EUROPOL - Council conclusions

TheCouncilreachedanagreementonchapter1("Establishmentandtasks")ofaproposalfora CouncilDecisionestablishingEuropol.

ItalsoadoptedconclusionsonreplacingtheEuropolConventionbyaCouncilDecision,asfollows:

"THECOUNCIL

"1. recalls thaton4and5December2006,itwasagreedthat,onthebasisthatitconstitutesa clearimprovementoftheoperationalandadministrativefunctioningofEuropol,the EuropolConventionshouldbereplacedbyaCouncilDecisionsubjecttoafullassessment oftheimplicationsoffinancingEuropolfromthegeneralbudgetoftheEuropeanUnion andtheapplicationoftheECStaffRegulationsandtheProtocolonthePrivilegesand ImmunitiesoftheEuropeanCommunities(ECPPI)guidedbytheprincipleofbudget neutralityandtakingintoaccountthespecificrequirementsresultingfromEuropol's mandateandtasks.

2. notes thattheEuropolWorkingPartyandtheWorkingPartyontheStaffRegulations carriedoutacomprehensiveexaminationoftheeffectsoffinancingEuropolfromthe generalbudgetoftheEuropeanCommunitiesandtheapplicationoftheECStaff Regulations,inparticulartheimpactassessmentpresentedbytheGermanPresidencyas setoutindoc.10325/07EUROPOL73.

3. acknowledges thatsincetheCommissionandEuropoluseddifferentbasesofcalculation (actualstaffcostsvs.averagebasicsalary;shorttermvs.midtolongterm),theyarrived atdifferingresultsasregardsthefinancialimplicationsofapplyingtheECStaff Regulations.

4. notes thatasaconsequence,theWorkingPartyontheStaffRegulationshaspointedout thatintheabsenceofcomparablecalculations,itwasnotpossibletomakeanydefinitive statementsonbudgetneutrality.

5. underlinesthatthechangeoffinancingmechanismshouldnotaffectEuropol'soperational ability.

Therefore,andinlinewiththeCouncilConclusionsofDecember2006,theCouncilagreestothe following:

• TheEuropolConventionwillbereplacedwithaCouncilDecisionpursuanttoArticle34(2)(c)of theTEUandthenecessaryCouncilDecisionwillbefinalisedby30June2008,atthelatest.

• InaccordancewithArt.41(3)TEUandotherapplicableprovisions,Europolwillbefundedfrom theCommunitybudgetasfrom1January2010,providedthatsatisfactorysolutionsonthe followingaspectshavebeenfound:

• TheliftingofimmunityforEuropolofficialswhenparticipatinginoperationalactivities, especiallyJointInvestigationTeams

• TheprincipleofstaffrotationandthepossibilityforEuropolstaffparticipatinginJITtoreceive instructionsfromtheteamleader

• clarificationofthebudgetaryconsequences,guidedbybudgetneutrality.

• EuropolandtheCommissionwillensurethatallpreparatoryworkiscarriedoutinorderto enabletheintroductionofCommunityfinancingasfrom1January2010.Tothisend,Europol andtheCommissionwilldrawupanimplementationplan(roadmap)whichsetsoutthe milestoneswhichhavetobereachedbeforethatdate.TheCouncilwillendorsethe implementationplan(roadmap)assoonaspossibleand,atthelatest,inDecember2007."

Itshouldbenotedthaton4and5December2006,theJusticeandHomeAffairsCouncilagreed thattheEuropolConventionshouldbereplacedbyaCouncilDecision.Thiswillconstituteaclear improvementoftheoperationalandadministrativefunctioningofEuropol.Atthatmeeting,the CouncilalsodecidedthatafullassessmentoftheimplicationsoffinancingEuropolfromthe generalbudgetoftheEUandtheapplicationoftheProtocolonthePrivilegesandImmunitiesofthe EuropeanCommunitiesshouldbedone,guidedbytheprincipleofbudgetneutralityandtakinginto accountthespecificrequirementsresultingfromEuropol'smandateandtasks.

STEPPING UP COOPERATION FOR PURPOSES OF PREVENTION AND INVESTIGATION OF CRIMINAL OFFENCES

TheCouncilreachedapoliticalagreementonaDecisiononthesteppingupofcrossborder cooperation,particularlyincombatingterrorismandcrossbordercrime (10232/07) .

