Welcome to Kenya Association of Manufacturers’ (KAM) Wins Brief for 2016. This annual publication seeks to enlighten you on the achievements we have made on behalf of the KAM Membership in the past one year. The Association has over the years worked towards ensuring that we give you, our members, world-class services that will ensure that organisations achieve profitability in their businesses.

This year saw us win big on issues that have long hindered our ability to do business competitively, and although not all our battles were won, we remain proud and happy to have made this a better business environment. Change of Guard: Flora Mutahi takes over as the chairlady of the KAM board

Ms. Flora Mutahi took over as the new Chairperson of the Kenya Association of Manufacturers board of directors, for a two-year term on 21 July 2016. Ms. Mutahi is the first woman to Chair the Association’s board since its inception in 1959. She is the founder and CEO of Melvin Marsh International.

Ms. Mutahi’s vision will continue to drive Kenya’s vision of becoming a middle income country by 2030, with focus on KAM playing a prominent role in opening up Intra-African trade; nurturing the promise and potential of our SMEs; leveraging counties as the champions of economic growth for Kenyans and promoting the ease of doing business.

Ms. Flora Mutahi shall focus on three key tenets; Engage - continued engagement of key stakeholders, Entrench – laying the groundwork for stronger policies to guide the growth of industry and Expanding linkages and market opportunities to grow our export markets especially for SMEs.

The new Vice Chairman is Mr. Sachen Gudka who is the Chief Executive of Skanem Interlabels Nairobi Limited and has been serving as KAM Director.

WIN: KAM hosts the Inaugural Kenya Manufacturing Summit & Expo

KAM in collaboration with Ministry of Industry, Trade & Cooperatives and UNIDO launched the inaugural Kenya Manufacturing Summit & Expo on 17th November 2016, an event graced by Cabinet Secretary Ministry of Industry, Investment and Cooperatives, Mr. Adan Mohamed.

Under the theme ‘Growth Opportunities in Kenya Manufacturing Sector’, with over 100 exhibitors and over 1000 participants, the three-day Expo and Summit promoted business partnerships and identified binding constraints

The annual event also sought to improve the global competitiveness of locally manufactured products which will enhance Kenya’s industrial statistics and increase employment opportunities. Policy Research and Advocacy The Policy Research and Advocacy Unit leads on our work with advocacy, engagements with Government and representation in Kenya, the EAC and in the region where decisions affecting Kenyan business are made. This year, KAM continued to focus on addressing issues with regard to the cost of doing business, market expansion and reduction of regulatory burdens that affect business. The environment in which businesses operate in is highly regulated and one of KAM’s main objectives is to ensure that the business environment remains competitive by providing services that ease this burden.

Meetings with Government Executives We need to maintain good and working relations with the executive as a way to ensure good policy and to this end the KAM Board members and KAM members together with the secretariat had several meetings with the Government at various levels as highlighted below. Further the KAM board had periodic meetings with the Cabinet Secretary for Ministry of Industry, Trade and Cooperatives during which strategic issues requiring mutual cooperation were presented for his Ministry to address. Other members of the executive that we engaged include Cabinet Secretaries and Permanent Secretaries and other key officials from the following:

WIN: Celebrating the 2016/2017 Budget Outcomes

On 8th June 2016, Mr. Henry K. Rotich, the Cabinet Secretary (CS) National Treasury tabled a 2.3 trillion budget to Parliament. The 2016/2017 budget addressed a good number of concerns that KAM raised through the National Treasury and the Ministry of Industry, Trade and Cooperatives. About 70% of the proposals that KAM presented to government in this year’s budget were addressed.

Some of the proposals that were adopted include; increase of import duties on iron and steel products, fishing nets, oil and petrol filters, smart cards and milk cans. This was done to support the local industry. Remission of duty was also granted to manufacturers of matches and match boxes, trigger spray and lotion pumps, solar equipment, industrial sugar and automobile leaf springs. WIN: KAM Launches MPA 2016

KAM launched its Manufacturing Priority Agenda (MPA) 2016 on March 7, 2016 at an event graced by Mr. Adan Mohamed the Cabinet Secretary Ministry of Industry, Trade and Cooperatives. The MPA themed ‘Promoting Industry for Shared Prosperity” is a concise guide on the most burdensome challenges facing Industry. The priority areas will be driven under five key pillars: General Policy Framework, Ensure a level playing field, Competitive Local Manufacturing, Make Kenya a manufacturing hub for Exports and Securing the future of Industry.

WIN: Development of the Commercial Law Guide Book Fast Tracked

Kenya Association and Manufacturers (KAM) has partnered with the Judiciary through the Kenya Magistrates and Judges Association (KMJA), to develop a commercial law guide book. The guide book, will provide simplified information on the judicial process addressing commercial disputes. A Core team, led by Justice Fred Ochieng, Presiding Judge of the Commercial and Admiralty Division is made up of KAM and KMJA representatives, are responsible for spearheading the development of the publication.

During the year the Guide Book underwent stakeholder validation with engagements held in several regions in the country such as Nairobi, Mombasa, Kisumu, Nyeri, Eldoret and Nakuru. In addition, key government institutions have also been engaged on the publication who include, the Kenya Bureau of Standards (KEBS), Kenya Revenue Authority (KRA), Kenya Industrial Property Institute (KIPI) and the Anti-Counterfeit Agency (ACA).

WIN: KAM Signs the Comprehensive Collaboration Framework on Administration of Justice within the context of Devolution

On March 10, 2016, Kenya Association of Manufacturers (KAM) and the Council of Governors (COG) signed a Comprehensive Collaboration Framework on Administration of Justice within the context of Devolution. The signing ceremony took place during the NCAJ-COG annual conference. Through the signing, KAM and COG agreed to partner and promote industrialization and investment at the counties among other things.

WIN: The draft operational manual for the court annexed mediation stakeholders forum

KAM participated in the stakeholder forum for the draft operational manual for the court annexed mediation program. The court annexed mediation program is a program under the judiciary that will take 6 months in the commercial division. The program has already began and there are mediations taking place. So far there are 75 mediators accredited and more are still being accredited.

WIN: EAC Manufacturers Network Chairmen meet to deliberate on integration issues

The East Community (EAC) Manufacturers Network Chairmen met in Arusha, on January 29, 2016 to discuss and firm up a sustainable mechanism to conduct affairs within the EAC calendar of activities as far as the manufacturing sector in the EAC region is concerned.

The Network is made up of the Manufacturers Associations from all the five (5) EAC Partner States: Burundi Manufacturers Association (AIB), Kenya Association of Manufacturers (KAM), Association of Manufacturers (RAM), Confederation of Tanzania Industries (CTI), Manufacturers Association (UMA)

ADVOCACY: KAM participates in the Private sector dialogue on the Tripartite Rules of Origin KAM participated in several Private sector dialogue on the Tripartite Rules of Origin that were aimed at Harmonizing and developing a common private sector position on the proposed Tripartite Free Trade Area rules of origin for increased market access.

WIN: KAM pays a courtesy call to the Principal Secretary, Trade

On January 22, 2016, KAM paid a courtesy call to the Principal Secretary for Trade, Dr. Chris Kiptoo. The purpose of this meeting was to welcome Dr. Kiptoo to his new mandate and more importantly to point out areas of concern to local manufacturers which will need immediate intervention from​ his Ministry. KAM raised issues pertaining to VAT Refund, EP​ A, Special Status Agreement between Kenya and among others. Dr Kiptoo made mention of his first 100 days strategy while in office and was glad to note that a number of the issues raised by KAM were captured in this strategy.

WIN: KAM engages KRA on VAT refunds

KAM held a meeting with KRA on January 28, 2016 to discuss the issue of outstanding VAT refunds. In the short term KAM proposed that KRA should allow netting VAT refunds against other tax obligations of taxpayer, revise VAT refund allocations and provide mandate to KRA to publish monthly figures on the VAT refund process. In the long term, VAT refund claims should be paid within 60 days from date of submission. KRA was receptive to KAM requests and was indicative that, for the current outstanding refunds (2014 onwards), taxpayers would start seeing results a promise that did actualise.

ADVOCACY: KAM meeting with Kenya Copyright Board

In the month of January KAM met Kenya Copyright Board (KECOBO) over the rates that the Music Copyright Society of Kenya (MCSK) is levying on KAM members for music being played in their commercial trucks as they distribute goods and in their factories via radios. Our discussions also extended to various levies being demanded by the Kenya Association of Music Producers (KAMP) and the Performers Rights Society of Kenya (PRiSK). KAM called for open dialogue and stakeholder engagement to agree on an amicable way forward so that business is not burdened with levies.

ADVOCACY: KAM Pays Courtesy call to the Council of Governors KAM paid a courtesy call to the Council of Governors team on January 26, 2016 to dialogue on the challenges facing manufacturers with the implementation of devolution. Manufacturers at the meeting called for the need for Counties to revise duplicative charges, streamline permits and enhance offers by providing services such as access roads to manufacturing premises, garbage collection, access to water etc.

ADVOCACY: KRA Sensitization Meeting on the New Excise Duty Act 2015 held Kenya Revenue Authority (KRA) held a sensitization Workshop on January 18, 2016 for manufacturers of excisable goods to take them through the new act and how to pay excise duty using the online platform.

ADVOCACY: Stakeholders Consultative meeting on National Export Development Strategy, National Trade Policy and EAC-EU Economic Partnership Agreement

KAM participated in a Stakeholders Consultative meeting on National Export Development Strategy, National Trade Policy and EAC-EU Economic Partnership Agreement held on March 11, 2016 in Nairobi. Speaking at the forum KAM Vice Chairlady Ms. Flora Mutahi reiterated the need for a coherent National Export Development Strategy which will make Kenya globally competitive. She called on the Kenyan Government to put pressure on other EAC Partner States to adhere to the set timelines in order to have a timely signing of the EAC-EU EPA agreement.

WIN: Business Court Users Committee Meetings initiated

Following the launch of the Business Court Users Committee (BCUC) in October 2015 by Hon. Dr. Willy Mutunga, the first BCUC was held on February 4, 2016 at the Milimani Law Courts. The meeting broadly discussed the Terms of Reference (TORs) that shall guide the BCUC and also nominated office holders. During the second BCUC held on 15 March, 2016, working groups were formed to deal with priority issues for the BCUC.

