Village of Fox Lake At the regular Board Meeting, held in said Village and County in the State of Illinois at 6:30 p.m. on January 24, 2017 meeting was called to order by Mayor Schmit. The following official business was transacted: Roll Call Present Mayor Schmit: Village Clerk Warden; Attorney Teegen; Trustees: Murrey, Jensen, Stochl, Konwent, Koske and Marr. I. Preliminary Audience Comments: There were no audience comments this evening.

II. Approval of Minutes Trustee Konwent made a motion to approve the Village Board Meeting Minutes of January 10, 2016, Seconded by Trustee Marr. III. ABCD Award – John Lavin and Fox Lake’s Deputy Police Chief Jimmy Lee

Lake County Sheriff’s Office Marine Unit Deputy Jonathan Levin was honored at the Fox Lake Village Board meeting by Mayor Donny Schmit, the Village Board, and Chief of Police Russell Laine, for his life-saving actions at a traffic crash on July 16, 2016. RETURN TO AGENDA DATE 1/24/17 2 of 8 Fox Lake Deputy Chief Jimmy Lee was honored for is life-savings actions at the Florence Fischer dinner in December 2016.

IV. Recognitions - Promote Fox Lake

Promote Fox Lake was honored by the Village Board for their ongoing dedication, time and talents that they have given to the betterment of Fox Lake.

V. Administrator Update Administrator Marrin presented the expenditures, warrants, and transfers for January 24, 2017. She asked if there were any questions, to which there were none. Administrator Marrin added that if there were no questions, there would be a motion to approve this evening under Finance VI. Recess to the Committee of the Whole Trustee Koske made a motion to recess into the Committee of the Whole Meeting at 6:45p.m., Seconded by Trustee Konwent. Finance Trustee Stochl asked if there were any questions regarding the budget amendment, raffle licenses request for the Lakes Region Post 703 50/50 raffle and their Queen of Hearts raffles. There were none.

Trustee Stochl asked the Board if there were any questions regarding the Waste Management proposal. The Board discussed tentative programs being added to contract such as leaf bag pick-up. B. Building and Zoning Trustee Marr asked if there were any questions regarding the foreclosure Ordinance. Village Attorney Howard Teegen stated that he was looking further into the legalities of this type of Ordinance. Teegen stated that once he had more information he would present it to staff for further review. Trustee Marr stated that the motion would be tabled.

Trustee Stochl asked if there were any questions regarding the Resolution for lane closures for the Triathlon. Director Day updated the Board on the status of Triathlon and what would be needed to proceed with the event. C. Parks and Recreation Trustee Koske updated the Village Board on the following events:  Senior Friends will meet on January 26th at Fox Lake Volunteer Bingo Hall.  Special Olympic Illinois Polar Plunge, Fox Lake will be held at the Lakefront Park on Sunday, February 26th.  Iceless Hockey will begin January 26th and run through February 23, 2017. D. Planning Trustee Marr stated that he did not have anything to report from planning this evening.

E. Public Safety Trustee Jensen asked if there were any questions regarding increasing the administrative towing fees. There was discussion from the Board on what type of arrests warranted a tow as well as options that the violator has for appealing the fee. He asked the Board if they had any further questions. There were none.

Trustee Jensen asked if there were any questions regarding the termination of the Lindenhurst agreement from FoxComm. Administrator Marrin stated that their agreement is set to expire and they have opted not to renew. There were no questions from the Board. F. Sewer and Water Trustee Murrey stated that he would like the Board to read the Village Administrator report and keep themselves updated on the Departments.

G. Streets Trustee Konwent read a letter of thank you to the Fox Lake Street Department and their employee “Anthony” for his diligence during the past snowstorms. VIII. XI. President’s Comments Mayor Schmit stated that Fox Lake has been awarded two grants from Stormwater Management for Dunn’s Lake Shoreline Estates (HOA) project as well for Woodhill’s Bay “Phase I Stormwater Control Improvement” project.

Mayor Schmit stated that Marine Grill is now open and will have their official Grand Opening on Saturday, February 4, 2017. Mayor stated that Ray Auto Group will be holding a “Career Fair” on Sunday, February 19th.

PURPOSE AND ACTION REQUESTED: Staff is requesting Village Board consideration for the approval and adoption of the attached Mission Statement and Core Values (Attachment 1) for the Village of Fox Lake, Illinois.

BACKGROUND/DISCUSSION: The Village Board in conjunction with Village Staff has been undertaking a strategic planning process for the last three months. Executive Service Corp. has been the Village’s consultant guiding the Board and Staff through a rigorous strategic planning process which has included interviews with key stakeholders, a strategic planning workshop, and most recently, a Board development workshop.

As a first steps towards developing and adopting a strategic plan, Executive Service Corp. has recommended approving and formally adopting a Village Mission Statement and set of Core Values. Staff is requesting those outlined in Attachment 1 be considered for Board approval and adoption.

Both the proposed Mission Statement and Core Values have had input and feedback from Staff and Elected Officials, and therefore, staff is requesting formal approval and adoption of the agreed upon Mission Statement and Core Values through Resolution.

BUDGET: There is no budgetary impact at this time.

RECOMMENDATION: Staff recommends approving and formally adopting the attached Mission Statement and Core Values (Attachment 1) through Resolution (Attachment 2).

PURPOSE AND ACTION REQUESTED: Staff is requesting Village Board consideration for an ordinance adopting the following International Code Council (ICC) codes:

 2015 International Building Code With amendments  2015 International Residential Code for One- and Two-Family Dwellings With amendments  2015 International Property Maintenance Code With Amendments  2015 International Mechanical Code in entirety  2015 International Fire Code in entirety with amendments to follow  2015 International Fuel Gas Code in entirety  2015 International Energy Conservation Code in entirety  2015 International Existing Building Code in entirety  2015 National Fire Protection Association 101 Life Safety Code  2014 National Electrical Code with existing amended sections

BACKGROUND/DISCUSSION: The Village is two (2) code cycles behind the most recent version of the ICC codes. ICC updates their code books every three (3) years to incorporate new building practices and methods of construction. BUDGET: 01-354-5700 OFFICE SUPPLIES: $750.00 For new code books. Admin : $1000.00 for codification (Sterling Codifiers) Total $1,750.00

RECOMMENDATION: Staff recommends updating the ICC codes to the versions outlined above and the recommended amendments as outlined below.

WHEREAS, the Village has adopted various Codes by reference and newer versions of said Codes have now become available; and

WHEREAS, the Community Development Director has recommended that updated versions of said Codes be adopted and the Corporate Authorities have determined that it is expedient to do so;

NOW THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Fox Lake, Lake and McHenry Counties, Illinois, as follows:

SECTION I: Section 6-1-1-1A of the Village Code of the Village of Fox Lake is

hereby amended by changing "2009 edition of the international building code" to "2015

edition of the International Building Code"

SECTION II: Section 6-1-1-1D of the Village Code of the Village of Fox Lake is

amended by replacing Section 6-1-1-1D with the following amendments:

ALL SECTIONS 1) Change all references to “code official” to “building official.”

