Date: Friday, March 2, 2012 Time: 9:00 a.m. Place: Roughrider Room, State Capitol, Bismarck Agenda: Presentations by representatives of the North Dakota University System regarding the internal review report of international transfer agreements at Dickinson State University, an update on the status of the University of North Dakota Fighting Sioux nickname and logo lawsuit, an overview of the 2010 Accountability Measures Report, and enrollment and student fee information; by a representative of Dickinson State University regarding the internal review report of international transfer agreements and future implications for the institution; by the Legislative Council staff of memorandums regarding constitutional and statutory provisions of the State Board of Higher Education, higher education governing and coordinating boards in other states, and previous higher education accountability measures adopted by the Legislative Assembly; and other presentations and testimony by interested persons regarding the committee's study of higher education Special Note: Anyone who plans to attend the meeting and needs assistance because of a disability should contact the Legislative Council staff as soon as possible. OBERGEFELL V. HODGES STUDY Chairman Hogue said the United States Supreme Court in Obergefell v. Hodges found that the 14th Amendment of the United States Constitution provides the right for same-sex couples to marry. He said the committee should determine whether the Constitution of North Dakota and applicable statutes should be amended to reflect the new constitutional right. Chairman Hogue called on Mr. Doug Bahr, Director of Civil Litigation, Attorney General's office, for testimony regarding the impact of the Obergefell v. Hodges decision. Mr. Bahr said he handled the two federal lawsuits challenging North Dakota's definition of marriage as used in North Dakota Century Code Sections 14-03-01 and 14-03-08, which were declared unconstitutional in June 2015. He said one of the lawsuits brought against North Dakota involved seven same-sex couples, some of whom wanted to be married in North Dakota and some of whom wanted their marriages to be recognized in North Dakota.

The Street Utility Fee would replace the current City policy of utilizing special assessments as revenue for street maintenance projects with an alternative funding source such as a street utility fee. The update detailed the scope of work the City is currently undergoing with AE2S Nexus staff to begin the process of incorporating the street utility fee.
