c Bryan Ward Senior Planner by invitation from North Central Area Committee Councillors to answer queries Order: Bryan Ward Senior Planner answered questions from the Councillors in relation to questions arising from April motions. He stated that the Development Plan Process review is the place to tease out high capacity issues and indicated the the National guidelines supersedes the Development Plan.

d Merville Avenue Waste Management Report Order: Noted. The Committee requested that a Big Belly Bin be considered at this location also that the ELO continue to monitor the situation here.

f Naming & Numbering Proposal for a new residential development on the site of 52, 54, 56 & 58 Station Road, Raheny, Dublin 5- (1-105 Barlow Hall, Station Road, Raheny, Dublin 5) Order: Raheny Heritage Society suggested Owenmore be used instead of “Barlow Hall” as this was the local name of this site in Raheny North townland from late 1890s onwards. Joanne reverted to the developer and they are happy with this name. The full name of the development will be Owenmore Hall, Station Road, Raheny, it is adopted as it has approval from the NCA Committee and the DCC Heritage Officer. Refer to City Council.

g Naming & Numbering Proposal for a new residential development on a site at 14-17 Newtown, Malahide Road, Dublin 17- (Heatly Place & Newton Place, Malahide Road, Dublin 17) Order: Agreed Heatly Place for block A. Refer to City Council. Block B Developer is going to submit alternative name for approval at June Area Committee.

j Housing Supply Report Order: Awaiting word back from Department regarding Oscar Traynor Lands. Cllr Cooney agreed to write a letter to the Minister for Housing on behalf of the NCAC requesting that he meet with them in order to progress this issue with no further delays.

Cllr. Gilliland supported by Cllr. O’Toole expressed concern regarding Slademore Presentation by Architects on 21/4/21. More meaningful consultation is essential. Brendan Kenny to refer back with responses to 12 questions. Connell McGlynn informed the Committee that there will be a 13 – 15 week delay on all City Council Builds.

a Motion in the name of Councillor Damian O'Farrell That this area committee requests that DCC immediately desists from introducing ‘all day’ car parking at the public car park located opposite the end of Hollybrook Road, Clontarf, removes all ‘all day‘ parking signage and refers this issue to our Arts SPC under whose remit our Public Parks fall.

Recently ‘all day’ paid car parking has been introduced by DCC at the above referenced car park which is located in Clontarf Promenade Park, without consulting with local councillors

Background Initially (the noughties) there was free car parking at this location which is utilised by park users, strollers, joggers , dog walkers and customers of local businesses opposite etc.

However there were significant problems due to all day parking and during the city council period 2009 / 2014 short term paid parking in this car park was agreed by local councillors on foot of a recommendation by DCC to prevent this ‘all day’ parking which was blocking use of this space for the purpose it was intended.

The recent introduction of €6 all day parking by DCC without any local area committee consultation is both a contradiction to the previous recommendation by DCC and a change in policy as regards the use of DCC’s Public Park car parks. The move will cause serious disruption to park users and local businesses as was the case previously.

Reply

The Parking Policy and Enforcement Section will investigate this matter of all day parking as outlined by Cllr O’ Farrell and return with a report on the matter as soon as possible.

Report to Councillor. c Motion in the name of Councillor Damian O'Farrell That this Area Committee agrees that all entry and exit roads ( listed below) to the Marino Scheme are entirely unsuitable for any kind of traffic diversions necessary during the estimated 18 / 24 month construction phase through Fairview (R105) of the Clontarf to City Centre Cycleway (CCCC) The Marino Scheme built in the 1920s includes a very narrow series of roadways totally unsuitable / unsafe for through traffic and a demographic of young children and older persons. There are major traffic safety concerns in the Marino area due to the impending construction of the CCCC and subsequent road closures and traffic diversions.

Furthermore, at the advance traffic planning stage and throughout the construction phase of the above project DCC will in the interests of safety and by whatever means necessary proactively ensure the Marino Scheme is not used for any traffic diversions nor will it be possible for drivers to rat run.

DCC will at an early stage report to the local area committee on how it intends to achieve the above mentioned traffic management.

The Environment & Transportation Department in has no current plans to use the road network in Marino for traffic diversions during the construction stage of the Clontarf to City Centre Project. The Environment and Transport Department would also agree that through traffic should be minimised on these roads as far as possible.

Dublin City Council is currently in the process of procuring a works contractor for the Clontarf to City Centre Project. The contractor is 4

required to prepare a works programme, which will include detailed temporary traffic management plans for all phases of the works. When the successful contractor is selected, Dublin City Council will have more detailed information on how the works will be phased and details of the traffic diversions proposed for each phase. More information can then be provided in relation to the proposed diversions. At that stage, supplementary traffic management measures to assist in reducing congestion in particular areas can be developed if required.

The Project Team in DCC will report at an early stage to the local area committees on the proposed traffic management plans for the project. The team will work with Councillors in relation to any concerns raised, and develop measures to address them, including measures to prevent rat running through the network of residential streets in Marino should the need arise.

Order: Motion Falls. 5 Abstensions. 2 For and 4 Against. d Motion in the name of Councillor Racheal Batten That this Area committee desist in any plans to take away the very limited open space in Kilmore next to the Primary Care centre and provide an open forum to the community to engage in a proper facility being put in place in this area. This area of the city lacks public space and in one of the most high population residential areas in Kilmore and with more housing being planed there is a need for open public space. This area is at the junction of a very busy road so would not be safe or suitable for housing. gIven the level of residentially units in the area there is a duty on the council to provide community space. As such I ask this area committee pass this motion and write to the chief executive putting the areas committee views.

