PREFACE

This Environmental Monitoring Report (EMR) for the Kanjhari Subproject presents the salient features demonstrating the compliance status of environmental mitigation measures, environmental monitoring of selected parameters for the civil work contractors. It is in compliance with Loan Covenants of Project -2 of the OIIAWMIP for the period July 2016 to end of Dec 2016. The report has been prepared by the PMU and support of CAD-PIM Directorate(O & M).

This report represents Compliance with Environmental Safeguard Policy of ADB which includes preparation of Initial Environmental Examinations (IEE) reports -prepared for Project -2, Environmental Monitoring Plans (EMP) preparations and implementation monitoring with periodic monitoring reports. The report preparation, field activities for data acquisition was planned and undertaken by PMU supported by SIO.

This document has been prepared using all available subproject chronological and current data / information, with necessary compilations for presentation; and analysis as deemed practicable to comply with Loan Agreement Schedule 5, Paras 5, 10, 11 and 14 item for the OIIAWMIP project – which requires PMU to submit progress report on the EMP implementation as part of ADB’s Safeguards Policy Statement (2009).

EXECUTIVE SUMMARY i. “Orissa Integrated Irrigated Agriculture and Water Management Investment Program” (OIIAWMIP) is a multi tranche financing facility (MFF) project with Asian Development Bank (ADB) assistance. Department of Water Resources (DoWR) had completed Project-1 implementation and Project -2 is under progress. Project 2 of the MFF implementation has commenced and will be closed in September 2018. It will modernize irrigation infrastructure of 4 major( Machhagaon, Pattamundai, HLC Range -1 and MCII) and 3 medium( Ramial, Kanjhari and Kansbahal) subprojects and 750 minor lift irrigation (MLI) schemes in selected river basin of . It will also strengthen 169 WUAs in improved land and water management for increase agricultural production, and restore saline embankments in 12 segments covering about 57 kilometres.

ii. The Executing Agency (EA) is the Department of Water Resources and the Implementing Agency (IA) is Project Management Unit (PMU). PMU / Subproject Implementation Officers (SIOs) undertake civil works through Contractors selected through National Competitive Bidding (NCB).

iii. The “Orissa Integrated Irrigated Agriculture and Water Management Investment Program (OIIAWMIP) under Project- 2 includes Irrigation sub-projects and Saline Embankments which are classified as “Category B” according to the Environment Policy (2009) of the Asian Development Bank (ADB). An environmental assessment and review framework (EARF) was also prepared to guide the environmental assessment of the subprojects. An Initial Environmental Examination (IEE) reports were prepared for the proposed sub-projects. Environmental Management Plan (EMP) is part of the IEE. EMP implementation responsibility mostly lies with the Contractors.

iv. Under Project -2, 6 sub-projects out of 7subprojects civil works commenced {three major subprojects (Machhagaon, Pattamundai and HLC Range-1); three medium (Ramial, Kanjhari and Kansbahal)} and 10 saline embankments out of 12 have civil works commenced, the implementation of EMP was Contractors responsibility. EMP is part of civil work contract packages executed by Contractors, but not with the civil works carried out by Pani Panchayat (for irrigation subprojects only). The semi – annual Environmental Monitoring Report (EMR) is prepared for each subproject, the present EMR report pertains to the Kanjhari subproject.

v. The Kanjhari sub project was divided into 3 contract packages and one sub-minor package implemented by Pani Panchayat. Out of the 4 contract packages (including sub- minors) by this period 2 contract packages (CW- NCB- KNJ-01 and CW- NCB- KNJ-02 have commenced civil works after signing the agreement. While Contract package CW- NCB- KNJ-01 & CW- NCB- KNJ-02 agreement signed on 27 November 2016 and CW- NCB- KNJ-03 contract package and sub-minors are yet to be awarded

vi. The objective of this report is to assess:(i) compliances of the project with the requirements of ADB’s environmental safeguards contained in ADB’s Environment Policy, (ii) the status of obtaining statutory clearances by the Contractors as per the national environmental laws, Govt. of India and (iii) status of implementation of mitigating measures suggested in the EMP and difficulties encountered during the stages of implementation. The

report findings also assist in formulation of corrective actions by PMU that may improve EMP implementation adjustments and in suggesting mechanism for effective supervision during Project-2 implementation

vii. Monitoring and reporting on EMP issues was going well there was no change in the scope of work from the approved contract package.

