1. Introduction

1.1 Background

The Asian Development Bank (ADB) is supporting the Government of India’s program to improve priority state road network in Rajasthan State. Public Works Department (PWD), Government of Rajasthan (GoR) is implementing d Rajasthan State Highway Development Program (RSHDP) which aims to improve about 20000 km of State Highways and Major District Roads (MDR) to 2-lane or intermediate lane standard.

As part of RSHDP, about 2000 km of State Highways (SH) and Major District Roads (MDR) have been included under ADB financial assistance, as Rajasthan State Highways Investment Program (RSHIP) to improve the efficiency and safety of road transport in the state of Rajasthan.

RSHIP is being implemented through PPP Division of PWD, Government of Rajasthan which acts as the client for RSHIP.

1.2 Project Overview

2000 Km of road sections proposed to be developed under ADB financial assistance, nearly 1000 Km have been identified under Tranche-1 in four different Packages. The project roads are to be constructed under two modalities i) three Packages in Annuity mode with a combined length of 746.162 km and ii) One Package in EPC mode with a length of 233.960 km.

Identification of roads in Tranche-2 of another 1000 km has been done and 4 EPC packages have been awarded by the middle of 2019.

RSHIP is being implemented through PPP division of PWD and PMC will assist PWD, GoR in implementing the road improvement works efficiently. Ultimately, the Investment Program will improve the access to social and economic activities in Rajasthan.

The executing agency for the project has been the state Government of Rajasthan acting through PPP Division of PWD, GoR. The PPP division of PWD, headed by Additional Chief Engineer, has establish project implementation unit (PIU) for contract packages of project roads in their respective areas. Each contract package has been undertaken by the Concessionaire / Contractor for execution and supervised by Independent Engineer / Authority Engineer.

1.3 Overall Objectives

▪ RSHIP will improve the Efficiency and Safety of Transport on the State Highways of Rajasthan, thereby providing Good Quality and Connectivity for Social and Economic Activities. ▪ RSHIP will upgrade about 2,000 KM of State Highways (SH) and Major District Roads (MDRs) to two-lane plus Paved shoulder, two-lane or intermediate-lane standards in keeping with Road Safety requirements; ▪ RSHIP will enhance the Capacity Building of Public Works Department by preparing and Piloting streamlined business process and procedures for Road Asset Management., Road Safety and Project Management.

1.4 Scope of Project Proposed for Tranche-1

The scope of the project includes development of roads distributed in two subsequent tranches with ADB funding.

1.5 Project Impact and Outcome

The outcome of the Tranche-1 Project has been mainly providing easy access to various part of the State of Rajasthan with efficiently developed road network which is vital for the movement of the local people with a wider objective of social and economic growth in the region. Better infrastructure of roads have encouraged tourist movement in so far unreached areas which in turn would boost the income earning opportunities for the local people in tourist business.

2. Involuntary Resettlement Impacts in 4 packages of Tranche-1 Project

Involuntary resettlement impacts have been identified in all four packages under Tranche-1 Project. Resettlement Plan (RP) for each package has been prepared during DPR stage in the year 2015 presenting the adverse social impacts, mitigation measures proposed, estimates of compensation and R&R assistances and entitlement matrix delineating the provisions made to eligible persons due to the project implementation.

The findings of the RPs have been discussed in here.

In all the 4 packages under Tranche-1 in general, subproject roads pass through scantily populated rural areas except for a few village settlements where clusters of houses are found. Thus, overall the magnitude of adverse social impacts in all the subprojects has been found to be less. However, there are impacts identified in respective RPs. These impacts are of loss of land to TH DPs, impact on roadside structures of TH DPs, impacts on properties / structures of NTH, livelihoods of both TH and NTH. In the following, impacts mentioned in RPs of respective packages have been provided.