Reply:

The area between Primary Care Centre and Kilmore Road is zoned Z4 ‘District Centre’ in the Dublin City Development Plan 2016- 2022. The Z4 zoning objective seeks to provide for and improve mixed- services facilities. Residential is a permissible use under the Z4 zoning objective. It is noted that there are substantial areas of public open space in the vicinity including the Z9 ‘open space’ lands on the opposite side of Kilmore Road and lands adjacent to the river.

Order: Report to Councillor. e Motion in the name of Councillor Racheal Batten That this area committee write to the Housing Minister stating that we want disadvantaged areas where housing projects are taking place, that an environmental assessment be done on the community facilities, especial those of youths and if they are low that there would be an additional requirement for a high percentage of open space and community facilities to be put in place.

Reply:

The City Council is required to carry out a Strategic Assessment Report on all proposed housing projects as part of a funding submission to the Department of Housing, Local Government and Heritage.

The report assesses a number of options for development of a site and establishes the need to provide accommodation within sustainable communities in line with the Dublin City Development Plan 2016-2022. This includes the availability of open space and community facilities.

I the council does not believe that it can facilitate a refreshment percent building that they explore the option of providing a permit to a mobile refreshment provider to ensure that the park is to be utilised as best as possible.

Reply:

The Council is activity exploring the licencing of mobile refreshment providers in such area where they can be provided in tandem with public toilets. Unfortunately there is no suitable toilet in the park that could be brought into commission under this initiative. The redundant pavilion to the north of the park is in such bad condition it would be prohibitively expensive to bring into service in the short term. The Parks Service is open to proposals from service providers as to how these objectives might be achieved.

With the government and the medical professional stating that outside summer is the theme the council has an obligation to encourage the health and safety message and ensure that toilets that are available are open.

It is assumed this motion refers to the pavilion to the northern end of the park which was taken out of commission due to condition and public health concerns and would be prohibitively expensive to upgrade to the point where it could be opened to the public.

Order: Report to Councillor. h Motion in the name of Councillor Deirdre Heney That the manager, in relation to access to the seafront in Clontarf, refer to concerns from users, both pedestrians and some cyclists, of the dangerous situation that prevails for pedestrians, particularly our valued elders, while trying to cross the cycle track at the various junctions in order to get to the seafront e.g. Vernon Avenue and Bull Bridge (at Kanoodle).

As the committee is aware, our elders have been more or less housebound for over a year now and its vital we take all possible measures to respect their right to be allowed enjoy our amenities in a safe manner. Many have now been vaccinated and so are keen to get out and about independently so we need to avoid situations where our valued elders are scared to cross the road at Bull Bridge.

Both cyclists and pedestrians appear to get the green light at the same time for crossing at the Bull Bridge which makes this crossing chaotic. This access point and others need to be made safe for pedestrians and cyclists e.g. calming measures installed, all cyclists to slow down/dismount at these junctions to avoid conflict and possible injury.

The pedestrian signals crossing the roadway at the entrance to the Bull Wall Bridge are known as ‘Toucan’ signals. A Toucan Crossing is designed for both pedestrians AND cyclists to cross at the same time, 7

hence "Two-can" crossing, or "toucan" crossing. Toucan crossings are commonly used across the city and many other cities and towns throughout Ireland in areas where Toucan crossing are used the width of the crossing is increased from a standard to 2.4m to 4m to allow sufficient space for pedestrians and cyclist to cross at the same time.

In order to reduce the wait time for pedestrian the junction in question currently operates with a maximum cycle length of 80s (the cycle length is the time required for all movements in the junction to operate, if demanded e.g. all pedestrian/cycles and vehicles movements). In order to allow sufficient time for the green and amber man for the pedestrian to operate the Toucan phase is allocated 25s each cycle. To allocate a further a separate time to a unique cycle phase would not leave sufficient timings to service all the required movements in the junction.

Order: Detailed report on safety issues at numerous junctions along cycling lane with regard to mix of pedestrians and cyclists. Issues concerned cyclists and large numbers of pedestrians crossing junctions at the same time and speed of cyclists in general causing safety issues for cyclists versus cyclists and for cyclists versus pedestrians in general along the route including the protected cycleway and the cycleway inside small wall along promenade (from Alfie Byrne Road to Blackbanks). Report to City Councillor. j Motion in the name of Councillor Catherine Stocker That this committee agrees to the parks department undertaking a revitalisation of the playground in Maypark. The fundamental equipment is good but over years graffiti and general appearance has dis-improved. The playground could do with removal of all graffiti, brightening up through painting/restoration of equipment and a thorough weeding of surrounding areas.

Reply:

The graffiti and cleaning of the playground will be addressed as part of the annual maintenance programme. As is no doubt appreciated the treatment of weeds around the playground with chemicals is no longer acceptable such weeds will be strimmed when there is sufficient growth to facilitate same. The policy shift away from chemical control of ‘weeds’ or native opportunistic pollinator friendly plants does mean that they will be more evident in the public realm. Such plants should not be regarded as unsightly but as a positive that toxic chemicals are not being used where children play.

