July 9, 2019 The Honorable Anthony Portantino Chair, Senate Appropriations Committee State Capitol, Room 3086 Sacramento, CA 95814 RE: Assembly Bill 1080 (Gonzalez) – SUPPORT IF AMENDED As Amended July 5, 2019 Dear Senator Portantino: On behalf of the Rural County Representatives of California (RCRC), I am writing with respect to Assembly Bill 1080, authored by Assembly Member Lorena Gonzalez, which, among other things, requires manufacturers to source, reduce, and recycle single- use packaging and products sold in California. While we are strongly supportive of what the bill seeks to accomplish, we believe some amendments are vital to avoid costly burdens on local governments. RCRC is an association of thirty-six rural California counties, and the RCRC Board of Directors is comprised of elected supervisors from each of those member counties. California is in the process of implementing SB 1383 (Lara, Chapter 395, 2016), which establishes ambitious goals to reduce landfill disposal of organic waste 75 percent below 2014 levels by 2025. CalRecycle’s far-reaching SB 1383 regulation could cost as much as $20 billion to implement and poses many challenges for local governments. Considering the massive costs local governments will soon face with SB 1383 implementation, it is vital to avoid imposing additional costly requirements on local jurisdictions. Previous versions of AB 1080 appropriately placed compliance obligations on manufacturers and retailers who produce and sell single-use products; however, the June 20 amendments significantly

HAS PAGA MET ITS FINAL MATCH? CONTINUED EXPANSION OF CALIFORNIA’S PRIVATE ATTORNEYS GENERAL ACT LEADS TO TRADE GROUP’S CONSTITUTIONAL CHALLENGE Ivan Muñoz* In 2003, California enacted the Private Attorneys General Act (“PAGA”) in response to its inability to enforce its labor code amid rapid expansion of its workforce. What was traditionally a responsibil- ity of the Attorney General, private plaintiffs could now sue their em- ployers for alleged violations of the labor code. The law was received with much controversy, and to this day, there are growing concerns that it has become an extortive mechanism for plaintiffs at the expense of the business community. This Note traces the historical development of the law by investi- gating its expansion in both the legislature and judiciary.

  • Pension Fund Leaders Term Corporate Board Diversification ‘Unacceptably Slow,’ Call for Increased Attention from Investors, Corporate Boards
FOR IMMEDIATE RELEASE PR16:21 Contact: Marc Lifsher June 1, 2016 [email protected] 916-653-2995 Pension Fund Leaders Term Corporate Board Diversification ‘Unacceptably Slow,’ Call for Increased Attention From Investors, Corporate Boards California State Treasurer John Chiang joins group of fiduciaries from funds with more than $1 trillion under management SACRAMENTO – California State Treasurer John Chiang today joined a group of state and local officials who contend that corporate boards have been too slow to diversify their ranks and that institutional investors should increase their focus on board diversity as a corporate governance priority. The joint statement emphasizes that racial and LGBT diversity as well as gender diversity are critical dimensions of effective board composition and performance. “There is broad agreement that a diverse corporate board is good for business,” Treasurer Chiang said. “Boards with directors, who possess a wide range of skills and experiences, are better positioned to oversee company strategy, risk mitigation and management performance.” Statistics show that board diversification has been slow—or has even regressed. White directors hold 85 percent of the board seats at the largest 200 S&P 500 companies, and the percentage of those boards with exclusively white directors has increased over the last decade. Men occupy 80 percent of all S&P 500 board seats. It is also estimated that there are fewer than 10 openly lesbian, gay, bisexual, or transgender directors among Fortune 500 companies. The 14 co-signers, many of them longtime leaders on the issue of board diversity, are fiduciaries for pension funds responsible for the retirement security of six million participants and with more than $1 trillion in assets under management.
