SUMMARY

• A Preliminary Ecological Appraisal was commissioned by Lancaster City Council to identify possible ecological constraints that could affect the development of 8 sites and areas currently being considered as new site allocations under its Local Plan. This report looks at one of these sites: Torrisholme.

• An ecological data search was undertaken of records held by the Local Record Centre for , LERN, together with additional sources such as the Magic website. The Environmental Statement for the M6 - Link Road was also consulted.

• An Extended Phase 1 Habitat Survey of the site was undertaken on 14th January 2016 by two members of the Greater Manchester Ecology Unit. An assessment was also made of the potential of the sites to support protected and priority species.

• The proposed site allocation lies within 2km of Bay SPA/SAC/Ramsar Site/SSSI. A HRA will be required for this proposed allocation.

• The site lies within the SSSI Impact Risk Zone for the SSSI. It is recommended that an Ecological Impact Assessment is undertaken on any proposals that come forward. There are also 6 Biological Heritage Sites within 2km of the proposed site.

• There are a number of wetland habitats on the site that require further survey. These also offer opportunities for biodiversity enhancement.

• The other areas of the proposed site allocation support arable and agriculturally improved grassland of limited ecological value. However the boundary features and adjacent habitats have ecological value. Further habitat surveys are required to fully assess this interest.

• The proposed site allocation also has the potential to support protected species including bats, water vole, great crested newts and breeding birds. Additional surveys will be required for these species before any detailed planning proposals can be brought forward.

1 INTRODUCTION

The Greater Manchester Ecology Unit (GMEU) was commissioned by Lancaster City Council in November 2015 to identify possible ecological constraints that could affect the development of 8 sites and areas currently being considered as new site allocations under its Local Plan. This report looks at one of these sites: Torrisholme.

1.1 SURVEY BRIEF

The work commission involved:

• Desktop surveys for any existing ecological information relating to the sites and areas, particularly concerning the presence of specially protected sites or species.

• A ‘walkover’ site survey and appraisal.

• The preparation of reports for each site appraising the ecological value of the sites and advising of any possible ecological constraints that may apply to future developments.

The reports will include:

 plans showing any areas of potential nature conservation importance;  a description of the survey techniques employed and their limitations (if any);  the findings of the desktop and site surveys;  an appraisal of the nature conservation value of the study areas;  recommendations for further ecological surveys that would be required in support of any future planning applications for the sites and areas

1.2 SITE LOCATION & PROPOSAL

Torrisholme is a suburb of Morecambe in the west of Lancashire. As part of its Local Plan Lancaster City Council is proposing a number of strategic sites to meet the needs for jobs and housing. The land currently identified in Torrisholme surrounds Torrisholme Barrow between the route of the new M6 / Heysham Link Road, the West Coast Mainline and the urban form of Morecambe / Torrisholme.

The identification of this site could provide development opportunities for up to 750 new homes. It is important to note that this site is illustrative of potential growth in the Torrisholme area and the scale of development proposed will be informed by the outcomes of the Green Belt Review. Figure 1 shows the area under consideration.

This site includes a large area of farmland on either side of Hasty Brow Lane, with the new Link Road forming the southern boundary of the site, the West Coast Mainline forming the east, the Morecambe Spur rail line forms the north and the western boundary formed by a range of field boundaries and rears of residential properties (see Figure 2).

2 LEGISLATION AND POLICY

The following UK legislation may be relevant to the proposed site allocations:

• The Conservation of Habitats and Species Regulations 2010 (as amended)

• The Wildlife and Countryside Act 1981 (as amended)

• The Natural Environment and Rural Communities (NERC) Act (2006)

• Countryside and Rights of Way (CROW) Act 2000

• Protection of Badgers Act 1992

The National Planning Policy Framework (NPPF) 2012 acts as guidance for local planning authorities and decision-takers, both in drawing up plans and making decisions about planning applications.

3 METHODOLOGY

3.1 Desk Study

The Multi-Agency Geographic Information for the Countryside (MAGIC) collaborative database website (http://magic.defra.gov.uk/MagicMap.aspx) was searched for information on key environmental schemes and statutory designations in January 2016.

