1.0 PURPOSE OF ARTICLE

1.1 To advise Members of the Government’s new planning practice guidance for renewable and low carbon energy.

2.0 INTRODUCTION

2.1 The Department for Communities and Local Government (DCLG) has issued new planning guidance for renewable and low-carbon energy projects. The new guidance ‘Planning Practice Guidance for Renewable Energy’ replaces the previous guidance ‘Planning for Renewable Energy: A Companion Guide to PPS22’, which has now been cancelled. The new guidance is available to download at the following web link. https://www.gov.uk/government/publications/planning-practice-guidance-for- renewable-energy

2.2 The practice guidance is designed to be used by the Local Planning Authority alongside the National Planning Policy Framework (NPPF) and will assist local authorities in weighing up the need for renewable energy projects against other environmental concerns.

2.3 The NPPF is committed to delivering the carbon reduction targets set out within the Climate Change Act (2008). In support of the NPPF, this guidance sets out clearly that increasing the amount of energy from renewable and low carbon technologies in the UK will help to secure energy supply, reduce carbon emissions and stimulate investment in new jobs and business.

- 127 - 2.4 The NPPF, at paragraph 98, also states that applications for renewable and low carbon energy should be approved if its impacts are or can be made acceptable. This guidance seeks to provide greater context to the framework and further emphasises that proposals must be balanced with other environmental impacts and that the need for renewable or low carbon energy does not automatically override environmental protections.

3.0 GUIDANCE CONTENTS

3.1 The guidance includes information for plan making, setting out how local authorities can develop a positive strategy to promote the delivery of renewable and low carbon energy but recognising that whilst local authorities should design policies to maximise such development, there is no set quota or target that the local authority has to deliver. Policy EN1 of the new Local Plan and the Councils Draft Sustainable Energy Strategy are both reflective of this guidance and demonstrate how the Council is already working to achieve low carbon and renewable energy delivery in the most appropriate way by providing a local framework.

3.2 In relation to decision making and planning proposals, the new guidance provides detail on the particular planning considerations for each of the technology types covered by the document which includes biomass, hydropower, active solar technology (photovoltaics and solar water heating), solar farms, and wind turbines.

3.3 In the run up to its release, the general media have been focusing on the greater “say” to be given to communities through this guidance with the suggestion that local objection to a wind farm would carry great weight and be sufficient in itself to refuse planning applications. However, this is not the case. The guidance is clear that the planning concerns of local communities should be properly heard and the criteria within the document is designed to help this assessment process. The guidance also advocates local and neighbourhood plans as the key to delivering development that has the backing of local communities. Therefore, the document does not give increased weight to local communities views against other issues, rather it emphasises the need to give full consideration of the local community and to fairly weigh up these concerns against the benefits of renewable energy projects. In doing so it does redress the balance between the two issues which previously was weighted more in favour of the delivery of renewable and low carbon energy.

3.4 In addition, paragraph 16 of the new guidance clearly sets out the Governments view on buffer zones and separation distances. This point is relevant as it has recently been raised by many local residents in areas where proposals for wind turbines have been put forward. Importantly the guidance does not advocate a blanket buffer zone policy and suggests a case by case assessment of suitable separation distance between wind turbines and residential properties.

4.0 IMPLICATIONS FOR THE COUNCIL

4.1 This guidance does not present any direct implications for the Council other than providing additional detail to allow Officers and Members of the Planning

5.0 SUSTAINABILITY IMPLICATIONS/COMMUNITY STRATEGY

5.1 There are no significant sustainability impacts associated with this article and, in particular, no significant impact on crime and disorder. The article has no significant links with the Sustainable Community Strategy.

SUBJECT: M58 TO SOUTHPORT CORRIDOR STUDY

1.0 PURPOSE OF ARTICLE

1.1 To inform Members of the recent publication of the M58 to Southport Corridor Study published by Lancashire County Council (LCC).

2.0 BACKGROUND

2.1 In 2012 independent consultants (Jacobs) were employed by LCC to produce the Southport to M58 Corridor Study. The purpose of the study was to gain a better understanding of the problems associated with traffic congestion on the M58 to Southport corridor and to evaluate the options for reducing this congestion, particularly around Ormskirk Town Centre.

2.2 The study was carried out in two stages, Stage one focused on data collection and engaging stakeholders to identify the issues and problems associated with the transport corridor. Stage two focused on options development and an appraisal of the options to consider how well they would address the issues raised through the Stage one report.

2.3 The options appraised included consideration of the proposed Ormskirk bypass and an alternative strategy which brings together a package of smaller-scale interventions known as the ‘alternative strategy’. The options evaluated within the report will eventually be considered as part of a wider Highways and Transport Masterplan currently being produced by LCC and is due to be published for consultation in autumn.

- 131 - 2.4 There has been a long standing aspiration to provide a bypass of Ormskirk in order to tackle congestion around Ormskirk Town Centre and improve overall access between the M58 and Southport.

2.5 Responsibility for this scheme was handed to LCC to consider taking forward as a local road proposal but it did not emerge as a priority through work undertaken to inform the Regional Funding Allocations in 2006.

2.6 As a result of the Coalition Governments Comprehensive Spending Review (2010), and the subsequent submission of Local Authority Best and Final Funding Bids (2011) the Department for Transport Local Major Transport Scheme programme is currently over-subscribed and as such there is no prospect of the Government accepting any new bids for funding in the short term.