However, in the RPs it has been mentioned that initially a basic land acquisition requirement has been estimated during the planning stage, which has been presented in the above mentioned Table 5. The RP document also states that the land acquisition plans have been prepared and the precise number of titleholders and extent of

All the 4 RPs have been updated based on SIA data which has been collected at the beginning of Tranche-1 project implementation. The SIA data has been finalized after a joint identification and verification process taken up by the implementing NGO and the respective PIU at package level. The revised data on impacted people and properties have been the bases of RP implementation during project implementation of Tranche-1 Project.

Implementation of RP during project implementation is a preceding activity to the implementation of the civil works for the project construction. This has been done with the assistance of an implementing NGO Manavadhikar Samajik Manch jointly with Krushi Adivasi Self Help Society. All the activities were planned to be carried out following the basic premises of ADB SPS 2009 as guiding tools.

During project implementation some modifications in the subproject alignments have provided scope to reduce impacts on DPs. In subproject stretches with village settlements construction of road has been restricted within existing ROW so as to avoid impacts on structures belonging to TH DPs mentioned in RPs. In cases of densely populated villages bypass / realignments have been considered. Proposed LA for toll-plazas has been changed to government land so as to reduce need of private land uptake. Efforts of mitigation of impacts have brought down number of NTH DPs and CPRs in some subprojects. However, due to verification of ownership of affected plots, numbers of TH DPs in some subprojects substantially increased for multiple part-owners that were not recognized earlier.

Activity-wise process of RP implementation has been discussed in the following.

3.1 Social Impact Assessment of Land Acquisition

The implementing NGO carried out a final social impact assessment (SIA) of acquisition of land in each of the subproject under the 4 packages in 2017. This was necessary to finalize the amount of land to be acquired for constructing the subprojects considering all the up-gradation / modification of alignment during project implementation. The following Table 8 provide the package-wise final requirements of land uptake in all the packages of Tranche-1 Project in comparison to RP based land requirements to assess the present scenario of land uptake for the project, whether reducing the impacts or increasing the land requirements due to unavoidable requirements of the project implementation.

There are some subproject roads where final land requirement for project implementation has been found to have increased as per final notification of land acquisition following RFCTLARRA 2019 including increase in the number of TH affected. However, in some subproject roads the land requirement reduced but the number of TH increased due to registering and updating of inheritors list in Revenue records. In some subproject roads land acquisition could be avoided adjusting civil construction of roads within existing ROW. In subproject Roopangarh- Naraina Road, the land requirement drastically reduced as measures of minimization of adverse social impact has been considered. Currently the number of TH DP in this road has reduced to only 1 as from Revenue records the owner of the affected plot has been identified as a single owner. Package-wise details of changes in land requirements and number of affected TH have been presented under the Remarks column in Table 8.

3.2 Impact on NTH DPs and CPRs

Identification of DPs and CPRs is a very important stage in the process of RP implementation. It provides an assessment of number of affected persons and loss of properties like structures, trees, standing crops, etc. to them. Moreover, it also assesses the impacts on the number of common property resources. The identified NTH DPs and CPRs are further verified through a joint verification process taken up by both the NGO and the PIU.

The following Table 9 and Table 10 provide details of package-wise identified and verified final numbers of NTH DPs and CPRs respectively as have been affected due to project implementation vis-à-vis the numbers of NTH DPs and CPRs mentioned in the RPs.

It has been found that in many subprojects the number of impacted NTH has been reduced adopting minimization of impacts by restricting civil construction activities within existing ROW. However, in few cases the number of NTH has been found to increase significantly. As in subproject Kanwas-Khanpur-Aklera Road (SH- 74), on-ground verification revealed that there were more NTH than reported in the RP of Package-1. This was also evident as the DPR design of the subproject Kanwas-Khanpur-Aklera Road (SH-74) presented the proposed alignment much different from that on the ground. In the Remarks column observations based on comparison have been presented for a better understanding of the scenario (Table 9).

The table shows that in overall in Package-1 the number of CPRs increased by 9 during RP implementation, while in other packages the number of impacted CPRs reduced. The implementing NGO has prepared a database of NTH DPs and Community Property Resources (CPRs) those are getting affected due to the implementation of Tranche-1 project. Based on the database the activity of preparing Micro-plans for NTH DPs and CPRs started.