An ecological data search was undertaken from the Local Record Centre covering Lancaster LERN. Information on all protected and priority species within 2km of the site allocations together with the citations for any BHS sites were requested. The information returned from LERN only includes data that they are at liberty to distribute. Therefore the North Lancashire Bat Group and the Lancashire Badger Group were also contacted for data.

In addition the ecological surveys and reports from the Environmental Statement for the M6 - Heysham Link Road (Lancashire County Council 2011) were consulted.

The results of these studies are found in Section 4.

3.2 Field Survey

The main survey of the site was undertaken using an Extended Phase 1 Habitat Survey methodology. This survey method records habitat distributions, assesses the potential of the site to support protected and priority species and records flora and fauna present at the time of survey. However no detailed surveys for species were undertaken. Invasive non-native plant species stands, as listed under Schedule 9 of the Wildlife and Countryside Act 1981, as amended, were also noted. The Bat Surveys for Professional Ecologists: Good Practice Guidelines (3rd edn) (Bat Conservation Trust 2016) were used to assessed the quality of the habitats present on site for bats.

The survey was undertaken on the 14th January 2015 by Suzanne Waymont MCIEEM Senior Ecologist and Mandy Elford MCIEEM, Ecologist (NE Bat License holder) with the Greater Manchester Ecology Unit. The weather conditions at the time of survey were cold and sunny.

3.3 Survey limitations

The timing of the survey in January is outside of the ideal time to undertake full ecological surveys. Many invasive, non-native plant species die back over winter, although their remains are often visible. Many of the hedgerows had been recently cut. As a result the number of species in some and their species richness may have been underestimated.

Access to the southern area of the site was restricted due to the construction works associated with the M6 - Heysham Link Road.

However the nature of the survey was to provide an initial appraisal of the ecological value of the site, advise on any possible ecological constraints and to provide recommendations for any further ecological surveys that would be required. The limitations listed above did not therefore limit the primary purpose of the survey; areas that supported habitats of potential interest, and features that could be used by protected species requiring further survey could be identified.

The data search from LERN includes only data that they are at liberty to distribute. The absence of biological records for an area in no way implies that taxa are not present.

4 BASE LINE ECOLOGICAL CONDITIONS

4.1 DESKTOP SEARCH

The desktop search results are shown in Appendix 1.

Designated Sites and Areas

Morecambe Bay The proposed site allocation lies within 2km of Special Protection Area for birds (SPA), Special Area for Conservation (SAC) and Site of Special Scientific Interest (SSSI). Morecambe Bay is also designated as a Ramsar Site (see Map 1). The citations for these designations can be found in Appendix 2

The SPA supports numerous coastal and marine habitats that support internationally important assemblages of breeding sea birds and wintering waterfowl. The site also support 3% of the British breeding population of sandwich terns together with important wintering populations of northern pintail, pink-footed goose, ruddy turnstone, dunlin, red knot, Eurasian oystercatcher, bar-tailed godwit, Eurasian curlew, grey plover, common shelduck and common redshank. The site is also of international importance for the numbers of common ringed plover it supports.

The primary qualifying habitats of Morecambe Bay SAC are estuaries, mudflats and sandflats not covered by seawater at low tide, large shallow inlets and bays, perennial vegetation of stony banks, Salicornia and other annuals colonising mud and sand, Atlantic salt meadows, shifting dunes along the shoreline with Ammophila arenaria, fixed dunes with herbaceous vegetation and humid dune slacks. Other qualifying habitats include sandbanks which are slightly covered by sea water all the time, coastal lagoons, reefs, embryonic shifting dunes, Atlantic decalcified fixed dunes and dunes with Salix repens ssp, argentea. The SAC is also designated for great crested newts.

The SSSI (see Map 2) is designated as one of the two largest areas of intertidal estuarine flats in Britain being of international significance for wintering wading birds and national significance for wintering wildfowl. It provides a vital link in the chain of west coast estuaries used by migrating birds. The site also supports important saltmarsh habitat including a number of rare and uncommon plants and a variety of scarce invertebrate species.