ThisDecisioncontainsprovisionsbasedontheessentialpartsofthePrümTreatyandisdesignedto improvetheexchangeofinformationbetweenauthoritiesresponsibleforthepreventionand investigationofcriminaloffences.

Tothisend,theDecisioncontainsrulesinthefollowingareas:

ontheconditionsandprocedurefortheautomatedtransferofDNAprofiles,dactyloscopic dataandcertainnationalvehicleregistrationdata,

ontheconditionsforthesupplyofdatainconnectionwithmajoreventswithacrossborder dimension,

ontheconditionsforthesupplyofinformationinordertopreventterroristoffences,and

ontheconditionsandprocedureforsteppingupcrossborderpolicecooperationthrough variousmeasures.

Thiscloserpoliceandjudicialcooperationincriminalmatterswillgohandinhandwithrespectfor fundamentalrights,inparticulartherighttorespectforprivacyandtoprotectionofpersonaldata, whichwillbeguaranteedbyspecialdataprotectionarrangementstailoredtothespecificnatureof differentformsofdataexchange.

TheDecisionistheresultofaninitiativesubmittedbyBelgium,Germany,Spain,France, Luxembourg,theNetherlandsandAustriawiththeaimofincorporatingthesubstanceofthe provisionsofthePrümTreatyintothelegalframeworkoftheEuropeanUnion.

ThePrümTreaty

Signedon27May2005atPrüm,Germany,theTreatyisdesignedtointensifycrossborderpolice cooperation,especiallyinthefightagainstterrorism,crossbordercrimeandillegalmigration 1.

TheTreatyhasmeanwhileenteredintoforceinAustria,SpainandGermanyandisexpectedtobe inforceintheotheroriginalsignatorystatesinthefirsthalfof2007atthelatest.Theratification processesinthecountriesintendingtoaccedetotheTreatyarealsowelladvanced.

Alreadyatthisearlystage,theautomaticinformationexchangehasbroughtaboutnoticeable operationalsuccess:Forinstance,theGermanauthoritiesmatchedDNAprofilesofopencases againstdataheldbyAustrianauthoritiesandfoundhitsinmorethen1500cases(datareportedin February2007).Inthiscontext,over700opentracesfromGermanycouldbeattributedtopersons knowntotheAustriancriminalprosecutionauthorities.Brokendownbytypesofcrime,14hitsin homicideormurdercases,885hitsintheftcases,and85hitsinrobberyorextortioncaseshave beenfound(asat4January).Itistruethateveryhitneedstobeexaminedcarefully,anditwillnot bepossibletoclearupopencasesbyaDNAhitalone.Neverthelessitcanbeexpectedthathitherto unsolvedcasesinGermanyandAustriacanbeclosedandtheperpetratorsbebroughttojustice.In anycase,prosecutionauthoritiesareconfidentthatthenumberofhitswillincreaseconstantlyas furtherPrümcountriestakepartinthisprocess,andthattheywillthusbeabletosolvenumerous otheropencases.

ThespecialvalueoftheTreatyliesinthesubstantiallyimprovedandefficientlyorganised proceduresfortheexchangeofinformation.Thestatesinvolvedmaynowgiveoneanother automaticaccesstospecificnationaldatabases.Thisamountstoaquantumleapinthecrossborder sharingofinformation.

Thecontractingstateshavefullanddirectonlinereadaccesstovehicleregistrationdataheldby theirpartners.TheygiveoneanotheraccesstotheirDNAanalysisanddactyloscopic(fingerprint) databasesinwhatiscalledahit/nohitsystem.Policeservicesmaylaunchaqueryinthedata systemofacontractingpartnertofindoutwhetheritcontainsdataconcerningaspecificprofile, andareautomaticallyinformedoftheresultwithinamatterofminutes.Furtherinformation,such aspersonaldata,maybecommunicatedinthecourseofmutuallegalassistance.

Furthermore,theexchangeofdataconcerningpotentialterroristperpetratorsandhooligansis regulated.Policecooperationmayalsobesteppedupthroughoperationalmeasures,suchasjoint patrols,transferringsovereignpowerstopoliceforcesofothercontractingstates,orassistancein thecaseoflargescaleevents.