The BCUC is designed to provide a platform for the business community, the judiciary, representatives from LSK and other key stakeholders of the commercial division of the High Court, to consider improvements in the operations of the courts, coordinate functions of all agencies within the justice system and improve the interaction of these stakeholders.

ADVOCACY: Stakeholders engage on port performance KAM participated in a stakeholders meeting at Inland Container Depot - Embakasi on February 2, 2016. The objective of the meeting was to assess the performance of the port in terms of cargo both imports, exports as well as cargo destined to Kampala -Uganda. Status update reports on the operations of the port were received from different agencies.

ADVOCACY: Beverage manufacturers engage KRA on EGMS issues KAM participated in a meeting organised by KRA for the technical working group on Excisable Goods Management System (EGMS) held in Nairobi on March 9, 2016. The KRA team took technical staff drawn from Juice and soft drink manufacturing companies, water bottlers and other carbonated drink bottlers through a list of EGMS implementation issues.

ADVOCACY: KAM participates in the Cairo Leather Fair KAM participated in the Cairo Leather Fair held on March 3-7, 2016 with the view to gain exposure and hold business meetings. In addition, the Cairo mission also aimed at seeking for business partnership from a well advanced leather sector in Egypt by marketing the opportunities in Kenya as well as those within the EAC region.

WIN: Kenya - Country economic memorandum launched

KAM participated in the World Bank launch of the Kenya - Country Economic Memorandum (CEM) on March 8, 2016 in Nairobi. The CEM is a strategic World Bank product that analyzes key aspects of the country’s economic development with the main aim of providing an integrated and long term perspective of the country’s development priorities.

WIN: Consultative meeting on Environmental Impact Fees The final meeting of the NEMA technical committee on review of environmental impact fees was held on March 15, 2016 at KAM Offices. The committee came up with recommended fees and project impact categorization at three levels i.e High, Medium and Low risk. The recommendations by this committee will be presented to the Director General NEMA and finally to the Cabinet Secretary, Ministry of Environment for gazetting.

ADVOCACY:Common External Tariff (CET) for selected products reviewed On 11 March 2016 KAM participated in the EABC meeting held in Arusha on the review of Common External Tariff (CET) for a range of selected products. The meeting observed that Industry was not fully consulted on some of the products and the information in the study on some products was inaccurate. The meeting called for further consultation with Industry to acquire the required information and to seek accuracy of the details required.

ADVOCACY: Special Economic Zones Regulations Stakeholders retreat During the month of March a stakeholders retreat on the Special Economic Zones regulations was held to provide the private sector with a forum to give their comments on The Special Economic Zone Regulations for the Special Economic Zone Act 2015.

WIN: EAC final draft AGOA strategy validated The EAC final draft AGOA strategy which covers the period 2015-2025 was validated at a meeting held in Nairobi on 10 - 11 March 2016. The main objective of the strategy is to “Harness the power of unity in order to transform doing business with U.S.A.” The strategy has been developed to take advantage of the 10 years extension of AGOA. The meeting agreed that each Partner State must come up with or finalize their individual National AGOA strategy which should be in line with the EAC AGOA strategy for immediate commencement of its implementation.

WIN: Stakeholders engage on breaking barriers and facilitating trade A stakeholders forum on breaking barriers and trade facilitation was held on 14 and 15 March 2016 in Busia, Kenya. The bilateral discussions brought together participants from Kenya, Uganda as well as various other partners. This was the first cross-border meeting on breaking barriers and facilitating trade with the objective of discussing issues

that will inform on how to facilitate, harmonize, simplify, standardize and how to integrate the private sector to facilitate trade.

ADVOCACY: Kenya Nutrition Advocacy, Communication and Social Mobilization Workshop KAM participated in the first regional Kenya Nutrition Advocacy, Communication and Social Mobilization (ACSM) workshop on 2-3 March, 2016 in Kisumu. The main purpose of the workshop was to disseminate the Advocacy, Communication, and Social Mobilization (ACSM) strategy guide in the regions/counties. The ACSM Strategy was developed in August last year in Nakuru and KAM was among the participants. The overall goal of the strategy is to improve the health and nutrition status of the Kenyan population for accelerated social and economic development towards the fulfillment of the country’s Vision 2030 and Sustainable Development Goals (SDG).

ADVOCACY:KenGen Industrial Park consultative forum The KenGen Industrial Park consultative forum was held on 15 March, 2016. The forum reviewed the Environment and Social Impact Assessment (ESIA) of the proposed industrial park at Olkaria, Naivasha. The industrial park will supply cheaper electricity and steam. It will also provide manufacturers with a platform to reduce their carbon footprint due to the use of renewable resources. The project will progress to the feasibility study stage where KenGen and all relevant stakeholders will engage to evaluate the feasibility of the project under proposed best practices.

ADVOCACY: Industrial Statistics Training Held The UNIDO training on Industrial Statistics was held from March 14 - 18 in Nairobi. The training focused on Manufacturing Employment and Industrial Drivers. The training ended with an Industrial Diagnosis part, to match the industrial competitiveness analysis (output) with an overview of potential factors (industrial drivers/inputs) affecting the performance and investigating further on the important issue of employment in manufacturing.

ADVOCACY: KAM Pays a Courtesy call to Director General, KNBS

KAM met with the Kenya National Bureau of Statistics (KNBS) Director General, Mr. Zachary Mwangi on March 23, 2016 to discuss the possibility of signing a Memorandum of Understanding on data sharing between the two organisations. KNBS has been working on high frequency reports and flagship documents such as the annual Economic Survey. Areas of collaboration include assisting KNBS collect information from companies with a poor response rate particularly in the Monthly Survey of Industrial Production (MSIP).

ADVOCACY: EAC Sectoral Council of Industrialization KAM participated in the EAC Sectoral Council of Industrialization meeting whose agenda was to provide possible solutions to salient issues facing industries today. Some of the key meeting resolutions included the following: The Terms of Reference for a regional comprehensive study on modalities of promotion of the automotive industry were revised; The session agreed on the Terms of Reference (ToRs) for a regional study on local content for approval by SCTIFI and an update was provided on ongoing studies funded by TMEA on textile and leather which will feed into the 17th EAC Heads of State Summit Directives on textile and leather sectors.

ADVOCACY: EAC stakeholders forum for Textiles and Apparels, Leather and Footwear, Dairy and Dairy Products and Sugar sectors The EAC stakeholders’ forum for Textiles and Apparels, Leather and Footwear, Dairy and Dairy Products and Sugar sectors was held from 29 March to 1 April, 2016. The aim of the forum was to develop strategies that are aimed at enhancing the competitiveness of the four sectors in line with the commitment by EAC heads of states to develop them. KAM made a presentation on the opportunities and challenges in the Kenyan Textile and Apparels sector. Successful backward integration in the Apparels - Textiles – Cotton value chain was pointed out to be a major opportunity for the sector to make high influence on employment, poverty eradication and reduction of balance of payments deficit in Kenya.

WIN: KAM, EATIH Sign MOU to promote trade and investment under AGOA

Kenya Association of Manufacturers (KAM) signed a Memorandum of Understanding (MOU) with the U.S. Agency for International Development (USAID) - funded East Africa Trade and Investment Hub (EATIH) to aid in the efforts to promote trade and investment, support policy reform activities and expansion of trading avenues especially under the African Growth and Opportunity Act (AGOA) on April 26, 2016. The signing of the MOU strengthens KAM’s commitment in seizing the opportunity to realize better business opportunities beyond borders. ADVOCACY: 20TH EAC Regional Forum on Non-Tariff Barriers (NTB) KAM participated in the regional NTB meeting organized by the EAC Secretariat and sponsored by TradeMark East Africa (TMEA) on March 30 - April 1, 2016 in Arusha, Tanzania. The meeting discussed existing and new trade restrictions imposed by countries that affect free movement of goods in the EAC. The main objective of the meeting was to facilitate the process of identifying and reporting new NTBs with evidence, monitoring the elimination of the current and future NTBs within the EAC, review outstanding NTB’s and to receive new ones from other Partner States. ADVOCACY: Launch of the 13th Kenya Economic Update The 13th Kenya Economic update was launched on 31 March, 2016. The report highlighted 3 main points; Kenya has shown strong economic growth despite the global turbulence and has exceeded average growth of most countries in Sub-Sahara Africa; Kenya remains vulnerable to risks that could derail the current growth momentum being experienced such as the forthcoming elections; there is need for policy interventions geared towards increasing access to broad skills beyond formal education. The Kenya Economic Update is organized by the World Bank Group Secretariat and is prepared in partnership with key Kenyan Policy Makers. ADVOCACY: Brand Kenya Meeting on the County Branding Convention KAM attended a preparatory meeting on 11 April, 2016 at the Brand Kenya offices on the progress on the County Branding Convention (CBC). The Convention will be an opportunity for all counties to showcase their brands and for Brand Kenya to launch the County Competitiveness Index (CCI). The tool will form the baseline for future indices. A stakeholders meeting with DANIDA, World Bank and other groups working on similar instruments will be held to compare tools and benchmark against other indices. WIN: NOREB Anti Counterfeit Awareness Forums

KAM participated in the North Rift Economic Block (NOREB) Anti Counterfeit Awareness Forums held in Nandi, Uasin Gishu, Elgeyo Marakwet and Baringo Counties from 4-8 April, 2016. NOREB forums were organized by Anti Counterfeit Agency (ACA) who called on all the key stakeholders to support the noble initiative of creating awareness to the National and County governments as well as the private sector and the Academia in the 4 counties.

WIN: KAM holds consultative meeting with EALA, Kenya Chapter

Kenya Association of Manufacturers (KAM) held a meeting with members of the East African Legislative Assembly (EALA), Kenya Chapter on 21 April 2016 to review pertinent issues that are hindering the smooth flow of the EAC integration process. KAM called for an enabling business environment and policies in EAC which will nurture the existing investments and attract new investments, create jobs and bring prosperity for East African people. Members of EALA asserted their commitment towards championing for a favorable business environment in the EAC.

ADVOCACY: 12th meeting of the COMESA, EAC and SADC Tripartite Trade Negotiation Forum (TTNF) KAM participated in the 12th meeting of the COMESA, EAC and SADC Tripartite Trade Negotiation Forum (TTNF) held on 17 – 20 March 2016 in Zambia convened by the Tripartite Task Force (TTF). The meeting deliberated in detail the progress on 3 key issues: Tariff offers, Rules of Origin and Trade remedies as well as reviewed the outstanding issues escalated to the TTNF by the Technical Working Group (TWGs) on Rules of Origin and Trade Remedies.