All the Micro-plans of NTH DPs and CPRs have been checked by the Resettlement Specialist of PMC, and sent to PIU for necessary approval. PIU has followed a process to get the micro-plans approved by the Rajasthan Government. In case of subproject Sardarsher-Lunkaransar Road (SH-6A), the micro-plans have been sent to Rajasthan Government for approval.

Micro-plans have been prepared by the NGO for TH DPs whose land has been acquired for Package 3 Tranche-1 for their R&R assistance (Schedule 2) amount of Rs. 500,000/- to each TH DP as per RFCTLARRA 2013. All the micro-plans of the remaining 3 packages (Package-1, 2 and 4) referring Schedule 2 of RFCTLARRA 2019 are under preparation by the NGO.

3.4 Distribution of Identity Cards for NTH DPs

The ID cards of all NTH in all the subprojects have been distributed to NTH DPs by the NGO only except in 3 subprojects. In subprojects Nagaur-Tarnau-Deedwana-Mukundgarh Road (SH-19 etc.) and Sanju-Tarnau Road (SH-60) distribution of ID cards partially done and the process is progressing. In case of subproject Sardarsher- Lunkaransar Road (SH-6A) the ID cards will be prepared following approval of micro-plans by the Rajasthan Government and only then the cards will be distributed to NTH DPs.

3.5 Status of Disbursement of Payment to TH DPs in ADB Tranche 1

In Package-1, 71 TH DPs have been paid with Rs. 4.64 Crore on 11.11.2019. The remaining TH DPs are yet to be disbursed for their affected properties.

In Package-3, subproject Nagaur-Tarnau-Deedwana-Mukundgarh disbursement of payment of compensation of Rs. 3.8 Crore has been made to 95 TH DPs for land acquisition at Kathoti Toll Plaza. The remaining TH DPs are yet to be disbursed for their affected properties.

In Package-4, subproject Sikar-Ganeri-Jaswantgarh Road (SH-20/20A) disbursement of payment of Rs. 0.17 Crore has been made to 9 TH DPs for land acquisition at Sewarwadi Toll Plaza. The remaining TH DPs are yet to be disbursed for their affected properties.

In Package-2, notification under Section 19 is completed and Section 23 notification is under process.

It is to be noted that the process of land acquisition is carried out by the Government machinery at the sub- divisional level. The PIU deposits allocated amounts to respective SDMs who in turn disburses the payments to TH DPs after verification of evidences at his level. The disbursements happen depending upon the fund deposited in SDM’s account.

Till November 2019 the requirement of land for Tranche-1 Project as estimated for acquisition is to the tune of 135.35 Ha affecting 2775 TH DPs. The cost in total for land acquisition estimated is Rs. 43.26 Crore out of which Rs. 22.73 is deposited to respective SDM’s accounts. So far, 175 TH DPs have been paid with Rs. 8.61 Crore for acquiring 19.42 Ha of land. Altogether 2600 TH DPs are required to be disbursed with an amount of Rs. 34.65 Crore to complete land acquisition in Tranche-1 Project.

The status update of the process of land acquisition as per RFCTLARRA 2013 has been appended in Annexure 1. It presents the progress of land acquisition processing as per various notifications of RFCTLARRA 2013.

3.6 Status of Disbursement of Payment to NTH DPs and CPRs in ADB Tranche 1

In Tranche-1 Project total NTH affected is 808, ID cards distributed to 704 NTH till date. The total amount to be paid to NTH is Rs. 13.122 Crore of which the deposited amount to respective SDM's accounts is Rs. 6.342 Crore. So far, 627 NTH are paid with Rs. 4.97 Crore in first installment, and 217 NTH paid with Rs. 1.49 Crore in second installment. Altogether 152 NTH is remaining to be paid with a sum of Rs. 6.382 Crore.5

It is to be noted that the disbursement of payments to NTH and CPR, the PIU takes help of the Government machinery to disburse payments. Thus, first the allocated money for estimated payment is deposited to

In Tranche-1 Project altogether 110 CPRs have been affected. The amount in total has been estimated as Rs. 1.865 Crore for compensation of all the CPRs. The amount deposited to respective SDM’s accounts is Rs. 0.003 Crore. The amount paid to only 1 CPR so far with Rs. 0.003 Crore. Altogether 109 CPRs are remaining to be compensated with Rs. 1.432 Crore.