TheTreatycontainscooperationmechanismsthatneedtoberegulatedatEUlevelintheFirst Pillar.Thisincludesprovisionsregardingdocumentadvisers,skymarshalsandreturnmeasures.

AnimportantaspectoftheTreatyisthecomprehensiverangeofmoderndataprotection regulations.

AsthedraftersofthePrümTreatysoughttofurtherdevelopEuropeancooperation,theTreatyhas beendesignedwithitsconversionintoEUlawinmind.

Thesignatorystatesare:Germany,Belgium,Spain,France,Luxembourg,TheNetherlands,and Austria.

ThosestateshavingnotifiedtheirwishtoaccedetothePrümTreatyare:Slovenia,Italy,Finland, Portugal,Bulgaria,Romania,GreeceandSweden.

PROTECTION OF PERSONAL DATA RELATING TO POLICE AND JUDICIAL CO- OPERATION IN CRIMINAL MATTERS

TheCounciladoptedthefollowingconclusions:

"TheCouncilrecognizestheimportanceoftheexistenceofacomprehensiveandcoherentsetof rulesattheleveloftheEuropeanUnionconcerningthehighlevelofprotectionofpersonaldata processedintheframeworkofpoliceandjudicialcooperationincriminalmatters,asapartofthe Union’severincreasingsetofregulatoryinstrumentsonsuchcooperation.Theseruleswillbuild upontheminimumdataprotectionprinciplessetbytheConventionof28January1981forthe protectionofindividualswithregardtoautomaticprocessingofpersonaldataanditsAdditional Protocolof8November2001,andtakeaccountofRecommendation(87)15regulatingtheuseof personaldatainthepolicesector,bothadoptedintheframeworkoftheCouncilofEurope.

TheCouncilnotesthattheEuropeanParliamenthasrapidlyforwardeditsopinionontherevised draftoftheCouncilFrameworkDecisionontheprotectionofpersonaldataprocessedinthe frameworkofpoliceandjudicialcooperationincriminalmattersandwillexamineallsolutions suggestedbytheEuropeanParliament,inthespiritofcooperationthatisreflectedintheopinion. TheCouncilthankstheParliamentforitscooperationonthisissue.

TheCouncilnotesthegeneralprinciplesintheannextotheopinionoftheEuropeanParliamentof 24May2007ontheprotectionofpersonaldataprocessedintheframeworkofpoliceandjudicial cooperationincriminalmatters.TheCouncilwilltaketheseprinciples,whereappropriate,into consideration,whendraftingtheCouncilFrameworkDecisionontheprotectionofpersonaldata processedintheframeworkofpoliceandjudicialcooperationincriminalmatters.

TheCouncilcontinuestogiveprioritytotheexaminationoftheproposalforaCouncilFramework Decisionontheprotectionofpersonaldataprocessedintheframeworkofpoliceandjudicialco operationincriminalmatters,andintendstoreachapoliticalagreementontheproposalassoonas possibleandatthelatestbytheendof2007."

VISA INFORMATION SYSTEM (VIS)

TheCouncilwelcomedtheagreementreachedinfirstreadingwiththeEuropeanParliamentona RegulationconcerningtheVISandtheexchangeofdatabetweenMemberStatesonshortstay visas.

ItalsoagreedonaDecisionconcerningaccessforconsultationoftheVISbydesignatedauthorities ofMemberStatesandbyEuropolforthepurposesoftheprevention,detectionandinvestigationof terroristoffencesandofotherseriouscriminaloffences.

TheVisaInformationSystem(VIS)isasystemfortheexchangeofvisadatabetweenMember States,which:constituteaninstrumenttofacilitatethefightagainstfraud,byimprovingexchanges ofinformationbetweentheMemberStates(atconsularpostsandatbordercrossingpoints)onvisa applicationsandresponsesthereto;contributetotheimprovementofconsularcooperationandto theexchangeofinformationbetweencentralconsularauthorities;facilitatechecksthatthecarrier andtheholderofthevisaarethesameperson,atexternalbordercheckpointsoratimmigrationor policecheckpoints;contributetothepreventionof"visashopping";facilitateapplicationofCouncil Regulation(EC)No343/2003determiningtheStateresponsibleforexaminingapplicationsfor asylum;assistintheidentificationanddocumentationofundocumentedillegalsandsimplifythe administrativeproceduresforreturningcitizensofthirdcountries;contributetowardsimprovingthe administrationofthecommonvisapolicyandtowardsinternalsecurityandtocombatingterrorism.

