JAEGER December 3, 2018 In accordance with Section 54-03-03 of the North Dakota Century Code, I certify the enclosed list is a true and correct record of members of the House of Representatives elected in the General Election held on November 6, 2018. The State Canvassing Board certified the results of the election on November 16, 2018. As specified in Section 16.1-15-45 of the North Dakota Century Code, Certificates of Election were then prepared by the Secretary of State and signed by the Governor, the Clerk of the Supreme Court (as the designated representative of the State Canvassing Board), and the Secretary of State. Each newly elected member of the Legislative Assembly was then issued their Certificate of Election (copies enclosed), as specified in Section 16.1-15-46 of the North Dakota Century Code. In addition, in accordance with Section 4, Article XI, of the North Dakota Constitution, an Oath of Office (or affirmation) form was provided to each Representative, with instructions to execute the Oath before a Notary Public and file it with the Secretary of State before he or she assumes the duties of their office. PRESCRIPTION DRUG STUDY Ms. Samantha E. Kramer, Senior Counsel, Legislative Council, reviewed a memorandum entitled Prescription Drug Pricing, Importation, Reference Pricing, and Pharmacy Benefit Managers Study - Background Memorandum. Mr. John Arnold, Deputy Commissioner, Insurance Department, presented a status report regarding the implementation of House Bill No. 1032 (2021). He indicated the first status report would be delayed because the appropriation for the bill, which is needed to create the database, is tied to the license fees collected each June. Mr. Mark J. Hardy, Executive Director, State Board of Pharmacy, presented testimony (Appendix B) on the implementation of House Bill No. 1032 (2021). In response to a question from the committee, Mr. Hardy said medications patients order online from Canada are dangerous because most are manufactured in third world countries without undergoing inspection by the Food and Drug Administration.

All parties participated via Microsoft Teams. Mayor Bakken and City Administrator Hunke provided a street utility update. The Street Utility Fee would replace the current City policy of utilizing special assessments as revenue for street maintenance projects with an alternative funding source such as a street utility fee. The update detailed the scope of work the City is currently undergoing with AE2S Nexus staff to begin the process of incorporating the street utility fee.