3.7 Disclosure of Project Entitlements

The project disclosure document has been finalized and the Hindi version of it has been distributed to DPs in all the Packages of Tranche-1 during April and May 2019. Translated disclosure document is appended in Annexure 2.

3.8 Livelihood Restoration Training

No training on livelihoods restoration has been done during the reporting period. The NGO has carried out training need assessment (TNA) for prospective recipients from DPs on selected courses. It is found that around 50% of the prospective DPs have turned down the offer of receiving livelihoods training. All women DPs have opted for tailoring / sewing trade for livelihoods restoration. Men on the other hand desired for computer related training courses. After TNA there was no progress on organizing skill development training. The NGO, however, has been looking into possible collaborations with governmental programmes running close to project region for organizing skill development trainings for DPs or their representatives nominated by the DPs.

3.9 Social Intervention in Terms of Awareness Creation

The NGO has carried out social interventions during the reporting period from January to June 2019. Awareness on HIV/AIDS prevention and road safety awareness for public at large in project region remained the main focus of the NGO in creating public awareness.

Gender differentiated overall development has been considered in ADB Tranche-1 Project during implementation of the project.

4.1 Gender Consideration in Project Implementation7

To enhance facilities for the benefit of women, children and physically challenged road-users road furniture, signposts, road markings, etc. have been implemented in subprojects of ADB Tranche-1 Project during implementation. User-friendly signages were implemented which include village names, bus-stops, speed limits in approaching stretches of schools / hospitals etc.

Bus shelter designs have been remodeled to accommodate ramp on one side for elderly women and children to climb up to the bus stand. Physically challenged persons using wheelchairs can make use of the ramps also for their convenience. In these cases the pre-fabricated wall of the ramp-side of the structure has been removed for better convenience of road users. Moreover, seats for women and children / elderly persons / physically challenged persons have been earmarked within the bus shelters as observed in Package-2 subprojects during field visits in February 2019.

4.2 Good Practice documentation in Tranche-1 Project implementation

In Package 3 (Nagaur-Tarnau-Deedwana-Mukundgarh Road) and Package 4 (Sikar-Ganeri- Jashwantgarh Road) an earthen footpath of 10 feet width is being constructed for a stretch of 40 km. This is being constructed keeping in view the convenience of pilgrims who walk on barefoot along these roads up to the famous Balaji (Mahaveer Hanuman Ji) Dham located at Salasar Town.

Initially, the road design did not have scope for this earthen footpath. However, there were public consultations on this and when it was found that the local communities had a demand of such a footpath provision, the PIU approved it and the Contractor started developing this provision of footpath for the convenience of the pilgrims to walk up to Balaji Dham on barefoot. Before taking final decision to implement the earthen pedestrian path, a series of public consultations have been conducted with local people by the PIU Team and the NGO.

5.1 Grievance Redressal Committee Formation during current SMR Period

Grievance redressal Committees have been formed at two levels in ADB Tranche 1 Project as suggested.

Grievance Redressal Committee (GRC) has been established at two-levels, one at the PIU level and another at Second level at PWD-PMU, to receive, evaluate and facilitate the resolution of displaced persons concerns, complaints and grievances.

The GRC has been providing an opportunity to the DPs to have their grievances redressed prior to approaching the State level LARR Authority, constituted by Government of Rajasthan in accordance with Section 51(1) of the RFCTLARR Act, 2013. The GRC is aimed to provide a trusted way to voice and resolve concerns linked to the project, and to be an effective way to address displaced person’s concerns without allowing it to escalate resulting in delays in project implementation.