ADVOCACY: Technical Consultative Forum on Water and Sanitation Policy and Legislative Framework for Nairobi City County KAM participated in the technical consultative forum on water and sanitation policy and legislative framework for Nairobi City County on 14 - 15 April 2016 in Naivasha. At the moment, water service provision in the city and most of the counties is directed by the Water Act No. 8 of 2002, which confers the role of water provision to the national

Special Edition | December, 2016 government. Major policy proposals made include: Water resource management and devolution; Institution and Regulatory Framework for the Water and Sanitation Sector and Stakeholder Engagement.

ADVOCACY: TICAD VI Private Sector Sensitization Forum KAM participated in the Private Sector Sensitization Forum on 18 April 2016 in preparation for the Sixth Tokyo International Conference on African Development (TICAD VI). The forum, hosted by Kenya Investment Authority, aimed at promoting structural economic transformation through economic diversification and industrialisation, promoting resilient health systems for quality of life and promoting social stability for shared prosperity.

WIN: Sector Consultation on the Tripartite (COMESA, EAC and SADC) FTA Product Specific Rules of Origin takes place

KAM held Sector Consultation on the Tripartite (COMESA, EAC and SADC) FTA Product Specific Rules of Origin on April 25 - 27, 2016 in Nairobi to assist speed up the negotiations and operationalize the TFTA using business friendly Rules of origin. Out of the 18 KAM sectors and subsectors, 15 were represented. The TFTA preferential Rules of Origin is one of the key thematic areas still under negotiations. The technical working group on the Rules of Origin is in the process of developing one common rules of origin which will apply in the 3 blocs. To-date, over 50 HS Chapters have been agreed upon (either fully or partially).

ADVOCACY: The 9th meeting of the Tripartite (COMESA, EAC, and SADC) Committee of Senior Officials KAM participated in the 9th Meeting of the Tripartite (COMESA, EAC, and SADC) Committee of Senior Officials (TCSO) held on 21 – 23 March 2016 in Zambia convened by the Tripartite Task Force (TTF). The main objective of this meeting was to consider reports from the Tripartite Technical Committee on Legal Affairs (TTCLA), Tripartite Trade Negotiation Forum (TTNF), Tripartite Technical Committee on Movement of Business Persons (TTC-MBP) and Tripartite Technical Committee on Industrial Development (TTCID) and to progress the negotiations towards concluding outstanding work leading to the implementation of the TFTA.

WIN: Presidential Roundtable adopts Proposed ‘Quick Wins’ in Manufacturing Kenya Association of Manufacturers presented the leading challenges for local businesses to H.E Uhuru Kenyatta on 26 May, 2016 at the Presidential Roundtable meeting organized under KEPSA. Among the issues ailing the manufacturing sector that were stated include, Access to markets –both regional and international, non-predictive regulatory environment, delayed payments to SMEs and manufacturers, County Business Fees and charges, Overlapping regulations and taxes that weaken the competitiveness of local products.

Of the issues tabled, the government led by His Excellency The President adopted a substantial number of the proposed solutions by the industry leaders present including KAM CEO Ms. Phyllis Wakiaga.

ADVOCACY: KAM engages PS Infrastructure KAM held a meeting with Infrastructure Principal Secretary, Eng. John Mosonik on 11 May 2016 to discuss various issues affecting manufacturers in the country. While KAM lauded the visible efforts by both National and County Governments to develop infrastructure in various parts of the country, KAM called for more government engagement especially on the flagship infrastructure projects set by the government.

ADVOCACY: KAM Engages Parliamentary Committee on Finance, Planning and Trade

KAM Board of Directors and members led by KAM Chief Executive Phyllis Wakiaga held a consultative meeting with the Parliamentary Committee on Finance, Planning and Trade on 18 May, 2016.

During the meeting KAM presented a detailed memorandum on key issues impacting on the manufacturing sector in Kenya and called on the committee to help advocate for a favourable business environment. Some of the issues of concern raised include: Removal of IDF and RDL levies on raw materials; VAT refund delays; Amendment to the Excise Duty Act; Specific Tax Waivers; Economic Partnership Agreement (EPAs); Multiplicity and duplication of licenses, fees and charges and Enhanced local sourcing through the Buy Kenya Build Kenya Policy among others.

ADVOCACY: KEBS holds meeting with Water Bottlers Kenya Bureau of Standards (KEBS) held a meeting with water bottlers on 11 May 2016 in Nairobi where the Managing Director, Mr. Charles Ongwae stated that they have suspended 369 water bottlers for not meeting the standards for bottling water.

Other concerns aired by KEBS include: Manufacturers installing filtration systems without first seeking information on the requirements set out by KEBS. On the other hand, Manufacturers called for better representation of the SME sector on the technical committee. KEBS asked SMEs to nominate a representative to sit in the technical committee.

ADVOCACY: 14th Meeting of the Tripartite (COMESA, EAC, and SADC) Technical Working Group (TWG) on Rules of Origin (RoO) held KAM participated in the 14th Meeting of the Tripartite (COMESA, EAC, and SADC) Technical Working Group (TWG) on Rules of Origin (RoO) convened by the Tripartite Task Force (TTF) on 9 – 13 May 2016. The main objective of this meeting was to continue working on the outstanding work on coming up with a common/agreed Tripartite Free Trade Area (TFTA) product specific Rules of Origin as well as revisit pending work from the Tripartite FTA legal text on Rules of Origin (Annex IV).

ADVOCACY: Validation of the Leather Industrial Park (LIP) Report KAM participated in the validation of the Final Report and Design for the intended Leather Industrial Park, a project under the Export Processing Zones Authority (EPZA) and the Ministry of Industry, Trade and Cooperatives on May 17, 2016. This validation was spearheaded by EPZA in collaboration with the Leather Desk at the Ministry of Industry, Investment and Trade. The main priority for the leather sector is the establishment of this industrial park which will have a common effluent treatment plant for all the tanneries within the Park among other government incentives.

ADVOCACY: KAM participates in a meeting on improving Tax Policy KAM participated in a meeting on improving Tax Policy on 13 May 2016 in Nairobi. The World Bank is currently undertaking a study entitled ‘Improving Tax Policy for Strengthened Domestic Revenue Mobilization’ with the aim of providing recommendations and strategies for increasing domestic revenue mobilization. Key stakeholders including KAM were invited to give their input to the study.

ADVOCACY: KAM Participates in a Policy Breakfast Meeting KAM participated in a Policy breakfast meeting on 20 May 2016 in Nairobi. The policy breakfast meetings are organised jointly by the Business Advocacy Fund (BAF) and Strathmore University for alumni of the Bloomberg Media Africa Initiative (BMIA) business journalism course. Mr. Joshua Oigara, CEO of Kenya Commercial Bank (KCB) and chairman of the Kenya Bankers Association was the chief guest invited to talk about the Banking (Amendment) Bill, 2015. He pointed out both the positive and negative aspects of the bill.

ADVOCACY: Trade Remedies and Dispute Settlement Meeting held KAM participated in the meeting of the Technical Working Group on Trade Remedies and Dispute settlement in Entebbe, Uganda from 9 to 13 May 2016. The meeting convened by the Tripartite Task Force (TTF) was attended by representatives from COMESA, SADC and EAC. The Agenda of the meeting was to discuss among other issues the legal implication of establishing a tripartite sub-committee on trade remedies and also analyzing the legal inconsistency of the provisions on anti-dumping and countervailing measures. The agenda was informed by Egypt who felt that the provisions had to be reviewed.

ADVOCACY: PWC pre-Budget Analysis on Economic Outlook and broadening the Tax base KAM participated in the PWC pre-Budget analysis event on economic outlook and broadening the tax base. Present was Habil Olaka, CEO of the Kenya Bankers Association. The discussion included the Economic Outlook, Broadening the Tax Base, Pre Budget Analysis, Banking Sector Issues, Banking (Amendment) Bill 2015, Consolidation of Banks, Interest Rates Spreads, CBR rate and the expected Income Tax Law.

ADVOCACY: Meeting to Validate KAM Study on EAC Fiscal Incentives KAM Technical Committee held a meeting to validate KAM study on EAC Fiscal Incentives on May 27, 2016 in Nairobi. The purpose of the study is to make recommendations on the best fiscal incentives to promote exports in the EAC which do not distort trade for purpose of creating a level playing field in the region. The recommendations of the study will be forwarded to the Ministry of Labour and East African Affairs for onward transmission to the EAC Sectoral Council on Trade, Industry, Finance and Investment (SCTIFI) for adoption.

WIN: Kenya Industrial Water Alliance Launched Kenya Industrial Water Alliance (KIWA) was officially launched on 29 September 2016 by Ministry of Water and Irrigation Cabinet Secretary, Eugene Wamalwa. KIWA is established to collectively address water-related risks. The Alliance is a Partnership of public, private and civil society organisations committed to socially acceptable, economically favourable and environmentally sustainable management of water resources in Kenya. KAM CEO, Ms. Phyllis Wakiaga is the Chair of the Alliance whereas Agatha Thuita of WRMA is the Vice Chair.

ADVOCACY: International Trade Center team meets KAM The International Trade Centre (ITC) Team met Kenya Association of Manufacturers (KAM) representatives on the Partnership for Investment and Growth in Africa on 16 June, 2016. The 5 year programme is jointly supported by China-Africa Development Fund and the China Council for the Promotion of International Trade (CCPIT) and is funded by the United Kingdom Department for International Development (DFID). The focus of the programme is promotion of investments in manufacturing and/or agro processing by the Small and Medium Enterprises (SMEs) to enhance exports by Africa to Africa and China.

WIN: World Anti-Counterfeit Day Commemorated

KAM participated in the Commemoration of ‘World Anti-Counterfeit Day’ 2016 on 28 June 2016 in Nairobi organised by Anti-Counterfeit Agency (ACA). The day was marked with a ‘Marketers Anti-Counterfeiting Symposium dubbed Getting Real about Counterfeits’.

WIN: SGR Project Stakeholders Sensitization Forum held KAM participated in the SGR Project Stakeholders sensitization forum that was held at the Inland Container Depot Nairobi (ICDN) located at Embakasi on 17 June 2016. The SRG was commissioned in June 2014 and is expected to be complete by June 2017.

