1 Human Traffi cking

Human traffi cking, often referred to as “modern-day slavery”, involves the recruitment, transportation, transfer, harbouring or receipt of individuals by means such as deception, coercion or abduction for the purpose of labour, sexual or other exploitation.

Tanzania is a source, transit and destination country for men, women and children subjected to forced labour and sex traffi cking. Traffi cking is mostly believed to occur within the country’s borders, involving women and children from rural areas exploited in urban areas in domestic servitude or for other types of forced labour in the agricultural, textile or construction sectors.

In 2008 the Government of enacted the Anti-Traffi cking in Persons Act criminalizing human traffi cking whilst creating a framework for direct assistance to victims of traffi cking.

This Directory provides a structured list of service providers and key stakeholders assisting victims of human traffi cking along with their contact information.

2 Foreword

Human traffi cking is a growing and complex problem throughout the world, and Tanzania has not been spared from this scourge. In Tanzania, human traffi cking often takes the shape of the exploitation of a child, often a girl, separated from her family with the promise of a job or education and then treated like a slave, forced to work under any type of condition, with limited or no freedom at all. It is therefore of utmost importance to set up and implement an effective strategy to combat human traffi cking, providing for victims’ protection and assistance, and ensuring that traffi cking crime is reported to the criminal justice system and prosecuted.

Tanzania is party to the Protocol to Prevent, Suppress and Punish Traffi cking in Persons, especially women and children, supplementing the United Nations Convention against Transnational Organized Crime (2000). The National Anti-Traffi cking Action Plan was developed as an instrument to address the issues of traffi cking in persons, particularly in the areas of prevention, protection, prosecution as well as rehabilitation. It outlines the strategic goals to drive and steer national efforts to combat traffi cking in persons; and related responsibilities within the Government bodies and programme areas to support and ensure effective implementation of the strategic goals.

Within the Government of the United Republic of Tanzania, the Ministry of Home Affairs and the Ministry responsible for Health and Social Welfare in Mainland and ; are mandated to provide victim assistance and monitor service provision for victims of traffi cking to ensure their welfare. The Government of Tanzania works in close collaboration with the International Organization for Migration (IOM) as well as specialized UN agencies to combat traffi cking in persons and provide rapid and appropriate assistance to victims within the framework of the UN Development Assistance Plan 2011-2015.

The basic purpose of this Directory is to provide guidance on the role of Service Providers in implementing the Anti-traffi cking in Persons Act, 2008 to combating traffi cking in persons by protecting victims of human traffi cking through effective support of service provision.

In order to fulfi ll the Government’s vision of eliminating all forms of Child Labour, Violence Against Children, Forced Labour and Human Traffi cking and to protect victims from these vices, a holistic approach and concerted efforts are needed from all stakeholders. It is my hope and expectation that this Directory will be used as one of many tools for the close cooperation between all persons, agencies and institutions who are providing care for traffi cked persons, and that it will contribute to encouraging more people to come forward and report suspected cases of traffi cking to the authorities.

I would like to take this opportunity to reaffi rm a strong and fi rm commitment of the Government of Tanzania to combating human traffi cking in all its forms, and to thank the UN for joining us in this important task.

6 PREFACE

The Anti-Traffi cking in Persons Act of 2008 The preamble to the Act provides among other things that: The United Republic recognizes equal rights and inherent human dignity of people as enshrined in the Constitution of the United Republic of Tanzania of 1977, and the United Nations Protocol to Prevent, Suppress and Punish Traffi cking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime (2000) and other universally accepted human rights instruments and international conventions to which the United Republic is signatory.

The Act contains the following sections: Preliminary Provisions (Part I); Prohibition of Traffi cking in Persons (Part II); Investigations and Judicial Proceedings (Part III); Rescue, Rehabilitation, Protection and Assistance to Victims (Part IV); the Anti-Traffi cking Fund (Part V); and the Anti- Traffi cking Committee (Part VI).