Report to Councillor. k Motion in the name of Councillor Catherine Stocker That this committee calls on the manager to increase the number of lifeguards facilitating sea swimming and the facilities available to them to do so. Sea swimming has become increasingly popular and the number of lifeguards needs to be increased correspondingly. Furthermore current lifeguard facilities are inadequate and purpose built units such as these 9

(pictures attached) currently rolled out in Cork have much better visibility for observing swimmers. This committee calls on the manager to ensure investment in appropriate facilities and resources for the provision of a safe life guarding service.

Reply:

The Parks Service has become aware of the increase in sea swimming in recent times often taking place in areas that are nether designated bathing areas nor covered by the Beach Guarding Service. It is unclear on what basis the current lifeguard numbers or huts are claimed to be inadequate. It certainly would not be practical to attempt to provide facilities of lifeguards at every location where citizens choose to swim and the Council would always encourage those who wish to engage in sea swimming to do so where the Beach Guards are in attendance.

The designation of new bathing areas is a statutory process under the bathing water directive transposed into Irish Legislation in 2008. There may well be a strong rationale to designate and service new areas for sea swimming and to which end the Parks Service will monitor the situation and engage with stakeholders in the coming months including Dublin Port, EPA, Irish Water, Water Safety and Water Quality Departments, Local leisure craft clubs and user groups.

Reply:

The North Central Area Community Call team, wherever possible arrange transport for medical appointments etc for their callers. However seeing as the Civil Defence are now assisting the HSE with transport and a number of volunteers from the St Johns Ambulance and Order of Malta are returning to work, their availability is not as plentiful as it had been over the past year. The North Central team will endeavour to arrange transport for the older and vulnerable people seeking transport to their vaccination.

Report to Councillor. m Motion in the name of Councillor Jane Horgan Jones That this area committee asks the Manager to engage with the Department of Minister for Housing, Local Government and Heritage to resolve the urgent issue of pollution of the biosphere through inadequacy of wastewater treatment in Dublin Bay which is endangering bathing water quality on strand and off Bull Island.

Reply:

Irish Water is the owner of the Waste Water Treatment Plant and is best placed to address any queries in relation to any inadequacies at their facility or clarify what those possible inadequacies may be and any actions they may be undertaking to address them. Irish Water operate Ringsend Waste Water Treatment Plant in accordance with discharge licence D0034-01 which is regulated by the Environmental Protection Agency (EPA). Industries that discharge wastewater (typically referred to as trade effluent) to a sewer or waters, are required to obtain the relevant discharge licence in accordance with the Water Pollution Act 1977, as amended. Discharge licences ensure that effluent is treated to the highest possible standard and released in a controlled manner that protects the receiving environment. Licences are issued under Section 4 and Section 16 of the Local Government Water Pollution Act 1977, as amended. Trade effluent licences are regulated by three separate bodies namely Dublin City Council, Irish Water and the EPA. The type of licence required depends on the scale and composition of the discharge. Sampling of trade effluent is carried out as per the frequency determined in the discharge licence. Dublin City Council regularly audits compliance of results with licence conditions and takes appropriate enforcement actions as necessary under the Water Pollution Act 1977, as amended. Dublin City Council is satisfied that it carries out its regulatory responsibilities in a professional manner and in accordance with the requirements of the relevant regulations and we are not aware of any third party operating their facility outside of their own licenses. In November 2019, Dublin City Council (DCC) set up a Task Force including representatives from Irish Water, Department of Housing, Planning and Local Government (DHPLG) and Dun Laoghaire Rathdown County Council (DLRCC). The Task Force meets on a monthly basis and is working to improve water quality on Merrion and beaches and to address other issues. The Council also hosts high level meetings with EPA, HSE and DHPLG on this issue. We will of course highlight your correspondence when we next meet. The Council is working closely with UCD Acclimatize, a research project which aims to identify the main sources of pollution in Dublin Bay Area. We are also consulting with several other councils, Inland Fisheries Ireland, DCU and Local Authority Waters Programme Regional Office 11

(LAWPRO). Since the introduction of the task force, water quality at Sandymount Strand has improved from Poor in 2018, to Sufficient in 2019 and 2020. This means that the permanent prohibition was lifted and bathing is now permitted. DCC is committed to improving water quality at Merrion Strand and across Dublin’s bathing areas.

In relation to bathing waters, Dublin City Council (DCC) does monitor and report on bathing water quality all year around at six bathing areas, including Dollymount Strand and the North Bull Wall. If I may take this opportunity to outline our role in that regard; In relation to the remit of DCC and our monitoring of bathing waters, the responsibilities of a local authority are set out in the Bathing Water Quality Regulations 2008 (S.I. No. 79/2008). The Regulations require that Local Authorities monitor bathing water quality at their designated bathing waters during the bathing season which is from the 1st June to 15th September each year. There are two designated bathing areas in Dublin City Council’s jurisdiction to where the Regulations apply, namely; Dollymount and Sandymount Strands, In addition, DCC monitors the bathing water quality at four non-designated bathing areas, namely; North Bull Wall, Half Moon, Merrion Strand & Shelly Banks. DCC monitors bathing water quality on at least 20 separate occasions at each bathing area during the bathing season (regardless of designation), this is five times the legally required frequency. DCC also continues to monitor bathing water quality across all six bathing areas outside of the bathing season on a fortnightly basis. DCC makes the results of the water sample analyses available on an ongoing basis on our website and by means of on-site notices in accordance with Schedule 4 of the Regulations (Cabinets with noticeboards adjacent to the six bathing areas). During the bathing season, the water quality assessment data from the designated bathing waters is also published on the EPA hosted website www.beaches.ie. Our DCC website also provides further information as to our activities and reporting in relation to bathing water monitoring, including the recently recorded ‘excellent’ bathing water quality at Dollymount Strand. Report to Councillor. n Motion in the name of Councillor Alison Gilliland The North Central Area Committee recognises the challenges presented in the local area over the coming months with regard to the significant absence of indoor dining and other recreational activities and the focus on 12

outdoor activities. The North Central Area Committee recognises the need to prepare for such activity, in particular to minimise the level of public littering. Therefore, the North Central Area Committee recommends that areas of high outdoor footfall, particularly at local amenities and outdoor eating areas are identified and audited to ensure an appropriate level of litter bin provision and that appropriate bin emptying rotas are put in place, particularly at weekends and during good weather.