CHAPTER 1 SCOPE AND ADMINISTRATION 1) SECTION 101 GENERAL a) Revise Section 101.1 “Title” to read as follows:

101.1 Title. These regulations shall be known as the Building Code of the Village of Fox Lake, hereinafter referred to as “this code.”

b) Revise Section 101.4.3 “Plumbing” to read as follows:

“101.4.3 Plumbing. The provisions of the Illinois State Plumbing Code as adopted by the Village of Fox Lake shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system.” RETURN TO AGENDA

c) Revise Section 101.4.4 “Property Maintenance” to read as follows:

“101.4.4 Property maintenance. The provisions of this code, the International Property Maintenance Code, the International Fire Code, and the International Existing Building Code as adopted by the Village Board shall apply to existing structures and premises; equipment and facilities; light, ventilation, space heating, sanitation, life and fire safety hazards; responsibilities of owners, operators and occupants; and occupancy of existing premises and structures.”

d) Revise Section 101.4.6 “Energy” to read as follows:

“101.4.6 Energy. The provisions of the Illinois Energy Conservation Code as adopted by the Village Board shall apply to all matters governing the design and construction of buildings for energy efficiency.”

2) SECTION 102 APPLICABILITY

a) Revise Section 102.6 “Existing structures” to read as follows:

“102.6 Existing structures. The legal occupancy of any structure existing on the date of adoption of this code shall be permitted to continue without change, except as otherwise specifically provided in this code, the International Existing Building Code and the International Fire Code.”

b) Revise Section 102.6.2 “Buildings previously occupied” to read as follows:

“102.6.2 Buildings previously occupied. The legal occupancy of any building existing on the date of adoption of this code shall be permitted to continue without change, except as otherwise specifically provided in this code, the International Fire Code, or as is deemed necessary by the building official for the general safety and welfare of the occupants and public.

3) SECTION 103 DEPARTMENT OF BUILDING SAFETY

a) Revise Section 103.1 “Creation of enforcement agency” to read as follows:

“103.1 Creation of enforcement agency. The Department of Community Development is hereby created and the official in charge thereof shall be known as the Director of Community Development.”

b) Revise Section 103.2 “Appointment” to read as follows:

“103.2 Appointment. The building official, shall be the Director of Community Development.”

b) Revise Section 103.3 “Deputies” to read as follows:

“103.3 Deputies. In accordance with the prescribed procedures of this jurisdiction and with the concurrence of the appointing authority, the building official shall have the authority to appoint a deputy building official, the related technical officers, inspectors, plan examiners and other employees. Such employees shall have powers as delegated by the building official.” RETURN TO AGENDA

4) SECTION 104 DUTIES OF THE BUILDING OFFICIAL

a) Revise section 104.2.1 “Determination of substantially improved or substantially damaged existing buildings and structures in flood hazard areas” to read as follows:

“104.2.1 Determination of substantially improved or substantially damaged existing buildings and structures. For applications for reconstruction, rehabilitation, repair, alteration, addition or other improvement of existing buildings or structures located within the boundaries of Fox Lake.

c) Revise Section 104.10.1 “Flood hazard areas” to read as follows:

“104.10.1 Flood hazard areas. The building official shall not grant modifications to any provisions required in flood hazard areas, unless a determination has been made that the development complies with the Lake County Watershed Development Ordinance.”

5) SECTION 105 PERMITS

105.2 WORK EXEMPT FROM PERMIT. Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following:

(Delete # 1, 2, 3, 4, 5 and 6)

7. Painting, papering, tiling, carpeting, cabinets, countertops and similar finish work.

8. Temporary motion picture, television and theatre stage sets and scenery.

9. Prefabricated swimming pools accessory to a group R-3 occupancy that are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons and are installed entirely above ground.

10. Shade cloth structures constructed for nursery or agricultural purposes, not including service systems.

11. Swings and other playground equipment accessory to detached one- and two- family dwellings.

12. Window awnings supported by an exterior wall that do not project more than 54 inches (1372 mm) from the exterior wall and do not require additional support of group R-3 and U occupancies.

13. Nonfixed and movable fixtures, cases, racks, counters and partitions not over 5 feet 9 inches (1753 mm) in height.

h) Revise Section 105.3 “Application for permit.” to read as follows:

RETURN TO AGENDA “105.3 Application for permit. To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the Department of Community Development for that purpose. Such application shall:”

i)Revise Section 105.5 “Expiration” to read as follows:

“105.5 Expiration. The permit is valid for a 180 day period from the time of issuance. Every permit issued shall become invalid unless the work authorized by such permit is commenced within 180 days after its issuance, or if the work authorized by such permit is suspended or abandoned for a period of 180 days after the time the work is commenced. The building official is authorized to grant, in writing, one or more extensions of time, for periods not more than 180 days each. The extension shall be requested in writing and justifiable cause demonstrated.”

105.8 Hours Of Construction. Construction within the Village of Fox Lake shall only be done during designated hours of construction. Work shall not commence prior to seven (7:00) A.M. and shall cease at eight (8:00) P.M. Monday – Saturday, and ten (10:00) A.M. to five (5:00) P.M. on Sundays/Legal Holidays.

105.9 Conditional Permits. If the sole reason for denial of a building permit is because the property is not properly zoned for the use for which the permit is sought, then the corporate authorities may authorize the building commissioner to issue a conditional permit if all of the following conditions exist: (1) an application for proper zoning is pending before the appropriate village board or commission; (2) the corporate authorities have reviewed and approved the architectural drawings for the building for which the permit is sought; and (3) the permit applicant executes and delivers to the village a release and hold harmless agreement in form acceptable to the village attorney, agreeing to remove any improvements constructed if the village does not approve proper zoning for the use applied for within six (6) months after the date of issuance of the conditional permit, and holding the village harmless from any liability for failure or refusal to approve proper zoning for the use applied for. (Ord. 2011-10, 3-22-2011)

6) SECTION 107 SUBMITTAL DOCUMENTS

a) Revise Section 107.1 “General” to read as follows:

107.1 General. Submittal documents consisting of construction documents, detailed description of work, statement of special inspections, geotechnical report and other data shall be submitted in five (5) sets with each permit application. The construction documents shall be prepared by a registered design professional licensed in the State of Illinois. Where special conditions exist, the building official is authorized to require additional construction documents to be prepared by a registered design professional.

b) Revise Section 107.5 “Retention of construction documents” to read as follows:

“107.5 Retention of construction documents. One set of approved construction documents shall be retained by Community Development for a period not less than that required by the Retention Policy.” RETURN TO AGENDA

7) SECTION 108 TEMPORARY STRUCTURES AND USES

a) Revise Section 108.1 “General.”

108.1 General. The building official is authorized to issue a permit for temporary structures; such temporary structures shall be limited as to time of service, but shall not be permitted for more than 90 days. The building official is authorized to grant extensions for demonstrated cause.