viii. During the early stage of the project, the SIO staff and contractor representatives at site were explained by ISPMC, Environment Specialist on the environmental safeguard requirements and the required measures that are needed at site along with necessary on job – training / sub project level trainings (on national environmental law requirements, environmental safeguards requirements of ADB, contractual clauses for EMP implementation. PMU with the help of ISPM consultants are also monitoring overall project progress and evaluating project benefits, social and environmental impacts.

ix. As part of capacity building program few persons (SIO staff and Contractors) were trained in the EMP implementation, environmental safeguards and an environmental Check list was introduced to the Contractors through PMU for effective monitoring.

x. The environmental monitoring report preparation for the implementation period i.e. from 1st July 2016 to 31st December 2016 is based on the monthly EMP checklist submitted by Contractors through SIO staff, feedback obtained from SIO staff especially Junior engineers inputs during day to day field activities, random field checking of work sites and verification and validation of information submitted by the Contractors and feedback from villagers by SIO.

xi. The Kanjhari sub project doesn’t require any environmental clearances from the State Pollution Control Board or Ministry of Environment & Forests since this subproject is an existing one, no new canals were formed and only strengthening of existing systems were taken up. The canals are not located in the Coastal Regulation Zone, no clearance were needed. The subproject is a pre 1980 project where some of the existing canals existing right of way located in the forest areas, no additional area is needed, hence SIO has written for Working Permission to Forest Department.

xii. The Contractors have not established any plants under the sub project. Materials are purchased from the vendors only.

xiii. Overall the EMP implementation was Partially satisfactory in two contract packages due to initial delays in documentation / environmental monitoring and testing.

xiv. As per the environmental assessment and review framework prepared for the project, it states that DoWR wants the surface and ground water quality monitoring to assess the source of impacts of upstream urbanization and industrialization and to check the level of deterioration due to increased application of fertilizers and pesticides. The suggested monitoring parameters to the contractor have a dual objective to generate the data base for water quality of WRD and to assess the impacts of construction by the Contractors by monitoring turbidity. Silt analysis was also incorporated to ensure quality of silt before disposal. The generated environmental data will be utilised for Integrated Water Resource Management

Planning. The SIO & Contractors are responsible for the environmental monitoring and the analysis would be carried out by the accredited laboratories.

xv. The environmental monitoring i.e. testing of surface water and, silt was carried out during the month of June 2016. During the period of July to December 2016 there was limited work was in progress due to release of water into the canal system for cultivation. Hence contractors could not adhere to the frequency suggested in the EMP of IEE report. SIO has requested to undertake environmental monitoring immediately.

xvi. In the subproject, SIO has not received any grievances and no grievances were noted during consultations also.

xvii. A compliance review indicates full compliance with Loan Covenants. Table 12 shows the environmental safeguards assurances and the status of compliances. Conclusions xviii. Overall, EMP implementation is rated “Partially Satisfactory” in both the contract packages Consultations reveal beneficiaries (local communities) are generally happy with the construction program. During this period i.e. between July to December 2016 there was no physical activity due to release of water in the canal for cultivation only limited slope protection work was carried out during this period. No adverse environmental impacts were observed and no grievances noted. The subprojects, after restoration of the canals shall increase economic benefits in the sub project area. xix. Awareness and Capacity development at PMU/SIOs commenced early in the project and included training on ADB environment policy and its implementation. Orientation programs on Environmental safeguards implementation was conducted during January and February 2016 which involves staff and Contractors of Kanjhari subproject also. Topics included ADB safeguards, environmental laws, contract clauses, and reporting needs xx. Subsequently subproject level orientation program was conducted on 24 June 2016 at Kamakhyanagar to overcome the short comings; around 14 persons including the Environment Specialist was present. The key participants were SIO & Contractors staff. xxi. SIO has initiated for obtaining working permission from State Forest Department, however he shall ensure that the clearance shall be available before the coming working season. xxii. EMP implementation timelines have been met in general. However, EMP implementation by Contractors is rated partially satisfactory in two contracts with only minor initial delays noted by some contractors, mainly due to understanding of the guidelines, contractual constraints and experience of contractor’s staff and documentation. xxiii. Contractor’s responsiveness is increasing and aided in EMP successful implementation as a Monthly Environmental Check was introduced to monitor all subprojects. xxiv. The Contractors shall ensure all the statutory clearances pending at the earliest, however SIO has written to the contractors for early compliances.

