July 12, 2021), Court Opinion Pagination * BL Majority Opinion > UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF INDIANA, INDIANAPOLIS DIVISION JOHN M. KLUGE, Plaintiff, vs. BROWNSBURG COMMUNITY SCHOOL CORPORATION, Defendant. No. 1:19-cv-2462-JMS-DLP July 12, 2021, Filed July 12, 2021, Decided BNA Headnotes FAIR EMPLOYMENT PRACTICES SUMMARY [1] Religious Accommodation An evangelical Christian teacher wasn’t denied a reasonable religious accommodation when an Indiana public school district forced him to resign after rescinding an agreement that allowed him to avoid using transgender students’ preferred first names and pronouns by referring to all students in his classes by their last names, a federal court in Indiana ruled. The teacher’s refusal to comply with a new transgender name- and-pronoun-use policy made the transgender students feel dehumanized and uncomfortable and imposed an undue hardship on the district’s obligation to educate all of its students, the court said. The school district further established undue hardship by its evidence that it risked potential lawsuits and liability under Title IX of the 1972 Education Amendments Act if it permitted the teacher to continue to flout the name- and-pronoun-use policy, the court said. © 2021 The Bureau of National Affairs, Inc.