The mega project has so far created 39,000 jobs both directly and indirectly. The project has also seen 5000 Kenyans being trained on skilled labor at the designated SGR technical training school while local suppliers have gained business due to the supply of local products as the project meets the local content criteria especially on diesel, explosives, steel among other products. Approximately 212 contracts have been signed by local suppliers since project inception.

ADVOCACY: 2nd EAC Standards Harmonization Meeting on Fats and Oils held KAM attended the second EAC Standards Harmonization Meeting on Fats and Oils held from 13 to 17 June 2016 in Tanzania. The objective of the meeting was to develop EAC harmonized standards for fats and oils products. This exercise is important as the African Organisation for Standardization (ARSO) is using the EAS standards to develop the African Standards which will be implemented in the Tripartite regime.

WIN: KAM hosts KRA and KEBS to a dialogue meeting

KAM Board of Directors and Members of Trade and Tax Committee led by KAM vice chairman, Sachen Gudka and KAM CEO Phyllis Wakiaga hosted KRA Commissioner General, John Njiraini and KEBS Managing Director, Charles Ongwae to a dialogue breakfast meeting.

The meeting reviewed and lauded the positive milestones that have been achieved through the partnership that has been built between KAM and these institutions. Areas of improvement and further intervention were also reiterated. Strengthening dialogue between KAM and these institutions was also emphasised.

ADVOCACY: Update on EAC-EU EPA Status Update

Ministry of Industry, Trade and Cooperatives Cabinet Secretary, Mr. Adan Mohamed and Trade Principal Secretary Dr. Chris Kiptoo on 26 July met representatives from the KAM Board and the EPA Task Force to discuss the recent development around the EAC - EU EPA.

A status update was given by both Mr. Mohamed and Dr. Kiptoo. Industry utilised the opportunity to express its concerns regarding the signing of the agreement. Industry was assured that the Government has given this issue the priority it deserves and is working to ensure that the deadline for signing of the EAC-EU EPA is met.

ADVOCACY: World Bank Group Brainstorming Session to identify priority areas for Trade and Competitiveness KAM participated in a brainstorming session on Priorities for Trade and Competitiveness Support for support by the World Bank Group on 24 August 2016 in Nairobi. The specific areas discussed include: Business Environment; Investment Promotion; Sector Specific Support; Trade Innovation; Entrepreneurship; Special Economic Zones among others.

ADVOCACY: UNCTAD XIV- World Investment Forum UNCTAD XIV- World Investment Forum was held in Nairobi from 17 - 22 July 2016 at the Kenyatta International Convention Centre. The Conference featured: the Global Leaders’ Summit, World Investment Forum, Global Commodities Forum, Global Youth Forum, the Civil Society Organisations (CSO) Forum, and the G77 Ministerial meeting. UNCTAD 14 is a very a crucial conference to the East African region as well as the African continent at large.

ADVOCACY: KAM participates in the 4th EAC Regional Training on designing effective Industrial Policies KAM participated in the 4th EAC regional training on designing effective industrial policies in Kigali, Rwanda from 26th June to 1st July 2016. The training concentrated on the industrial policy design process, objectives and selectivity and it also tackled the Indicators to be used in the Monitoring and Evaluation (M&E) process.

ADVOCACY: 21st EAC Regional Forum on Non-Tariff Barriers The 21st East African Community (EAC) Regional Forum on Non-Tariff Barriers (NTBs) was held from 28 - 30 June 2016 in Nairobi. The purpose of the meeting was to review progress on elimination of identified NTBS, receive reports from the Partner States on the activities of NMCs including new NTBs and updating of EAC Time Bound Program.

WIN: Review of Government Performance Contracting Guidelines KAM participated in the Ministries, Departments and Agencies (MDAs) Performance Contracting guidelines review session between 26 - 28 June, 2016 at Kenya School of Government, Nairobi. A key achievement for manufacturers was having the Buy Kenya Build Kenya initiative factored in the Performance Management guidelines for the MDAs. They are now required to enforce procurement practices that promote the 40% local content considerations.

ADVOCACY: Forum on Doing Business in Kenya: Dealing with Construction Permits and Utility Service Connections KAM participated in a policy dialogue forum organised by Kenya Institute for Public Policy Research and Analysis (KIPPRA) to review Construction Permits and Utility Service Connections (Electricity and Water) in Kenya on 24 June 2016. KIPPRA laid out the Policy and Regulatory Framework which consists of the National Housing Policy for Kenya (SP No.3 of 2004). KIPPRA pointed out the need to review the National Housing Policy every 10 years due to the dynamism of the sector.

ADVOCACY: The EABC – BDI Exposure visit to Brussels KAM participated in the EABC – BDI Exposure visit to Brussels organized by the East Africa Business Council (EABC) and the Federation of German Industries (BDI). As part of their 2016 work plan, EABC organized an exposure visit to Brussels, Belgium from 26 June – 1 July 2016 for its Advocacy Team which included national focal points and sector associations as part of their partnership with the Federation of German Industries (BDI). The EAC manufacturers’ network, currently housed at KAM, was one such sector association. The objective of this mission included getting a general understanding of the working of the European Union.

ADVOCACY: First Textiles and Apparels Annex Body Meeting for SITA-ITC Project Joint stakeholders meeting for the Supporting Indian Trade and Investment for Africa (SITA) – Investment for Africa (ITC) project was held on 15 July 2015. The agenda of the meeting was to confirm KAM as the secretariat of the project for a span of 4 years. Terms of reference for the Secretariat were discussed and the Annex team developed working committees to work on various deliverables under the project. SITA is a project run by ITC whose objective is to enhance the competitiveness of textiles & apparels and Pulses value chains.

WIN: KAM Holds meeting with Pest Control Products Board KAM held a meeting with the Pest Control Product Board Chief Executive, Mr. Peter Opiyo on 26 July 2016 to deliberate on issues experienced by members including delay in the registration of products, delay in issuing import permits and payment of the Board’s fees by cash to National Bank. Mr. Opiyo assured KAM that registration would begin and it would be done in batches. He attributed the delays and backlog to the late appointment of the Board.

ADVOCACY: EABC meets on Tax Harmonization in the EAC KAM participated in the EABC meeting on Tax Harmonization in the EAC on 1-2 August 2016 to revive the Technical Working Group and discussions on harmonization of domestic taxes. The East African Business Council (EABC) established a Technical Working Group (TWG) on Excise taxes in 2014 composed of members dealing in excisable products. The group developed a position on excise tax and a study on the impact of excise harmonization was prepared. The meetings of the technical working group however stalled due to lack of funding. It is against this background that the EABC decided to revive the TWG and expand its scope of work to include all domestic tax issues. KAM is part of the TWG.

ADVOCACY: KAM meets Agriculture CS on Food Crops Regulations On 22 August 2016, Kenya Association of Manufacturers (KAM) Food and Beverage sector together with other organizations in the sector met the Ministry of Agriculture, Livestock and Fisheries Cabinet Secretary, Mr. Willy Bett to present a memorandum on the Food Crops Regulations under the Crops Act, 2013. The Cabinet Secretary informed the task force to join in the Stakeholder Consultation Forums in order to address their issues.

WIN: Food Fortification Handbook Launched The Food Fortification Handbook was launched in Nairobi on 26 August 2016. KAM was among the Private sector organizations recognized for participating in the development of the e-book. The main objective of this manual is to provide practitioners in the food processing industry with some background on food fortification while at the same time providing millers and edible oils processors with detailed knowledge on fortification of their products

ADVOCACY: KAM Meets Cabinet Secretary Eugene Wamalwa KAM delegation led by Environment Committee Chairman, Mr. Suresh Patel and Industrial Area Chairman Mr. Manoj Shah met with the Ministry of Water and Irrigation Cabinet Secretary (CS), ​Hon. Eugene Wamalwa on August 29, 2016 to address Water and Sanitation related issues experienced by members. Areas of concern included overlaps by water regulators, availability/supply of water, Water Policy and the keenness in enacting the Water Bill 2014. The Cabinet Secretary​ ​reported that the Water Bill 2014 has been passed to the president for assent.

ADVOCACY: KAM engages Public Institutions Dealing with Revenue Generation On September 7 2016, KAM engaged Council of Governors, Commissioner of Revenue Authority and County Assemblies Forum in view of addressing Inter-County trade challenges in the Country. Manufacturers cited issues such as company drivers being arrested and harassed by county officers, Losses in terms of damaged goods and spoilt fresh produce when it is impounded as county officers make demands for branding fees and other charges, lack of legislation to guide revenue management and the lack of utilization of ICT in revenue collection among others.

ADVOCACY: KPA Stakeholders Meeting Held KAM participated in the KPA stakeholders meeting on 6th September, 2016 at KPA ICD in Embakasi. The meeting reviewed the Standard Gauge Railway (SGR), operations of the ICD in Nairobi and container terminal at the port of Mombasa, KRA delays in container release, lengthy transit period of wagons from Nairobi to Mombasa among others. KRA reported that they are working out on a way to ensure that the auctioning exercise at the customs warehouse is done on a monthly basis. KENTRADE reported that the single window system was at its final stage of implementation and they are also rolling out an e-trade portal and a module on duty remission.

ADVOCACY: EGMS Mobile App Stakeholders Sensitization Forum KAM participated in the EGMS Mobile App Stakeholders Sensitization Forum organised by Kenya Revenue Authority (KRA) on 28 September 2016 in Nairobi. The aim of the forum was to call for support and collaboration with like- minded institutions such as KAM in order to curb illicit trade and safeguard the health of the innocent consumers. KRA has realized that there is prevalent excisable goods in the market whose origin cannot be traced and some of these were not meeting the right standards. In order to address this problem, KRA came up with a Smartphone Application for Verification of Excisable Goods in an effort to curb illicit alcoholic drinks and tobacco products.

WIN: Second Regional Anti-Illicit Trade Conference

East African Business Council (EABC) in collaboration with Kenya Association of Manufacturers (KAM) and the Ministry of Trade, Industry, and Cooperatives held the Second Regional Anti-Illicit Trade Conference on 15 - 16 September, 2016 in Nairobi.

The main focus of the conference was to seek practical solutions on the ever growing issue of counterfeits, piracy and other forms of intellectual property infringement, smuggling, substandard goods, transit fraud and dumping and trade in prohibited goods and products.

