1.0 INSTRUCTION TO BIDDERS:

1.1. NOTICE FOR INVITING BIDS/PROPOSALS:

NOTICE IS HEREBY GIVEN that the San Bernardino Community College District, hereinafter referred to as “District”, is calling for and will receive sealed Proposals for the award of a contract for the “Construction Services for KVCR New Broadcasting Tower at Moreno Valley, Riverside County, RFP#03-1718-09.” Proposals will be accepted up to but not later than, the time stated in Section 1.3 below.

License Required: Contract License A, B, C, C-51, C-8.

1.2. PREQUALIFICATION REQUIREMENTS:

In compliance with the Resolution for the Districtwide Pre-Qualification Program for all Construction Projects adopted on August 13, 2015 by the District’s Board of Trustees, prequalified contractors and subcontractors that have participated in the District’s Prequalification Program and have received a prequalification approval status and can meet the specific scope of work and services requirements are hereby invited to submit their proposal for Construction Services for KVCR New Broadcasting Tower at Moreno Valley, Riverside County, RFP#03-1718-09.

All proposals shall be made and presented only on the forms presented by the District and pursuant to the instructions set forth in this RFP. Any proposals received after the time specified above, or after any extensions due to material changes, shall be returned unopened.

1.5. PRE-PROPOSAL INFORMATION:

There will be one scheduled Mandatory Site Walk and Conference. Attendance by a representative of the Contractor is MANDATORY for submitting a Proposal to this RFP.

The MANDATORY Site Walk and Conference will be held on February 13, 2018 at 10:00 a.m. PST at the KVCR tower location, 10550 Box Springs Mountain Rd, Moreno Valley, CA 92324.

1.6. PROJECT IDENTIFICATION & DESCRIPTION:

San Bernardino Community College District, Construction Services for KVCR New Broadcasting Tower at Moreno Valley, Riverside County, RFP # 03-1718-09.

THE SCOPE OF WORK AND SERVICES INCLUDE:

a. Based on the preliminary design that already has been done, complete the design and engineering calculations for the 344.5 feet tall Self-Supporting Steel, 4-legged Communications Tower, including foundation design, and civil drawings necessary for regulatory agency review and approval; obtain the design and construction permit.

b. Provide labor, materials, equipment, insurance, and bonds to design, procure, manufacture, fabricate, install, erect, and permit the 344.5 feet tall Self-Supporting Steel, 4-legged Communications Tower including the foundation and all necessary site improvement for the new tower.

c. Dismantle, remove, and dispose the old communication tower.

1.8. DSITRICT’S VICE CHANCELLOR AUTHORITY: DELEGATED BOARD AUTHORITY TO INCREASE AND DECREASE CONTRACT TIME AND CONTRACT PRICE:

The District’s Board of Trustees has delegated authority to the District’s Vice Chancellor for Fiscal Services to execute change orders, partial change orders, Construction Directives, and compromises, which may increase and/or decrease the Contract Price and/or may increase and/or decrease the Contract Time for this Project. As such, the Vice Chancellor for Fiscal Services’ signature on a change order, partial change order, Construction Directive, and/or compromise is sufficient to bind the DISTRICT provided that the increased and/or decreased costs of individual changes do not exceed the amount specified in the applicable contract.

California Public Contract Code Sections 20651, 20655, and 20659, as revised in accordance with Section 22020, if applicable, or ten percent (10%) of the original contract price, whichever is greater. See the General Conditions for more specific information regarding the level of the Vice Chancellor for Fiscal Services signature authority.

1.10. COMPLIANCE WITH PROPOSAL REQUIREMENTS

Each proposal must strictly conform with and be responsive to the contract documents as defined in the General Conditions.

The District reserves the right to reject any or all bids,and to waive any irregularities or informalities in any proposals or any requirements of these specifications as to bidding procedures.

1.11. SUBCONTRACTORS

Each bidder shall submit with its bid, on the form furnished with the contract documents, a list of the designated subcontractors on this Project as required by the Subletting and Subcontracting Fair Practices Act, California Public Contract Code Sections 4100 et. seq.

1.12. BID SECURITY

In accordance with California Public Contract Code Section 22300, the DISTRICT will permit the substitution of securities for any monies withheld by the DISTRICT to ensure performance under the contract. At the request and expense of the Contractor, securities equivalent to the amount withheld shall be deposited with the DISTRICT, or with a state or federally chartered bank as the escrow agent, who shall then pay such monies to the Contractor. Upon satisfactory completion of the contract, the securities shall be returned to the Contractor. SBCCD Prequalification Program 5 of 9

Each bidder’s bid must be accompanied by one of the following forms of bidder’s security: (1) cash; (2) a cashier’s check made payable to the DISTRICT; (3) a certified check made payable to the District; or (4) a bidder’s bond executed by a California admitted surety as defined in Code of Civil Procedure Section 995.120, made payable to the District in the form set forth in the contract documents. Such bidder’s security must be in an amount not less than ten percent (10%) of the maximum amount of bid as a guarantee that the bidder will enter into the proposed contract, if the same is awarded to such bidder, and will provide the required Performance and Payment Bonds and insurance certificates. In the event of failure to enter into said contract or provide the necessary documents, said security will be forfeited.

1.13. PUBLIC WORKS REFORMS (SB 854) REQUIREMENTS

No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)].

No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.