xxv. During the period of July 2016 to December 2016 limited work was in progress due to monsoon and also due to release of canal water system for cultivation, only limited slope protection work was carried out during this period the SIO/contractors had undertaken testing during June 2016,hence they could not undertake testing during this period. The SIO had requested contractors to undertake environmental testing i.e ., testing of surface water, ground water, silt, soil and noise as per the suggested frequency.

xxvi. Contractor had provided safety gear equipment and had encouraged the labour for a regular use. xxvii. Integrated Borrow area management approach by SIO’s (borrow area test for soil classification, OMC and MDD tests along with agreement with the landowners, obtaining Environmental Clearance from DEIAA/ DEAC) will ensure easy Contractors compliances, as a result this will improve the borrow area management. xxviii. SIO had requested Contractor to conduct AIDS awareness program periodically and the contractor shall ensure that they conduct in the next working season. xxix. The EMR data acquisitions may be archived as information and baseline for use in future DOWR environmental program management options and as anticipated policy enforcement changes evolve over time.

1.0 INTRODUCTION 1.1 Project Background 1. “Orissa Integrated Irrigated Agriculture and Water Management Investment Program” (OIIAWMIP) is a multi tranche financing facility (MFF) project with Asian Development Bank (ADB) assistance. It aims to enhance the productivity and sustainability of the existing irrigation schemes in the four northern river basins and a part of delta. This will involve renovating irrigation infrastructure, installing participatory irrigation management (PIM) systems with Pani Panchayats (PP) / water users associations (WUAs), and empowering WUAs as a cohesive platform for irrigation operation and maintenance (O & M) and agriculture development. The OIIAWMIP will also strengthen the institutional basis for PIM and integrated water resource management (IWRM) with management reforms and capacity strengthening of the relevant institutions.

2. Department of Water Resources (DoWR) had completed Project-1 implementation and Project -2 are under progress. 7. In the present report, EMP implementation status of Kanjhari subproject covering 2 sub- projects are presented from July 2016 to end of December 2016. The Table 1 Shows the project components contract package wise, starting date of implementation, Scheduled date of completion etc., along with physical progress for each contract package in Kanjhari sub project under Tranche -2.

8. The Kanjhari sub project was divided into 3 contract packages and one sub-minor package implemented by Pani Panchayat. , Out of the 4 contract packages (including sub-minors) ,period 2 contract packages i.e. CW- NCB- KNJ-01 and CW- NCB- KNJ-02 was awarded during 27 November 2015 and CW- NCB- KNJ-03 contract package and sub-minors are yet to be awarded.

2.0 IMPLEMENTATION STATUS AND EVALUATION 9. In Kanjhari Subproject civil works award of contract for 2 contract packages took place during November 2015 and while other contract packages are yet to awarded. While sub minors works implemented by Pani Panchayat are also yet to commence. Implementation of Environmental Management Plans is part of Contractors agreement for Contract packages but not for works implemented by Pani Panchayat. Monitoring and reporting on EMP issues was going well there was no change in the scope of work from the approved contract package.

4.0 ENVIRONMENTAL COMPLIANCES 13. The environmental compliances are in accordance with the statutory requirements of National, State level authorities, as per ADB safeguard requirements and EMP requirements which were made part of Contractors agreements. The Status of compliances is described below:

4.1. Compliance Status with National / State / Local statutory Authorities 14. The Initial Environmental Examination (IEE) documents have identified the Environmental Regulations and Legislations applicable to the project and the clearances/NOCs to be obtained at various stages of construction. The EMPs detail out the mitigation measures for potential negative impacts. However, the Kanjhari sub project doesn’t require any environmental clearances from the State Pollution Control Board or Ministry of Environment & Forests since all the subprojects were existing one, no new canals were formed and only strengthening of existing systems were taken up. The canals are not located in the Coastal Regulation Zone, no clearance were needed.

B. Tree Cutting Permission

16. In the IEE document identified there are trees that are present within the existing ROW of embankments out of which some trees might require felling, to the possible extent tree cutting shall be avoided but if any tree needs to be removed shall be done with State Forest Department Permission. The details of tree cutting are provided in Table 3 below:

C. Consent From State Pollution Control Boards:

17. The Contractor doesn’t require any specific environmental clearances from the Odisha State Pollution Control Board since they have not established any crusher/ HMP/ WMM plant etc. The contractors are purchasing the materials (aggregates) from the vendors only details provided in Table 4; they haven’t taken any quarry on lease nor were undertaking any blasting operations.