Key to these discussions was the current status of the existing regional and national regulatory frameworks for combating various forms of illicit trade and strategies on how to strengthen them. The talks also centered on how the region can achieve effective enforcement, including the need to set-up inter-agency cooperation’s at national and regional level; the long-existing contributors to illicit trade, information exchange and consumer education.

WIN: ACA destroys Counterfeits in Mombasa

Anti-Counterfeit Agency (ACA) destroyed counterfeits goods worth KES 7 Million on 21st September 2016 in Mombasa. Since inception of the Agency in June 2010, the Agency has received and investigated over 1,000 complaints on intellectual property rights infringements. These investigations resulted from seizures of a wide range of counterfeit goods with a street value of over Ksh 1.2 Billion. The Agency has successfully won over 200 cases in the courts and goods worth over half a billion have so far been destroyed.

ADVOCACY: Stakeholder engagement on insurance requirements of marine cargo On September 27, 2016, KAM participated in a stakeholder meeting on Implementation of Provisions requiring Importers to insure marine cargo with Local Insurers provisions highlighted under Section. The section provisions are mandatory and therefore create an offence for contravening the provisions of the section. The said provisions have not been in operation since its enactment and it was only during the reading of the Budget Statement this year, when the Cabinet Secretary directed that the provision should be operationalised. The provisions will come into full effect on 1st January 2017. In addition, the provisions will be deemed to have come into operation from 1st September 2016. The three months period allow for compliance.

ADVOCACY: Forum for Transparency and Accountability in Pharmaceutical Procurement Network Held KAM participated in a Forum for Transparency and Accountability in Pharmaceutical Procurement Network on 24 October 2016 in Nairobi. The objective of the forum was to monitor pharmaceutical procurement and supply chain management with the aim of exposing transparency and accountability in the health sector. The forum looked into the Drug Price Index Project which shall assist in developing an effective pricing policy in Kenya and hence regulate the cost of drugs.

ADVOCACY: IMF Regional Economic Outlook The bi-annual IMF Regional Economic Outlook report was launched on 25 October 2016. The report gives an outlook of the Global economic growth which is projected to slow down to 3.4% mainly due to the subdued outlook for advanced economies. The global slowdown affects SSA based on structure.

ADVOCACY: CAF regional meeting held in Nakuru, Kisumu & Mombasa KAM in partnership with the County Assemblies Forum (CAF) and the Commission on Revenue Allocation (CRA) reviewed the progress made in developing legislative frameworks on revenue in line with constitutional requirements. Model revenue Laws had been developed by CRA and KAM which counties were to adopt. Among other things, the purpose of the review was to document the lessons learnt and also inform the ongoing process of developing County Finance laws and other Revenue bills in preparation for the 2017- 2018 budgets.

WIN: Taskforce to promote good business practice formed During an engagement with the State Department of Trade Principal Secretary, Dr. Chris Kiptoo a taskforce for promotion of good business practice between suppliers, retailers and manufacturers was formed. The aim of the taskforce is to address concerns raised by suppliers, retailers and manufacturers on crucial matters such as late payments, building synergies that facilitate ease of trade and developing a shared vision for all stakeholders.

ADVOCACY: 5th meeting of the Tripartite (COMESA, EAC, and SADC) Technical Working Group (TWG) on Rules of Origin (RoO) held KAM participated in the Tripartite Task Force (TTF) on 26 – 29 September 2016. The main objective of this meeting was to continue working on outstanding work on coming up with common/agreed Tripartite Free Trade Area (TFTA) product specific Rules of Origin as well as revisit pending work from the Tripartite FTA legal text on Rules of Origin (Annex IV).

ADVOCACY: KAM engages the Intergovernmental Technical Committee KAM team lead by the CEO, Ms. Phyllis Wakiaga paid a courtesy call to the Intergovernmental Relations and Technical committee (IGRTC) on 6 October 2016. Ms. Wakiaga elaborated on the memorandum shared with IGRTC on issues challenging the manufacturing sector under the devolved system. While members appreciate the role of the two levels of government they called for synergy among the two levels of government and amongst the 47 counties to enable businesses to thrive and be competitive.

BUSINESS FACILITATION

Immigration work permits - The KAM Work Permit desk is committed to fast delivery, with an average turn-around of two weeks for renewals and two months for new permits from the time application documents are submitted to immigration. This is a members’ only service which members are encouraged to utilize.

WIN: 76 Work Permits and 83 Special Passes were processed for members during the year.

WIN: Meeting with the Director of Immigration and Registration of Persons

KAM Team, led by KAM Chairlady, Ms. Flora Mutahi paid a courtesy call to the Director of Immigration on 16 August, 2016. The partnership between KAM and the Directorate of Immigration and Registration of Persons has continued to ensure that investors are facilitated in the course of their investments in Kenya through the processing of work permits and passes.

The Continuous exchange of information continues to strengthen the partnership and establish a conducive business environment for investors. The issues deliberated upon include: Delay in issuance of work permits and passes, Occasional delays in the electronic immigration system, Exchange of information and Citizenship & permanent residency.

ADVOCACY: Meeting to Review of Policies on Permits KAM together with other stakeholders in the private and government sector held a meeting on 26 August 2016 at the Ministry of Tourism to deliberate on the various interventions to be put in place in a review of the permits policies mainly classes G and D. The key areas of intervention were on; Number of investors; Investment threshold; Guidelines; Business Visa; Transfer of knowledge/stronger employment opportunity for local citizens and delays in approval. It was agreed that the vetting committees ought to speed up their processes and the possibility of having a single window system in the immigration functions.

AGOA Visa Processing – This service is exclusively offered to KAM members. This is one of the services that we are proud of because of the increased uptake by you, our members.

WIN: Over the year, we are happy to announce that we were able to process a total of 3376 AGOA Visa’s.

Duty Remission Scheme – The EAC Duty Remission scheme allows duty remission on raw materials intended for use in manufacture of finished products both for home use and for export.

WIN: During the year, we processed and tabled 261 applications to the Duty Remission Committee. Of this, 224 were approved.

In a bid to ensure that KAM is the most preferred BMO among manufacturing value-add industries, the Association embarked developed a comprehensive membership recruitment and retention strategy in a bid to ensure that the existing members are retained as other new ones are recruited.

KAM held its 55th AGM on June 17, 2016 at Nairobi Serena Hotel which was followed by the KAM Members AGM Cocktail. Highlights of the Association’s achievement for 2015 were presented. Mr. Peter Arina and Mr. Pankaj Bedi were elected to the KAM Board during the AGM.

WIN: KAM Members Sundowners

KAM hosted various members sundowner during the year. The Sundowners bring members and other stakeholders together to deliberate on topical issues as well as provides for a networking platform. WIN: Kenya Power engages Members on Power Concerns Kenya Power engaged KAM members on power concerns within the year. Manufacturers depend heavily on power for production however, power supply interruptions have resulted to heavy losses.

One of the steps that KAM has taken towards making Kenya competitive is advocating for reliable and constant power supply. Kenya Power has been keen on delivering better customer services. This has been achieved in the Chapters since they started using Kenya Power’s Large Power Consumers Whatsapp Group for feedback.

ADVOCACY: KAM and other BMOs engage County Government over business concerns

Kenya Association of Manufacturers (KAM) and other BMOs engaged Nairobi County Government on various issues that have hindered the ease of doing business in Nairobi. This was during a Governor’s Roundtable held on 16 August, 2016 in Nairobi.

Some of the key issues presented include: County Fees and charges, Overlapping regulations, Inter-County business challenges, State and Decongestion of Roads, Garbage collection in the city, Inspection of new buildings, , Cashless Payment among others.

Nairobi County Governor, Dr. Kidero acknowledged the issues presented by the BMOs stating that the issues raised today will make a lot difference in making Nairobi County a better investment destination.

WIN: KAM Service and Consultancy Sector Revived The Service and Consultancy sector held its meeting on 29 June, 2016 after a period of slow engagement in the sector. This year, two meetings have taken place with progress made in identifying effective ways of engagement within the sector and sub-sectors. The following Sub-Sectors have been identified, and interim Chairs elected: Human Resource & Training; Financial Service; Airlines & Logistics; Events & Marketing; Security & Education. The Sub-Sectors objective is to identify priority areas and develop a strategy on how to engage for positive results.

WIN: Ministry of Industrialisation reaffirms commitment to the Manufacturing Sector KAM and the Ministry of Industry Investment and Cooperatives held a meeting on January 20, 2016 to discuss key priority areas and sector alignments for the manufacturing sector for 2016 towards a more strategic partnership. PS Korir reiterated that the Ministry is keen on working with Industry to resolve these issues.

WIN: PS Industrialization visits motor vehicle sector members During the month of January 2016, KAM in conjunction with Ministry of Industry Investment and Cooperatives visited three Motor Vehicle Sector members, General Motors, Honda Motorcycles Ltd and Auto Industries Ltd within Nairobi. A number of issues pertaining to this sector were discussed during the visit.

WIN: KAM ICT Sector meeting with Ministry of ICT CS, Joe Mucheru KAM ICT subsector members met with the Ministry of Information, Communication and Technology Cabinet Secretary, Mr. Joe Mucheru on 9 March, 2016. The main agenda of the meeting was on enhancing local procurement through the buy Kenya build Kenya initiative. The sector also called for the protection of intellectual property rights (IPR) protection for ICT developments which would help to recognize the creativity and provide material reward for innovations in the ICT sector. The CS asked the members to let the Government know what they offer and encouraged the companies to list in the Nairobi Stock Exchange.

WIN: Joint Position Meeting on Textiles and Apparels Manufacturing held A consultative stakeholders meeting to develop a joint position as regards the Textiles and Apparels sector was held on 15th June, 2016. The following were the immediate measures agreed upon and adopted: Domestic textiles and garment manufactures to be provided with similar incentives/benefits as those provided to those operating in EPZ. This will create a level playing field for manufacturers within and out of EPZ regimes; Local textile and Garment manufacturers to be granted the same power support by the government in order to be competitive; Speedy conclusion and implementation of the Buy Kenya Build Kenya Policy.

ADVOCACY: KAM Pharmaceutical Sector engages with KRA KAM Pharmaceutical Sector engaged with Kenya Revenue Authority (KRA) Officials on several occasions to review some pertinent issues impacting on the sector. Issues discussed included: the actualisation of the exemptions in place for the sector as relates to for example excise duty on alcohol, review of the delays in refunds based on the exemptions, imposition of duty and VAT on Sucrose (sugar), delays in VAT refunds, multiple regulation of medical devices on KENTRADE system among others. KRA took up most of the issues for further review and dialogue with Industry.