Dublin City Council is calling out to all those partaking in outdoor activity to act responsibly by using the bin to dispose of litter and where there is no bin available to please bring litter home and being part of the “Leave no Trace” Campaign. There are currently over 3,200 bins in the City Council area with an additional 70 barrel bins in place at identified litter hotspots to assist with the extra demand with 30 additional big belly bin being installed in the first half of the year. Litter levels are monitored on a continuous basis to ensure there is an appropriate level of litter bin provision. Frontline street cleaning and bin emptying staff are working around the clock in an effort to deal with all of the extra litter that is being generated by this current focus on outdoor activities.

The Parks Service has become aware of the increase in sea swimming in recent times often taking place in areas that are neither designated bathing areas nor covered by the Beach Guarding Service. There are no current proposals to increase the number of life guards, upgrade the lifeguards stations or designate new bathing areas but these matters will be monitored during the bathing season and reviewed in the context of water safety.

The Jetty and slipway at Clontarf yacht Club is provided for the launching and berthing of crafts and is not a swimming area. In the absence of byelaws restricting the use of jetskis in Dublin Bay other than in the areas covered by the Dublin Port Co. it would seem that the slipway at the yacht club could be considered an appropriate site to launch such a craft and the Council could be considered as acting ultra vires by erecting the signage requested to ban jetskis from using this public facility. Further legal advices will be sought on the use of the jetty and slipway.

It certainly would not be practical to attempt to provide facilities of lifeguards at every location where citizens choose to swim and the Council would always encourage those who wish to engage in sea swimming to do so where the Beach Guards are in attendance.

The designation of new bathing areas is a statutory and consultative process outlined under the bathing water directive transposed into Irish Legislation in 2008. There may well be a strong rationale to designate and service new areas for sea swimming and to which end the Parks Service will monitor the situation and engage with stakeholders in the coming months including Dublin Port, EPA, Irish Water, Water Safety and Water Quality Departments, Local leisure craft clubs and user groups.

Dublin City Council is implementing School Zones across the city. The School Zone treatment is designed to give priority to students at the school gate by freeing up footpaths and reducing vehicle drop-offs, pick- ups and idling. The aim is to reduce congestion and increase safety at the front of school, and prioritise active travel (walking, cycling and scooting) to and from school. School Zones aims to:  Encourage traffic to slow down in the School Zone area  Prevent parking on pavements  Encourage drivers to make drop-offs outside the School Zone area and not to stop in the School Zone area

A School Zone includes:  Line-marking stating ‘School Zone’ at either end of the area  Colourful circles on the road demarcating the front of school area  Pencil-shaped bollards on the footpath to prevent illegal parking  These design features assist in creating a safer, calmer, more attractive environment at the school gate.

We contacted all Schools in Dublin City in August 2020 inviting them to apply for a School Zone. To-date we have received 120 application. We have not received an application from St. Fiachra’s as yet but the application process remains open. We will contact St. Fiachra’s directly inviting them to apply through our online portal, https://www.dublincity.ie/residential/transportation/covid-mobility- measures/school-mobility-programme If the school applies, a site visit will be organised to determine the most appropriate intervention at this location.

Local Authorities have, since the enactment of the Road Traffic Act 1994, been required to engage in a consultation process with respect to the publication of Special Speed Limit bye laws. It is recommended that the process should commence at the earliest opportunity so that the bodies involved can make informed contributions to the overall process.

The Road Traffic Act 2004 introduced a requirement for consultation with the general public. All representations and objections relating to proposed bye-laws must be made in writing to the Local Authority. Consultation includes:

. Advertising for submission of requests for consideration . Consultation with any adjoining Road Authority in respect of roads which pass through each adjoining Authority to ensure consistency of approach. . Road Authorities must consult with An Garda Síochána in respect of all proposals relating to Special Speed Limit bye-laws. . The Road Traffic Act 2004 provides for a public consultation process in relation to the making of Special Speed Limit bye-laws.

The proposal for the Special Speed Limit Bye-Laws 2020 ( Covid 19) Phase 5 followed the above procedure, and the Dublin City Council Road Safety Section sent an email on the 01 July 2020 16:17 to Garda Síochána and adjoining Local Authority requesting their submission on the proposed proposal Special Speed Limit bye- laws 2020 ( Covid 19). The Road Safety Section didn’t receive any submission from Garda Síochána at that time.

With regard to the concept design for the proposed Special Speed Limit Bye Laws April 2021 at the Non- Statutory Public Consultation, The Road Safety Section sent an email on the 19 of April 2021 15:55 to the Garda Síochána and adjoining Local Authority requesting their submission on the proposed proposal, and no responses was received from the Garda Síochána.