18. No HSD was stored at the camp; limited quantity of diesel stored however the contractors are purchasing HSD from the vendor only. Vehicle fitness and Pollution under Control certificates were requested for effective implementation of works and vehicles were sent to nearby garages for repair work if required.

D. Environmental Clearance for Borrow Earth

19. The details of borrow earth approvals subproject wise are provided under Table 5 below but no earth work was in progress during this period due to monsoon as well as water supply in the canal for cultivation purpose.

4.2.1 Kanjhari Subproject 22. The Kanjhari Subproject is covering 3 contract packages and one sub minor package. Out of the 3 contract packages only 2 contract packages have been awarded during this period. The status of EMP implementation against different environmental components for each contract package is shown in Annexure 3 to 4.

23. Overall the EMP implementation is rated partially satisfactory with only minor delays (testing of surface water, ground water and silt/ soil) noted by some contractors, mainly due to understanding of the guidelines, contractual constraints and experience of the contractors & SIO staff & documentation Process.

24. EMP implementation quality in each contract packages is rated on a 3-point scale (i.e. satisfactory, partially satisfactory and unsatisfactory). Ratings are assigned considering the degree of contractors compliance with EMP condition as determined by reports, periodic monitoring by SIO with ISPMC assistance. The definitions adopted for assessment of the EMP implementation quality ratings are: (i) “Satisfactory” (S) - when overall compliant with EMP; “Partially Satisfactory” (PS) mostly compliant with EMP; and “Un-Satisfactory” (NS) – when inadequately compliant with EMP”.

25. The EMP implementation rating is shown in Table 8. EMP implementation out of 2 contract packages, it is partially satisfactory in both the contract packages (CW- NCB- KNJ -01 and CW- NCB- KNJ -02).

4.2.1.1 Environmental Monitoring 26. During the design phase sub-project wise IEE’s were prepared incorporating EMP, to make EMP more effective WRD had incorporated Environmental testing and monitoring (Surface water, ground water and silt analysis) as part of environmental budget. As part of technical specification of Contractors BOQ Contractors shall adhere to the mitigation measures as stipulated in the IEE document. As per the environmental assessment and review framework prepared for the project, it states that DoWR wants the surface and ground water quality monitoring to assess the source of impacts of upstream urbanization and industrialization and to check the level of deterioration due to increased application of fertilizers and pesticides. The suggested monitoring parameters to the contractor have a dual objective to generate the data base for water quality of WRD and to assess the impacts of construction by the Contractors by monitoring turbidity. Silt analysis was also incorporated to ensure quality of silt before disposal. The generated environmental data will be utilised for Integrated Water Resource Management Planning. The SIO & contractors are responsible for the environmental monitoring and the analysis would be carried out by the approved laboratories.

27. The details of provisions under EMP as per IEE are detailed in Table 9 which also provides the number of locations against the proposed is also indicated. The analysis of the data is as follows:

4.2.1.1.1 Ground Water Quality Monitoring 28. The project -2 do not have a provision of providing tube wells in the on the sides of the canals. However in the subproject contractors didn’t drilled tube wells under the contract packages. The contractors of both the packages are using existing tube wells and surface for meeting the water requirements. As few supervisory staff is staying in the camp they use the existing bore wells. However SIO had requested the Contractors to undertake water quality testing from a accredited laboratories immediately, the results shall be included in the next monitoring report.

4.2.1.1.2 Surface Water Quality Monitoring 29. As per the Initial Environment Examination Report prepared for the subproject there is a provision for testing the surface water in 6 locations. The environmental testing budget was not part of contractor’s responsibility; however SIO had carried out testing from reservoir during June 2016 which may serve as baseline for the future. Though agreements were conducted during November 2015,after bringing capacity Building progamme SIO & contractor got interested during June 2016.During this period July to December 2016 limited activity was in progress due to release of water in the canal system. Hence SIO couldn’t undertake water testing, however they were requested to undertake immediately.