The proposed site at Torrisholme lies within the SSSI Impact Risk Zone for Morecambe Bay, which is used to assess planning applications for likely impacts on SSSIs/SACs/SPAs & Ramsar sites (). The risks listed for the site at its nearest point include:

• Pipelines, pylons and overhead cables. Any transport proposal including road, rail and by water (excluding routine maintenance). Airports, helipads and other aviation proposals • Solar schemes with footprint > 0.5ha, all wind turbines. • Planning applications for quarries: new proposals or extensions, outside or extending outside existing settlements/urban areas affecting greenspace, farmland or semi natural habitats. • Large non-residential developments outside existing settlements/urban areas where net additional gross internal floor space is > 1,000m² or footprint exceeds 0.2ha • Residential development of 50 units or more. • Any residential development of 10 or more houses outside existing settlements/urban areas. • Any industrial/agricultural development that could cause air pollution (including: industrial processes, pig & poultry units, slurry lagoons > 200m³ & manure stores > 250t). • General combustion processes >20MW energy input. Including: energy from waste incineration, other incineration, landfill gas generation plant, pyrolysis/gasification, anaerobic digestion, sewage treatment works, other incineration/ combustion. • Landfill. Including: inert landfill, non-hazardous landfill, hazardous landfill. • Any composting proposal with more than 75000 tonnes maximum annual operational throughput. Including: open windrow composting, in-vessel composting, anaerobic digestion, other waste management.

Lune Estuary SSSI The proposed site allocation lies just over 2km from the Lune Estuary SSSI (see Map 2). The Estuary is part of Morecambe Bay SPA/SAC but is designated separately as a SSSI. As part of Morecambe Bay this SSSI forms a major link in the chain of estuaries along the west coast of Britain used by birds on migration between the breeding grounds in the far north, and the wintering grounds further south and is of international importance for the passage and wintering waterfowl it supports. A large part of the estuary, between Knott End and Cockersands Point, is covered by the Wyre-Lune Sanctuary which provides a protected roost for wintering pink- footed geese. Some of the saltmarshes are of interest for their breeding bird populations and collectively support a variety of plant communities and a number of uncommon plant species.

The risks listed for the site at its nearest point to the SSSI include: • Airports, helipads and other aviation proposals. • Wind turbines • Any industrial/agricultural development that could cause air pollution (including: industrial processes, pig & poultry units, slurry lagoons > 750m³ & manure stores > 3500t). • General combustion processes >50MW energy input. Including: energy from waste incineration, other incineration, landfill gas generation plant, pyrolysis/gasification, anaerobic digestion, sewage treatment works, other incineration/ combustion. • Landfill. Including: inert landfill, non-hazardous landfill, hazardous landfill. • Any discharge of water or liquid waste that is more than 5m³/day. The water needs to either be discharged to ground (i.e. to seep away) or to surface water, such as a beck or stream. Discharges to mains sewer are excluded.

BHS There are 6 Biological Heritage Sites (BHS) within 2km of the proposed sites. The citations for these sites can be found in Appendix 3. The table below lists the BHS and the reasons for selection. Their locations are shown in Map 3. .

Species and Species Groups

Bats Five roosting species of bats have been recorded from within 5km of the site together with records of unidentified bat species and unidentified Myotis species (see Map 4). These are common pipistrelle, soprano pipistrelle, noctule, Brandt’s bat and brown long-eared bat. There are no records for the site itself; but there are roosts recorded just to the south of the sites in the Crematorium and in a residential property.

Other bat records were returned for 7 identified species within 5km of the site. These included serotine, Daubenton’s bat, whiskered bat, noctule, common pipistrelle, soprano pipistrelle and brown long-eared bat together with several unidentified species (see Table 4). There appear to be no records from the proposed site itself but this may be due to lack of survey rather than lack of bats.

