NOTICE INVITING TENDER No. 4(Sl. No.1) OF 2020-2021 OF THE ASSISTANT ENGINEER PWD, MATHABHANGA SUB-DIVISION. The Assistant Engineer, Mathabhanga Sub-Division, Public Works Department, invites Tender for the work detailed in the table below will be received by the Assistant Engineer, Mathabhanga Sub-Division, P.W.D. in printed tender form as specified in sealed packet. 1. List of scheme:- As per Annexure “A” 2. Earnest Money: @ 2% (two percent) of the estimated amount put to tender only for each job.

3. EMD: Earnest Money may be remitted through demand draft/pay order issued from any Nationalized/Scheduled bank in favour of Executive Engineer, PWD, Cooch Behar Division, Cooch Behar with the tender documents in sealed envelope. FSD in the form of Earnest Money will not be allowed vide G.O. No.24-A/2D-13/2010 Dated 31-01-2014. Successful bidder, whose tender will be accepted, has to submit the cost of tender document during formal agreement after issuance of acceptance or acceptance-cum-work order. The documents submitted by the Bidders should be properly indexed & self attested with seal. 4. Eligibility criteria for participation in tender: a. Self-attested scanned copy of PAN Card, Current Income Tax Return (ITR) Acknowledgement, Current Trade License, Professional Registration/ Enrollment Certification with Current Tax receipts Challan, GST registration certificate with current Tax receipts Challan, Balance sheet verified by competent authority i.e. Chartered Account, of last 3 years to be accompanied with Tender document.(Non Statutory Documents). b. For registered Unemployed Engineers’ Co-operative Societies / Unemployed Labour Co.- Op. Societies are required to furnish valid Bye Law, Current Audit Report along with other relevant supporting papers. c. Registered partnership deed (For partnership Firm only) along with power of attorney to sign on the tender document. (If required) d. The partnership Firm shall furnish the registered partnership deed and the company shall furnish the article of Association and Memorandum. e. A prospective bidder participating in a single job either individually or as a partner of a firm shall not be allowed to participate in the same job in any other form. f. A prospective bidder shall be allowed to participate in a single job either in the capacity of individual or as a partner of a firm. If found to have applied severally in a single job, all his application will be rejected for that job. g. Neither prospective bidders nor any of constituent partner had been debarred to participate in tender by the Public Works Department during the last 5(Five) years prior to the date of this NIT. Such debar will be considered as disqualification towards eligibility. (A declaration in this respect has to be furnished by the prospective bidders as per prescribed format without which the Technical Bid shall be treated non-responsive). h. “Any intending bidders who have failed to execute more than one works contract under any Directorate of this Department and was terminated by any sub rule under clause 3 of Tender Form No 2911 or terminated under any clause of Standard Bidding Document by the Engineer-in-charge / Employer during last 3(Three) years will not be eligible to participate in any bid under any Directorate under this Department for another 2(Two) years from the date of imposition of last termination notice by the Engineer-in-charge / Employer. 5. Other term & Conditions of credentials:- i) Payment certificate will not be treated as credential:- ii) Credential certificate issued by the Executive Engineer, or equivalent authority of a state /Central Government, State/Central Government undertaking, statutory/Autonomous bodies constituted under the central/State, on the executed value of completed/ running work will be taken as credential 6. Constructional Labour Welfare Cess @ 1(one) % of cost of construction will be deducted from every Bill of the selected agency vide order No.599A/4M-28/06 dt. 27-09-2006 & finance Order No.853-F, dt. 01-02-2006. Vat, Royalty & all other statutory levy/ Cess will have to be borne by the contractor & the rate in the schedule of rates inclusive of all the taxes & cess stated above. 7. No Mobilization Advance and Secured Advance will be allowed. 8. Agencies shall have to arrange equivalent land for installation of Plant & Machineries, (specified for each awarded work, storing of material, labour shed, laboratory etc. at their own cost and responsibility. 9. Bids shall remain valid for a period 120 (One hundred & Twenty) days from the last date of submission of Financial Bid/ Sealed Bid submission. 10. All materials like Cement, steel, Bitumen etc. will be supplied by the Contractor. 11. Date & Time Schedule: Sl. No Particulars Date & Time 1 Last date & time for receipt of application for permission. 06.10.2020 at 14.00 Hrs 2 Last date & time for Purchase. 07.10.2020 at 14.00 Hrs 3 Last date & time limit for of sealed tender. 09.10.2020 at 15.00 Hrs 4 Date & time for open tender box. 09.10.2020 at 16.00 Hrs If the last date of permission, purchase and submission of tender paper becomes a holiday, next Working days would be treated as the date of permission, purchase and submission of tender at the Same schedule of time.