5.2 Grievance Redressal Reporting during current SMR Period ending June 2019

There was no grievance recorded from DPs during the current reporting period. However, in the month of October 2019, after the LA award of payment has been notified, grievances have been registered with SDM’s office in Package-1. All the grievances were mainly concerning amount of payments, queries about Schedule 2 parts of Rs. 500,000/- etc. Some grievances were concerning incorrect incorporation of names of TH DP in the notifications under Section 23 of RFCTLARRA 2013.

It was noted that all the grievances in writing have been received at the SDM's office. However, SDM and PD, Package-1 jointly looked into the matters and resolved all grievances at their level. In the following Table 14 the grievance process in Package-1 during October 2019 has been provided. Annexure 3 presents sample grievance documents.

Carrying out meaningful public consultation has been a means to create project awareness during RP implementation. The NGO has adopted subproject level public consultations with affected people during the SMR reporting period.

6.1 Consultations taken up by NGO at Subproject Level

During the current reporting period (January to June 2019) informal public consultations have been carried out by the NGO on a regular basis in all the packages. Moreover, during distribution of project disclosure documents during April-May 2019 consultations have been carried out with DPs.

7.1 Project Management Unit

The PPP Division, PWD, Government of is be the Project Management Unit (PMU) and is overall in charge of coordination between the eight Project Implementation Units (PIU) and in prioritizing subprojects for subsequent tranches based on social safeguards compliance.

The PMU has engaged a Nodal Safeguards Officer Mr. Anil Kumar Jain, EE, PPP Cell, PWD Rajasthan, who has coordinated with the PD, PIUs and ensured that road subprojects under RSHIP are in compliance with the Resettlement Framework (RF) and also has been proactive in identifying likely safeguard issues that could be relevant in the context of PIU’s portfolio of projects. 7.2 Process of Land Acquisition

Land acquisition is being done with the institutional support of the District Administration. The PIU has a minimal role to play except assessing the land requirement of the project with the help of the SIA Consultant and the Local level administrative machinery (SDM Office). Only after this the land requirement is submitted to District Collectorate which in turn carries out acquisition process as per LARR Act 2013.

Land acquisition has been planned by PIU to be completed in 3 month time from the National Election scheduled in April-May 2019. PMU’s e-mail communiqué in this regard has been provided below. [email protected] 5:55 PM (50

Regarding LA Activities of Tranche-I ADB Projects is stated as under:

This is to state that LA in all affected sub-projects of 4 Contract Packages under ADB Tranche-I, is in progress. In all sub-projects Section-11 Notification of LARRA 2013 has been completed. In Contract Package-3 sub-project Nagaur-Tarnau-Deedwana-Mukundgarh the Section 16 Notification (on R&R Scheme) has been completed and Section 19 Notification on R&R Commissioner's appointment has also been made.

Keeping in view the Current Progress of LA, it is conveyed that best efforts will be made to the completion of LA progress and disbursement of compensation thereof to Title Holder DP’s within three months after Lok Sabha Election 2019.

7.3 Process of Payment Disbursement to Losses accrued on NTH DPs

The disbursement of payments for losses of NTH DPs is taken care of by the Sub Divisional Magistrate at SDM Level. In this process the INGO prepares Micro-Plans, gets them approved by the ADB PIU, PPP Cell, PWD and then submits the micro-plans to SDM office for disbursement of payments to NTH DPs.

7.4 Handing over Stretches Free from Encumbrances for Construction Purposes

As per ADB SPS 2009 norms no DP or CPR will be dislocated unless and until these are compensated fully and supported with resettlement assistances. However, the civil construction activities have started and progressed quite substantially during the reporting period. The civil construction activities started before LA process completion and disbursement of payments to affected NTHs and CPRs. However, of late the process of disbursement of

Semi-Annual Social Monitoring Report (January-June 2019) Page 39 of 61 Project Management Consultant, Rajasthan State Highway Investment Program - RSHIP payments to affected TH DPs, NTH DPs and CPRs have been done and this has been discussed with updated status in Tables 11, Table 12 and Table 13 above8.

