPAN By Mr. Masakatsu OKABE Police Superintendent, Deputy Director, Police Policy Research Center, National Police Academy, Tokyo, Japan I. INTRODUCTION Recently, public security in Japan has been severely challenged by the sudden increase in the number of offenses and the remarkable decrease of the clearance rate. For example, according to the latest “White Paper on Police 2002”, the number of Penal Code offenses known to police in 2001 was 2,735,612, which shows a significant increase of 57.0% (993,246) over the last ten years. This is the highest level since the Second World War. On the other hand, the number of Penal Code offenses cleared in 2001 was 542,115, that is to say, the clearance rate was 19.8%. This is the lowest level since the Second World War. In Japan, until the 80’s, the clearance rate had been kept at about 60%, but in the 90’s, it decreased to about 40%. We can say that such circumstances threaten the myth that “Japan is the safest country in the world”. Of course, the general crime situation in Japan is not so serious compared to other countries. For example, the rate of homicide was only 1.1 in 2001 (compared to 5.7 in the United States in 1999) and the clearance rate for homicide is 94%. The number of police officers killed on duty is about 10 per year (including traffic accidents) and the number of cases of a police officer firing his gun on duty is only about 10 per year.

Ghana has a multi-party parliamentary government with an elected President who is both Chief of the executive branch and the Head of State. Ghana has a centralized government with local divisions in eleven regions. There is a single legislature in the country, consisting of the President and the National Assembly. Regional leaders report to the central government in the capital of Accra. The criminal justice system is centralized in that the government has control over the courts, prisons, judges, and police. The Chief Justice of the Supreme Court, the Inspector General of Police, and the Director of Prisons are all appointed by the government and serve the entire country. Ghana is a member of the organization for African Unity (OAU) and a member of Economic Community of West African States (ECOWAS). It joined the British commonwealth in 1960. 2.

The society perceives them as custodians of law and order and providing safety and security to all. This essentially involves continuous police-public interface. The ever changing societal situation in terms of demography, increasing rate and complexity of crime particularly of an organized nature and also accompanied by violence, agitations, violent demonstrations, variety of political activities, left wing terrorism, insurgency, militancy, enforcement of economic and social legislations, etc. have further added new dimensions to the responsibilities of police personnel. Of late, there has been growing realization that police personnel have been functioning with a variety of constraints and handicaps, reflecting in their performance, thus becoming a major concern for both central and state governments. In addition, there is a feeling that the police performance has been falling short of public expectations, which is affecting the overall image of the police in the country. With a view to making the police personnel more effective and efficient especially with reference to their, professionalism and public interface several initiatives have been launched from time to time. The Ministry of Home Affairs, Govt. of India, the Bureau of Police Research and Development (BPR&D), the National Crime Records Bureau (NCRB), the SVP National Police Academy (NPA) have initiated multi- pronged strategies for the overall improvement in the functioning of police personnel. The major focus is on, to bring about changes in the functioning of police personnel to basically align their role with the fast changing environment.

In March 2006, the Russian news agency ITAR-TASS cited Interior Ministry data as indicating that Russian police seize over 25,000 false Russian passports every year (15 Mar. 2006), a figure which could not, however, be corroborated by the Research Directorate within the time constraints of this Response. On 13 May 2005, ITAR-TASS reported that the Moscow prosecutor's office had charged a police inspector with forging and selling 36 false passports over a 5 month period in 2003, but further or corroborating information could not be found among the sources consulted by the Research Directorate within time constraints. In November 2005, Russia's Federal Security Service (FSB) detained 30 citizens using counterfeit documents to pass themselves off as FSB operatives and other government officials (RIA Novosti 16 Nov. 2005; ITAR-TASS 16 Nov. 2005). According to Sergei Ignatchenko, the head of the FSB's public relations department, such fraud is a major concern and requires stricter sanctions, since "Russia's effective legislation does not envision criminal responsibility for the use of copies of service IDs" (ibid.). According to Ignatchenko, criminals and "terrorists" often use forged FSB documents in combination with police and security service uniforms, which can be "easily purchase[d]" (RIA Novosti 16 Nov.

Newman. We have concluded that the officer acted lawfully in self­ defense and defense of others. FACTUAL SUMMARY On July 3, 2010, at approximately 1:31 a.m., SFPD Inspector John Newman and his partner, Sergeant Jon Kasper, were in the area of Columbus Avenue and Broadway Street in North Beach. They were both in plain clothes, and Sergeant Kasper was driving their unmarked police car northbound on Columbus. As they drove past the front of the Little Darlings strip club at 312 Columbus, Sergeant Kasper and Inspector Newman saw a group of men who looked like they might start fighting. All of a sudden, one of the men on the sidewalk, wearing a red hat, pulled out a black firearm and started shooting at the people in the group while walking backwards. Witnesses heard him fire five to six shots. Inspector Newman immediately put a call out on the radio, and Sergeant Kasper followed the shooter (later identified as Rudy Mejia) in the patrol car, as he ran northbound on Columbus and then eastbound on Grant Street.

In every national police force, greater diversity means better quality, so this international network is vital. Exchanging views and approaches helps to foster creativity and prevent tunnel vision. The police are part of a pluralist society. In order to remain engaged with the community they serve, they must invest in diversity. Despite all that has been achieved on gender mainstreaming in the past few decades, the position of women is still an issue that requires attention. Thanks to opportunities for part-time employment, job-sharing and access to child care, the proportion of women in police organisations throughout Europe has increased. Yet the number of women in management positions remains small due to lack of upward mobility. Many women still find it difficult to profile their talents and to recognise and create opportunities for themselves. The ENP is trying to address this problem and is helping women get past this stumbling block. Its efforts include Career Development Seminars for policewomen aspiring to positions in middle management. Participants are taught leadership and networking skills, and given tools for sharing knowledge and making the most of opportunities. This magazine tells you what ENP has been doing over the past twenty years and what it is planning for the future. We hope that you will find it inspirational. Diversity is the future.

    Core factors of police corruption across the world By Hubert Williams1 Abstract In the present article, the author examines the institutional and cultural factors that account for police corruption in various countries. He shows how police corruption arises primarily from deficiencies in four major areas: (a) recruitment, training and promotion; (b) resources, such as pay and equipment; (c) systems of accountability within departments, courts and the law; and (d) cultural traditions that inhibit the develop- ment of professional police standards. Recent efforts to combat police corruption are discussed and additional measures for minimizing it are suggested. Introduction Acts of corruption by people in power have long shaken public faith in government, but the loss of public faith is particularly acute when those acts involve the police. That is because the public relies on the police to uphold the law, protect the community and assist it in times of need. Police are also the most visible arm of government for most citizens and a yardstick by which they measure authority. When an officer acts ille- gally, he dishonours both himself and the law and justice system he represents. Unfortunately, the organizational culture of the police does encourage some officers to commit acts of corruption. Such acts might involve taking monetary bribes, abusing their authority or concealing criminal enterprises. More importantly, they might also involve violation of human rights or ethnic and racial discrimination. When police organizations fail to punish travesties of justice, they inadvertently foster a culture of corrup- tion that breeds discrimination, deception and greed. 1President of the Police Foundation, Washington, D.C.