The National Anti-Traffi cking Committee The National Anti-Traffi cking Committee is responsible for coordinating activities of government ministries, departments and agencies dealing with matters related to traffi cking in persons. It is also the key implementer of the National Plan of Action against traffi cking in persons. The Secretariat is headed by the Secretary who is appointed by the President. The secretariat’s role is mainly to advise the Anti-Traffi cking Committee on matters related to the general administration of the Act.

The Ministry of Home Affairs The Ministry in cooperation with other Ministries is responsible for taking adequate measures for protection, rehabilitation, assistance and repatriation to rescued victims. The National Anti-Traffi cking Secretariat on Human Traffi cking is housed in the Ministry of Home Affairs, coordinating the government’s multi-sectoral response to human traffi cking.

The Ministry Responsible for Health and Social Welfare in Mainland and Zanzibar - Social Welfare Department The Ministry (Department of Social Welfare) is responsible for implementing rehabilitative and protective programmes for traffi cked persons, providing counselling and temporary shelter to traffi cked persons and developing a system for accreditation among non-governmental organizations (NGOs) for purposes of establishing centres and programmes for intervention.

The United Nations Development Assistance Plan in Tanzania The International Organization for Migration (IOM) is part of the United Nations Development Assistance Plan (UNDAP) 2011-2015. UNDAP is the business plan of 20 UN agencies, funds and programmes in Tanzania commonly known as “Delivering as One”. On the basis of this plan, IOM is providing technical and fi nancial assistance to NGOs for shelter support, medical services, voluntary counselling and testing, shelter, meals, education and vocational training to child victims of traffi cking, family reunifi cation where appropriate as well as the support to the production and dissemination of data on human traffi cking.

Moreover, IOM is supporting the development of a Multi-Sectoral Communication strategy on violence against children including traffi cked children; assisting the government in developing Regulations for the implementation of the Anti-Traffi cking in Persons Act of 2008; and setting up a Directory of Service Providers for victims of traffi cking in Tanzania. This booklet has been prepared in this context, following the completion of a mapping exercise of all shelters and service providers present in Tanzania.

The Directory The Directory of Service Providers in Tanzania is intended to facilitate the referral mechanisms and improve coordination among Service Providers with a focus on the protection and

7 assistance to victims of traffi cking as mandated by Tanzania’s Anti- Traffi cking in Persons Act, 2008. The Directory was compiled by IOM in consultation with the National Anti-Traffi cking Committee and its Secretariat members and other stakeholders. The information was pro- vided by the respective Service Providers.

Service Providers

Service Providers are Government Ministries, Departments, Agencies and Non-State Actors organizations providing services to victims of traffi cking, including trained specialized psychosocial support, shelter, medical care or legal services. Service Providers may also include UN-Agencies, and local and international NGOs.

8 Description of Services

Shelter: A place where victims of traffi cking can be temporarily accommodated as part of their recovery and rehabilitation.

Medical: A victim of traffi cking is entitled to the same access to public health care as Tanzanian citizens.

Psychosocial: Psychosocial services are to be provided to benefi ciaries by a qualifi ed mental health professional in coordination with the benefi ciaries’ case managers, in order to meet their psychosocial needs.

Legal: Benefi ciaries should be aware of their legal rights and should be provided with professional legal services to ensure they are able to exercise these rights.

Regularization of stay: Non-national benefi ciaries can utilize government services to help prevent untimely deportation from Tanzania by ob taining permits or visas or by other regularizing mechanisms.

Asylum and refugee procedures: Where relevant, benefi ciaries are assisted with the procedures involved in determining refugee status and/or seeking asylum.

Skills Building: Programmes are in place aimed at the provision of skills development training for benefi ciaries in preparation for ‘life after traffi cking’ and to prevent re-traffi cking.

Rehabilitation: Victims of traffi cking can utilize rehabilitation activities including sport, games and the arts as part of rehabilitation.

Repatriation: Benefi ciaries are returned to the country or area of origin with due regard to safety, prevention of re-traffi cking and suitability of care arrangements.

Reintegration: Is intended to provide for the benefi ciary’s safe, dignifi ed and sustainable reinsertion into society and normalized life. Reintegration also includes prevention of re-traffi cking and reunifi cation.