8) SECTION 110 INSPECTIONS

a) Add Section 110.3.1.1 “Foundation inspection” to read as follows:

“110.3.1.1 Footing inspection. Inspection of the footings shall be made prior to placement of any piers, footings, or poles and after the full foundation area is excavated to the required depth. The footing inspection shall include excavations for all foundation walls, frost walls, thickened slabs and isolated piers intended for the support of bearing walls, partitions, structural supports, or equipment.”

b) Add Section 110.3.1.2 “Backfill inspection” to read as follows:

“110.3.1.2 Backfill inspection. Inspection made after foundation walls are erected. Prior to backfilling the following systems or components including, but not limited to, damp/waterproofing, subsurface drainage system, exterior insulation, and anchoring shall be placed.”

c) Revise Section 110.3.2 “Concrete slab and under-floor inspection” to read as follows:

“110.3.2 Concrete slab and under-floor inspection. Concrete slab and under-floor inspections shall be made after in-slab or under-floor reinforcing steel and building plumbing, electrical & mechanical systems or service equipment, conduit, piping, accessories and other ancillary equipment items are in place, but before any concrete is placed or floor sheathing installed, including the subfloor.”

d) Revise Section 110.3.10.1 “Flood hazard documentation” to read as follows:

“110.3.10.1 Flood hazard documentation. If located in a flood hazard area, inspections shall be conducted as required and detailed by the Lake County Watershed Development Ordinance.”

e) Revise Section 110.5 “Inspection requests” to read as follows:

“110.5 Inspection requests. It shall be the duty of the holder of the building permit or their duly authorized agent to notify the building official when work is ready for inspection at least one day before said inspection. It shall be the duty of the permit holder to provide access to and means for inspections of such work that are required by this code.”

CHAPTER 11 ACCESSIBILITY

RETURN TO AGENDA 1) Delete Chapter 11 Accessibility and replace as follows:

a) “1101.1 Scope. The provisions of the Illinois Accessibility Code shall control the design and construction of facilities for accessibility for individuals with disabilities.”

CHAPTER 13 ENERGY EFFICIENCY

1) SECTION 1301 GENERAL

a) Revise Section 1301.1.1 “Criteria” to read as follows:

“1301.1.1 Criteria. Buildings shall be designed and constructed in accordance with the International Energy Conservation Code.”

CHAPTER 18 SOILS AND FOUNDATIONS

1) SECTION 1804 EXCAVATION, GRADING, AND FILL

a) Revise Section 1804.5 “Grading and fill in flood hazard areas” to read as follows:

“1804.5 Grading and fill in flood hazard areas. In flood hazard areas established in Section 1612.3, grading, fill, or both, shall be qualified and approved in accordance with the Lake County Watershed Development Ordinance.”

1) SECTION 1805 FOUNDATION DRAINAGE

a) Revise 1805.4.3 “Drainage discharge” to read as follows:

“1805.4.3 Drainage discharge. The floor base and foundation perimeter drain shall discharge by gravity or mechanical means into an approved drainage system that complies with the Illinois Plumbing Code and the ordinances adopted by the Lake County Department of Health. Where discharged at grade, the point of discharge of the drainage system shall be diverted in such a manner so as to not create a hazard and shall be no closer than one half (1/2) the distance between the required yard setback and the property line or five (5) feet, whichever is greater.”

CHAPTER 29 PLUMBING SYSTEMS

1) Delete Chapter 29 “Plumbing Systems” and replace as follows:

2) “2901.1 Scope. The provisions of the Illinois State Plumbing Code shall govern the erection, installation, alteration, repairs, relocation, replacement, addition to, use or maintenance of plumbing equipment and systems. Toilet and bathing rooms shall be constructed in accordance with the Illinois Plumbing Code, Illinois Accessibility Code, and Section 1210 of this code. Plumbing systems and equipment shall be constructed, installed and maintained in accordance with the Illinois Plumbing Code. Private sewage disposal systems and private and non-community water supplies shall conform to the Lake County Public Health Ordinance.” RETURN TO AGENDA

CHAPTER 31 SPECIAL CONSTRUCTION

1) SECTION 3103 TEMPORARY STRUCTURES

a) Revise Section 3103.1 “General.” as follows:

3103.1 General. The provisions of Sections 3103.1 through 3103.4 shall apply to structures temporarily occupied or erected in conjunction with a Temporary Use Permit. Tents and other membrane structures erected in accord with section 3103.1.2 shall comply with the International Fire Code. Temporary structures shall be erected for a period of less than 90 days; those erected for a longer period of time shall comply with applicable sections of this code.

b) Revise Section 3103.1.1 “Conformance.” to read as follows:

“3103.1.1 Conformance. Existing structures and temporary structures occupied for temporary uses shall conform to the structural strength, fire safety, means of egress, accessibility, light, ventilation and sanitary requirements of this code as necessary to ensure public health, safety and general welfare.”

c) Revise Section 3103.1.2 “Permit required.” to read as follows:

“3103.1.2 Permit required. Temporary structures that are used or intended to be used for the gathering together of 100 or more persons in an Assembly without fixed seats; ‘un-concentrated (tables and chairs)’ function of space (15-sf net) as prescribed in Table 1004.1.2, shall not be erected, operated or maintained for any purpose without obtaining a permit from the building official.

d) Revise Section 3103.3 “Location” to read as follows:

“3103.3 Location. Temporary structures shall be located in accordance with the requirements of the Village of Fox Lake Zoning Ordinance, International Fire Code, and Table 602 based on the fire-resistance rating of the exterior walls for the proposed type of construction.”

2)SECTION 3107 SIGNS

a) Revise Section 3107.1 “General” to read as follows:

“3107.1 General. Signs shall be designed, constructed and maintained in accordance the Village of Fox Lake Sign Ordinance and other applicable sections of this code.”

3) SECTION 3109 SWIMMING POOL ENCLOSURES AND SAFETY DEVICES

a) Revise Section 3109.1 “General” to read as follows:

RETURN TO AGENDA “3109.1 General. Swimming pools shall comply with the requirements of the Chapter 5 of the Village Code and other applicable sections of this code.”

SECTION III: Delete Chapter 4 of Title 4 of the Village Code of the Village of

Fox Lake in its entirety.

SECTION IV: Section 6-1-1-3-A of the Village Code of the Village of Fox Lake is

amended by replacing “The 2011 edition of the National Electrical Code” to “The 2014

edition of the National Electrical Code”.

SECTION V: Section 6-1-1-4 of the Village Code of the Village of Fox Lake is

hereby amended by replacing “The 2012 edition of the Illinois Energy Conservation

Code” to “The 2015 edition of the Illinois Energy Conservation Code”.

SECTION VI: Section 6-1-1-5-A of the Village Code of the Village of Fox Lake is

hereby amended by changing "The 2009 edition of the International Mechanical Code” to

“The 2015 edition of the International Mechanical Code”.

SECTION VII: Section 6-1-1-7 of the Village Code of the Village of Fox Lake is hereby amended by changing “The 2009 edition of the International Fuel and Gas Code” to

“The 2015 edition of the International Fuel and Gas Code”.

