INTRODUCTION On January 16, 1996, only eight days after hearing oral argu- ments in the case, an equally divided2 Supreme Court let stand the First Circuit's decision in Lotus Development Corp. v. The practical effect of the Court's 4-4per curiam deci- sion4 is to let stand the First Circuit's finding that the menu hierarchy of a leading spreadsheet program amounts to an uncopyrightable "method of operation," despite expressive elements contained it its ar- rangement and structure.5 The treatment by the Court may result in "forum shopping" as plaintiffs situated similarly to Lotus seek to avoid the First Circuit.6 Conversely, the choice of the Court to not offer an accompanying written opinion also strengthens the lower court's characterization of Borland as a matter of first impression, as well, as its determination not to follow standards for protection previ- ously articulated by other circuits.7 In Lotus v. Borland, the First Circuit validated appellant Bor- land's contention that it had "lawfully copied" unprotectable aspects of Lotus' popular spreadsheet program for use in a similar product.' By ruling in Borland's favor, the court provided remaining circuits with a significantly narrowed view of what constitutes protectable ex- pression and may have affirmatively exposed the limitations of ex- isting copyright law in the context of computer software programs. 9 At issue was whether Borland infringed Lotus' copyright when it duplicated the Lotus 1-2-3 menu command hierarchy for use in its Quattro and Quattro Pro'" spreadsheet programs." Counsel in the case speculated based on questions presented during oral arguments that Justices Breyer, Kennedy, Souter, and Thomas sided with Borland while Justices Ginsberg, O'Connor, Scalia, and Chief Justice Rehnquist sided with Lotus. The Borland court reviewed the leading authority from other circuits, principally the Second Circuit decision in Computer Assoc. Int'l, Inc. v. Altai, Inc., 982 F.2d 693 (2d Cir. 1992), which articulated a complex methodology for determining infringement of the code and structure of computer programs. Because Borland involved the literal copying of a menu hierar- chy, however, the court rejected its applicability. The First Circuit agreed that the test set forth in Altai would have been appropriate had the case involved the nonliteral copying of the Lotus I - 2-3 computer code. Lotus, 49, F.3d at 815. 8. The inadequacy of copyright protection for computer software was articulated by the concurring opinion in Borland: "The computer program is a means for causing something to happen; it has mechanical utility, an instrumental role, in accomplishing the world's work. Granting protection, in order words, can have some of the consequences ofpatent protection in limiting other people's ability to perform a task in the most efficient manner. Utility does not bar copyright (dictionaries may be copyrighted), but it alters the calculus." Id. at 819 (emphasis in original). 10. The terms "Quattro" and "Quattro Pro" will be used interchangeably throughout the text to refer to the Borland computer spreadsheet program. 11. 49 F.3d at 810. 1996] LOTUS V BORLAND ultimately answered this question in the negative.1 2 Without explicitly rejecting the district court's conclusion that Lotus engaged in expres- sive choices13 in the selection of its command terms, the Borland court held that the disputed structure was a means by which the pro- gram functioned and was therefore an uncopyrightable "method of op- eration" under § 102(b) of the Copyright Act. 4 BACKGROUND Lotus 1-2-3 is a computer spreadsheet program that enables users to perform complex accounting functions.15 The program's 469 com- mands are operated through an innovative menu tree hierarchy. 16 Lo- tus 1-2-3 also possesses the capability to create macros. 7 A macro is a simple procedure created by the user to replace what would other- wise be a lengthy series of keystrokes. Macros significantly reduce the time required to operate the program.'" These features helped Lo- tus dominate the spreadsheet market throughout the early 1980's.9 Borland released its first Quattro spreadsheet program in 1987. Quattro Pro users could choose to either use menu commands designed by Borland or activate the Lotus Emulation Interface that adopted 1-2-3's menu hierarchy.2" Quattro Pro also had the capability of translating and using macros created for 1-2-3 through a device known as the "Key Reader."21 In 1990 Lotus sued Borland for copyright infringement in the United States District Court of Massachusetts.2" In a motion for sum- mary judgment, Borland admitted copying the Lotus command struc- ture but contended that the 1-2-3 menus were not copyrightable23 and that "no reasonable trier of fact could find that the similarity between its products and Lotus 1-2-3 was sufficient to sustain a determination 12. "Because so many variations were possible, the district court concluded that the Lotus developer's choice and arrangement of command terms, reflected in the Lotus menu command hierarchy, constituted copyrightable expression." Id. at 811. 14. "In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regard- less of the form in which it is described, explained, illustrated, or embodied in such work." On July 31, 1992, presiding Judge Robert Keeton granted partial summary judgment in favor of Lotus, holding that the company's se- lection and placement of command terms amounted to copyrightable expression," The district court found Lotus' argument strengthened by the fact that Borland had created its own command structure for the Quattro program but included the 1-2-3 structure as an alternative, presumably to attract users already familiar with the Lotus menu hierarchy.27 Although the court determined that the Quattro and Quattro Pro programs had indeed infringed Lotus' copyright, it concluded that Borland had not copied the entire 1-2-3 interface, as Lotus con- tended.2" Consistent with this finding, the court determined that a jury trial was necessary to assess the actual scope of Borland's 29 infringement.

