Introduction In 1837, Swiss cartoonist Rudolphe Töpffer found several publishers in Europe willing to publish and release his newest literary creation: a story with accompanying pictures. 2 On September 14, 1842, this story made its way across the Atlantic after John Neal, the publisher of New York newspaper Brother Jonathan, ran an English-language version of the story in his newest issue. 3 Featuring the tales of Mr. Oldbuck failing to woo a woman known to the reader as his “ladye-love,” this tale represents the first recorded publication of a comic book in the United States. 4 While several other publications resembling a comic book followed Mr. Oldbuck over the passing decades, the true comic book superstars first showed up in the late 1930s. 5 The June 1938 issue of Action Comics No. 1 revealed the Man of Steel, Superman, to the world. 6 Just one year following Superman's *362 introduction to the American public, Batman made his heralded debut in Detective Comics No. 27. 7 The appearance of characters such as Batman and Superman captivated millions of Americans, and a new massive entertainment industry was born. Without counting the hundreds of millions of dollars earned by comic book-based movies each year, the domestic sales of comic books and graphic novels reached an all-time high of nearly one billion dollars in 2013.

Id. Petitioners, the children of the acclaimed comic-book artist/creator Jack Kirby (The Fantastic Four, X-Men, The Mighty Thor, The Incredible Hulk, etc.), served statutory notices of termination on the Marvel respondents regarding the key works Kirby authored as an independent contractor in 1958-63. Section 26, the “work for hire” provision of the 1909 Copyright Act, applicable to pre-1978 works, states simply: “The word author shall include an employer in the case of works made for hire.” For six decades, including in 1958-63, “employer” was duly given its common law meaning, and “work for hire” applied solely to conventional employment, not to independent contractors like Kirby. It follows then, in 1958-63 Kirby was the original owner of the copyrights to the works he authored and subsequently assigned to Marvel, and his children have the right to recapture his copyrights by termination of such assignments under 17 U.S.C.§304(c).

    THE JOHN MARSHALL REVIEW OF INTELLECTUAL PROPERTY LAW THE CONSISTENTLY INCONSISTENT "INSTANCE AND EXPENSE" TEST: AN INJUSTICE TO COMIC BOOKS THOMAS M. DEAHL II ABSTRACT Joe Simon once said that “we always felt, we wuz robbed.” He is not alone. This article will discuss Jack Kirby’s estate’s case against Marvel and how the current state of the law robs creators of the rights to their own works. The evaluation of case law will show that the application of the ‘instance and expense’ test creates an injustice of inconsistent results in litigation, where creators attempt to regain control of their works. If the court continues to inconsistently apply the law to these work-for-hire cases, then the Supreme Court or Congress needs to address the intended purpose of this section of the Copyright Act. As this article will address, it is troubling to see a continuous strain of inconsistent decisions coming from our court system.