SECTION VIII: Amend Title 6, Chapter 1 of the Village Code of the Village of Fox

Lake by adding a new Section labeled, 6-1-1-8 EXISTING BUILDING CODE

SECTION IX: Amend Title 6, Chapter 1 of the Village Code of the Village of Fox

Lake by adding the following Section, 6-1-1-8-A and include the following, The 2015

International existing Building Code is hereby adopted by reference in its entirety subject to the modifications hereinafter set forth and any amendments hereinafter made by the board of trustees and shall hereinafter be applicable in the village. SECTION XII: Amend Title 6, Chapter 1 of the Village Code of the Village of Fox

Lake by inserting a new Section titled 6-1-1-10: RESIDENTIAL BUILDING CODE

SECTION XIII: Amend Title 6, Chapter 1 of the Village Code of the Village of Fox

Lake by inserting Section, 6-1-1-10-A and include the following, The 2015 International

Residential Code is hereby adopted by reference in its entirety as the official residential building code of the village, subject to such modifications as may from time to time be made by the board of trustees, and the following revisions which shall apply within the village:

ALL SECTIONS 1) Change all references to “code official” to “building official.” 2) Change all references to “legal counsel” to “Village Attorney.” CHAPTER 1 SCOPE AND ADMINISTRATION 3) SECTION R101 GENERAL a) Revise Section R101.1 “Title” to read as follows: “R101.1 Title. These provisions shall be known as the Residential Code for One- and Two-family Dwellings of the Village of Fox Lake, and shall be cited as such and will be referred to herein as “this code.” 4) SECTION R102 APPLICABILITY a) Revise Section R102.7 “Existing structures” to read as follows: “R102.7 Existing Structures. The legal occupancy of any structure existing on the date of adoption of this code shall be permitted to continue without change, except as is specifically covered in this code, the International Fire Code, or as is deemed necessary by the building official for the general safety and welfare of the occupants and the public.”

5) SECTION R103 DEPARTMENT OF BUILDING SAFETY RETURN TO AGENDA a) Revise Section R103.1 “Creation of Enforcement Agency” to read as follows: “R103.1 Creation of Enforcement Agency. 7) SECTION R105 PERMITS a) Revise Section R105.2 Work Exempt From Permit – a. Building - Remove 1, 2, 3, 4, 5, and 10. b. Mechanical - Remove 4. c. Plumbing - All references to plumbing removed from this code. Plumbing work in the Village of Fox Lake shall meet the requirements of the current Illinois state plumbing code plus village amendments.

b) Revise Section R105.3 “Application for Permit” to read as follows: “R105.3 Application for permit. To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the Department of Community Development for that purpose. Such application shall: ….”

c) Add Section R105.3.1.2 ““Determination of Substantially Improved or Substantially Damaged Existing Buildings located within the corporate limits of the Village of Fox Lake. “R105.3.1.2 Determination of Substantially Improved or Substantially Damaged Existing Buildings located within the corporate limits of the Village of Fox Lake. Permits for reconstruction, rehabilitation, addition, alteration, repair or other improvement of existing buildings or structures located within the corporate limits of the village, requiring 50% more than the assessed value of the structure, shall require the structure to be brought up to current adopted code.”

d) Revise Section R105.5 “Expiration” to read as follows: “R105.5 Expiration. Every permit issued shall become invalid unless the work authorized by such permit is commenced within one hundred eighty (180) days RETURN TO AGENDA after its issuance, or if the work is authorized by such permit is suspended or abandoned for a period of one hundred eighty (180) days after the time the work is commenced. The building official is authorized to grant, in writing, one or more extensions of time, for periods not more than one hundred eighty (180) days each.

e) Add Section R105.10 “After the Fact Permits and Building Code Compliance Inspections” to read as follows: “R105.10 After the Fact Permits and Building Code Compliance Inspections. Any owner of property where work has been done without the required permit having been first obtained as required by Section R105.1, shall make an application to the building official and obtain the required permit after the fact.

8) SECTION R106 CONSTRUCTION DOCUMENTS a) Revise Section R106.1.4 “Information for Construction in Flood Hazard Areas” to read as follows: “R106.1.4 Information for Construction in Flood Hazard Areas. For buildings and structures located in whole, or in part, in flood hazard areas as established by Table R301.2(1), construction documents shall be prepared in accordance with the Lake County Watershed Development Ordinance and this code. Where conflicts exist, the more WDO shall supersede.”

9) SECTION R109 INSPECTIONS a) Revise Section R109.1.1 “Foundation Inspection” to read as follows: “R109.1.1 Footing inspection. Service inspection must be conducted prior to any connection by the utility supplier. The service inspection shall include routing of all utilities from the right of way of the utility source to the main distribution point for the structure.” d) Add Section R109.1.1.3 “Slab Plumbing Inspection” to read as follows: “R109.1.1.3 Slab Plumbing Inspections. Inspection made prior to the placement of concrete for any and all Plumbing, Electrical & Mechanical Installations proposed under concrete slabs.” e) Revise Section R109.1.3 “Floodplain Inspections” to read as follows: RETURN TO AGENDA “R109.1.3 Site Development Inspections. Inspections as required by the Lake County Watershed Development Ordinance for building permits.” f) Add Section R109.1.4.1 “Insulation Inspection” to read as follows: “R109.1.4.1 Insulation Inspection. Inspection of insulation that makes up the thermal envelope and insulation at piping, duct, or other system components prior to application of finishes and general concealment. The final energy performance specifications and tests shall be available during inspection.” g) Revise Section R109.3 “Inspection Requests” to read as follows: “R109.3 Inspection Requests. It shall be the duty of the permit holder or their agent to notify the building official that such work is ready for inspection at least one (1) work day before said inspection. It shall be the duty of the permit holder requesting any inspections required by this code to provide access to and means for inspection of such work.” 10) SECTION R110 CERTIFICATE OF OCCUPANCY a) Revise Section R110.1 “Use and Occupancy” to read as follows: “R110.1 Use and Occupancy. A building or structure shall not be used or occupied, and a change in the existing use or occupancy classification of a building or structure or portion thereof shall not be made, until the building official has issued a certificate of occupancy or certificate of completion therefor as provided herein. Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction shall not be valid.”

11) SECTION R112 BOARD OF APPEALS a) Revise Section 112.1 General to read as follows: “R112.1 General. The village board shall act as the board of appeals.

12) SECTION R115 UNSAFE STRUCTURES AND EQUIPMENT a) Add Section R115.1 “Conditions” to read as follows: “R115.1 Conditions. All structures or existing equipment which are or hereafter become unsafe, unsanitary or deficient because of inadequate means of egress facilities, inadequate light and ventilation, or which constitute a fire hazard, or are otherwise dangerous to human life or the public welfare, or which involve illegal or improper occupancy or inadequate maintenance, shall be deemed an unsafe condition. All unsafe structures shall be taken down and removed or made safe, as the building official deems necessary and as provided for if structure is considered a temporary measure until a decision can be made as to what remedy the owner will pursue as provided in this section; but cannot exceed six (6) months or as the building official may deem necessary.” b) Add Section R115.2 “Record” to read as follows: “R115.2 Record. The building official shall cause a report to be filed on an unsafe condition. The report shall state the occupancy of the structure and the nature of the unsafe condition.” c) Add Section R115.3 “Notice” to read as follow: RETURN TO AGENDA “R115.3 Notice. If an unsafe condition is found, the building official shall serve on the owner, agent or person in control of the structure, a written notice that describes that condition deemed unsafe. Such notice shall require the person thus notified to declare immediately to the building official the specific repairs or improvements that will be made to abate the unsafe condition or to demolish the unsafe structure within a stipulated time.” d) Add Section R115.4 “Method of Service” to read as follows: “R115.4 Method of Service. Such notice shall be deemed properly served if a copy thereof is (A) delivered to the owner personally or (B) sent by certified or registered mail addressed to the owner at the last known address with the return receipt requested. If the certified or registered letter is returned showing that the letter was not delivered, a copy thereof shall be posted in a conspicuous place in or about the structure affected by such notice. Service of such notice in the foregoing manner upon the owner’s agent or upon person responsible for the structure shall constitute service of notice upon the owner.” e) Add Section R115.5 “Restoration” to read as follows: “R115.5 Restoration. The structure or equipment determined to be unsafe by the building official is permitted to be restored to a safe condition. The extent that repairs, alterations or additions are made or a change of occupancy occurs during the restoration of the structure, such repairs, alterations, additions or change of occupancy shall comply with the requirements of this code.” f) Add Section R115.6 “Disregard of Notice” to read as follows: “R115.6 Disregard of Notice. Upon refusal or neglect of the person served with an unsafe notice to comply with the requirements of the order to abate the unsafe condition, the Village Attorney shall be advised of all the facts in order to pursue recourse provided by law.” 13) SECTION R116 EMERGENCY MEASURES a) Add Section R116.1 “Imminent Danger” to read as follows: “R116.1 Imminent Danger. When, in the opinion of the building official, there is imminent danger of failure or collapse of a building or structure or any part thereof which endangers life, or when any structure or part of a structure has fallen and life is endangered by the occupation of the building or structure, the building official is hereby authorized and empowered to order and require the occupants to vacate the same forthwith. The building official shall cause to be posted at each entrance to such structure a notice reading as follows: “This Structure is Unsafe and its Occupancy has been “Prohibited” by the Building Official.” It shall be unlawful for any person to enter such structure except for the purpose of making the required repairs or of demolishing the same.”