Waste Management Services have attempted to make contact with the management of Shopping Centre on several occasions over the last year. However when calling in to Costcutter, the shop assistant was unable to answer any questions relating to the management of the facility. We believe Priorswood Inn is the anchor tenant but this was closed each time we called. We will endeavour to make contact with the owners of this pub to establish if they are indeed the anchor tenant with responsibility for maintenance and upkeep of the car park.

Waste Management Services personnel regularly respond to reports of illegal dumping at this location.

The fence at Kilbarrack Playground was installed and funded at the request of North Central Area Office during the summer of 2020.

The weldmesh style fencing is the same as the boundary on the all weather pitch and is suitable for such a location. The gate is to prevent scrambler style vehicles entering the greenspace and to allow for the area to be maintained by Parks staff.

The installation of speed limit signage in most areas was suspended due to Covid-19 related actions. Currently, the installation of the new speed limit signage 30 km/h has been resumed in phases for all remaining areas and is expected to be fully in place by July 2021. The Feasibility Study for Bridgefoot Street/Merchants Quay was funded by the Urban Regional Development Fund for two City Council owned buildings and a City Council owned site. In the case of Butterly Park the potential sites or buildings are privately owned. The City Arts Officer will liaise with the Area Manager to communicate with the owners of Butterly Park to establish what interest they may have in Artists Workspaces whether by rental or sale or whether a site exists that could be acquired for redevelopment as an Arts Facility. We are currently awaiting a delivery of new litter bins to replace these damaged bins. If the councillor has any specific locations in mind, she can email them to me and I will ensure that they are replaced as soon as possible.

It is understood that these areas come under the remit but a detailed title search can be carried out to ascertain the full legal position. These areas act as de-facto wildlife refuges and connectivity corridors and provide a level of noise abatement and screening whether this was the original intent or not. While the Parks Service have no objection in principle to suitable sections of these areas being adopted by community or residential groups careful consideration would have to be given to the precise locations and proposed usages. It would be of the utmost importance to ensure that all residents that might be impacted upon and suddenly exposed to traffic noise or the loss of screening are agreeable. Furthermore any impacts on biodiversity and loss of wildlife corridors or connectivity would have to be considered in the context of biodiversity objectives. Also condition of the tree and the safety of these areas for public use might be a limiting factor here.

The plot of ground (A) was included as part of Ref. 7 of the Dublin County Borough (Drumcondra Clontarf New Road) Order 1928. While the plot between the railings and the roadway was acquired and is under the control of Parks Division, there is no record in the Council’s Property Register of the portion between railings and the concrete wall ever having been acquired by the Council. The plot is unregistered in the Land Registry.

The plot of ground (C) was initially considered for inclusion in the Compulsory Purchase Order but according to the Property Register it was excluded from the confirmed Order. The land between the railings and road is in Council Ownership but the land south of the railings at Beresford Estate is not. This plot is also unregistered in the Land Registry and Dublin City Council has no record of who the owner(s) of this or the part of plot (A) mentioned above may be.

The map with the current bye-laws - as supplied to us by DCC in March of this year - indicates that the entirety of Seafield Road is 50kmph and there is no marking to indicate that the reduced speed limit applicable to schools applies in this area.

If you approach from Castle Ave the speed limit is signposted as 30. If you approach from Vernon Ave it is not signposted indicating no change in speed limit i.e. 50km from Vernon Ave or 50km from Seafield Road West. Our view has always been that the section of Seafield Road in the vicinity of the schools should always have been 30km even if only at school times similar to how St Brigids on the Road is treated.

It would be useful to have clarification on this matter and to have the signage rectified to indicate the correct legal position”

Under the current Dublin City Council’s Bye-Laws adopted in the January 2020, the existing speed limit at Seafield Road Speed are as follows:

 From the junction of Castle Avenue to Vernon Avenue, Seafield Road West speed limit is 30 km/h. Therefore, the schools Belgrove Girls School and Belgrove Junior Boys are located on a 30 km/h.  From the junction of Clontarf Road to Vernon Avenue, Seafield Road East speed limit is 50 km/h.

Reply: . The Parks Service has become aware of the increase in sea swimming in recent times often taking place in areas that are neither designated bathing areas nor covered by the Beach Guarding Service. There are no current proposals to increase the number of life guards, upgrade the lifeguards stations or designate new bathing areas but these matters will be monitored during the bathing season and reviewed in the context of water safety.

The Jetty and slipway at Clontarf yacht Club is provided for the launching and berthing of crafts and is not a swimming area. In the absence of byelaws restricting the use of jetskis in Dublin Bay other than in the areas covered by the Dublin Port Co. it would seem that the slipway at the yacht club could be considered an appropriate site to launch such a craft and the Council could be considered as acting ultra vires by erecting the signage requested to ban jetskis from using this public facility. Further legal advices will be sought on the use of the jetty and slipway.

It certainly would not be practical to attempt to provide facilities of lifeguards at every location where citizens choose to swim and the Council would always encourage those who wish to engage in sea swimming to do so where the Beach Guards are in attendance.

The designation of new bathing areas is a statutory and consultative process outlined under the bathing water directive transposed into Irish Legislation in 2008. There may well be a strong rationale to designate and service new areas for sea swimming and to which end the Parks Service will monitor the situation and engage with stakeholders in the coming months including Dublin Port, EPA, Irish Water, Water Safety and Water Quality Departments, Local leisure craft clubs and user groups.

Reply: . The large sycamore was inspected and assessed by Dublin City Tree Officer. The tree is hollow and removal is recommended within 6 months and a replacement tree will be provided during next planting season if ground conditions allow.

