Washington, D.C. 20260 Re: Appeal of FOIA Request No. 2020-FPRO-01322 Dear General Counsel: Citizens for Responsibility and Ethics in Washington (“CREW”) hereby appeals the initial determination by the United States Postal Service (“USPS”) on a portion of CREW’s request under the Freedom of Information Act (“FOIA”) for records concerning voting by mail in the upcoming presidential election and the replacement of the Postmaster General. As set forth below, the USPS failed to conduct a search reasonably designed to uncover all responsive documents, as evidenced by the limited number of responsive records USPS claims to have uncovered. Further, the USPS improperly relied on FOIA Exemption 5 to withhold nearly the entire contents of the disclosed records. On June 16, 2020, CREW submitted to the Postal Service by email a FOIA request for ten categories of records. First, CREW requested copies of any and all briefing materials and or documents created by USPS employees prepared for or presented to Louis DeJoy, Postmaster General of the United States, referring or relating to voting by mail (“item 1”). Second, CREW requested any and all briefing materials and or documents created by USPS employees prepared for or presented to Postmaster General of the United States Megan Brennan referring or relating to voting by mail (“item 2”).     January 13, 2017 The Honorable Eric Greitens Governor of Missouri Missouri State Capitol 201 West Capitol Avenue Jefferson City, MO 65101-1556 Dear Governor Greitens: We are the members of the Board of Trustees of the Missouri Hospital Association. We write you today to express the vital importance to Missouri’s hospitals of restoring a liability protection that was put into state law in 2005 but undermined by a 2014 court ruling. The court ruling is spawning dramatic increases in liability exposure and medical malpractice insurance premiums. Those increased premiums drive up health care costs, both for patients and businesses that buy employee health insurance coverage for workers and their families. The ruling is having an adverse effect on Missouri hospitals even more substantial than past tort reform issues such as the loss of caps on noneconomic damages. The effects of the case are daunting. But the ruling itself is based on a legislative drafting error. When the General Assembly enacted medical liability reform legislation in 2005, it revised the law to specify that providers would not be held liable for the actions of those who are not their employees. However, the enactment defined the term “physician employee” but did not use that term elsewhere in the law. Instead, the law used the term “employee.” In its Jefferson v. Missouri Baptist decision, the Eastern District Court of Appeals used the discrepancy to justify applying a significantly broader standard for imposing liability for the actions of nonemployees. In doing so, the court expanded the liability of hospitals and other organizations for the actions of physicians and other practitioners who are not their employees.

    GOVERNOR’S SECURITY DIVISION The protection of Missouri governors has come a long way since 1881, when Governor Thomas Crittenden kept a .44-caliber Smith and Wesson revolver in his desk drawer. He had offered a $5,000 reward for the arrest and delivery of Frank and Jesse James, and kept the weapon handy to guard against retaliation. In less than a year, Jesse James had been killed, and in October 1882, Frank James surrendered, handing his .44 Remington revolver to Governor Crittenden in the governor’s office. In 1939, eight years after the creation of the Missouri State Highway Patrol, several troopers were assigned to escort and chauffeur Governor Lloyd Stark, and provide security at the Governor’s Mansion for the first family following death threats by Kansas City mobsters. Governor Stark had joined federal authorities in efforts to topple political boss Tom Pendergast. Within a year, Pendergast and 100 of his followers were indicted. In early 1963, Colonel Hugh Waggoner called Trooper Richard D. Radford into his office one afternoon. He told Tpr. Radford to report to him at 8 a.m. the following morning in civilian clothes. At that time, he would accompany Tpr. Radford to the governor’s office. The trooper was introduced to Governor John Dalton and was assigned to full-time security following several threats. Since security for the governor was in its infancy, Tpr. Radford had to develop procedures as he went along. There was no formal protection training available at this time, and the only equipment consisted of a suit, concealed weapon, and an unmarked car.

In this and future issues, I’ll try to be informative about space or space-related topics, provide news about my latest books, magazines, or articles, and share my sometimes-off-the- wall-thoughts … Science Fact 2019 was a BIG year for solar sailing, with The Planetary Society and China launching test sails into space, NASA nearing completion of the Near-Earth Asteroid Scout sailcraft, and selecting a new solar Sail project called Solar Cruiser (formerly “Kon-Tiki”). The Planetary Society successfully launched and flew their LightSail-2 solar sailcraft in Earth orbit, demonstrating controlled deployment and successful navigation. The LightSail, measuring 32 square meters (~344 Square feet), successfully unfurled on June 23, 2019 and, as of this writing, is still in space – sail on! China’s Shenyang Institute of Automation (SIA) launched that country’s first solar sail, SIASail, in late 2019. Details are scant, but it appears that their sail was tested from a small satellite in Earth orbit and successfully completed its mission demonstration. Meanwhile, NASA is nearing completion of the Near-Earth Asteroid Scout mission which will use an 86 square meter (~925 square feet) solar sail to send a small spacecraft to survey an asteroid to which we might someday send people. The space agency also announced that another solar sail mission, the Solar Cruiser with its 1600 square meter (~17,000 square feet) sail, was selected for further study and is one of two mission candidates to fly in space by 2024.