GLOBAL APPROACH TO MIGRATION - Council conclusions

TheCouncilendorsedConclusionsonExtendingandenhancingtheGlobalApproachtoMigration. TheconclusionswillnowbesubmittedtotheGeneralAffairsandExternalRelationsCouncil,for adoption.

"1. TheCouncilunderlinestheimportanceoftheissueofmigrationfortheEUandits MemberStates.TheCouncilthereforewelcomestheimportantprogressbeingmadewith theadoptionandtheimplementationoftheGlobalApproachtoMigration,thestrategy establishedbytheEuropeanCouncilinDecember2005andcomplementedbyits ConclusionsonthedevelopmentofcomprehensiveEuropeanMigrationPolicyof December2006.

2. TheCouncilnotesthefirstsetofpriorityactionsforthepurposeoftheGlobalApproach focussedonAfricaandtheMediterranean.Strengthenedpoliticaldialogue, includingtherecentEUmissionstoAfrica,andconcretecooperationwithAfricanand EuroMedpartnersonmigrationandrelatedissues,includingdevelopmentaspectsof migration,areimportantrecentachievements.Thestrengthenedcapacitytomanagethe controlofexternalborders,inparticularthroughjointmaritimeoperations,isanother importantachievement.TheCouncilbelievesthatthesemeasuresshouldbefurther intensifiedinthelightofrecentevents.

3. TheCouncil,whileunderliningtheneedtocontinuetheseeffortsasamatterofurgency, alsoreaffirmstheneedtobothextendthegeographicalscopeandtoenhancethecontentof theGlobalApproachingeneral.

4. TheCouncilthereforewelcomestheCommissionCommunicationsof16May2007on applyingtheGlobalApproachtomigrationtotheEasternandSouthEasternregions neighbouringtheEuropeanUnionandoncircularmigrationandmobilitypartnerships betweentheEuropeanUnionandthirdcountries.TheCouncilcallsontheMemberStates andtheCommissiontoensurethatsufficienthumanandfinancialresourcesareallocated, withintheexistingfinancialframework,inordertoenablethetimelyimplementationof thecomprehensiveapproachtomigration.

A. Extending the Global Approach - Applying the Global Approach to Migration to the Eastern and South-Eastern Regions Neighbouring the European Union

TheCouncilunderlinesthenecessityfortheEUtoachieveamoreefficientmanagementof migrationgiventheconsiderablenumbersofmigrantscomingfromorthroughtheeastern andsoutheasternregions.Existingcooperationstructuresintheregionneedtobe enhancedandfullyintegratedinEUrelationswiththethirdcountriesconcerned,inorder tocreateamorecomprehensiveandcoherentapproach.Thisapplies,inparticular,to dialogueandeffectivecooperationinmatterssuchasenhancingbordercontrol,combating illegalimmigration,organisedcrimeandtraffickinginandsmugglingofhumanbeings. Thisalsoappliestoensuringwellmanagedmigrationforsocial,culturalandbusiness purposesandharnessingtheopportunitiestostrengthenthelinksandsynergiesbetween migrationanddevelopmentintheseregions.

6. TheCouncil,whilerecognisingthatthedialoguewitheasternandsoutheasterncountries iswelladvanced,stressestheneedtotakeadditionalcomprehensiveandconcreteactions basedonexistingpoliticalandinstitutionalframeworkstakingintoaccountthe competencesofMemberStates.Asamatterofpriority,particularattentionshouldbe giventostrengtheningthedialogueandcooperationwiththeregionsdirectlyneighbouring theEU,i.e.thecountriesoftheWesternBalkans,,theENPcountries–including issuesthatcouldaffectthem,suchastheconsequencesoftheIraqirefugeesituationand theRussianFederation.Furthermorethedialogueonmigrationissuesshouldbeintensified withCentralAsianandAsiancountriesoforiginandtransitidentifiedinaccordancewith themigratoryroutesconcept.