The area south just south of the site was identified in the M6 Link Road surveys as having moderate bat activity.

Badgers The data search from LERN returned no records for badgers.

The records from LERN do not include information from the Lancashire Badger Group. The badger group have been contacted separately for their information, although no data has been received so far. Any results will be published in a separate confidential report.

Otters There several records for otter within 2km of the proposed site allocation, associated with the River Lune and The Lancaster Canal (see Map 5). There is also a record of a sighting by the entrance to Lancaster Crematorium.

Water Vole There is one record for water vole from the Lancaster Canal, although the record is from 1979 (see Map 5). Water vole was not recorded during the surveys undertaken for the M6 link road.

Brown Hare There is one record for brown hare within 2km of the site to south (See Map 5), on the opposite side of the River Lune. No brown hares were recorded from the proposed site during the survey work for the M6 Link Road.

Hedgehog There are several records for hedgehog with 2km of the site, to the south of the site (See Map 5), mostly from residential areas.

Amphibians and Reptiles There is population of great crested newts recorded from Raikes Head BHS to the north east of the site, over 800 metres away (see Map 6). There are also records of smooth newt at this location. There are occasional records of common toad and common frog within 2km of the proposed site.

There are no records for reptiles.

Species of Principle Importance This group of species have been identified as being of Principle Importance for Conservation in England under Section 41 of the Natural Environment and Rural Communities (NERC) Act which came into force on 1st Oct 2006. In addition to the species listed above, records for 56 other species were returned. There appear to be no records from the proposed site. However some of the records are recorded at the tetrad level, so their occurrence within the site cannot be ruled out. A full list can be found in Table 3.

59 Lancashire BAP Long List Species occur within 2km of the proposed site. These are species which occur in Lancashire and are considered to be of significance. There appear to be no records of these species from the proposed site. However some of the records are recorded at the tetrad level, so their occurrence within the site cannot be ruled out. A full list can be found in Table 4.

In addition the surveys for the M6 Link Road identified a number of wintering birds using the proposed site, including curlew, sparrowhawk, dunnock, fieldfare, redwing and song thrush.

Invasive and Non-Native Species Invasive Species are considered to be any non-native or plant that has the ability to spread causing damage to the environment, the economy, our health and the way we live (GB Non-native Species Secretariat)

The data search returned records for 8 such species within 2km of the site (see Map 8). These are all plant species and include: Japanese Knotweed, Himalayan balsam, giant hogweed, winter heliotrope, Canadian waterweed, rhododendron, common cord-grass and fringed water-lily. None of these appear to have been recorded from the proposed site, although some of the records are recorded at the tetrad level, so their occurrence within the site cannot be ruled out. The nearest record is from the Torrisholme Barrow.

4.2 SURVEY RESULTS

Habitats

The proposed site at Torrisholme is primarily agriculturally improved pastures and arable fields with field boundaries of hedgerows. A number of mature broadleaved trees are also found across the site. The results of the survey can be found in Figure 3. The topography of the land is undulating in places.

The pond shown on the OS map at SD46186406 appeared to be no longer present. It was recorded as dry in 2003 during the surveys for the M6 Link Road. A pond was present at SD46476428. Due to the wet winter, this may be just a temporary pond but further survey will be required to assess this. The other pond shown on the OS map no longer appears to be present. The dry ponds do represent enhancement opportunities for any future development proposals

There is an area of rush pasture/marshy grassland in the northern half of the site. This was identified in the M6 Link Road survey as being relatively species rich. Further surveyed will be required in this area.

There are a number of drains and ditches across the site. These were identified in the Link Road surveys as being generally species poor. However given the time that has elapsed, further survey will be required on these features.

The hedgerows appeared at the time of survey to be species poor, although many had been recently cut. Species present include hawthorn, ash, holly and elder with mature ash trees in places. A number of mature trees occur across the site including beech, oak, sycamore and ash.

Protected and Priority Species

Bats The habitats on the site are considered to have moderate potential to be used by foraging and/or commuting bats. The hedgerows provide good commuting and foraging corridors across the site and connect to the wider countryside, particularly to the east. In addition, the mature trees across the site have features that could be used by roosting bats.