ADVOCACY: Salt Sub-Sector Courtesy Call on Coast Regional Coordinator KAM Salt Sub-sector members paid a courtesy visit to the Coast Regional Coordinator, Mr. Marwa on 12 April 2016. The main objective of the visit was to congratulate him on his new appointment and to bring him to speed on the issues affecting salt sub-sector. The meeting agreed to reconstitute and revive regular salt belt stakeholders’ forums Chaired by the Regional Coordinator.

ADVOCACY: KAMs Textile and Apparels Sector holds a meeting with CS, Ministry of Industrialization KAM Textile and Apparels Sector held a meeting with the Cabinet Secretary, Ministry of Industry, Trade and cooperatives, Mr. Adan Mohamed on January 12, 2016 whose aim was to highlight gains and shortcomings within the sector in 2015 and to create a platform for engagements in 2016.

ADVOCACY: KAM Engages on the Plastic Waste Management Bill 2016 The proposed Nairobi City County Plastic Control Bill, 2016 has left the plastic sector concerned about its implementation. According to manufacturers of plastic products the bill is a duplication of a number of other regulations by other agencies such as KRA, KEBs and NEMA. If passed into law, they argued, the bill will create avenues for possible harassment by county officers.

The bill seeks to introduce a raft of measures to curb pollution. One of the notable proposal is the requirement by shoppers to pay a fee for using plastic bags at the point of sale depending on the quality and size of the bags.

The regulation will not only have a negative impact on the industry, but also on the common mwananchi who mainly relies on plastic packaging for carrying household goods. The sector proposes the need for more emphasis and investment in plastic waste management as opposed to regulations that risk watering down investment strides realized over the years. In the 2016/2017 national budget, the treasury increased the excise duty on plastic bags to KES 120 per kilogram, complicating the matter further.

KAM has continued to champion and mobilise other Business Membership Organisations in addressing devolution issues. Chapters have also organised several seminars on topical issues as well as members forums aimed at networking.

Specific Wins & Advocacy from our Chapter advocacy are highlighted below:

MOMBASA CHAPTER

As part of engagement with KAM Members, the KAM Board held its March 2016 board meeting in Mombasa hosted by Mabati Rolling Mills. The board members engaged with the Coast chapter members at a forum that was attended by Kenya Power officials. Kenya Power also sponsored a member’s sundowner during which they engaged with members on power challenges at the region and the way forward to have the problems solved.

The KAM board members led by KAM Chief Executive Ms Phyllis Wakiaga and Shippers Council of East Africa CEO Gilbert Langat also paid a courtesy call to the Kenya Ports Authority. Industry is looking forward to positive engagement and areas of collaboration that will further enhance the port’s efficiency.

Various meetings were held at the chapter level. The Kenya National Cleaner Production (KNCP) and NEMA were engaged on how to create awareness on resource efficient and cleaner production. Discussions were also held on the need to strategically position and strengthen trade associations to enable them to optimize on existing structures presented by devolution.

The Ministry of Transport and Infrastructure launched a Taskforce on the Development of the Integrated National Maritime Policy in March 2016 at the English Point Marina, Mombasa. It is anticipated that this policy will spur growth of the shipping industry.

The Salt sub-sector members held a number of CSR engagements with the community as well as dialogue meetings with various government representatives such as the Director General of NEMA. The Members are looking into ways to foster relationship with the community as well as give back to the Community through their CSR programme.

MACHAKOS CHAPTER

The chapter engaged its members through various membership forums. Other events organized at the chapter included a manufacturer’s investment Forum. Kenya Power was engaged frequently on power concerns. Members called for quality and reliable power.

Various engagements were also held with the County Government on ease of doing business in the county. Manufacturers face a myriad of challenges including multiple licenses which are adding to the cost of doing business in the county. KAM also called for business involvement and consultations in the key aspects of the finance bill drafting process.

CENTRAL KENYA CHAPTER

The Chapter carried out Advocacy in many areas including infrastructure and engagements with the county assembly on devolution issues. The Cabinet Secretary Ministry of Transport, Mr. James Macharia launched the construction of Broadway-Kiandutu-Athena and Engen-Kiaganjo-Muthaiga roads. The project will be done by the national government at a cost of Ksh. 580m.

The Kiambu Regional Business Coalition also held a Roundtable meeting with Kiambu Deputy Governor and County Executive Committee Members to deliberate on issues impacting on business in the county. Members were also engaged through various members forums.

NYANZA/WESTERN CHAPTER

Various engagements were held at the Chapter including members forums, the Kisii county entrepreneurship summit, The Homa bay County Investment Conference. Joint meetings in the County championed by KAM were held to discuss ways to mitigate the anti IEBC demonstrations that were threatening peace and security within the county.

The County Government was also engaged on issues impacting on business. Kisumu County Governor H.E Jack Ranguma assured businesses that he is committed to creating a conducive environment for businesses in the County. Further, he announced plans by his government to provide alternative power through a 40 megawatt solar power plant

On investment, regional paint manufacturer, Crown Paints opened a Sh400 million plant in Kisumu to tap into the region’s growing construction industry.

NAKURU CHAPTER

Following the regular stakeholder engagements between KAM and Kenya Power at the Nakuru Chapter, a WhatsApp group for KAM Nakuru Chapter members and Kenya Power Central Rift team was created. During the year, this WhatsApp group won praise from members and is proving to be a game changer in service delivery for the power provider. The platform has enabled Kenya Power monitor it’s system through the valuable feedback and engagement by KAM members.

The County Government of Nakuru was also engaged throughout the year on devolution matters and ways in to facilitate business. Resolving of land related issues and Infrastructure remained some of the key advocacy areas for the chapter. Nakuru Governor, Kinuthia Mbugua revealed plans by his Government to rehabilitate the Mashambani bus terminus in Nakuru Town at a cost of Ksh.13 million. Mashambani stage is one of the important terminus in Nakuru Town. The Molo-Kibunja road which has been dilapidated for a long time is also set for rehabilitation. The road connects Molo to the Nakuru Eldoret highway and once complete will ease transport and promote business in the area.

To tackle security concerns, a special police squad was formed to counter the new wave of violent robberies and killings in Nakuru Town and its environs. Stakeholders also called on the county government of Nakuru to guard Lake Nakuru National Park against pollution from plastic bags.

UASIN GISHU CHAPTER

The chapter engaged the county government on devolution issues impacting on business. Other key advocacy areas included security and infrastructure. During the first Uasin Gishu Business Coalition CECs Forum held in Eldoret, the Governor of Uasin Gishu County, H.E. Jackson Mandago assured the business community of his Governments support and lauded structured Public Private Dialogue as the best way to develop the County.

During a members forum KAM Uasin Gishu Chapter members commended Kenya Power on the improved response to emergency cases. A Whatsapp group comprising of KAM Members and Kenya Power Team in the North Rift Region is also in place and is aimed at enhancing communication between Kenya Power and the members ultimately improving service delivery.

On investment, Industrial and Commercial Development Corporation (ICDC) revealed plans are underway to set up an Industrial Park in Eldoret. The park will among other things help create employment opportunities and support innovations.

INDUSTRIAL AREA CHAPTER

The Chapter engaged Kenya Power on power concerns facing manufacturers in the region. Members called for quality and reliable power. Members were also urged to make good use of their respective WhatsApp groups for streamlined and faster communication with the Kenya Power team.

Devolution, security, traffic congestion and infrastructure related challenges remained on top of the Chapters advocacy agenda. The chapter committee members engaged the KURA General Manager for Design and Construction. KURA assured members that there are a number of road projects on course. At a luncheon held at the Chapter, Eng. John Mosonik, Principal Secretary Infrastructure, assured members that his Ministry is committed to enhancing infrastructure in the country. He noted that even though infrastructure-related projects are costly, the government will always prioritize areas like Industrial Area due to their contribution to the growth of the country’s economy and employment to its citizens.

Nairobi County was engaged on devolution matters with the County committing to ensuring that businesses have a conducive business. In a meeting with the Industrial Area chapter officer Ms. Anna Othoro, the County Executive Committee member in charge of Trade, Industrialization, Co-operative Development, Tourism and Wildlife promised to work closely with other CECs in ensuring that they attend to every concern raised by the business community in Nairobi.

Members were also engaged on Public and Occupational Health Compliance and various forums held including the Manufacturers’ Investment Forum.

Global Compact Network Kenya

Through the Global Compact Network Kenya which we host, KAM has continued to support Kenyan firms to integrate sustainability into their business strategies and op­erations by assisting companies to advance 10 universal principle­ s of the UN Global Compact. To date 142 business and non-business organizations from Kenya have signed up to the UN Global Compact principles. 584 companies have to-date signed up to the code of ethics for business in Kenya.

WIN: Global Compact Network Kenya holds 1st AGM The Global Compact Network Kenya held its first Annual General Members Meeting on 3 June 2016 at Serena hotel, Nairobi. The meeting was officiated by the Kenya Network secretariat led by the Representative Ms. Phyllis Wakiaga and Network Coordinator Ms. Judy Njino. Participating companies had the opportunity to receive important updates from the UN Global Compact including on the Kenya network transition plan aimed at enhancing its governance and sustainability.