1. DEFECT LIABILITY PERIOD: Clauses 17 of CONDITIONS OF CONTRACT ACT of the Printed Tender Form Shall be substituted by following:- Clause 17. – If the contractor or his workman or servents or authorized representative shall break, deface, injure destroy any part of building, in which they may be working, or any building, road, road- curbs, fence, enclose, water pipes, cables, drains, electric or telephone posts or wires, trees, grass or grassland or cultivated ground contiguous to the premises, on which the work or any part of it is being executed, or if any damage shall happen to the work from any cause whatsoever or any imperfection became apparent in it at any time whether during its execution or within a period of As Per Rule after issuance of a certificate of its completion by the Engineer-in-Charge, the contractor shall make the same good at his own expenses, or in default, the Engineer-in-Charge may cause the same to be made good by other workmen and deduct the expense (of which the certificate of the Engineer-in-Charge shall be final) from any sums, whether under this contract or otherwise, that may be then, or at any time thereafter became due to contractor by Executive engineer(P.W.D.),Cooch Behar Division or from his security deposit, or the proceeds of sale thereof, or of a sufficient portion thereof and if the cost, in the opinion of the Engineer-in-Charge (which opinion shall be final and conclusive against the contractor), of making such damage or imperfections good shall exceed the amount of such security deposit and/ or such sums, it shall be lawful for the Executive engineer(P.W.D.),Cooch Behar Division to recover the excess cost from the contractor in accordance with the procedure prescribed by any law for the time being in force. The security deposit of the contractor shall not be refunded before the expiry of As Per Rule after the issuance of the certificate, final or otherwise, of completion of work by the Engineer-in-Charge; Provided that the work shall not be deemed to have been completed unless the “Final Bill” in respect thereof shall have been passed and certified for payment by the Engineer-in-Charge;

Provided further that the Engineer-in-Charge shall pass the “Final Bill” and certify thereon, within a period of forty five days with effect from the date of submission thereof by the contractor, the amount payable to the contractor under this contract and shall also issue a separate certificate of complession of work to the contractor within the said period of forty five days. The certificate of Engineer-in-Charge whether in respect of the amount payable to the contractor against the “Final Bill” or in respect of complession of work shall be final and conclusive against the contractor. However, the security deposit of the contractor held with Executive Engineer (P.W.D.),Cooch Behar Division under the provision of Clause 1 hereof shall be refundable to the contractor As Per Rule.

Vide notification no. 177-CRC-/2M-57/2008 dated 12/07/2012 of Secretary, P.W.D., Govt. of West Bengal. No interest would be paid on the performance Security Deposit

Explanations :- The word “Work” means and includes Road work , Bridge work , Building work, Sanitary & Plumbing Work, Electrical Work and /or any other work on contemplated within the scope and ambit of this Contract. The work may be of original or special repair in nature or a combination thereof, or of original or special repair in nature in combination with the work (s) of repair and / maintenance in nature. Provided that in respect of the work of repair or maintenance in nature or a combination thereof, the words three years wherever appearing in this clause shall be deemed to be one year and in which case the security deposit of the Contractor held with the Government under the provision of Clause-1 hereof shall be refundable to the contractor on expiry of one year after the issuance of certificate of completion of work by the Engineer-in-Charge. (2) The following Paragraph shall be added to the Interpretation Clause of CONDITIONS OF CONTRACT:- “The word ‘Government’ means of the Government of the State of West Bengal in Public Works Department”. This bears concurrence of Group-T of Finance (Audit) Department vide their U.O. No.614 dated 06/07/2012.