Birds No detailed bird surveys were undertaken as part of this study, although records of any birds seen were noted. Species observed include house sparrow, wood pigeon, jackdaw, dunnock, magpie and pheasant. Other wintering bird species are likely to be present.

The hedgerows and trees are likely be used by breeding birds.

Badgers No signs of badgers were observed during the survey but given the weather conditions, some signs may have been missed.

Invasive and Non Native Species No such species were recorded during the surveys but given the timing they may not have been visible, as many die back in the winter months.

Other Species The area supports suitable habitats for brown hare, water vole, hedgehog and potentially amphibians.

5.0 ECOLOGICAL CONSTRAINTS – IMPLICATIONS & RECOMMENDATIONS

Although areas of the proposed site allocations support habitats of limited ecological value, there are a number of constraints on any future development at the site.

SPA/SAC/Ramsar Site Given the proximity of the site to Morecambe Bay a Habitat Regulations Assessment (HRA) of any proposal on the Torrisholme proposed site will be required. The biggest risk to the European Site appears to be disturbance to birds that may use the proposed site when displaced from the estuary and the impact of increased human disturbance on the estuary.

SSSI Any proposals that come forward that are within the categories identified by Natural England in the SSSI Impact Risk Zones may need to undertake additional surveys and studies depending on the nature of the proposals. Impacts on all the identified SSSI will need to be considered.

BHS As identified above there are 6 BHSs within 2km of the site allocation, the closest being the Lancaster Canal, Chestnut Drive Pasture and Belmount Farm Grassland & Fen. There is no physical connection between the BHSs and the proposed site. The development at the site is therefore will not result in any direct habitat loss. However all the Local Wildlife Sites may be impacted by increased recreational pressure or increased pollution from new traffic generated from any new development. Other forms of pollution may also arise depending on the nature of development brought forward at this site.

Pond & Amphibians The pond recorded at SD46476428 will require further survey to determine if it holds water during the amphibian breeding season. If so surveys for great crested newts and water vole may be required.

Hedgerows and Scattered Trees The proposed allocation sites support a network of hedgerows and individual trees. As well as being valuable in their own right, these features provide important habitat for bats and birds (see below). As well as direct loss of these habitat features, development could lead to deterioration of the habitats due to increased disturbance and diffuse pollution.

Marsh The marsh in the north of the site will require further survey to assess its value.

Ditches The ditches across the site will require survey to evaluate their ecological value and as potential habitat for water vole (see below).

Water Vole The site supports a number of habitats that could be used by water vole. These include ditches, marsh and a pond. Water vole surveys of these areas will be required.

Bats There are several mature trees across the sites that have the potential to be used by roosting and foraging bats. The network of hedgerows and trees may provide important foraging and commuting corridors across the landscape.

Birds The habitats across the site are likely to be used by nesting birds, particularly the hedgerows and trees. The site may also be used by wintering birds associated with Morecambe Bay for foraging and for refuge at times of high tide and stormy weather.

6 CONCLUSIONS

6.1 There are a number of ecological constraints should development be brought forward at this the Torrisholme proposed site.

6.2 Any development at the site could significantly effect the special interest of Morecambe Bay SPA/SAC/Ramsar Site and a HRA will be required. Additional ecological survey and pollution assessments are likely to be required to support the HRA.

6.3 Ecological Impact Assessments should also be undertaken on the impact of any proposal on the River Lune SSSI.

6.5 There are a number of wetland habitats on the site that require further survey. These also offer opportunities for biodiversity enhancement.

6.6 The other areas of the site allocation support arable fields and agriculturally improved grassland of limited ecological value. However the boundary features and adjacent habitats have ecological value. Further habitat surveys are required to fully assess this interest.

6.3 The proposed site allocation also has the potential to support protected species including bats, water vole, great crested newts and breeding birds. Additional surveys will be required for these species before any detailed planning proposals can be brought forward.