7. TheCouncilendorsesthepriorityactionsfocusingontheEasternandSouthEastern regionsneighbouringtheEUannexedtotheseConclusionsinthecontextoftheextension oftheGlobalApproachtoMigration.TheCouncilinvitestheCommissiontoreportback ontheimplementationoftheGlobalApproachthusextended."

B. Enhancing the Global Approach - Circular Migration and mobility partnerships between the European Union and third countries

8. TheCouncilreiteratesthatactiveconsiderationmustbegiventohowlegalmigration opportunitiescanbeincorporatedintotheUnion'sexternalpoliciesinordertodevelopa balancedpartnershipwithinterestedthirdcountries.Thesewouldneedtobeadaptedtothe specificEUMemberStates'labourmarketneedsaswellastothecooperationresults achievedfromthethirdcountriesconcerned.

TheCouncilwelcomestheCommissionCommunicationoncircularmigrationand mobilitypartnershipsasabasisforfurtherdiscussions.TheCouncilbelievesthatthesetwo conceptscouldmakeanimportantcontributiontoacomprehensiveapproach,which combinesmeasuresaimedatfacilitatinglegalmigrationopportunitieswiththosereducing illegalimmigration.Suchastrategycould,inparticular,bedirectedtopromotingsustained cooperationwiththirdcountriesalongthemigrationroutestowardstheEuropeanUnion.

10. TheCouncilunderlinesthatthesemobilitypartnershipswillbeconsideredinthosecases wheretheybringaddedvaluebothtotheEUandthethirdcountryonthemanagementof migrationflowsandontheunderstandingthatthewillingnesstocontributetothis partnershipandtocooperateactivelyisthebasisfortheopportunitiesofferedbythem. Suchpartnershipsshould,asfarasappropriate,includetheofferoflegalmigration opportunities,adaptedinparticulartothespecificMemberStates'labourmarketneeds, whilefullyrespectingthecompetencesoftheMemberStatesandtheprincipleof Communitypreferenceontheonehand,andagenuinecooperationonpreventingand combatingillegalimmigration,traffickinginandsmugglingofhumanbeingsaswellas effectivereadmissionandreturnpolicywhilerespectingtheprotectionofhumanrights,on theotherhand.

FurthermoretheCouncilagreesthat,buildingupontheeffortstoimplementmeasuresandactions thatarealreadypartofthedialogueandcooperationwiththirdcountries,thesepartnershipscould include:

• theenhancementofthelinksbetweenmigrationanddevelopment,i.a.tofacilitateproductiveuse oftheresourcesofmigrantcommunitiesandtopromotecodevelopmentprojects;

• thepoolingofsupportmeasuresincapacitybuildinginordertobettermanageandcontrol migration;

• thepromotionofthereintegrationofreturnees;

• visafacilitationinaccordancewiththecommonapproach,takingintoaccounttheexperiencesin theimplementationofthecurrentagreements;

• theenhancementoftheprotectionofhumanrightsinthefightagainstillegalimmigration,in readmissionandreturnpoliciesandinthereceptionofmigrantsandasylumseekers;and

• theprotectionofrefugeesinaccordancewithinternationalstandards.

TheCouncilbelievesthattheconceptofmobilitypartnershipsbetweentheEuropean Union,MemberStatesandthirdcountriescouldbetestedbywayofalimitednumberof pilotpartnerships.TheCouncilthereforeinvitestheCommissiontoconsultMemberStates onthefurtherdevelopmentofthisconcept,including,inparticular,onthetermsof reference,andwithaviewtoexploratorytalkswithinterestedthirdcountriesonpilot partnershipsinclosecooperationwiththePresidencyandinterestedMemberStates.The CommissionisinvitedtoreportbacktotheCouncilontheoutcomeoftheseconsultations inordertoenabletheCounciltodecidebytheendof2007whethertoinvitethe Commissiontolaunchpilotpartnerships.