4.2.1.1.3 Soil Quality Monitoring 30. In the study area, Keonjhar district falls in the Garhjat hills (including Mayurbanj, Keonjhar, , , etc) occupying around 26.4 % of the States geographical area. The project area covers Keonjhar, Patna, and Ghatgaon Tehsils the soils in these Tehsils are mainly Balisahi series and Raghubera series. The Balisahi series are of fine mixed, hyperthermic, typic Haplustepts locally known as Balia Chikita Mati. These are gently sloping soils ranging from 3 to 8% with moderate erosion, normal relief. The soils are of granite genesis and moderately well drained and with moderate permeability. The thickness of the solumn ranges from 60 to 85 cm. The texture of a horizon ranges from sandy clay to sandy loam, while the horizon B texture varies from sandy clay loam to silty clay. These soils have a land capability subclass of IIIes and irritability sub-class of 3t.

31. While Ghatgaon block has Raghubra series with fine loamy, mixed hyperthermic, typic Rhodustalfs locally known as Balia Dorasa Mati. These are moderately sloping with 8 to 15% with severe soil erosion and excessive relief. These are of Granite and granite gneiss parent material with well drained and with moderate permeability. The solumn is more than 100 cm thick; a horizon texture varies from sandy loam to sandy clay. B horizon texture varies from sandy clay to sandy clay as per Soil Series of Odisha, NBSS&LUP publication.

32. However the soil samples adjacent to the canal embankment were to be tested as per the EMP provisions of the IEE however the SIO was not aware hence he was requested to undertake immediately.

4.2.1.1.4 Silt Quality Monitoring 33. Desiltations of canals are proposed now out of 3 contract packages only 2 packages are in force. Though IEE reports suggested for testing of 6 silt samples in the subproject. However SIO has undertaken testing of silt in 2 locations during the period covering one sample from each contract package.

34. The silt sample from contract package KNJ -01 was collected from RD 3.0 km of left main canal and for KNJ-02 it was collected from RD 0.150 km of right main canal. All the samples were tested during 23 June 2016.

35. The results of the silt analysis is presented in the previous EMR. Since there was no desiltation activity during this period i.e. due to release of canal water, hence SIO & Contractor was requested to undertake immediately.

4.2.1.1.5 Noise Quality Monitoring 36. The ambient air quality standards in respect of noise in the project area for each contract package under Kanjhari subproject were to be monitored on a hourly basis for each contract package which are under implementation. The noise testing was not part of IEE nor BOQ. However after the ADB mission review visits during May 2016 it suggested and accordingly SIO had requested Contractors for undertaking the noise monitoring at the earliest. To ascertain the need for mitigative measures to be adopted by Contractors during construction period i.e. Noise emanating from vehicular movements, blowing of horns, and operation of construction equipment like concrete mixer, movement of construction equipments and sound producing instruments etc., were measured for a day during day and night.

37. The noise monitoring reports for each contract package shall be enclosed in the next environmental monitoring report.

38. However, the present work locations are away from the residential areas where the noise levels get diluted hence no impact of noise anticipated, in addition contractors were also instructed to do maintenance of the vehicle and equipments which will also reduce the noise levels further. So Contractor was instructed to adhere to the ambient air quality standards specified under the rules and shall undertake measures for abatement of noise including use of silencer for the vehicle if necessary and sending equipments for maintenance regularly

Plantation Details

39. The IEE has identified that there are some trees within the existing right of way of the embankments, which might get affected due to construction and also to enhance the aesthetics of the area a provision for plantation has been indicated for in the IEE report. The contractor BOQ doesn’t have a provision for Plantation (Table 10). However at present no trees were cut and no plantation was carried out in the subproject areas, however if required as part of compensatory plantation the DoWR shall request State Forest Department in undertaking plantation where ever surplus ROW is available after completion of civil works

4.2.1.3 Consultation (Focus Group Discussion) with Villagers 40. The public consultations were conducted in two villages (Kaliabeda & Gopapura villages) that are located in the Kanjhari subproject, during June 2016 and the details were submitted in the previous EMR report. Since there was not much physical activity the consultations will be undertaken during the next EMR report preparation.

4.2.1.4 Grievance Mechanism

41. The subproject is part of Project -2 of investment program (OIIAWMIP) which has established a Grievance Redress Mechanism (GRM). In addition, there is an arrangement at the district level which provides a grievance mechanism whereby a grievance cell was located at the Collector’s office. The subproject, SIO has not received any grievances and no grievances were noted during consultations (details of consultations provided in section 4.2.1.3). If any minor grievances noted during SIO visits are being addressed by SIO staff.