b) Add Section R116.1.1 “Authority to Seal Equipment” to read as follows: “R116.1.1 Authority to Seal Equipment. In the case of an emergency, the building official shall have the authority to seal out of service immediately any unsafe device or equipment regulated by this code.”

RETURN TO AGENDA c) Add Section R116.1.2 “Unlawful to Remove Seal” to read as follows: “R116.1.2 Unlawful to Remove Seal. Any device or equipment sealed out of service by the building official shall be plainly identified in an approved manner. The identification shall not be tampered with, defaced or removed except by the building official and shall indicate the reason for such sealing.”

3) SECTION R305 CEILING HEIGHT a) Revise Section 305.1 “Minimum Height” to read as follows:

“R305.1 Minimum Height – Habitable Space, hallways and portions of basements containing these spaces shall have a ceiling height of not less than 8 feet. Bathrooms, toilet rooms and laundry rooms shall have a ceiling height of not less than 7 feet. b) Revise 305.1 Minimum Height Exception 2 to read as follows: “The ceiling height above bathroom and toilet fixtures shall be such that the fixture is capable of being used for its intended purpose. A shower or tub equipped with a showerhead shall have a ceiling height of not less than 7 feet above an area of not less than 30 inches by 30 inches at the showerhead.”

4) R309 GARAGES AND CARPORTS a) Revise Section R309.3 “Flood Hazard Areas” to read as follows: “R309.3 Flood Hazard Areas. For buildings located in flood hazard areas as established by Table R301.2 (1), garage floors shall be constructed in accordance with the Lake County Watershed Development Ordinance.” b) Add Section R309.6 “Gas Curb” to read as follows: “R309.6 Gas curb. A concrete curb extending at least four inches (4”) above the garage floor and around all below grade openings shall be provided for attached garages.” c) Add Section R309.7 “Garage floor slope” to read as follows: “R309.7 Garage Floor Slope. The parking area shall have a minimum two (2") inch slope to the direction of the vehicle entrance door.”

5) R311 MEANS OF EGRESS a) Revise Section R311.2 “Egress Door” to read as follows: “R311.2 Egress doors. Not less than two (2) egress doors shall be provided for each dwelling unit. At least one (1) of the required egress doors shall be side- hinged, and shall provide a clear width of not less than 32 inches (813 mm) where measured between the face of the door and the stop, with the door open 90 degrees . The second required egress door shall be permitted to be a side-hinged door or slider. Egress doors shall be readily openable from inside the dwelling without the use of a key or special knowledge or effort.”

6) R313 AUTOMATIC FIRE SPRINKLER SYSTEMS a) Delete Section R313.2 One-and Two-family dwellings automatic fire sprinkler systems. (including the exception)

The following provision shall be added:

7) R322 FLOOD RESISTANT CONSTRUCTION a) Revise Section R322.1.5 to read as follows: “R322.1 General. Buildings and structures constructed in whole or in part in flood hazard areas, including A or V Zones and Coastal A Zones, as established in Table R301.2(1), and substantial improvement and restoration of substantial damage of buildings and structures in flood hazard areas, shall be designed and constructed in accordance with the provisions of the Lake County Watershed Development Ordinance and as contained in this section. Construction documents shall be prepared by an architect or appropriate design professional licensed by the State of Illinois. Buildings and structures that are located in more than one flood hazard area shall comply with the provisions associated with the most restrictive flood hazard area. Buildings and structures located in whole or in part in identified floodways shall be designed and constructed in accordance with Lake County Watershed Development Ordinance and ASCE 24.” b) Delete Section(s) R322.1.1thru 322.3.6 in their entirety.

8) R326 SWIMMING POOLS, SPAS AND HOT TUBS a) Revise Section R326 “SWIMMING POOLS, SPAS AND HOT TUBS” to read as follows: “R326.1 General. The design and construction of pools and spas shall comply with the Village Code”

CHAPTER 4 FOUNDATIONS 9) R403 FOOTINGS a) Revise Section R403.1.1 “Minimum Size” to read as follows: “ R403.1.1 Minimum Size. The minimum width, W, and thickness, T, for concrete footings shall be no less than 16” x 8” for light-frame construction and 20” x 10” for light-frame construction with brick veneer or in accordance with Tables R403.1(1) through R403.1(3) and Figure R403.1(1) or R403.1.3, as applicable. The footing width shall be based on the load-bearing value of the soil in accordance with Table R401.4.1. Footing projections, P, shall be not less than 2 inches (51 mm) and shall not exceed the thickness of the footing. Footing thickness and projection for fireplaces shall be in accordance with Section R1001.2. The size of footings, supporting piers and columns shall be based on the tributary load and allowable soil pressure in accordance with Table R401.4.1. Footings for wood foundations shall be in accordance with the details set forth in Section R403.2, and Figures R403.1(2) and R403.1(3).” b) Add Section R403.1.1.1 “Turned Down Footing” to read as follows: RETURN TO AGENDA “R403.1.1.1 Turned Down Footing. The minimum width, W, of a turned down footing shall be no less than 12 inches or shall be based on the load-bearing value of the soil in accordance with Table R401.4.1. 10) R404 FOUNDATION AND RETAINING WALLS a) Revise Section R404.1.2.1 “Masonry Foundation Walls” to read as follows: “R404.1.2.1 Masonry Foundation Walls. Concrete masonry and clay masonry foundation walls shall have a minimum nominal thickness of 8” or as set forth in Table R404.1.1(1), R404.1.1(2), R404.1.1(3) or R404.1.1(4) and shall also comply with applicable provisions of Section R606. In buildings assigned to Seismic Design Categories D0, D, and D2, concrete masonry and clay masonry foundation walls shall also comply with Section R404.1.4.1. Rubble stone masonry foundation walls shall be constructed in accordance with Sections R404.1.8 and R606.3.2. Rubble stone masonry walls shall not be used in Seismic Design Categories D0, D, and D2.” b) Remove all reference to Wood Foundations. 11) R405 FOUNDATION DRAINAGE a) Add Section R405.2.4 “Point of Discharge” to read as follows: “R405.2.4 Point of Discharge. The point of discharge of the drainage system shall be diverted in such a manner so as to not create a hazard and shall be no closer than one half (1/2) the distance between the required yard setback and the property line or five (5) feet, whichever is greater.” 12) R408 UNDER-FLOOR SPACE a) Revise Section R408.5 “Removal of Debris” to read as follows: “R408.5 Removal of Debris. The under-floor grade shall be cleaned of all vegetation and organic material and granular fill, pea gravel, or a concrete slab placed over a vapor barrier that complies with R506.2.3. All wood forms used for placing concrete shall be removed before a building is occupied or used for any purpose. All construction materials shall be removed before a building is occupied or used for any purpose.” b) Revise Section R408.7 “Flood Resistance” to read as follows: “R408.7 Flood Resistance. For buildings located in the flood hazard areas refer to the requirements of the Lake County Watershed Development Ordinance.”