ThePresidencyconcludedasfollows:

SANCTIONS AGAINST EMPLOYERS OF ILLEGALLY STAYING THIRD COUNTRY NATIONALS

TheCouncilhadafirstexchangeofviewsonaCommissionproposalforaDirectiveprovidingfor sanctionsagainstemployersofillegallystayingthirdcountrynationals(9871/07) .

ThisproposalformspartoftheEU'seffortstodevelopacomprehensivemigrationpolicy.In accordancewiththeCommissionproposal,oneofthefactorsencouragingillegalimmigrationinto theEUisthepossibilityoffindingwork.Thisproposalaimstoreducethatpullfactorbytargeting theemploymentofthirdcountrynationalswhoareillegallystayingintheEU.Buildingonexisting measuresintheMemberStates,theaimistoensurethatallMemberStatesintroducesimilar penaltiesforemployersofsuchthirdcountrynationalsandenforcethemeffectively.

Underthisproposal,itistheemployerwhowillbesanctioned,nottheillegallyemployedthird countrynationals.

Recalling theReportoftheEuropeanParliamentonstrategiesandmeansfortheintegrationof immigrantsintheEuropeanUnionofMay2006,theOpinionoftheEuropeanEconomicandSocial CommitteeonImmigrationintheEUandintegrationpolicies:cooperationbetweenregionaland localgovernmentsandcivilsocietyorganizationsofSeptember2006andtheOpinionofthe CommitteeoftheRegionsofMay2006ontheCommunicationoftheCommissiononaCommon AgendaforIntegration,(amongotheractivitiesdevelopedatCommunitylevelonintegrationbythe EuropeanParliament,theEconomicandSocialCommitteeandtheCommitteeoftheRegions).

AND ADOPT THE FOLLOWING CONCLUSIONS:

1. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesstressthe needtopromoteaglobalandcoherentapproachtointegrationpolicies,migrantflow management,developmentandcooperationwiththecountriesoforigin.Theyrecognize thecomplementarylinkagebetweenimmigrationandintegration.

2. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesrecognize thatintegrationisadynamictwowayprocessinvolvingbothimmigrantsandthehost society,withresponsibilitiesforbothsides,whichshouldbeunderpinnedbyanagreed valuesystem.Involvingthehostsocietyinthisprocessisoneofthemajorchallengesto theachievementofsuccessfulintegrationpoliciesandlongtermsocialcohesion.All individualsmustassumeresponsibilityinthisintegrationprocess–aswellasstate institutions,politicalparties,media,businessesandcivilsociety.Migrantswhoaimtostay permanentlyorforthelongtermshouldmakeadeliberateefforttointegrate,inparticular learningthelanguageoftheirhostsociety,andunderstandingthebasicvaluesofthe EuropeanUnion.

Theyfurtherrecognizetheroleoflocalstakeholders,includinginparticular,theroleof localgovernmentandcitiesindesigningandimplementingintegrationprogrammes,given thatintegrationtakesplaceprimarilyatalocallevel.

3. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStates emphasize theneedtocontinuetostrengthentheintegrationpoliciesofMemberStateswithaviewto managingdiversesocieties,counteractingallformsofdiscriminationandintolerance, maintainingsocialcohesionandensuringthatimmigrantsareabletoreachtheirfull potentialandareabletoparticipatetothefullestextentpossibleinthesocial,economic, culturalandciviclifeoftherelevantMemberState.

4. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStateswelcome theinitiativestaken,intheperiodsincetheadoptionoftheCommonBasicPrinciples (CBP),tofacilitatetheexchangeofexperienceaswellastheopportunityprovidedbythe InformalMeetingofEUIntegrationMinistersheldinPotsdamon1011May2007to reviewatapoliticallevelthescopeforfurtheractiondirectedtostrengtheningthe EuropeanframeworkforintegrationandtheintegrationpoliciesoftheMemberStates,by promotingunityindiversity.

5. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesalso welcomethepublicationbytheCommission,inallofficiallanguages,ofthesecond editionoftheHandbookonIntegrationforpolicymakersandpractitionersandrequestthe Commissiontoensurethattheeditionsbecontinuedanditbedisseminatedwidely throughouttheMemberStates.

6. TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesemphasize thecontinuingimportanceoftheCBPasthebasisoftheEuropeanapproachtointegration andtheneedfortheCBPtocontinuetoguidetheactivitiesoftheNationalContactPoints (NCPI)onintegration.TheCouncilandtheRepresentativesoftheGovernmentsofthe MemberStatesrecognizetheneedtofurtherstrengthentheroleoftheNCPInetwork.

7. TheCouncilinvitesMemberStatestomakemaximumuseofthepossibilitiescreatedby theIntegrationFundtopromoteintegrationpoliciesandsharedexperience.

8. TheCouncilinvitestheCommissiontocontinuetosupporttheactivitiesoftheNCPI networkandtoconsiderwaystoredesigntheAnnualReportonImmigrationand Integrationinordertomakeitanuptodateinstrumentforthecomparativeanalysisof newdevelopmentsinintegrationpolicyintheMemberStatesandinduecoursetopresent anewconceptfortheAnnualReport.

9. TheCouncilinvitestheNCPI,supportedbytheCommission,toconsiderapproachesto integrationthatinvolvethesocietyasawhole,includinginparticularto:

TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesrecognize thatinterculturaldialoguehasbecomeanimportantinstrumentinfosteringthesuccessful integrationofcitizensofdifferentorigin,cultureandreligioninEuropeandin counteractingracismandextremism.TheCouncilandtheRepresentativesofthe GovernmentsoftheMemberStates,takingaccountofdevelopmentsinthecontextofthe forthcomingYearofInterculturalDialoguein2008,inviteMemberStatestobegina regularexchangeofexperiencegainedintheirrecenteffortstoestablishsuchdialogue.

TheCouncilandtheRepresentativesoftheGovernmentsoftheMemberStatesfurther welcometheinitiativeofGermanytoconvenethefirsttwoexpertmeetingsforthis purposeandwithaviewtothepreparation,inconsultationwiththeNCPI,ofareportfor theMinisterialConferencein2008,whichshouldincludeproposalsfortheestablishment ofaflexibleprocedurecapableofreactingtointerculturalproblemsorconflictswitha potentialcrossborderdimension.

COMMON EUROPEAN ASYLUM SYSTEM

TheCouncilhadanexchangeofviewsonthefollowingitems:

– aproposalforaCouncilDirectiveconcerningtheextensionofthescopeofaCouncilDirective 2003/109/ECdeterminingthestatusofthirdcountrynationalswhoarelongtermresidentsto beneficiariesofinternationalprotection,

– areportontheevaluationofthe"Dublin"system,and

– aGreenpaperonthefuturecommonEuropeanasylumsystem.

TheCouncilpreparatorybodieswillfurtherexaminetheproposalforaDirectiveandthereport.

ConcerningtheGreenpaper,theCommissionintendstolaunchanindepthreflectionanddebate. TheCommissionwillsynthesizetheresultsofthisreflection,togetherwiththeresultsofthe evaluationofthefirststageECasyluminstruments,andwillthensubmitaroadmapofthework thatwillhavetobecarriedoutinthefuture,inordertoachievetheCommonEuropeanAsylum System.

CouncilDirective2003/109/ECdeterminesthestatusofthirdcountrynationalswhoarelongterm residents.AtthetimeoftheadoptionofthisDirective,theCouncilwelcomedtheCommission commitmenttotableaproposalfortheextensionoflongresidentstatustorefugeesandpersons undersubsidiaryprotectionstatus,takingintoaccountthequestionoftransferofprotectionstatus. ThenewCommissionproposalrespondstothiscommitment.

Thesocalled"Dublinsystem"includesCouncilRegulation343/2003establishingthecriteriafor determiningtheMemberStateresponsibleforexamininganasylumapplication,andCouncil Regulation2725/2000concerningtheestablishmentof"Eurodac"forthecomparisonoffingerprints fortheeffectiveapplicationoftheDublinConvention(subsequently,Regulation343/2003).

ThesetwoRegulationsrequiredtheCommissiontoreportontheirapplicationafterthreeyearsof operationsandtopropose,whereappropriate,thenecessaryamendments.TheCommissionhasnow submittedamergedreportonbothinstruments,giventheircomplementarycharacter.The Commissionintendstoproposeinthefuture,withintheframeworkofthefutureCommon EuropeanAsylumSystem,thenecessarymeasuresaimingatimprovingthepracticalapplication andtheeffectivenessofthe"Dublinsystem".