2. There shall be no provision of Arbitration. Hence clause 25 of 2911 (ii) is omitted vide notification no. 558/SPW dated. 13.12.2011 of Principal Secretary, P.W. & P.W. (Roads) Department. 3. The Bidder, at the Bidder’s own responsibility and risk is encouraged to visit and examine the site of works and its Surroundings and obtain all information that may be necessary for preparing the Bid and entering into a contract for the work as mentioned in the Notice inviting Tender, the cost of visiting the site shall be at the Bidder’s own expense. Traffic management and execution shall be the responsibility of the Agency at his/her/their risk and cost. 4. The intending Bidders shall clearly understand that whatever may be the outcome of the present invitation of Bids, no cost of Bidding shall be reimbursable by the Department. The Assistant Engineer, P.W.D ,Mathabhanga Sub-Division, Mathabhanga reserves the right to reject any Bid documents and to accept or reject any offer without assigning any reason whatsoever and is not liable for any cost that might have incurred by any Bidder at the stage of Bidding. 5. Prospective applicants are advised to note carefully the minimum qualification criteria as mentioned in ‘Instructions to Bidders’ before bidding 6. In case of Ascertaining Authority at any stage of tender process or execution of work necessary registered irrevocable power of attorney is to be produced. 7. All intending bidders are requested to be present in the office of the ‘The Assistant Engineer, PWD, Mathabhanga Sub-Division, Mathabhanga during opening of the Tender paper. The Assistant Engineer, PWD, Mathabhanga Sub-Division, Mathabhanga, may call Open Bid/ Seal Bid after opening of the said bid to obtain the suitable rate further, if it is required. No objection in this respect will be entertained raised by any bidder who will present during opening of bid, or from any bidder who will absent at the time of opening of Tender. No informal tender participant will be entertained in the bid further. 8. No CONDITIONAL/ INCOMPLETE TENDER will be accepted under any circumstances. 9. The Assistant Engineer, PWD, Mathabhanga Sub-Division, Mathabhanga reserves the right to cancel the N.I.T. due to any unavoidable circumstances and no claim in this respect will be entertained. 10. During scrutiny, if it is come to the notice to tender inviting authority that the credential or any other papers found incorrect/manufactured/fabricated, that tender participant will not be allowed to participate in the tender and that application will be out rightly rejected without any prejudice. 11. Before issuance of the work order, the tender inviting authority may verify the credential (Completion Certificate) & other documents of the lowest tender participant if found necessary. After verification, if it is found that such documents submitted by the lowest tender participant is either manufacture or false in that case, work order will not be issued in favour of the tender participant under any circumstances and necessary action will be taken by the tender inviting authority.

12. Refund of EMD: The Earnest Money of every technically disqualified Tenderer as well as that of every qualified Tenderer other than L1 (i.e. 1st Lowest Tenderer) and L2 (i.e. 2nd Lowest Tenderer) within three (3) days after the L1 has accepted the LOI (i.e. Letter of intent) will be refunded by the undersigned on receipt of application from Tenderers on the basis of P.W.D. accounts branch notification no- 451-A /PW/O/10C-35/10 dated 26/07/2011 of Secretary to the Govt. of West Bengal. 13. Contractor shall have to comply with the provisions of (a) the contract labour (Regulation Abolition) Act. 1970. (b) Apprentice Act. 1961 and (c) minimum wages Act. 1948 of the notification thereof or any other laws relating thereto and the rules made and order issued there under from time to time.

14. Rejection of bid The Tender inviting officer reserves the right to accept or reject any Bid and to cancel the Bidding processes and reject all Bids at any time the prior to the award of Contract without thereby incurring any liability to the affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of the ground for Tender inviting officer’s action.