CHAPTER 5 FLOORS 13) R502 WOOD FLOOR FRAMING a) Revise Section 502.1” General” to read as follows: RETURN TO AGENDA “R502.1 General. Wood and wood-based products used for load supporting purposes shall have a maximum spacing not to exceed 16”o.c, Engineered floor systems are to be installed to manufacturers specifications." b) Revise Section 502.3 “Allowable joist spans” to read as follows: “R502.3 Allowable joist spans. Spans for floor joists shall be in accordance with Table 502.3(2). For other grade and species and for other loading conditions, refer to AWC STJR.” c) Remove section R502.3.1 Sleeping areas and attic joists. CHAPTER 6 WALL CONSTRUCTION 14) R601 GENERAL a) Revise section R601.2 “Requirements” to read as follows: “R601.2 Requirements. Wall construction shall be capable of accommodating all loads imposed in accordance with Section R301 and transmitting the resulting loads to the supporting structural elements, a maximum spacing of 16”o.c is allowed for conventional framing within the Village limits.”

CHAPTER 8 ROOF-CEILING CONSTRUCTION 15) WOOD ROOF FRAMING a) Revise Section R802. 1 “General” to read as follows: “R802.1 General. Wood and wood-based products used for load-supporting purposes shall conform to the applicable provisions of this section. Traditionally framed roofs shall be no greater than 16” on center. “

b) Delete and revise Section 802.11.”Roof tie-down” to read as follows: “R802.11 Roof tie-down. Roof tie-downs are required for all structures covered by this code.”

CHAPTER 11 ENERGY EFFICIENCY 1) Delete “CHAPTER 11 [RE] ENERGY EFFICIENCY” and reference as follows: “The provisions of the Illinois Energy Conservation Code as adopted separately by the Fox Lake Village Board shall regulate the design and construction of buildings for the effective use and conservation of energy over the useful life of each building.”

PART VII – Plumbing 1) Delete CHAPTER 25 THROUGH 32 and replace as follows: “The provisions of the Illinois Plumbing Code as adopted separately by the Fox Lake Village Board shall govern the erection, installation, alteration, repairs, relocation, replacement, addition to, use or maintenance of plumbing equipment.” PART VIII – Electrical 1) Delete CHAPTER 34 THROUGH 43 and replace as follows: “The provisions of the National Electrical Code as adopted separately by the Fox Lake Village Board shall govern the installation of electrical systems, equipment and components indoors and outdoors that are within the scope of this code, including services, power, distribution systems, fixtures, appliances, devices and appurtenances.” RETURN TO AGENDA

SECTION XVII: Amend Title 6, Chapter 1 of the Village Code of the Village of Fox

Lake by adding section 6-1-1-12-A and include the following, The 2015 International Property

Maintenance Code is hereby adopted by reference in its entirety as the official Property

Maintenance Code of the village, subject to such modifications as may from time to time be made by the board of trustees, and the following revisions which shall apply within the village:

CHAPTER 1 SCOPE AND ADMINISTRATION 1) SECTION 101 GENERAL a) Revise Section 101.1 “Title” to read as follows: “101.1 Title. These regulations shall be known as the Property Maintenance Code of the Village of Fox Lake, hereinafter referred to as “this code” 2) SECTION 102 APPLICABILITY a) Revise Section 102.3 “Application of other codes” to read as followed: “102.3 Application of other codes. Repairs, additions or alterations to a structure, or changes of the occupancy, shall be done in accordance with the procedures and provisions of the International Building Code, International Energy Conservation Code, International Fire Code, International Fuel Gas Code, International Mechanical Code, International Residential Code, Illinois State Plumbing Code and NFPA 70. Nothing in this code shall be construed to cancel, modify or set aside any provision of the Village Code.” The 2015 edition of the International Property Maintenance Code is hereby adopted by reference in its entirety as the official property maintenance code of the village, subject to RETURN TO AGENDA such modifications as may from time to time be made by the board of trustees, and the following revisions which shall apply within the village: SECTION 103 DEPARTMENT OF PROPERTY MAINTENANCE INSPECTION a) Revise Section 103.1 “general” to read as follows:

”103.1 General. The Department of Community Development is hereby created and the official in charge thereof shall be known as the Director of Community Development.” b) Revise Section 103.2 “Appointment” to read as follows:

“103.2 Appointment. The building official shall be known as the Director of Community Development.” a) Revise Section 103.3 “Deputies” to read as follows: “103.3 Deputies. In accordance with the prescribed procedures of this jurisdiction and with the concurrence of the appointing authority, the Director of Community Development shall have the authority to appoint a deputy code official, code enforcement officer, other related technical officers, inspectors and other employees.”

“103.5 Fees. The fees for activities and services performed by the department in carrying out its responsibilities under this code shall be as indicated in the fee schedule maintained by the village from time to time.” (Ord. 2011-10, 3-22-2011)

“108.6 Abatement Methods. The owner, operator or occupant of a building, premises or equipment deemed unsafe by the code official shall abate or cause to be abated or corrected such unsafe conditions either by repair, rehabilitation, demolition or other approved corrective action. Such repair, rehabilitation, demolition or other corrective action may only be undertaken after permits and a construction schedule have been approved by the building commissioner and work may only be done between 7:00 A.M. and dusk on weekdays including Monday through Friday.” (Ord. 2013-35, 12-10-2013) SECTION 111 MEANS OF APPEAL Remove sections 111.2-111.8 CHAPTER 3 GENERAL REQUIREMENTS a) Revise Section 302.4 “Weeds” to read as follows:

“302.4 Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in excess of 8 inches. All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens.”

Upon failure of the owner or agent having charge of a property to cut and destroy weeds after service of a notice of violation, they shall be subject to prosecution in accordance with section 106.3 and as prescribed by the authority having jurisdiction. Upon failure to comply with the notice of violation, any duly authorized employee of the jurisdiction or contractor hired by the jurisdiction shall be authorized to enter upon the property in violation and cut and destroy the weeds growing thereon, and the costs of such removal shall be paid by the owner or agent responsible for the property. b) Revise Section 304.14 “Insect Screens” to read as follows:

During the period from April 1 to November 1, every door, window and other outside opening required for ventilation of habitable rooms, food preparation areas, food service areas or any areas where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored, shall be supplied with approved tightly fitting screens of not less than 16 mesh per inch (16 mesh per 25 mm) and every swinging door shall have a self-closing device in good working condition.