Tree number 2 was also assessed. There is a significant amount of dieback in the canopy, possibly due to some roots damages. It is recommended to remove the dead branches within 6 months and to monitor the tree.

Reply: . The Dublin City Development Plan 2016-2022 provides a comprehensive and coherent spatial framework to guide the development of our city, and includes a schedule of Local Area Plans and Local Environmental Improvement Plans.

Santry/Whitehall is not identified in the current Development Plan schedule of LAPs. The new draft Plan will include a schedule of LAPs for approval and prioritising by the City Council.

There have been 41 Strategic Housing Development Permissions granted by ABP to date across all areas of the City; 9 have been refused Permission and 6 are subject to Court Proceedings. These permissions have the potential to provide almost 11,000 apartments.

In view of the ongoing housing crisis, it is not considered appropriate to halt development until a LAP/Masterplan is in place. Rather, the City Council will continue to work with all Agencies, including Irish Water and the Department of Education & Science to address infrastructure deficits in order to provide for a more sustainable compact City.

Dublin City Council are committed to the promotion of high quality design, and all schemes are subsequently assessed by the Planning Department of Dublin City Council during the Part 8 Process, in order to ensure that any proposed development is done in the interest of the proper planning and development of the area in which it is located.

It should be noted that there is precedent for a three story development opening onto Slademore Avenue at St. Paul’s Court, some 100 meters from the subject site. The currently proposed scheme of 35 units of age friendly housing is two storey where it meets the existing houses to the south of the site, and all three storey elements face onto the gable walls of adjoining homes, or directly onto Slademore Avenue.

Ayrfield Park is located some 60 metres from the subject site, however Dublin City Council are willing to discuss the potential to enhance green spaces to the North-West of the site, Ayrfield Park, the proposed open spaces associated with the subject scheme, and any other spaces adjoining the proposed development.

Due to the number of homes proposed and the expected demographic of the future tenants, the requirement for car ownership/parking is not expected to have an adverse effect on the existing traffic conditions in the area. This will be reviewed as part of the Part 8 Application and assessment process by the Planning Department of Dublin City Council.

It has been brought to my attention that elderly residents are unable due to safety fears to cross the cycle track to access the promenade and wooden bridge. Both cyclists and pedestrians get the green light at the same time for the crossing at the Bull bridge and the speed and frequency of approaching cyclists is prohibitive for pedestrians crossing and measures need to be undertaken to ensure safe crossing”

Reply: . Rumble strips and slow down road markings were marked on the ground to inform the cyclists that they are entering into a shared space. We will put additional rumble strips to reinforce the need to slow down.

The pedestrian signals crossing the roadway at the entrance to the Bull Wall Bridge are known as ‘Toucan’ signals. A Toucan Crossing is designed for both pedestrians AND cyclists to cross at the same time, hence "Two-can" crossing, or "toucan" crossing. Toucan crossings are commonly used across the city and many other cities and towns throughout Ireland. In areas where Toucan crossings are used the width of the crossing is increased from a standard to 2.4m to 4m to allow sufficient space for pedestrians and cyclist to cross at the same time.

In order to reduce the wait time for pedestrians the junction in question currently operates with a maximum cycle length of 80s (the cycle length is the time required for all movements in the junction to operate, if demanded e.g all pedestrian/cycles and vehicles movements). In order to allow sufficient time for the green and amber man for the pedestrian to operate the Toucan phase is allocated 25s each cycle. To allocate a further a separate time to a unique cyc le phase would not leave sufficient timings to service all the required movements in the junction.

In relation to the cycle track at Vernon Ave / Clontarf Rd, pedestrian signals do not control crossing of this cycle track, however that section of the cycle track is clearly marked with cyclist Yield signs and signs indicating a shared pedestrian / cyclist’s area.

While such criminality is primarily a matter for the Gardaí the Parks Service did meet with local Gardaí who have advised of the intention to increase patrols in the area. The Gardaí did request that consideration be given in the medium to longer term to the installation of cctv at the entrances to the park. This is not something that is normally considered by the Parks Service as staff are not available to monitor same. The Gardaí have indicated that the images could be fed to the local Garda Station. To this end consultations will be held with the area office and Gardaí to ascertain the feasibility of this suggestion with regard to infrastructure, data legislation and if this can be achieved in the context of future budget allocations.

A number of public consultation options were discussed with the North Central Area Committee at an online meeting which took place on 21st April, including the following: 1. To meet directly with the residents directly adjoining the proposed development to inform them about the scheme, and gather feedback to inform the designs. This should also include the management of the adjoining St Paul’s National School. 2. To circulate the scheme proposals to the public via the DCC consultation Hub and other social media. This information to be promoted by the local councillors through their own channels. Feedback forms to be made available to interested parties for return to DCC. 3. Paper copies of the scheme proposals should also be made available through the area office for those with technical, connectivity or other issues. 4. An online session/sessions could be held to allow interested parties to engage with the DCC team, in order to give comments and feedback regarding the development proposals. 5. A proposal was made to mount an exhibition in Ayrfield community centre, where people could attend to view physical copies of the scheme proposals and provide feedback. This will have to comply with Covid 19 restriction regarding protective distancing etc., and would most likely need to be by appointment only. 6. A suggestion was made to defer consultation until full in-person sessions could be carried out. This was however rejected on the basis that this would introduce an unacceptable delay to the planning and construction timelines.

