Les uns en souriaient, mais les autres voulaient réveiller l’opinion publique. Un Premier ministre confiait la rédaction d’un rapport sur le sujet à un parlementaire en mission. Roger Ikor interpellait le Président de la République, les familles s’organisaient en associations de défense des victimes, le Parlement créait une Commission d’enquête, le Gouvernement mettait sur pied un Observatoire, un nouveau Premier ministre instituait une Mission de lutte contre les sectes, un autre la transformait en Mission Interministérielle de Vigilance et de Lutte contre les Dérives Sectaires, les médias presque unanimes dénonçaient le fléau des méthodes d’emprise de ces groupes. Bref, la prise de conscience du phénomène était bien réelle, et le sentiment que l’on ne pouvait se décharger de ce problème sur la sphère privée, largement partagé. Au-delà des nuances liées aux sensibilités politiques des uns et des autres, au-delà des subtilités de vocabulaire, c’est en fait toute une politique de prévention, d’information, d’aide aux victimes et à leurs familles, et de lutte contre toutes les formes de dérives sectaires qui a pris forme petit à petit à la lumière des expériences acquises, dans le plus large consensus politique qu’un sujet de société ait jamais pu réunir dans notre pays. La mouvance sectaire, qu’elle se manifeste dans le domaine spirituel, philosophique, ésotérique, occultiste… en perte de vitesse très sensible depuis le début du nouveau siècle, ou qu’on la retrouve dans ses expressions plus modernes et mieux adaptées à l’attente de nos concitoyens que sont les thèmes de la santé, de la formation, du développement personnel, du coaching ou de l’accompagnement sur mesure etc… ne pouvait laisser faire sans réagir et force est de reconnaître qu’elle a su s’organiser rapidement pour riposter, au double plan national et international. Son discours est désormais bien au point : Toute action de l’État en ce domaine est attentatoire à l’exercice des libertés publiques et en particulier à la liberté de croyance, sans que la notion de croyance puisse le plus souvent être réellement mise en évidence. Toute mise en garde des pouvoirs publics est discriminatoire, toute accusation diffamatoire. Il n’y a pas de victimes, seulement des apostats dont les témoigna- ges sont plus que sujet à caution. Il n’y a pas de faits établis, il n’y a que des rumeurs. Rapport au Premier ministre 2007 ▼ 5 Il y a bien ça et là quelques décisions de justice, mais elles sont forcé- ment iniques et cette jurisprudence ne pèse pas très lourd face aux décisions des juridictions européennes ou nationales dont les arrêts et jugements sont alors interprétés et croisés par les mouvements en question avec un don pour l’instrumentalisation qui mérite l’admiration. En résumé, il n’y a pas de victimes et pas de trouble à l’ordre public ; il y a des affaires plus urgentes et plus sérieuses qui devraient mobiliser l’éner- gie de l’État, seule une poignée de personnes, toujours les mêmes d’ailleurs, gaspillent les deniers publics dans une vaine chasse aux sorcières qui date d’un autre temps. Eh bien, pendant trois ans, j’ai rencontré quotidiennement ces victimes que l’on voudrait invisibles, j’ai écouté leurs familles, j’ai mesuré les dégâts, les dommages irréparables commis par tout ce que la mouvance sectaire compte de gourous et d’apprentis sorciers. J’ai constaté l’attente de tous ceux qui avaient souffert et souffraient encore du fait d’agissements faisant fi de tout respect de la dignité humaine. J’ai relevé le cynisme et l’arrogance de certains responsables de mouve- ments sectaires. Je suis encore stupéfait par l’aplomb et la mauvaise foi de leurs leaders et de leurs défenseurs. C’est pourquoi je veux rendre hommage à l’action de tous ceux qui se dévouent sans compter pour que nos concitoyens ne succombent pas à l’atti- rance exercée par ces mouvements et pour que ceux qui ont gravement nui à d’autres hommes, à d’autres femmes, à des enfants, pour que ceux qui abusent de la faiblesse, de la crédulité ou de la détresse de leurs semblables soient obli- gés de rendre des comptes à la justice. A tous, élus de la Nation, responsables d’associations, professionnels de la santé, de l’éducation, de la justice, personnes qualifiées, fonctionnaires de l’administration centrale, déconcentrée ou territoriale, je dis un merci sincère pour leur action désintéressée et profondément humaine. Les comportements totalisants des mouvements sectaires les conduisent à piétiner la devise de la République : quel sens ont encore les mots « Liberté Égalité Fraternité » dans un monde où la dignité humaine n’a plus cours ? Puissions-nous ne jamais nous tromper de victimes et continuer à répondre à ceux qui appellent légitimement l’État au secours. 