2.7 Previous work undertaken has always assumed that an Ormskirk by-pass would be the most appropriate solution. However, the scale and likely costs of the bypass effectively rule out any detailed development work within the lifetime of the current Local Transport Plan, which cover the period 2011-2021.

2.8 As such, LCC commissioned the M58 to Southport corridor study to re-examine the problems and issues associated with this part of the highway network in West Lancashire with a view to determining whether there are alternative (lower cost) measures that the County Council and other agencies could implement to mitigate identified problems and issues. These measures will need to be both affordable and deliverable within the Local Transport Plan period.. The study also identifies whether there is a need for the bypass.

2.9 In 2012, WLBC Officers along with other interested parties were made aware of the proposals and invited to an Options Workshop as a stakeholder. During this workshop a set of study objectives were agreed and a series of Options/interventions were then investigated by the consultants.

3.0 CURRENT POSITION

3.1 In July this year the study was published on LCC’s website. Regrettably, despite previous involvement, the Borough Council was not directly informed that the study had been published. The study is available on the LCC website on the link below or on request from the Planning Policy team:

3.2 Following on from the Stakeholder workshop, a series of options were considered. These options included schemes which have previously been considered through past transport studies as well as new options derived through the Stakeholder Workshop and early evaluation work. Following an initial sifting process, forty seven options were identified by LCC to be taken forward for further consideration. 3.3 In order to ensure that the alternative strategy delivers the widest possible benefits, a set of prioritisation criteria was derived in order to create a short list of potential options that will form the alternative strategy

- 132 - 3.4 A bespoke options appraisal tool was developed as part of the M58 to Southport Corridor Study. This tool appraised the options against the seven Local Transport Plan (LTP) priorities which are used to guide LCC expenditure on transport within the Borough. In addition, seven M58 to Southport corridor study objectives (listed below) were derived through discussion with stakeholders to establish the key concerns in relation to the M58 to Southport corridor and traffic congestion. The tool was also based upon the underlying principles set out within DfT’s Early Assessment & Sifting Tool.

3.5 The seven LTP transport priorities: x Improving access in areas of economic growth and regeneration x Providing better access to education and employment x Improving peoples quality of life and well being x Improving the safety of streets for the most vulnerable residents x Providing safe reliable, convenient and affordable alternatives to the car x Reducing carbon emissions

3.6 The agreed study objectives:

x Ensure efficient management of seasonal traffic and planned events to limit impact upon the M58 to Southport corridor and the local road network. x Improve the management of traffic and transport related to Edge Hill University. x Maximise the effectiveness of the Ormskirk town centre loop. x Encourage greater use of walking and cycling for local trips. x Reduce the impact of Heavy Goods Vehicles within Ormskirk and on the surrounding local road network. x Ensure transport infrastructure and services in the study area do not constrain future development. x Maximise the effectiveness of the public transport network and facilities within the study area.

Options considered but not taken forward

3.7 As part of the study, a number of rail options were considered, along with the Ormskirk A570 Park Road to A59 County Road route. Options for rail improvements included the re-introduction of the Burscough Curves, electrification to Burscough and the provision of a new rail station in Skelmersdale.

3.8 Although the proposed schemes would offer some benefits the options were discounted as being considered for the alternative strategy for a number of reasons including cost, deliverability within the LTP period (2011-2021) and not necessarily meeting the objectives of the study, as set out above at 3.6.

3.9 A number of the shortlisted interventions were considered and subsequently discounted due to the limitation of the option to deliver significant benefits and complicated dependencies on other projects and delivery organisations such as the Highways Agency.

- 133 - 3.10 The interventions that were considered to contribute to the study objectives and to be deliverable were then consolidated to form an alternative strategy of preferred options to be taken forward as an alternative to the proposed Ormskirk by-pass. The alternative strategy can be seen in the table below.

4.0 CONCLUSIONS AND IMPLICATIONS FOR THE COUNCIL

4.1 The report concludes that although the Ormskirk bypass contributes well towards the study objectives (set out at 3.6 above), its contribution towards the LTP transport priorities is poor given the scale and likely costs, including the challenges regarding funding and deliverability. The report also concluded that there is potential for the alternative strategy, consisting of the above discrete projects and interventions, to deliver many of the same benefits of the proposed Ormskirk bypass but at a much lower cost.

4.2 At this stage, the study only provides a number of recommendations for consideration and is not an indicative framework which is required for delivery by the Borough Council or County Council. However, LCC are currently working on the West Lancashire Transport Masterplan which will provide a framework for transport and highways improvements in West Lancashire that may benefit from potential future funding sources.

4.3 The Masterplan will be informed by a number of documents including the emerging Local Plan, the Lancashire LTP3 and the recommendations of this study. In addition, some schemes which did not make it through the sifting process of this study as they did not meet enough of the study objectives, may still need considering for inclusion within the West Lancashire Masterplan and

- 134 - future LTP implementation plans. As such, officers will continue to work to develop relevant schemes and make appropriate representation when consulted.

4.4 In summary, the Council should continue to work with LCC on the delivery of the Masterplan to ensure that it is reflective of the Boroughs needs and growth plans. Future consultations relating to the Masterplan will be reported to Members along with updates to advise of the publication of the final Masterplan.

5.0 SUSTAINABILITY IMPLICATIONS / COMMUNITY STRATEGY

5.1 There are no significant sustainability impacts associated with this report and, in particular, no significant impact on crime and disorder. The report has no significant links with the Sustainable Community Strategy.

6.1 There are no significant financial or resource implications arising from this report.