Exception: Screens shall not be required where other approved means, such as air curtains or insect repellent fans, are employed.” CHAPTER 4 LIGHT, VENTALATION, AND OCCUPANCY LIMITS

SECTION 404 OCCUPANCY LIMITS a) Revise Section 404.3 “Minimum ceiling heights” to read as follows:

“404.3 Minimum ceiling heights. Habitable spaces, hallways, corridors, laundry areas, bathrooms, toilets rooms and habitable basement areas shall have a minimum clear ceiling height of 8 feet.”

b) Revise 404.3 Exception “2” to read as follows:

“404.3 Exception 2. Basement rooms in one- and two-family dwellings occupied exclusively for laundry, study or recreation purposes, having a minimum ceiling height of 7 feet with a minimum clear height of 6 feet 6 inches under beams, girders, ducts and similar obstructions.”

c) Revise Table 404.5 “Minimum Area Requirements” as follows: 1. Living room 180 sq. ft. 2. Dining room 100 sq. ft. 3. Kitchen 70 sq. ft.; 100 sq. ft. if no dining room 4. Master bedroom 120 sq. ft. 5. Other bedroom(s) 100 sq. ft. 6. Bathroom(s) 35 sq. ft. 7. Other uses 100 sq. ft. 8. Closets 8 sq. ft. min. /depth 24 inches CHAPTER 6 MECHANICAL AND ELECTRICAL REQUIREMENTS a) Revise Section 602.2 “Residential Occupancies” to read as follows:

“602.2 Residential Occupancies. Dwellings shall be provided with heating facilities capable of maintaining a room temperature of 68°F (20°C) in all habitable rooms, bathrooms and toilet rooms. Cooking appliances shall not be used to provide space heating to meet the requirements of this section.”

b) Revise Section 602.3 “Heat supply” to read as follows: “602.3 Heat Supply. Every owner and operator of any building who rents, leases or lets one or more dwelling units, sleeping units on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from RETURN TO AGENDA October 1st to May 1st to maintain a temperature of not less than 68°F (20°C) in all habitable rooms, bathrooms, and toilet rooms.” c) Revise Section 602.4 “Occupiable work spaces” to read as follows: “602.4 Occupiable Work Spaces. Indoor occupiable work spaces shall be supplied with heat during the period from October 1st to May 1st to maintain a temperature of not less than 65°F (18°C) during the period the spaces are occupied.” Exceptions:

1. Processing, storage and operation areas that require cooling or special temperature conditions.

2. Areas in which persons are primarily engaged in vigorous physical activities. (Ord. 2011-10, 3-22-2011) CHAPTER 7 FIRE SAFTEY REQUIREMENTS Add section 705-705.2 to read as follows: 705 Carbon Monoxide Detectors. Carbon monoxide detectors shall be installed in all dwelling units that have fossil fueled appliances, including fireplaces. Buildings that have all electric appliances are exempt unless there is an attached garage. 705.1 New Construction. Carbon monoxide detectors will be installed per the requirements of the most recent adopted residential building code.

705.2 Existing Dwellings. Carbon monoxide detectors shall be installed within 15 feet of all bedrooms. In existing dwellings, battery operated and plug-in with battery back-up carbon monoxide detectors shall be allowed. SECTION XVIII: Section 6-2-1 of the Village Code of the Village of Fox Lake is hereby deleted in its entirety.

SECTION XIX: All Ordinances and parts of Ordinances in conflict with this

Ordinance are hereby repealed to the extent of the conflict.

SECTION XX: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.

The following is a brief summary of the status of current projects being worked on by TAI.

Sewer and Water Projects

Lakewood, Highland, and Glen Avenue Water Main Improvements The project is complete. A small retainage has been withheld from payment to cover any landscape repair work that may be required in the Spring.

2016 Sewer Cleaning and Lining – Phase 2 The project is complete, and was finished $8,605 below the bid price. We are awaiting submittal of all final paperwork necessary to process payment to the Contractor.

Grand Avenue Valve Replacements The project is complete and final payment has been made. The project was completed $2,668 below the bid price.

Phase II SCADA System Improvements The contractor is continuing to address issues with the SCADA systems as they are identified. At this time, we do not have an estimate as to when all issues will be corrected. The contractor is being responsive at this time.

Data Collection / GIS Integration Trotter and Associates, Inc. has continued to assist Rocky with technical questions relating to effective use of the Village of Fox Lake’s GIS. Trotter has also updated both the water distribution and sewer layers within the GIS.

Using the 3,294 points that the Water Department collected with the Fulcrum application, TAI updated and edited the water distribution and sewer layers to reflect a more accurate location of

manholes, sewer lines, fire hydrants, control valves, lateral lines and other data associated with both the water and sewer GIS information.

TAI will use the updated GIS to identify and create a list of additional water and sewer items needed to be picked up using the Fulcrum software.

North Water System Contract A – Elevated Storage Tank Foundation for the elevated tank is under construction and concrete work should be completed on Wednesday, January 18. Fabrication of the steel tower structure is proceeding at the contractor’s facilities in Sioux Falls SD. The second payment application and second loan disbursement are in process as of this writing. The project is proceeding per the schedule.

North Water System Contract B – Booster Station Rehabilitation This project is generally paused until the new elevate tank is in service and the booster station can be taken off line. In preparation for the anticipated October start, equipment selections and shop drawings reviews are in process.

Water and Wastewater Interconnect – Phase I Design Services Title commitments have been received and reviewed, and research has been performed to determine right-of-way status. The field topographic surveys are complete with the exception of the channel crossings, which were not completed due to ice formation. Preparation of the CAD base drawings has been completed for all of the field data collected. The request for a jurisdictional determination of the wetlands has been completed and submitted to the Corps of Engineers.

NWRWRF Projects

General Assistance This past month we continued providing assistance to NWRWRF staff with the coordination with the Lake County SSES Policy and Technical Advisory Committees.

Cost Effectiveness and Efficiency Study

We were on track to finish the project prior to year-end 2016. However, we have ceased work on this project at the direction of the Village.

PURPOSE AND ACTION REQUESTED: As required by contract Matt Formica with the Village of Lindenhurst has provided the Village of Fox Lake with notice to terminate the Emergency and Non-Emergency dispatch services contract effective April 30,2017.

BACKGROUND/DISCUSSION: Lindenhurst was approached by the Village of Fox Lake to renew their existing contract with the new pricing model paying a fair share cost. Lindenhurst came back to the table on December 13, 2016 and advised they had made the decision to move to Glenview Dispatch Center in Glenview, IL due to the New World CAD system. Fox Lake did offer a reduction in price in attempt to keep Lindenhurst however they were very clear that the move was truly to embrace the New World CAD operations and utilize the integration of products that were available, as they had already invested in the New World CAD Records package. Another meeting was held on January 2, 2017 which included the Lake County ETSB to work with Lindenhurst on their New World RMS system and provide background on how this records package is already integrated in the Lake County ETSB system to no avail. The attached letter was provided to Administrator Marrin on January 20, 2017 to move forward on the termination/expiration of the Lindenhurst Police services through FoxComm E9-1-1. BUDGET: The loss of the Lindenhurst Police contract will be $22,0076.76 a year. FoxComm is currently in talks with a neighboring agency which will more than offset this loss.