5.0 INSTITUTIONAL ARRANGEMENTS 42. The following are the key agencies involved in the implementation of the EMP:

43. DoWR is the Executing Agency for OIIAWMIP. A Project Management Unit (PMU) has been established within the CAD&PIM Directorate with a Project Director of the rank of Chief Engineer operating under the overall guidance of Special Secretary cum Director CAD - PIM with the overall responsibility of program implementation. Chief Engineer cum Project Director, PMU will exercise the powers vested by the OPWD code for execution of all civil works.

44. At the field level Sub-project Implementation Offices (SIO) have been formed to implement the program. For Major irrigation sub-projects the concerned Superintending Engineer is the Sub- project manager and the concerned Executive Engineer is the Sub-project manager for Medium irrigation Sub-projects. The Sub-Project Manager, who is a Superintending Engineer (SE) for major irrigation systems and an EE for medium schemes, will manage the Technical Cell as well as monitor and guide the CAD and PP Support Cells for effective integration and coordination of the sub-project activities, under the support and guidance of PMU, EIC (P&D), and ISPM Consultants provided through regular PMU-SIO meetings.

45. DoWR for effective implementation of Project-2 sub-projects under OIIAWMIP proposes to create one Circle, four Divisions, 12 Sub-Divisions under the Chief Engineer – cum – Project Director, PMU.

Circle: One Superintending Engineer S.E will be in charge of circle office. He will be responsible for the managing the Technical Cell as well as monitor and guide the CAD and PP Support Cells for effective integration and coordination of the sub-project activities.

Division: Under each division one Executive Engineer (E.E) will be in charge of the division for, processing tender and bid documents executing the works, check measurement etc. He will ensure the quality of the ongoing works etc.

Sub-Division: Under each sub-division Assistant Engineer / Asst. Executive Engineer shall be in charge of the sub-division office. He will be supported by field functionaries like Junior Engineer and other field for execution, check measurement, monitoring the works and ensuring the quality of the work.

46. The Junior Engineer at the field level will be responsible for day to day environmental monitoring and the overall supervision and responsibility of EMP implementation will be with the concerned SIO Manager (S.E for Major sub project and E.E for medium sub project).

Institutional Strengthening and Project Management Consultants (ISPMC)

47. The ISPMC had an Environment Specialist, Resettlement Specialist and Indigenous group Specialist who were supporting the PMU in advising and monitoring the EMP measures with help of SIO Staff and WUAs. The ISPMC assisted in reviewing all the contractors’ monthly environmental reports submitted by Contractors through SIO in consultation with PMU. They were assisting the PMU in preparing environmental monitoring reports and other reports like preparation of IEEs, RP and social assessment reports.

Responsible for carrying out monitoring measures

48. As per the “ Environmental Assessment and Review Frame work (EARF) prepared for the project it states that “PMU will be responsible to undertake (i) environmental screening at subproject identification stage; (ii) preparation of IEEs/EIAs at subproject appraisal stage; and (iii) environmental management and mitigation during subproject implementation and operational stage. At appraisal, IEEs /EIAs will be done with the engagement of consulting firms who would be guided by the project environmental specialist.

49. Environmental management and mitigation will be undertaken by the construction contractors during construction phase under the supervision of the designated staff in the subproject management offices (SIOs) and monitored by PMU environmental cell. The consultants mobilized for institutional strengthening and project management will also be entrusted to provide necessary capacity development of the DOWR engineers and SIO (S.E for major sub project and E.E for medium subproject) in terms of environmental planning and management”.

50. . The PMU / SIO of DoWR assisted by the WUAs, and the Institutional Strengthening and Project Management Consultants (ISPMC) will be guiding the implementation of the EMP. The SIO (S.E for major sub project and E.E for medium subproject). The field level Junior Engineer shall be responsible for monitoring the EMP activities of the Contractors on a day to day basis. The SIO

staff and WUAs with the help of ISPMC, Environment Specialist will monitor the EMP implementation of the Contractor.

51. While the implementation of sub-minors shall be on WUAs and monitored by SIO. Pani Panchayat Support Unit (PPSU) is the state level apex agency who is responsible for strengthening the PP activities. PPSU - Environmental Monitoring Specialist be made responsible for the monitoring of WUAs along with SIO staff and these will work under the overall guidance of ISPMC.