EU/Ukraine - Visa facilitation and readmission agreements

TheCounciladopteddecisionsapprovingthesigningofanagreementbetweentheEUandUkraine onfacilitatingtheissuanceofvisastocitizensoftheEUandUkraine,aswellasanagreementon readmission (9323/07, 9312/07) .

Thepurposeofthevisaagreementistofacilitate,onthebasisofreciprocity,theissuanceofvisas foranintendedstayofnomorethan90daysperperiodof180daystocitizensoftheEUand Ukraine.TheagreementwillnotapplytotheterritoryofDenmark,IrelandandtheUnited Kingdom.

Thereadmissionagreementestablishes,onthebasisofreciprocity,rapidandeffectiveprocedures fortheidentificationandreturnofpersonswhodonot,ornolonger,fulfiltheconditionsforentry toandstayontheterritoriesofUkraineoroneoftheMemberStatesoftheEU,andtofacilitatethe transitofsuchpersonsinaspiritofcooperation.Theagreementwillnotapplytotheterritoryof Denmark.

Rapid border intervention teams

TheCounciladoptedaregulationestablishingamechanismforthecreationofRapidBorder InterventionTeamsandamendingCouncilRegulation(EC)No2007/2004asregardsthat mechanismandregulatingthetasksandpowersofguestofficers (PE-CONS 3616/07) .

Theregulationestablishesamechanismforthepurposesofprovidingrapidoperationalassistance foralimitedperiodtoarequestingMemberStatefacingasituationofurgentandexceptional pressure,especiallythearrivalatpointsoftheexternalbordersoflargenumbersofthirdcountry nationalstryingtoentertheterritoryoftheMemberStateillegally,intheformofRapidBorder InterventionTeams.Inaddition,itdefinesthetaskstobeperformedandpowerstobeexercisedby membersoftheteamsduringoperationsinaMemberStateotherthantheirown.

Application of the Schengen Information System (SIS) to new Member States

TheCounciladoptedadecisionontheontheapplicationoftheprovisionsoftheSchengenacquis relatingtotheSchengenInformationSystem(SIS)intheCzechRepublic,Estonia,Latvia, Lithuania,Hungary,Malta,Poland,SloveniaandtheSlovakRepublic (9201/07) .

The2003ActofAccessionprovidesthatallSchengenacquisprovisionswillonlyapplyinanew MemberStatefollowingaCouncilDecision,afterverificationthatthenecessaryconditionshave beenmet.

TheCouncilconcludedinDecember2006andJune2007thatthenecessaryconditionshadbeen fulfilled.ItisthereforepossibletosetadatefromwhichtheSchengenacquisrelatingtotheSIS mayapplyinthoseMemberStates.

TheentryintoforceofthethisdecisionwillallowforrealSISdatatobetransferredtotheMember Statesconcerned.TheconcreteuseofthisdatawouldallowtheCounciltoverifythecorrect applicationoftheprovisionsoftheSchengenacquisrelatingtotheSISintheMemberStates concerned.TheseevaluationsarescheduledtotakeplaceinSeptember2007.

Underthesetwojointactions,theEUwillprovideadviceandassistancetotheCongolese authorities,includingwithaviewtopromotingpoliciescompatiblewithhumanrightsand internationalhumanitarianlaw,democraticstandardsandtheprinciplesofgoodgovernance, transparencyandrespectfortheruleoflaw.Bothmissionsaretobecarriedoutinclosecooperation withtheUnitedNationsandotheractorsoftheinternationalcommunity.

The2006electionsintheDRCmarkedtheendofthetransitionprocessandenabledtheformation ofagovernmentin2007.Itsprogrammeprovides, inter alia ,forareformofthesecuritysector,the drawingupofanationalplan,andpriorityreformsinthepolice,armedforcesandjudicialsectors.

TheEUhasshownitssupportforthetransitionprocessintheDRCandforthereformofthe securitysector,includingbytheorganisationofthreeoperations:EUSECRDCongo,EUPOL KinshasaandOperationEUFORRDCongo,whichcontributedtothecreationofasecure environmentduringtheelectionprocess.