8 The issues regarding likelihood of non-compliance have been discussed at length during the ADB Mission held during 13th and 14th November 2019. However, the PIU has consented to complete the process of disbursement of payments to TH DPs, NTH DPs and CPRs on priority basis to complete the disbursement as soon as possible, preferably by the end of December 2019 for compliance of social safeguards concerns arising out of project implementation.

8.1 Conclusion

▪ In all the packages of Tranche-1 the RP implementation is being carried out.

▪ Micro-plans have been approved for NTH DPs in Packages 1, 2, 3 and 4. All these are being done complying social safeguards as per guidelines of ADB SPS 2009. However, some additional micro-plans have been approved for Package-3 recently.

▪ Micro-plans for TH DPs in Packages 1, 2, 3 and 4 are under preparation. For, Package-3 it is completed.

▪ The disclosure document has been translated in locally accepted Hindi language with details of entitlements due to the DPs and CPRs. This has been printed and distributed to DPs for sharing project information during April and May 2019.

▪ LA for Tranche-1 Project has been progressing slowly. However, the PIU has geared up to complete the process within December 2019 with full payment disbursement to TH DPs.

▪ More actions have been taken in disbursing payments to NTH DPs and a sizeable number of NTH DPs have been paid till the end of October 2019. The process includes depositing disbursement amounts with respective SDM Office and disbursement of payment in Package 1, Package-3 and Package-4 to sizeable amount has been done. However, the process is yet to start in Package-2 where the disbursement amount has been deposited in SDM’s account. 8.2 Recommendations

▪ The process of LA needs to be completed at the earliest as almost all payable amounts have been deposited to SDM of respective administrative Sub Divisions coming under the project region of ADB Tranche-1 Project. In almost all the subprojects, notification under Section 23 of RFCTLARRA 2013 on award has been attained, only except in Package 2 where notification under Section 19 is under progress. The Acquiring Authority is suggested to complete this social safeguards compliance keeping in view the completion of Due Diligence for ADB Tranche-1 Project on time. The PMU needs to set a plan by the end of November 2019 to expedite and complete the LA process for Tranche-1 latest by December 2019.

▪ The disbursement of payments of affected NTH needs to be completed in a fast track mode as in many cases the civil construction of subprojects have been completed and the roads are in operation and maintenance stage. Though in some subprojects substantial payments have been made or have been allocated and deposited to respective SDM’s office accounts, the NGO personnel at site should liaise with SDM on a day-to-day basis with the SDM office and share updates with the respective PIUs. Moreover, monthly progress on this subject is required to be shared with PMC also for reporting in their MPR, QPR and SMR as desired. The PMU needs to set a plan by the end of November 2019 to expedite and complete the LA process for Tranche-1 latest by December 2019.

▪ The NGO has been advised by the RS, PMC for preparing micro-plans for TH DPs in all the subprojects under four packages of Tranche-1, for the Schedule 2 provision RFCTLARRA 2013 of Rs. 500,000/- to each TH DP. This has been done for Package-3 and the NGO is advised to complete the same for the remaining packages on a priority basis.

The timeline set for completion of this process is no later than end of December 2019. Though in three packages (Packages 2, 3 and 4) the civil construction activities have been done prior to disbursement of payments to TH DPs, NTH DPs and CPRs, in Package 1 there is no issue of non-compliance in regard to completion of land acquisition process and disbursement of payments to NTH DPs and CPRs.

▪ The PIU needs to ensure all compensation to be paid prior to possession of land and demolition of structures at the earliest.

▪ Processing of public grievances, should be recorded and resolved following process adopted for the project.

▪ Meaningful public consultations on regular intervals have to be conducted and documented by the NGO.

▪ Social intervention activities need to be taken up for public in project areas by the NGO.