RECOMMENDATION: Staff recommends accepting the termination of the Lindenhurst intergovernmental agreement for Emergency and Non-Emergency Dispatch Services. ATTACHMENT: 1. Resolution

A RESOLUTION AUTHORIZING THE MAYOR AND VILLAGE CLERK OF THE VILLAGE OF FOX LAKE TO APPROVE THE TERMINATION OF THE INTERGOVERNMENTAL AGREEMENT FOR EMERGENCY AND NON- EMERGENCY DISPATCH SERVICES BY AND BETWEEN THE VILLAGE OF FOX LAKE AND THEVILLAGE OF LINDENHRUST

WHEREAS, Fox Lake and Lindenhurst previously entered into an intergovernmental agreement dated May 14, 2012, to provide for the provision of radio emergency and non- emergency dispatch services by Fox Lake to Lindenhurst (“IGA”); and

WHEREAS, pursuant to section 8.B.1 of the IGA, the parties can mutually agree to terminate the IGA by written amendment duly authorized by the appropriate legislative action of the parties; and

WHEREAS, Fox Lake and Lindenhurst have determined that it is in the best interests of each party to this Agreement to terminate the IGA effective April 30, 2017.

NOW, THEREFORE, in consideration of the foregoing and of the following covenants and agreements, the parties agree as follows:

Section 1. Recitals. The above recitals are hereby incorporated by reference as substantive parts of this Amendment as if fully set forth herein.

Section 2. Amendment; Termination. The IGA between Fox Lake and Lindenhurst is hereby amended to terminate the IGA effective April 30, 2017, in accordance with the provisions of Section 8.B.1 of the IGA.

PURPOSE AND ACTION REQUESTED: Staff is requesting Village Board consideration for an ordinance adding additional language that allows participation in Village Board Meetings by audio or video conference in Chapter 6 – Board of Trustees, Section 1-6-4.

BACKGROUND/DISCUSSION: Per General Provision 5 ILCS 120/7 (the Open Meetings Act) “attendance by a means other than physical presence,” is allowed if a quorum of the members of the public body is physically present as required by Section 2.01 of the Open Meetings Act, a majority of the public body may allow a member of that body to attend the meeting by other means if the member is prevented from physical attending because of:  Personal illness or disability  Employment purposes of the business of the public body  A family or other emergency

“Other means” is defined as by video or audio conference.

If a member wishes to attend a meeting by other means, the member must notify the recording secretary or clerk of the public body before the meeting unless advance notice is impractical. Forty- eight hours in advance is requested.

Staff is requesting the Village Board adopt the language listed below into Chapter 6 – Board of Trustees Section 1-6-4 of the Village of Fox Lake Village code.

BUDGET: No budgetary impact as this time.

RECOMMENDATION: Staff recommends adopting the Ordinance below adding the addition to Chapter 6 – Board of Trustees, Section 1-6-4 of the Municipal Code listed below.

WHEREAS, the Village has adopted various Village Board of Trustee meeting guidelines; and

WHEREAS, the General Provision 5 ILCS 120 (the Open Meetings Act) allows municipalities to adopt certain guidelines regarding the attendance of meetings; and

WHEREAS, Section 7 of the Open Meetings Act (5 ILCS 120/7) allows for the attendance of meetings via video or audio conferencing; and

WHEREAS, Chapter 6, Section 1-6-4 of the Village of Fox Lake Village Code shall now include an additional item – Letter “H”; and

WHEREAS, Chapter 6, Section 1-6-4-H: Participation in Village Board Meetings by Audio or Video Conference shall now be added into the Village Code: and

NOW THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Fox Lake, Lake and McHenry Counties, Illinois, as follows:

CHAPTER 6: Section 1-6-4: Participate in Village Board Meetings by Audio or

Video Conference of the Village Code of the Village of Fox Lake is hereby amended by

adding:

Section 1-6-4-H: Participation in Village Board Meetings by Audio or Video Conference:

1. Compliance with Open Meetings Act: The Mayor and any Trustee shall be allowed to participate in and vote, as set forth in this code, in any Village Board workshop, regular and special meetings, via telephone or any other electronic communication device, but only in compliance with the open meetings act and this code. In the event of a conflict between the open meetings act and this code, the open meetings act shall control.

RETURN TO AGENDA 2. Eligibility: If a quorum of the corporate authorities is physically present as required by section 2.01 of the open meetings act, any alderman or the Mayor may attend the meeting by video or audio conference if such Trustee or the Mayor is prevented from physically attending because of: 1) personal illness or disability; 2) employment purposes or the business of the public body; or 3) a family or other emergency. Audio or video conference attendance shall be in accord with this section.

3. Notice To Clerk: If a member of the corporate authorities wishes to attend a meeting by video or audio conference, the member must notify the Village Clerk in writing or by e- mail at least forty eight (48) hours before the meeting. The Clerk or his or her designee, after receiving the electronic attendance request, shall inform the Mayor and Village Board of the request for electronic attendance.

4. Audio Standards: To be allowed to attend by audio or video conference, there must be suitable equipment available in the room where the meeting is to be physically held which will provide a clear, audible, two-way transmission of the audio from the physical meeting to all members desiring to attend remotely and from the member(s) attending remotely to the physical meeting in sufficient volume to be comfortably heard by members, the Village Clerk, and the public in physical attendance. The telephonic connection shall be of sufficient quality to carry uninterrupted audio of the meeting.

5. Determination Of Mayor Or Temporary Chairman: The Mayor (if physically present), or duly elected temporary Chairman of the meeting, may refuse to allow a member to attend by video or audio conference if he or she determines that the audio standards set forth above cannot be met. The Mayor or temporary Chairman shall make such determination as a matter of record and direct the Clerk or recording secretary note such determination in the minutes of the meeting. Members may override the determination of the Mayor or Chairman if a majority of the members physically present determine that the audio transmissions meet the above audio standards. Such override shall be upon motion passed by the affirmative vote of a majority of the members physically present.

6. Remote Attendance Of Mayor; Chairman Must Physically Attend: The Mayor may attend a meeting by audio or video conference, but may not Chair. In the physical absence of the mayor, a member must be physically present to serve as temporary Chairman.

7. Rights Of Remote Member: A member permitted to attend electronically will be able to express his or her comments during the meeting and participate in the same capacity as those members physically present, subject to all general meeting guidelines and procedures previously adopted and adhered to. Accordingly, although the Mayor cannot Chair the meeting, the Mayor may break a tie or vote when statutorily permitted when attending electronically. The member attending electronically shall be heard, considered, and counted as to any vote taken. Accordingly, the name of any member attending electronically shall be called during any vote taken, and his or her vote counted and recorded by the clerk and placed in the minutes for the corresponding meeting. A member attending electronically may leave a meeting and return as in the case of any member, provided the member attending electronically shall announce his or her leaving and returning.