1.14. PREVAILING WAGES REQUIREMENTS

The DISTRICT has obtained from the Director of the Department of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work in the locality in which this work is to be performed for each craft, classification, or type of worker needed to execute the contract. These per diem rates, including holiday and overtime work, as well as employer payments for health and welfare, pension, vacation, and similar purposes, are on file at the DISTRICT, and are also available from the Director of the Department of Industrial Relations at; http://www.dir.ca.gov/OPRL/PWD/index.htm. Pursuant to California Labor Code Sections 1720 et seq., it shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subcontractor under such Contractor, to pay not less than the said specified rates to all workers employed by them in the execution of the contract.

1.15. WITHDRAWAL OF BIDS

No bidder may withdraw any bid for a period of sixty (60) calendar days after the date set for the opening of bids.

1.16. BONDS

Separate payment and performance bonds, each in an amount equal to 100 % of the total contract amount are required, and shall be provided to the District prior to execution of the contract and shall be in the form set forth in the contract documents.

All bonds (Bid, Performance, and Payment) must be issued by a California admitted surety as defined in California Code of Civil Procedure Section 995.120. 1.17. TIMELY DELIVERY OF BIDS SBCCD Prequalification Program 6 of 9

It is each bidder’s sole responsibility to ensure its bid is timely delivered and received at the location designated as specified above. Any bid received at the designated location after the scheduled closing time for receipt of bids shall be returned to the bidder unopened.

2.0 DISTRICT AND KVCR PROFILE

The District was established in 1926 and serves most of the County of San Bernardino and a small portion of the County of Riverside. The District includes two comprehensive community colleges: San Bernardino Valley College and Crafton Hills College, a Professional Development Center, and KVCR-TV and FM. The District employs approximately 800 full- time permanent faculty and staff and approximately 600 part-time faculty, and have approximately 17,000 students enrolled in one or more courses during the 2015 Spring Semester.

KVCR is dual license television and radio broadcast station responsible for acquiring, producing and disseminating educational, informational and cultural content via all platforms, including TV, FM radio and online. KVCR radio, 91.9 FM, went on the air in 1952, KVCR-TV Channel 24 in 1962. Both have served the students, faculty, staff, and administration of the District, Crafton Hills College and San Bernardino Valley College, as well as the greater Los Angeles metropolitan area with a primary focus on the and Coachella Valley.

In September 2011, through a partnership between the San Manuel Band of Mission Indians and KVCR, FNX|First Nations Experience was launched in . FNX is the first public television network in the United States focusing on Native American and world indigenous cultures. FNX broadcasts 24/7 and features content that reflects the authentic voices, stories, experiences and reality of indigenous peoples worldwide.

In the summer of 2014, FNX had seven affiliate stations broadcasting in ten states – from Alaska to Illinois. In May 2014, FNX was granted full-channel status on the Public Television Interconnect System and is expected to be available, via satellite, to over 300 public TV stations in November 2014. FNX broadcasts locally on KVCR-Digital Channel 24.2, on DirecTV Channel 24-2 and on Verizon FIOS Channel 471.

2.1 PROJECT OVERVIEW

The District is seeking prequalified construction services for the Construction Contract for KVCR New Broadcasting Tower at 10550 Box Springs Mountain Rd, Moreno Valley, CA 92324.

KVCR is transitioning from ultra-high frequency (“UHF”) to very-high frequency (“VHF”) channel and required to procure new broadcasting tower at 10550 Box Springs Mountain Rd, Moreno Valley, CA 92324. As part of the transitioning, the District has procured antenna solution and transmitter solution systems. The existing tower will not accommodate the new antenna solution system procured by the District. The design and construction of new tower must accommodate the new antenna procured by the District and fulfil the requirements specified in the scope of services including geotechnical analysis, specified height approved by the Federal Aviation Administration (“FAA”), determined longitudinal and latitudinal coordinates for the center of the tower, and other specifications.

The KVCR New Broadcasting Tower is necessary to comply with current code requirements and accommodate the new VHF antenna solution system from Jampro Antennas Inc. procured by the District.

This UHF-to-VHF transition is mandated by the Federal Communication Commission (“FCC”) which provides a strict timeframe to complete the transition project by December 31, 2018. The design and construction of the new tower needs to be completed by December 31, 2018. The new antenna will be installed upon the new tower and is permitted to operate by December 31, 2018.

The District is aiming to have the follow-up engineering and construction work commence in February 2018, and then to complete the design, receive permit by the county, procure materials, fabricate, and erect and complete the construction by December 31, 2018. KVCR must cease broadcasting from their current channel in early 2019. The existing KVCR tower will then be demolished once the new tower is permitted to operate and the new antenna is installed.

The District has done its due diligence and upfront studies for the KVCR New Broadcasting Tower and all necessary information are provided as Exhibits to this RFP. These Exhibits are as follows:

i. FAA approval for the KVCR new broadcasting tower height of 345 feet. The new tower profile shows the exact location for the newly Jampro antenna system procured y the District. ii. Preliminary design document showing the potential structural steel profile or similar of the new 345 feet tower height with proposed pad location that shall not exceed 60 feet x 60 feet. iii. Geotechnical and geological analysis report for the site condition of the KVCR new tower location. iv. Topography surveying report showing the KVCR new tower pad location with elevations. The design firm needs to maintain the longitudinal and latitudinal coordinates for center of the new tower in their design. v. The new procured VHF antenna solution system specifications and profiles. The design of the antenna attachments to the new structural steel tower will be developed after the design of the KVCR new tower is complete and permitted.

The District has also formed a collaborative team of specialized environmental consultants, specialized broadcasting and communication engineers, and legal counsel who are currently working to obtain National Environmental Policy Act (“NEPA”) and California Environmental Quality Act (“CEQA”) approval in conjunction with this RFP process.

The successful contractor is expected to work with the District various consultants collaboratively for the successful achievement of this project.
