STATEMENTS BY MINISTERS

1. SHRI SUSHILKUMAR SAMBHAJIRAO SHINDE to make a statement regarding status of implementation of recommendations contained in the Eighteenth, Twentieth, Twenty-first and Twenty-second Reports of the Department-related Parliamentary Standing Committee on Energy. 2. SHRI P. CHIDAMBARAM to make a statement on ‘Reconciliation of Revenue and Fiscal Deficits as in Finance Accounts 2006-07 and Accounts- at-a-Glance/Budget-at-a-Glance’; and 3. SHRI B.K. HANDIQUE to make a statement regarding status of implementation of recommendations contained in the Eighteenth Report of the Department-related Parliamentary Standing Committee on Chemicals and Fertilizers. ______

SHORT DURATION DISCUSSION

REPLY to the discussion on the situation arising out of the misuse of funds provided by the Central Government under the National Rural Employment Guarantee Programme, raised by Shri V. Narayanasamy on the 5th December, 2007. ______

(FROM 2-30 P.M. TO 5-00 P.M.) PRIVATE MEMBERS' BUSINESS (RESOLUTIONS)

FURTHER DISCUSSION on the following Resolution moved by Shri Shantaram Laxman Naik on the 23rd November, 2007:— “Having regard to the facts that – (i) an era of coalition Governments at the national and states has crept in; (ii) Indian political scenario is not likely to change substantially in this respect in near future; (iii) there is no mechanism at present which can effectively find solutions to the problems which arise out of coalition form of Governments; and (iv) there is a need to ensure that the nation does not suffer on account of delays, uncertainties under such dispensations; this House resolves to constitute a Committee for the purpose of recommending amendments to the Constitution by way of adding a new chapter on the governance of coalition governments providing 211 for the powers, duties and responsibilities of coalition partners, and for providing a code of conduct in the matters where constitutional provisions may not be practicable.”

1. SHRI V. NARAYANASAMY to move the following Resolution:—

“Having regard to the fact that– (i) the Government has announced setting up of Special Economic Zones in various parts of the country for developing industrial base for generation of employment, productivity and developing the rural areas through industrial infrastructure.; (ii) in several states, areas have been identified and the Government have given permission for setting up of industries in the Special Economic Zones announcing a lot of concessions for those industries; (iii) the problems being faced by the farmers whose lands are acquired for setting up Special Economic Zones have not been addressed properly; (iv) there are agitations in various parts of the country by farmers on the acquisition of the land for SEZs; (v) there are no job opportunities for the children of the farmers whose lands are acquired; and (vi) due to the SEZ policy, landowners are becoming landless labourers,

this House urges upon the Government to look into the problem faced by the farmers whose lands have been acquired for Special Economic Zones and to take the following remedial measures: -

(a) the Government should intervene in the acquisition of the lands in Special Economic Zone by the industrialists; (b) the Government should ensure adequate compensation to the farmers when the lands are taken over for Special Economic Zone; and ( c) employment opportunities should be provided to the farmers’ family members in the Special Economic Zone for their livelihood and to sustain their standards of living.” 2. DR. (SHRIMATI) NAJMA A. HEPTULLA to move the following Resolution:- “Having regard to the fact that– (i) the Rajya Sabha, as one of the constituents of Parliament, has led to the consolidation of our democratic ethos and has played a pivotal role in social engineering; (ii) both in terms of volume and content of legislation and the time devoted to the transaction of business, the Rajya Sabha has scrupulously adhered to its constitutional role; (iii) the Rajya Sabha is the Council of States wherein 229 members are elected by the elected Members of Legislative Assemblies of the States by proportional representation; (iv) being a representative body of States, it is incumbent upon the Rajya Sabha to discuss certain matters pertaining to States; and

212 (v) in view of the complexities in governance, jurisdiction of States and the Centre in many matters is overlapping, this House resolves that –

(a) there is a need for change in the role of Rajya Sabha in the Parliamentary set up. (b) matters concerning atrocities on women, children, farmers and Scheduled Castes and Scheduled Tribes, violation of human rights, land reforms, terrorism, naxalism, health and education pertaining to States be allowed to be discussed in the Rajya Sabha.”

3. SHRI JAI PARKASH AGGARWAL to move the following Resolution: —

“Having regard to the fact that, - (i) organizing Commonwealth Games in 2010 is a matter of prestige not only for but for the whole of the country; (ii) the time of organizing Commonwealth Games is coming closer, but many important projects related to these Games are still pending due to objections from various departments; (iii) emergence of such objections at this point of time will have an adverse effect on the completion of projects; (iv) even plans of some projects have not been finalized which, if further delayed, will be difficult to accomplish; (v) Commonwealth Games Federation (CGF) has also expressed concern over the slow pace of preparedness; (vi) there is a huge shortage of hotels required for Commonwealth Games as more than ten thousand hotel rooms of high standard have to be arranged within next two and half years; and (vii) pollution will directly affect the performance of athletes during games,

this House urges upon the Government to take necessary steps for accomplishing all the tasks in time by – (a) accelerating the preparedness for the Commonwealth Games; (b) fostering proper coordination between the organizing committee and all the government agencies while making plans; (c) appointing professionals for completion of projects; and (d) reducing pollution level in NCT of Delhi.”

4. SHRIMATI SUSHMA SWARAJ to move the following Resolution:-

“That this House expresses its serious concern over the delay in implementing the demand for the formation of a separate Telangana State in Andhra Pradesh and urges upon the Government to take appropriate steps for creation of the State of Telangana.”

SHRIMATI BRINDA KARAT to move the following Resolution:- “Having regard to the fact that:- (i) the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 of Parliament was notified in the Gazette on the 2nd January 2007; (ii) the Act has not come into force so far as the rules have not been notified yet; (iii) despite the non-notification of the rules, Ministry of Environment and Forests is implementing a part of the Act viz., section 2(b) regarding identification and notification of “critical wildlife habitat”, while other Sections of the Act remain unimplemented; (iv) because of non-implementation of the Act in totality, tribals and forest dwellers are being displaced from their dwelling places in the forest areas in some states; and (v) implementation of a part of the Act, ignoring major operative part of the Act as stated in its preamble as well as violating the sequential implementation of the same, are violation of the letter and spirit of the Act,

this House resolves that the Government immediately notify the rules to implement the Act so that the recognition and vesting the forest rights and occupation in forest land in forest dwelling Scheduled Tribes and other traditional forest dwellers, who have been residing in such forests for generations but whose rights could not be recorded, are done without any further delay.”