It is now proposed to immediately action point’s number 1, 2, 3, and we are also investigating the issues surrounding point number 4 regarding technical and any potential GDPR issues.

Further consideration of the issues surrounding point number 5 are required and we will report back to the NCAC in due course regarding the practicality of same.

Point number 6 is noted only.

It should also be noted that upon submission of the Part 8 Application, all parties will have the opportunity to submit observations on the scheme proposals for consideration by the Planning Department in the assessment of the suitability of the proposed scheme.

Dublin City Council has committed to 5% of all newly constructed housing units to be adapted for applicants with a physical disability. 10% of Allocations to social housing tenancies are to households where a member of the household or the main applicant has a disability. Applicants must be eighteen years of age to be eligible for the social housing waiting list in their own right.

Planning permission was granted for a Strategic Housing Development proposal to construct 124 no. apartments at the Bonnington, (formerly Regency Hotel), Swords Road, Whitehall, Dublin 9 under DCC ref. SHD0002/20 & ABP ref. 306721-20.

There is no condition relating specifically relating to potential knotweed or other invasive species, however, the permission included an archaeological condition as follows:

20. The developer shall facilitate the preservation, recording and protection of archaeological materials or features that may exist within the site. In this regard, the developer shall: (a) notify the planning authority in writing at least four weeks prior to the commencement of any site operation (including hydrological and geotechnical investigations) relating to the proposed development, (b) employ a suitably qualified archaeologist who shall monitor all site investigations and other excavation works, and (c) provide arrangements, acceptable to the planning authority, for the recording and for the removal of any archaeological material which the authority considers appropriate to remove. In default of agreement on any of these requirements, the matter shall be referred to ABP. Reason: In order to conserve the archaeological heritage of the site and to secure the preservation and protection of any remains that may exist within the site.

The final grant date for this development was the 21st September 2020 and no compliance details have been submitted to date. Under the Dublin Regional Enterprise Development Plan 2020, the Economic Development Office (EDO) of Dublin City Council conducted a survey of Enterprise Space provision across Dublin city and the Dublin region in late 2019. All results were collated into a final report which was completed in December 2019; provided to our Economic Development & Enterprise Strategic Policy Committee (SPC) in February 2020 and published following the SPC meeting. Meetings were held with our colleagues in Planning in March 2020 to review these results in line with the LAP for the area and in advance of URDF application submissions.

The Economic Development Office are currently preparing a follow-up survey on: hubs* in Dublin City and region, their contribution to the entrepreneurship and innovation ecosystem and economic development, and on the impact that the COVID-19 pandemic and associated economic crisis has had on them. The survey will be conducted in Qtr. 2 2021 and a report will be published in Qtr. 3 2021.

This updated report would be beneficial to area committees in showing the significant impact of Covid 19 and remote working on Enterprise Space provision across various locations.

EDO would welcome the sharing of information from any further research into Enterprise Space provision carried out by the local areas.

The Local Enterprise Office supports and services are available to all businesses across each area of Dublin City, including Clongriffin and the LEO is fully available to support business and enterprise in the area. 30 km/h Slow Zone sign, Sign F 403, may be used on Housing Estate roads where there is a 30 km/h Speed Limit and where a Slow Zone has been established in accordance with the guidance set out in Guidelines for Setting and Managing Speed Limits in Ireland published by the Department of Transport, Tourism and Sport. Traffic Signs Advice Note provide guidance to Local Authority staff in the use/employment of the Slow Zone sign. This manual explains that this sign should be used at entry points to housing estates where a 30 km/h speed limit is being implemented and a ‘Slow Zone’ is being created. Therefore, to avoid the proliferation of signage extra signage, it is not recommended and additional 30 km/h signage at this location.

Kincora road is currently traffic calmed with a number of speed ramps / cushions placed at the appropriate distances apart for optimum traffic calming and comply with the current standard. Reply:

The Area Engineer has reported that the minimum requirements for the installation of ramps have not been met with regard to straight road length and traffic volume.

A previous site inspection did not indicate the presence of excessive speeding on Brookwood Crescent.

For the most part, there is on-street parking which effectively acts as a traffic calming measure by physically narrowing the carriageway and reducing drivers’ forward visibility.

In addition, Brookwood Crescent is covered by the 30 km/h Slow Zone sign, indicating the lower speed limit and that the area is a Home Zone/Slow Zone, which warns motorists that it is a residential area and to expect children.

In relation to road closures, Dublin City Council only recommends road closures and one-way systems in exceptional circumstances, as they can have considerable drawbacks associated with them including:

• Operational difficulties for emergency services, waste disposal and delivery. • Considerable inconvenience to local residents and other road users due to diverted traffic. • Increased volumes of traffic on other local streets as traffic is displaced. • Increased traffic speeds. Therefore, it is not advised to turn Brookwood Crescent into a cul de sac.

The laneway in question is ‘in charge’ of Dublin City Council which means there is a statutory public right of way over it. In order to extinguish the public right of way the resident’s in house numbers 11 & 15 on the Road of (details supplied) (the only properties abutting the laneway) will need to submit an official application to the Executive Manager, Dublin City Council, North Central Area Office, Northside Civic Centre, Bunratty Road, Coolock, Dublin 17. The application should include the following:  A signed petition from homeowners of 11 & 15 on the road of (details supplied)  The reason for requesting closure.  A map of the location highlighting where they propose to erect the gates/walls.  A statement as to how the laneway will be maintained in the future by the fee simple owner of the ground and/or the adjoining owners/occupiers and how access will be provided for any private right of way, and to any public services – E.S.B, Gas, Water, Drainage etc. that may exist on or under the laneway if these services are not diverted at the proposers expense.  Commitment from residents to undertake the cost of closure and the future maintenance of the laneway, which includes the cost of diverting services if they exist in the laneway.