52. The Environmental Framework prepared for the Project -2 states “Environmental management and mitigation will be undertaken by the construction contractors during construction phase”. The PMU and SIOs as well as contractors were guided by the ISPMC Environmental Specialist in implementation of the EMPs and associated monitoring and reporting activities.

53. Systematic monitoring of the EMP was facilitated by a check list developed specifically for SIO- J.Es and contractors. The format was part of the IEE report and subsequently during January & February 2016 orientation program the format was explained.

54. The SIO staff and contractors representatives at site were explained on the environmental aspects and the required safeguards measures that are needed at site along with necessary on job – training / sub project level trainings (on national environmental law requirements, environmental safeguards requirements of ADB, contractual clauses for EMP implementation).

Capacity Building

55. During January 2016 and February 2016 Capacity building on EMP implementation was carried out by PMU with the help of ISPMC Consultants. So far 88 persons (Senior DoWR staff, SIO staff and Contractors also) were trained (which includes staff and Contractors from Kanjhari Subproject also) SIO staff and Contractor representatives in the EMP implementation and as a result Contractor compliances had improved to a greater extent.

56. The orientation program on Environmental Safeguards for Kanjhari subproject was held on 24 June 2016 at Kamakhyanagar, ( Covering the staff and contractors of Ramial and Kanjhari Subprojects) to bring awareness on EMP implementation to SIO field staff and contractor representatives. There were 14 numbers of participants including the speaker. One Junior Engineer for each contract package was identified who will act as an Environmental Co-ordinator for monitoring the field level EMP implementation. This mechanism had helped in timely EMP compliances but with some delays.

6.0 COMPLIANCES STATUS OF PREVIOUS EMP REPORT - SUB PROJECT WISE 57. For the Kanjhari Subproject i.e. contract package wise status of compliances with reference to the previous Environmental Monitoring Report (EMR) is stated in Table 11. As this is the first Environmental Monitoring Report for the subprojects so there are no previous compliances reported pending.

8.0 CONCLUSIONS 59. Overall, EMP implementation is rated “Partially Satisfactory” in both the contract packages Consultations reveal beneficiaries (local communities) are generally happy with the construction program. During this period i.e. between July to December 2016 there was no physical activity due to release of water in the canal for cultivation ,only limited slope protection work was carried out during this period. No adverse environmental impacts were observed and no grievances noted. The subprojects, after restoration of the canals shall increase economic benefits in the sub project area. 60. Awareness and Capacity development at PMU/SIOs commenced early in the project and included training on ADB environment policy and its implementation. Orientation programs on Environmental safeguards implementation was conducted during January and February 2016 which involves staff and Contractors of Kanjhari subproject also. Topics included ADB safeguards, environmental laws, contract clauses, and reporting needs 61. Subsequently subproject level orientation program was conducted on 24 June 2016 at Kamakhyanagar to overcome the short comings; around 14 persons including the Environment Specialist was present. The key participants were SIO & Contractors staff. 62. SIO has initiated for obtaining working permission from State Forest Department, however he shall ensure that the clearance shall be available before the coming working season. 63. EMP implementation timelines have been met in general. However, EMP implementation by Contractors is rated partially satisfactory in two contracts with only minor initial delays noted by some contractors, mainly due to understanding of the guidelines, contractual constraints and experience of contractor’s staff. 64. Contractor’s responsiveness is increasing and aided in EMP successful implementation as a Monthly Environmental Check was introduced to monitor all subprojects. 65. The Contractors shall ensure all the statutory clearances pending at the earliest, however SIO has written to the contractors for early compliances. 66. During the period July 2016 to December 2016 there was no physical activity due to release of water into the canal water system for rabi cultivation, the SIO / Contractors had undertaken environmental monitoring i.e surface water and silt during June 2016. The SIO had requested contractors to undertake environmental testing i.e ., testing of surface water, ground water, silt, soil and noise as per the suggested frequency.

67. Integrated Borrow area management approach by SIO’s (borrow area test for soil classification, OMC and MDD tests along with agreement with the landowners, obtaining Environmental Clearance from DEIAA/ DEAC) will ensure easy Contractors compliances, as a result this will improve the borrow area management. 68. SIO had requested Contractor to conduct AIDS awareness program periodically and the contractor shall ensure that they conduct in the next working season. 69. The EMR data acquisitions may be archived as information and baseline for use in future DOWR environmental program management options and as anticipated policy enforcement changes evolve over time.
