Having identified lacunas in the existing literature and empirical research base, this thesis considers three main areas: how young people define pornography; the range of pornography viewed by young people, and; young people’s perspectives on the legal regulation of pornography. In-depth interviews were conducted with eighteen young people aged 18-25 in England and Scotland, with a novel research method – Spectral Elicitation – developed and incorporated into the empirical research design. The research found that young people’s definitions of pornography largely echo those in existing literature and legislation, and found that by establishing definitions with participants contextual unity between the thematic focus and the empirical findings of the research can be ensured. Young people had viewed a wide range of pornographic materials, with the research finding that unsolicited contacts were often regarded as a necessary evil of viewing pornography. Within this, significant proportions of young people had viewed materials of a violent or ‘extreme’ nature. With legal regulation, the research found that: young people generally thought more materials are and should be criminalised than currently are under the CJIA 2008 and the CJL(S)A 2010, with minimal support for possession offences; young people generally did not look to legislation to establish ethical precedents when negotiating access to materials, and; animated materials, depictions of rape, and perceptions of sexual consent within pornography are significant areas requiring further consideration. This research revealed that there is greater scope for qualitative research in the academic study of pornography, including utilising innovative and ethically-sound elicitation methods when investigating complex and potentially sensitive issues. This thesis recommends further empirical research on the range of materials viewed by young people and their perspectives on these materials, utilising mixed methods incorporating both large-scale surveys and further in-depth studies. They give us some of the most complex and sensitive decisions to take. In 2014-15 we reached the highest volume ever of all VAWG1 police referrals, charged defendants, prosecutions and convictions. Work with the police has successfully reversed the fall in volumes identified by the CPS over the previous few years, culminating in the conviction of over 11,000 more defendants – a 17% increase since 2013-14. For domestic violence, rape, sexual offences and child abuse, convictions reached the highest volume ever. In total 68,601 defendants were convicted for domestic abuse, a rise of 10,325, just under 18% from the previous year. 2,581 defendants were convicted of rape, an increase of 233, just under 10%, since the previous year. 631 more defendants were also convicted for child sexual abuse – a 19% rise, reaching the highest level ever of 3,975. Prosecutions commencing, in respect of stalking and harassment offences, also rose by 15.1% in 2014-15 from 2013-14.2 The conviction rate for domestic abuse remained relatively steady at 73.9%, against the large rise in prosecution and conviction volumes that reached a record high.

    Peep Behind the Curtain – the Impact of Pornography What is the scope of the issue? Research of popular pornography films found that 88% of the scenes- not just the movies, but the scenes in these movies- there was verbal and physical aggression, usually toward a woman. The more interesting finding is that 95% of the time when someone is violent with another person in porn, usually a man toward a woman, the recipient is shown as either liking that violence or having no objection. PornHub was chosen because it is one of the world’s top adult websites and the 36th most visited site on the internet in 2017, with more than 81 million daily visits. Pornhub reports that in 2016, people watched 4.6 billion hours of pornography on its site alone; 61% of visits occurred via smartphone. In 2017 alone, Pornhub got 28.5 billion visits. That’s almost 1,000 visits a second, or 78.1 million a day—way more than the population of the entire United Kingdom. That number has since jumped to 33.5 billion site visits in 2018. Pornhub, “Pornhub’s 2016 Year in Review,” (2016). Eleven pornography sites are among the world’s top 300 most popular Internet sites. The most popular such site “xvideo”, at number 18, outranks the likes of eBay, MSN, and Netflix.

The analysis comprises a historical account of its inception as relayed mainly by Ryk Hattingh, the first editor of Loslyf and primary creative force behind the publication. Such an investigation offers valuable insights into an aspect of South African media history as yet undocumented. As a powerful contributor to an Afrikaans imaginary, emerging at a time of political renewal, Loslyf provides a glimpse into the desires, tensions and tastes of and for an imagined community potentially still shaped by a censorial past. The magazine is worth studying, in part, as an example of an attempt at reinvesting the prescriptive and seemingly generic genre of pornography with cultural specificity and political content, with a view to making it more interesting and relevant.