A steering committee that will drive the network’s strategy in the next two years was also unveiled. The meeting also provided members with a unique opportunity to network with each other. The Kenya Network membership has grown steadily from the initial number of 12 to the present 147. Out of 12 local networks operating in Africa, the Kenya Network currently has the highest number of business participants and has recorded some of the highest member retention rates in the Africa and Middle East North Africa (MENA) regions. WIN: Anti-Corruption Compliance Training Program Launched KAM and Global Compact Network Kenya (GCNK) with support from Center for International Private Enterprise (CIPE) on 23 March, 2016 launched the Anti-Corruption Compliance Training Program for local companies. The program will be offered to companies every quarter and is intended to help them actualize their commitments to operate ethically and contribute to the national fight against corruption. WIN: KBA Signs Code of Ethics for Business in Kenya The banking industry body representing all registered banks in Kenya, Kenya Bankers Association (KBA) signed on to the Code of Ethics for Business in Kenya on 21 April 2016 and announced plans to adopt a Self-Regulatory Framework and Conduct Standards for member banks during the KBA Annual General Meeting to be held in June 2016. Since November 2015, 10 banks have already signed up to the code. This includes: Commercial Bank of Africa; Kenya Commercial Bank; Prime Bank; Standard Chartered Bank; Stanbic Bank; Housing Finance Group; First community Bank; Cooperative Bank of Kenya; National Bank of Kenya and Barclays Bank. WIN: NSE Signs Code of Ethics for Business in Kenya Nairobi Securities Exchange (NSE) signed up to the “Code of Ethics for Business in Kenya” on May 30, 2016. In an effort to promote corporate sustainability practices in NSE and the capital markets at large, the NSE has committed to embrace, support and enact a set of core values in the areas of human rights, labour standards, the environment and anti-corruption by joining the world’s largest corporate sustainability initiative, the UN Global Compact. WIN: 2nd Annual KCB Suppliers’ Conference held UN Global Compact Signatory Kenya Commercial Bank (KCB) collaborated with the Global Compact Network Kenya to host their 2nd annual Suppliers’ Conference under the theme “Sustainability - The way of doing business enhancing compliance”. The conference officiated by KCB Group Chief Operating Officer Mr. Samuel Makome, brought together 200 companies from the Bank’s supply chain to dialogue on the role of business in contributing to sustainable development.

WIN: Business Ethics and Integrity Compliance Training held Global Compact Network Kenya (GCNK) and Kenya Association Manufacturers (KAM) with support from Center for International Private Enterprise (CIPE) held a series of the Business Ethics and Integrity Compliance trainings in Nairobi. The training was aimed at equipping participants with practical knowledge and skills to develop and implement an effective compliance program.

WIN: Anti-corruption Collective Action Workshop takes place Global Compact Network Kenya held a workshop on Anti-corruption Collective Action on September 9, 2016 as a means to foster cooperation between various stakeholders to jointly counter corruption. The workshop was aimed at introducing the newly launched initiative to participants and engage them in the process of collectively identifying mutual interests that will contribute to among other things advancing the Anti-corruption agenda in Kenya. ADVOCACY: The Technical Working Group on Education Meeting held The Ministry of Education, Science and Technology: State Department of Vocational and Technical Training has collaborated with Kenya Association of Manufacturers to establish a Technical Working Group that will help develop a structured approach for industries to support and recognize education, research, and innovation in the country. The proposed partnership is aligned to the Government’s policies on Vision 2030, Medium Term Plan, 2013-2017, Sessional Paper No.1 of 2005 on policy framework for education, training and research and the Kenya Industrial Transformation Programme.

ADVOCACY: Research Project between Manufacturing Academy and African Studies Centre Reviewed KAM participated in the Mid-Term Stakeholders Review Workshop on Dutch-Multinationals Business, Dutch Government and Promotion of Productive Employment in Sub-Saharan Africa: A Comparative Study of Kenya and Nigeria in Lagos, Nigeria from 27 - 31 January 2016. The project under review aims at understanding the nature of the relationship between multinational businesses and their host and home governments and how this influences the character of such companies. In Kenya, African Studies Centre Leiden (ASCL) works together with University of Nairobi and Kenya Association of Manufacturers (KAM), through the Manufacturing Academy.

WIN: KAM Partners with COMESA Business Council KAM partnered with COMESA Business Council (CBC) to build sustainable sourcing partnerships between SMEs and Corporate Companies. Subcontracting between SMEs and large companies is a key priority in SME Development for job creation and economic development. The program aim was to ensure a sustainable sourcing system from SMEs that ensured businesses met the standards required for them to effectively participate in a competitive supply chain network of Multinational companies in the hospitality industry, food and beverage industry.

WIN: KAM focuses on enhancing SMEs capacity for Local Sourcing KAM in partnership with COMESA Business Council (CBC) in the month of March held a training for SMEs aimed at promoting local sourcing. The Local Sourcing for Partnerships (LSP) Project targets the Small Growth Enterprises within the hospitality and agro-industry sector with the aim of building their capacity on quality standards. LSP project is supported by the Investment Climate Facility for Africa (ICF), USAID-IPAA and the Private sector.

WIN: KAM SME Caucus meeting held KAM organized several SME Caucus High tea meetings to discuss the caucus’ progress for 2015 and the key priority areas for 2016. The meetings identified the following four areas of focus that will require a joint effort from large and small manufacturers, government and external stakeholders: Access to Finance from financial Institutions, government and donor agencies, Access to both local and export markets, Access to land including EPZA and finally SME support on matters of regulatory compliance.

During the meeting held on 8 June 2016, Anthony Kirori of Green Pencils was confirmed as the Caucus Chairman while Rosemary Muthomi of Meru Greens was confirmed as the vice chairperson.

WIN: CMA holds a session with Manufacturers on Listing Opportunities Capital Markets Authority in partnership with KAM members participated in a one on one session on 12 May 2016 at Kenyatta International Convention Center (KICC), Nairobi. The main objective of the seminar was for members

WIN: 2nd Agribusiness Capacity Building Program for SMEs KAM held the 2nd Agribusiness Capacity Building Program for SMEs in order to Subcontract and get the needful Food Safety Certification on May 18, 2016. The training aimed to build capacity for local suppliers to ensure that their products complies with regulations and commercial requirements, particularly concerning food safety, respect for the environment and ethical trade.

WIN: Seminar for Growth Oriented Enterprises held Kenya Association of Manufacturers (KAM) in partnership with Ministry of Industry, Investment and Cooperatives (MOIIC), Micro and Small Enterprises Authority (MSEA) and Brand Kenya held a seminar for Growth Oriented Enterprises at the Nairobi Safari Club on Friday, 3 June 2016. Kenya is currently implementing Kenya’s Industrial Transformation Programme (KITP) that seeks to, in part, grow the Small, Medium Enterprises (SMEs) through sub- contracting and creation of a conducive business environment. The SME sector has been identified as a key growth driver for our economy.

WIN: Invest in Africa APP launch held KAM participated in the Invest in Africa APP launch on 23 June 2016. Invest in Africa (IIA) is a private sector initiative that brings together leading companies across sectors to develop local enterprise and support investment in Africa. KAM has actively participated as a partner in APP Technical Advisory Committee where we have identified minimum requirements that will guide the pre-qualification process of on-boarding SMEs on to the APP e-platform. IIA is focused on job creation and improving business environment for investors and local SMEs.

Centre for Energy Efficiency and Conservation (CEEC)

CEEC runs energy efficiency conservation projects for businesses in Kenya and is housed at KAM. CEEC carries out energy audits which are aimed at assisting companies in tracking their energy consumption with the aim of reducing energy costs and increasing profit margins, with the support of the Government of Kenya and DANIDA. The audits have over time helped firms prudent energy management and in the process helped them save a lot of money through reduced energy costs.

WIN: During the year, 46 energy audits and 6 water audits have been conducted and completed. In addition, 15 energy audits and 5 water audit are still underway.

ADVOCACY: Sensitization on Energy Management Regulations 2012 KAM members were sensitized on Energy (Energy Management) Regulations 2012 and the need to comply.

WIN: Energy Efficiency Best practice Exchange Visit to EABL

CEEC organized an Energy Efficiency Best practice Exchange Visit to East African Breweries Limited (EABL) in Nairobi on 19 August 2016. This year, KBL Ltd participated in the Energy Management Awards 2016 and was crowned winners in the Fuel Savings Award (VLC) and first runners up on Overall Energy Management Award-Very Large consumer Category. The initiatives KBL has taken to promote energy efficiency and conservation in their facility underscored the need for this exchange visit. Participants were exposed various energy conservation measures that EABL has successfully implemented.

ADVOCACY: Climate Change workshop on Kenya’s Preparedness for the Paris Agreement on Climate Change The Climate Change workshop took place on 23 - 24 March, 2016 in Machakos to take stock of Kenya’s preparedness for the signing of the Paris Agreement on Climate Change. The participants acknowledged climate change will be a developmental issue in a decade or so and there is a need to identify mitigation issues across all the sectors in Kenya. The sectors reviewed were energy, transport, waste management, Forestry, industry and agriculture. As a roadmap to post 2020 on climate change, the participants agreed to identify planners in Kenya and mechanisms to link them with the vision of this Paris agreement on Climate Change.

ADVOCACY: Power Issues reviewed Kenya Power and KAM held meetings in Industrial area and Machakos chapters where power quality, cost and reliability issues were discussed. A Power cost and outage tracker was sent to members for feedback.

The Energy sub-committee also held a number of meetings to further address energy issues raised from AOLEC team and at policy level. A survey to check on energy quality and pricing in relation to cost of manufactured goods was done. Terms of Reference for a survey to be conducted on power outages and cost reduction and its impact on production cost and cost of goods in the market has also been developed.

ADVOCACY: Green Buildings and Advancing Industry Standards in Kenya Workshop held On June 21, 2016, the Embassy of the Federal Republic of Germany in Nairobi, Kenya, together with the Delegation of German Industry and Commerce (AHK), the Kenya Green Building Society (KGBS), the Kenya Property Developers Association (KPDA) and the Kenya Federation of Master Builders (KFMB), organized a workshop on “Green Buildings and Advancing Industry Standards in Kenya” at the InterContinental Hotel Nairobi. The workshop exposed industry practitioners and its stakeholders to “Green” Building and Construction Practices, ranging from the architectural conceptualization to implementation of respective technologies.

ADVOCACY: Kenyan - German Water Week held KAM participated in the Kenyan - German Water & Waste Water Week that took place from 10 - 14 October 2016 in Nairobi. Experts of German technology solutions presented their knowledge in the water and wastewater sector. The Kenyan-German Water Week 2016 is part of the Export Initiative Environmental Technologies of the German Federal Ministry of Environment, Nature Conservation, Building and Nuclear Safety (BMUB). The medium-term to long-term objective is to form a strategic partnership between Kenya and Germany in the water and wastewater sector and to develop a roadmap thereof.

British American Tobacco scooped the overall Energy Management Award during the 12th Annual Energy Management Awards (EMA) Gala Dinner held on 8 April, 2016 at Safari Park Hotel, Nairobi. In the last 12 years, KAM has seen 12 billion saved through energy efficiency measures.