Purpose (1) MSP was developed in a PC environment with the original version of Borland C++, then adapted in several stages to Version 5.0, the standard for this book. Many readers, however, prefer to or must use a different compiler. The environment most frequently mentioned that is somewhat close to the book’s is Microsoft’s. This file describes my adaptation of MSP as a suite of Microsoft Visual C++ Win32 Console Applications. (2) It’s an adaptation guide, not a completed product. Most MSP features described in this book work under the adaptation, but it has not been used for further development. With it, you can see how these features work in your Microsoft environment. To use it for a major project, however, you’ll probably want to select only the appropriate MSP modules. You’ll need to test the adaptation much more thoroughly, and probably add minor cor- rections as needed by your specific application. ii. Major differences (1) Microsoft’s complex mathematics module is implemented with templates. That adds more levels of implicit conversions for the compiler to consider when resolving overloaded function declarations. Many more ambiguities would result, and some methods MSP uses to resolve them would no longer work. This would cause so many changes that you’d lose sight of the rest. So the adaptation contains a completely rewritten complex module. (2) Microsoft handles hardware faults, such as overflow detected by the floating-point processor, by throwing“structured exceptions”.

Installation When you open your carton of Borland Pascal, you may be frightened by the tens of kilos of books and mountain of disks. This Appendix will get you started on installation and use of the system to write your Pascal programs. Even if you have already installed Borland Pascal and are using it, you may find some useful tips here, so please thumb through these pages. (There is much useful information in the Borland Pascal User's Guide, which is in your package.) For starters, your computer should have a goodly chunk of free disk space in one hard disk partition. If you install the complete Borland Pascal system, that will take about 30M. The programs with this book will fill about 2M, and when you start writing programs, who knows? Before you start installation, decide which partition to use, and note how much free disk space is available. Don't push a partition to its absolute limit. Start the "Install" program by inserting Disk 1 into the A: drive and typing A:INSTALL <Enter> (By the time this book appears you will probably be able to acquire BP on CD­ ROM and install it that way.) The "Install" program gives you lots of options, and explains what it is doing as it runs. If you have adequate disk space, the easiest course is to install everything. If you want to install only what you need for using this book, when the "Install" program prompts you for what to install/omit, you can omit the Windows version, the Assembler, the Profiler, the Debugger, the Turbo Vision package, and the On-line compilers.

    Session 2532 Web-based C++ Compiler Aleksander Malinowski, Bogdan M. Wilamowski Bradley University, Peoria, IL / University of Wyoming, Laramie, WY Abstract This paper reports the successful use of Web-based interface to C++ compilers. There are several benefits that make networked software desirable. A web-based application can be used remotely throughout any network connection. Any operating system can be used to access it, making it platform independent. There is no local installation or maintenance work necessary. Access can be controlled and limited if required by software license agreement. Internet Compilers Package (ICP) is an example of a networked software-engineering tool. Different compiler packages can be used for various stages of application development providing either maximum error detection or code optimization. Introduction During the process of software development frequently more than one compiler package is required. Some products are known to be very useful for locating errors or debugging, while others perform extremely well when a program or library is in the final stage of development and should be optimized as much as possible. Also when facing obscure error messages, which may result in a time-consuming search for the error, a different error message from the second compiler frequently cuts that time dramatically. Therefore students should be to some extend exposed to different compilers at some point in their software courses curriculum. Although all necessary software is installed in the computer laboratories, most students prefer to work on their computers at home or dormitory and connect to the university network. That situation creates unnecessary burden either for the network administrators who have to install additional software on many machines of non-standard configuration, or on students who must purchase and install on their own several software packages along their full course of study.

    Using Borland C++ Tutorial (Last update Aug 21, 1998 by R. Tront) This tutorial provides an introduction to using Borland C++. Borland C++ comes with several compilers/linkers/ debuggers: some are for use from a (DOS) command line, and some are for use within a window-based Integrated Development Environment (IDE). The IDE provided is a single application that allows you to edit, project manage, compile, link, and debug your program files. This tutorial starts out with an explanation for first year computing students of command line environments and of writing programs targeted for running under a command line operating system like DOS. It then moves on to using the IDE to write command line programs that will run and can be debugged in a simple window, but it does not describe MS-Windows application programming. Along the way, it introduces proper programming of multi-module applications. Introduction The master operating system (OS) program of a computer is designed to accept operational commands of various types from users. In most operating systems, the user can interact with the OS via a simple command line interface. A command line interface uses simple text characters rather than bit-mapped graphics. The screen scrolls up as the user and computer write information to the bottom of the screen. The user is prompted on the left (often with just a “>”) to enter a command which (s)he must have memorized. The command often has parameters following it (usually not in brackets). A common command is to type the name of a program file, which the operating system takes as a request to start the application program contained in that program file.