It offers a comprehensive doctrinal illustration of how both existing sexual harassment doctrine and popular critiques of that doctrine fail to respond to the unique case of the sexual harassment of a non-sexualized worker in the sexual titillation industry (e.g. a secretary at a pornographic magazine publisher). The article offers a doctrinal fix that draws inspiration from the “bona fide occupational qualification” and “business necessity defense” exceptions to Title VII’s prohibition on workplace discrimination.

    IMAGES OF WOMEN IN PORNOGRAPHY AND MEDIAt TERESA HOMMEL If a solution is to be found to the culture-wide violence towards women that we accept as part of our normal everyday society, we must first character- ize this violence as a problem and then change the attitudes we hold towards men, women, and violence. We can begin to change our attitudes by changing the images with which we surround ourselves that teach, reinforce, and perpet- uate these attitudes. Physical and psychological violence towards women is the norm in our cul- ture. Many men clearly believe that they should commit these acts, whether to enjoy themselves or to assert their masculine identity. But where do these men learn that violence towards women is a form of enjoyment or a way to assert masculinity? Feminists believe that today the primary source of images of such violence is the mass media, especially pornography. The purpose of the slideshow you are about to see is to help the audience recognize the hatred of women expressed in pornography, and to increase un- derstanding of the destructive consequences of these images. Many feminists believe that portrayals of women being bound, raped, tortured, killed, or de- graded for sexual stimulation or pleasure create a psychological association of sexuality and violence, and teach men that women are easy targets and fair game, that women enjoy being pushed around, and that violence itself is a sex- ual turn-on. In addition, such images teach women to accept victimization as inevitable, and to feel helpless and passive. The important thing to watch for throughout the slideshow is the repetition of certain themes: the association of sexuality and violence, the macho image projected as appropriate for men, the weak, passive image projected as appro- priate for most women, the joking attitude in many of the images of rape or battering, and finally, the constant suggestion that women are less than human.

She has given evidence before the Scottish Parliament on this topic, and worked with parliamentarians to shape the new Scots law, as well as giving presentations across Ireland, Iceland and Australia on lessons learnt from the UK experience. She is a regular media and public commentator regarding ‘revenge porn’ and online abuse. Structure of evidence submission This evidence submission addresses specific questions in the discussion paper, as well as making four preliminary points: 1. Terminology matters and recommendation re term ‘image-based sexual abuse’; 2. Positive impact of new criminal legislation in England & Wales; 3. Criminal regulation justified as being human rights enhancing; 4. Sharing intimate images without consent as a form of ‘cultural harm’; and 5. Sharing of intimate images without consent as a form of sexual offence. Terminology Matters: image-based sexual abuse 6. The decision of the discussion paper not to use the term ‘revenge porn’ is welcomed. This term is unduly limiting and inappropriate. The term ‘revenge porn’ only covers one particular form of online harassment and abuse involving private, sexual images. While using this term has worked to secure the attention of the media and policy-makers, it’s time to widen the focus of law and policy to address all forms of what can be called image-based sexual abuse.1 7.

Today, pornography is pervasively available on the internet and viewed by both men and women in ever-increasing numbers. In New Zealand, violence against women and children remains at alarmingly high levels, and concerns about pornography’s influence on gendered violence are a common refrain. Research remains inconclusive about the impacts of pornography on viewers’ sexual scripts, behaviours and attitudes, yet the voices of those most affected by pornography – viewers and their partners – are often omitted from pornography studies. Few New Zealand studies employ a gendered analysis of men’s and women’s experiences with pornography. To provide research specific to New Zealand about these experiences, this thesis explores the reported influences of mainstream pornography on the lives of a self-selecting sample of (primarily) heterosexual New Zealanders between the ages of 18 and 30. It adopts a uniquely gendered analysis and critically interrogates both men’s and women’s experiences with pornography in the digital age. The findings of this research suggest that pornography research necessitates a gendered appraisal both in terms of how pornography is experienced individually, but also within intimate relationships.