WIN: CBA training on Financial Sustainability SUNREF team on 4 March, 2016, took part in a half day training workshop aimed at training staff at Commercial Bank of Africa HQ in Upper Hill. The objective of the training that was organised at the bank’s request was aimed at improving the understanding of the staff in matters around renewable energy and energy efficiency. 15 Members of staff from credit risk analysis, corporate banking and business banking including CBA Kenya CEO were present. Hydro and Solar PV was given special attention at the workshop.

WIN: KAM, UMA sign focal point agreement to support EE and RE investments

On 31 March 2016, Kenya Association of Manufacturers (KAM) and Uganda Manufacturers Association (UMA) signed an Accord to Promote Clean Energy Solutions in Uganda at the UMA Business Networking Luncheon Event. The Focal Point agreement between KAM and UMA allows the SUNREF East Africa program to have a focal point organization to drive its day-to-day activities in Uganda.

SUNREF East Africa will help private sector actors in Uganda seize the opportunities of the eco-friendly transition and encourage East African banks to finance such efforts on customized financial terms. This innovative range of services consequently gives the private sector greater access to bank financing to purchase better quality equipment, and thereby make savings and increase its competitiveness.

WIN: CEO Forum on Financing Clean Energy Projects This forum held on April 8, 2016 attracted more than 200 high level participants drawn from government, development institutions and the private sector. The aim of the forum was to showcase successful energy efficiency and clean energy projects, bring together project developers and financiers to share available clean energy financing and challenges facing clean energy project developers.

ADVOCACY: Inventing Green Roundtable discussion held KAM participated in the Inventing Green roundtable discussion organised by Aspen Network of Development Entrepreneurs (ANDE). The event was themed: Strengthening the Ecosystem for environmentally responsible inventors and green technology-based small and growing businesses (SGBs) in East Africa. KAM made a presentation on what the Association is doing to promote the uptake of Green technologies in industry.

ADVOCACY: Solar Lighting Policy Brief Workshop KAM participated in the Solar Lighting Policy brief workshop on 27 June-1 July 2016 in Nakuru. The workshop was organized by the Ministry of Environment and Natural Resources (MENR) through the Low Emissions Climate Resilient Development (LECRD) programme.

The main goal was to develop a Solar Lighting policy brief for submission to government. The policy is expected to accelerate the uptake of solar products, promote local assembly and manufacturing of solar products, promote proper disposal of solar waste, create awareness of solar products and ensure and safeguard customer protection - quality of solar products and services.

WIN: Clean Energy and Climate Conference

The Clean Energy & Climate Change Conference was held in Mombasa, Kisumu and Nakuru. This conference provided a platform for industry to meet Renewable Energy and Energy Efficiency technology solution providers, National and County Government, Financiers and Industry Stakeholders.

With the signing of the Paris Agreement at COP 21 and with Kenya’s commitment to reduce carbon emissions, there is need for the private sector to understand the impacts of this agreement and commitments and appreciate the opportunities especially in investments in clean energy. KAM aims to create awareness of the opportunities and assist national and county governments to create an enabling environment in a bid to catalyze investments in clean energy.

WIN: KAM Holds trade mission to Goma, DRC

Kenya Association of Manufacturers (KAM), in partnership with the Ministry of Foreign Affairs in Kenya organized a Trade and Investment mission to Goma, Democratic Republic of the Congo (DRC) on 10 – 14 October 2016. The aim of the trade mission was to make contacts with both Government and Businesses of DRC and to explore Trade and Investment opportunities in the DRC market.

With the guidance from the Trade and Tax board committee in KAM, it was resolved that DRC is a virgin market which if explored would provide Market opportunities for Kenyan Products.

The 12th KAM Kaizen Conference was held on 27 and 28 July, 2016 at Safari Park Hotel, Nairobi. WIN: KAM Participates in the India-Africa Food Business Forum KAM participated at the India-Africa Food Business to Business Meeting whose aim objective was to showcase the strong Food Sourcing and Processing base of India. WIN: KAM hosts the Ethiopian Ambassador KAM Chief Executive and Board of Directors on February 2, 2016 hosted the Ethiopian Ambassador to Kenya for a courtesy call to KAM. The meeting emphasised on the need to actualise the Special Status Agreement (SSA) between Kenya and Ethiopia to enhance trade between the two countries.

WIN: Kenya hosts VF Corporation for Investment and B2B Forum On 17 March 2016, Kenya’s Ministry of Industry, Trade and Cooperatives led by Cabinet Secretary Adan Mohamed hosted VF Corporation delegation for B2B meetings with business representatives from various sectors. VF Corporation is an American Company that specializes in both textile and footwear and it is anticipated that these sectors will benefit from this visit.

ADVOCACY: Kenya - Ethiopia meet to Enhance Bilateral Trade Ties The Business Community in Kenya, led by Kenya Association of Manufacturers held a meeting with the Ethiopian Delegation led by the Ethiopian Prime Minister to review trade ties between the two countries. The need to put more efforts in enhancing the realization of the objectives of the Special Status Agreement (SSA) by both countries was lauded. KAM called on the two Governments to work more closely to strengthen their economic and commercial ties.

ADVOCACY: Kenya - South Africa Business Forum Held Kenya - South Africa Business Forum was held on 11 October 2016 in Nairobi during a state visit by the President of South Africa, H.E. Jacob Gedleyihlekisa Zuma.

The Business forum involved presentations on investment opportunities in Kenya and South Africa followed by a B2B networking session between Kenyan manufacturers and South African manufacturers.

ADVOCACY: Kenya Mining Forum Held KAM participated in the Kenya Mining Forum on 28 - 29 September 2016 in Nairobi. The Forum showcased Kenya’s ‘open for business’ potential. The inaugural edition of Kenya Mining Forum showcased the country as an emerging destination for mining. Discussions with the Ministry of Mining and key stakeholders in the region highlighted the fact that is an opportune time to promote investment in Kenya as they recently approve the Mining Act in May 2016, providing more transparency and credibility for investors.

KAM’s presence in both the electronic and print media during the year greatly enhanced the Association’s visibility both locally and internationally. Our engagement through the media took various forms.

WIN: We had over 27 opinion articles and over 20 news releases appearing in the newspapers and media mentions all together numbered over 300. This was achieved through a variety of news articles and radio and television appearances in major news outlets. We also achieved our website target of a minimum of 10 monthly updates. This ensured that KAM was always visible in both print and electronic media and its voice on various issues affecting businesses was heard.

WIN: We ensured members had online access to all KAM publications by posting the online copies on ISSUU.

WIN: 45 Executives Briefs, 10 KAM wins, 7 Chapter Newsletters were published in addition to the daily KAM news highlights and monthly media mentions.

Technology platforms such as mailchimp continued to be used to enhance marketing of KAM services such as trainings. We continued to enhance our presence in social media and followers on both our Facebook and Twitter pages increased by over 35 percent. We are also on Youtube channel with over 16 videos uploaded this year. Emails to members were reduced by the introduction of The Weekly Snapshot. The e-shot comprised of KAM information alerts such as the Standards Alert, Legislation Alert, Events Alert, Market Watch, Tender Watch and the CEO’s Brief.

WIN: Over 100 events were held this year all supported through publicity and branding.

WIN: Corporate Events and Summits

KAM-Kenya Power Golf Day KAM and Kenya Power held the third KAM-Kenya Power Golf Day on 12 August 2016 at the Muthaiga Golf Day which attracted 150 players from senior level management.

KAM Chief Executive, Ms. Phyllis Wakiaga appreciated Kenya Power for their partnership and support over the years. Kenya Power’s Strategy Business - General Manager, Eng. Peter Mungai stated that the event provided Kenya Power with an opportunity to interact and get feedback away from the boardroom.

KAM participates in the EAC Business Leaders Summit

The East African Community (EAC) Business Leaders Summit and Heads of State summit took place on 1 and 2 March, 2016 respectively in Arusha, Tanzania.

The Business Summit featured key business leaders discussing the state of the Integration process particularly the implementation of the Common Market Protocol and the Customs Union Protocol and the opportunities and challenges arising from the implementation of the incremental stages of the Customs Union and the Common Market.

During the summit the EABC led CODE of Ethics for Businesses in the East African Community, the EABC Corporate Book and the EABC NTB Report for 2015 were launched.

African Transformation Forum 2016 takes place in Rwanda

The African Center for Economic Transformation (ACET), in partnership with the Government of Rwanda convened the first African Transformation Forum (ATF) in Kigali, Rwanda on 14 to 15 March 2016.

KAM Chief Executive participated in the panel discussions on seizing new opportunities in manufacturing. The objective of the ATF was to facilitate knowledge sharing and peer learning across global and African luminaries from the public and private sectors and to launch the Coalition for Transformation in Africa.

Nation Media Group launches new printing press

KAM participated in the official launch of Nation Media Group’s new printing press on Mombasa Road that was officially opened by His Highness The Aga Khan. The press, which has a capacity to print 86,000 newspapers per hour, is a state-of- the-art facility intended to offer a range of options for advertisers and a fresh new look for readers.

KAM Participates in the IDG Frontier 100 Forum The Initiative for Global Development (IGD) Frontier 100 Forum took place on 13 -14 May, 2016 in Nairobi. The event was themed, “Engines of Growth: Powering African Companies to Create Employment and Accelerate Development”, and focused on how African companies and multinational corporations can drive job creation and capitalize on today’s business environment for growth. The Forum featured a panel on achieving inclusive growth through greater trade opportunities that was moderated by KAM Chief Executive Ms. Phyllis Wakiaga.

Finance and Institutional Development As a membership organisation, we rely on membership for the upkeep of the organisation. During the year many of you renewed your subscription and patronised the organisation’s activities and for these we are grateful. Indeed we are very proud of your support which enabled us meet all our operating expenses. We were able to contain our operational expenses within the budget levels with some operational surplus to tide us over a rainy day.

The 5-Storey state of the art KAM building was constructed to House KAM and provide an income stream in form of rental income. Managing of the facility which is now fully let is going on well.

In addition we received grants earmarked and targeted support from partners of the organisation mostly targeted at facilitating our policy advocacy work and member services with a special focus on Energy and SME services. Conclusion

Though we did not win all our battles neither has the war been lost. We are approaching the New Year full of optimism given the successes we have managed to achieve this year. The secretariat has its work cut out for it in 2017 and we are ready to face the challenge.

Our agenda remains focused on Securing industry in Kenya for Shared Prosperity, reducing the cost of doing business and enhancing Kenya’s competitiveness.