An extinguishment of a public right of way is a statutory procedure, which must be published, there is a right of objection by local residents and members of the general public, who may not agree with the proposal and these objections must be considered by the City Council even to the extent of hearing the views of both proposers and objectors at an Oral Hearing should the need arise. The extinguishment of a public right of way is a reserved function of the City Council.

The ACFO in charge of operations is in the process of drafting an emergency response plan for Dublin Fire Brigade for incidents on Bull Island, Dollymount. The plan has been drafted in consultation with other emergency services, in particular the Irish Coast Guard. The aim of the plan is to assist in rapid deployment and co-ordination of the resources needed to help mitigate the effects of an emergency incident on Bull Island.

The following agencies were consulted in the preparation of the plan:

Dublin Fire Brigade are satisfied that we can deal with an incident at the cottages or the scout Den. The Sports Section have been monitoring use figures for Clontarf Sports Pitches and they are as follows:  Week 26th April to 2nd May – 17 total users  Week 3rd May to 9th May – 18 total users

Despite much media coverage and these toilets appearing on several Apps and websites these numbers are disappointingly low.

The tender for the provision of public conveniences in conjunction with retail units closed on Friday 14th May. It is hoped this tender will provide additional facilities in the North Central Area.

Cluid Housing are now in full ownership of this apartment complex and tenants have taken up occupation of their new homes.

Reply:

Clongriffin is only half built with another half to go so it is hard to see the full impact of all the facilities in place. Fr. Collins Park is Ireland’s first wholly sustainable park, wind turbines provide electricity to the park. The extensive landscape in Fr. Collins Park offers excellent walking/running trails for all ages. The Train Station Park and Ride is an excellent facility for the community. The construction of the Hole in the Wall Rd/Mayne Road junction update which commenced in 2020 has been designed to incorporate the Bus Connects-Core Bus Corridor No. 1 from the City Centre to Clongriffin Train Centre.

Adjacent to the Train Stations is Civic Square which is ideal for small events and outdoor exhibitions, which features a performance area, ambient lighting and integrated terrace stone block seating.

There is a very good community spirit in Clongriffin with many clubs and groups who access both the Hub, 60 Main Strret and the Junction Community Centre, 11 Station Square for various activities such as: Dance, martial arts, Mother & Toddler Groups, Scouts, Dog training, Drama, Yoga, Weight Watcher classes. The Hub also hosts parties and social events for the community. These two community facilities are a joint initiative between Gannon Homes and Dublin City Council and provide a free, bookable community space with lots of family activities to the community in Clongriffin.

There is a wide range of retail and dining amenities and Gannon Homes are actively seeking/negotiating with prospective tenants for vacant units. CRC Day Care Centre will be moving into 1 Station Street and Clongriffin Medical Centre situated at 17 Main Street hope to soon be in a position to provide dental services.

Reply:

1. Response: There is precedent for a three story development opening onto Slademore Avenue at St. Paul’s Court, some 100 meters from the subject site. The currently proposed scheme of 35 units of age friendly housing is two storey where it meets the existing houses to the south of the site, and all three storey elements face onto the gable walls of adjoining homes, or directly onto Slademore Avenue.

2. Response: Ayrfield Park is located some 60 metres from the subject site, however Dublin City Council are willing to discuss the potential to enhance green spaces to the North-West of the site, Ayrfield Park, the proposed open spaces associated with the subject scheme, and any other spaces adjoining the proposed development.

3. Response: As part of the design process Dublin City Council typically carries out a shadow analysis of any proposal in order to assess the potential impact of overshadowing on any adjoining buildings or spaces. We are willing to share the results of this analysis when completed.

4. Response: Due to the number of homes proposed and the expected demographic of the future residents, the requirement for car ownership/parking is not expected to have an adverse effect on the existing traffic conditions in the area. This will be reviewed as part of the Part 8 Application and subsequent assessment process by the Planning Department of Dublin City Council.

5. Response: Area impact studies of this nature, are typically not required for a development of this scale. Dublin City Council will review the requirement for same with their design team. If there are specific areas of concern however, we would be happy to meet with you to discuss these further.

Alternative Proposal: Dublin City Council are committed to the promotion of high quality design, and all schemes are subsequently assessed by the Planning Department of Dublin City Council during the Part 8 Process, in order to ensure that any proposed development is in the interest of the proper planning and development of the area in which it is located.

The community facility was included in response to the zoning requirements on the site, and to add a further resource and amenity to the proposed development and the wider community. We will review the requirement for the proposed community facility in conjunction with our design team and the Planning Department.

Reply:

A developer is responsible for complying with all relevant conditions when a permission is implemented. Some permissions in the Clongriffin area have lapsed and some permissions have not been implemented to date. Planning enforcement will investigate if there is concern that a development has not been implemented in accordance with the relevant permission and associated conditions.

Two separate concurrent SHD permissions were granted for the development of most of the remaining Clongriffin town centre lands under DCC Ref: SHD 0015/19(SHD1) & SHD0016/19(SHD 2) & ABP Ref: 305316-19(SHD1) 305319-19(SHD2). The developer has not indicated when it is intended to commence development. The developer can implement either permission up until early 2025 when both permissions expire.