6 MIVILUDES ▼ Introduction Le décret qui a institué la Mission interministérielle de vigilance et de lutte contre les dérives sectaires fait obligation à son Président de présenter chaque année un rapport au Premier ministre. Ce document est le cinquième, puisque la création de la Mission remonte à décembre 2002. Les deux premiers documents, par ordre chronologique, avaient suc- cessivement mis l’accent sur le risque sectaire puis sur les dérives sectaires, s’ef- forçant de bien cadrer le champ de ses activités et de préciser, à l’usage du Parlement qui suit attentivement son action et des citoyens attendant de l’État d’être protégés contre un danger ressenti comme particulièrement intoléra- ble, la nature des risques, et la façon d’en appréhender la réalité dans le strict respect de l’état de droit. Dans son troisième rapport, la Mission mettait l’accent, exemples à l’ap- pui, sur quatre domaines qui justifiaient, compte tenu de la qualité des victimes potentielles, une vigilance aiguë et une complète information des responsables politiques et administratifs : les atteintes visant les mineurs, les dérives sectaires dans le domaine de la santé au sens large, le risque de pénétration de l’appa- reil économique et l’infiltration du secteur porteur qu’est, en termes d’image, l’aide humanitaire. L’an passé, le choix a été fait d’aborder des sujets nouveaux, reflétant au plus près l’évolution du paysage sectaire ainsi que la capacité d’adaptation, au quotidien, des organisations en question et de leurs dirigeants. Il ne s’agis- sait pas, pour la MIVILUDES, de stigmatiser qui que ce soit a priori, mais bien de jouer pleinement son rôle de vigie en procédant, en amont, à une analyse du risque, à une recherche objective de l’évolution des dangers. En effet, cha- que fois que l’État se prémunit contre un type de risque, la mouvance sectaire a tôt fait de s’adapter en contournant les textes,

    FRANCE 2016 INTERNATIONAL RELIGIOUS FREEDOM REPORT Executive Summary The constitution and the law protect the right of individuals to choose, change, and practice their religion. The government investigated and prosecuted numerous crimes and other actions against religious groups, including anti-Semitic and anti- Muslim violence, hate speech, and vandalism. The government continued to enforce laws prohibiting face coverings in public spaces and government buildings and the wearing of “conspicuous” religious symbols at public schools, which included a ban on headscarves and Sikh turbans. The highest administrative court rejected the city of Villeneuve-Loubet’s ban on “clothes demonstrating an obvious religious affiliation worn by swimmers on public beaches.” The ban was directed at full-body swimming suits worn by some Muslim women. ISIS claimed responsibility for a terrorist attack in Nice during the July 14 French independence day celebration that killed 84 people without regard for their religious belief. President Francois Hollande condemned the attack as an act of radical Islamic terrorism. Prime Minister (PM) Manuel Valls cautioned against scapegoating Muslims or Islam for the attack by a radical extremist group. The government extended a state of emergency until July 2017. The government condemned anti- Semitic, anti-Muslim, and anti-Catholic acts and continued efforts to promote interfaith understanding through public awareness campaigns and by encouraging dialogues in schools, among local officials, police, and citizen groups. Jehovah’s Witnesses reported 19 instances in which authorities interfered with public proselytizing by their community. There were continued reports of attacks against Christians, Jews, and Muslims. The government, as well as Muslim and Jewish groups, reported the number of anti-Semitic and anti-Muslim incidents decreased by 59 percent and 58 percent respectively from the previous year to 335 anti-Semitic acts and 189 anti-Muslim acts.

    France Page 1 of 8 France International Religious Freedom Report 2006 Released by the Bureau of Democracy, Human Rights, and Labor The constitution provides for freedom of religion, and the Government generally respected this right in practice; however, some religious groups remain concerned about legislation passed in 2001 and 2004, which provided for the dissolution of groups under certain circumstances and banned the wearing of conspicuous religious symbols by public school employees and students. A 1905 law on the separation of religion and state prohibits discrimination on the basis of faith. Government policy continued to contribute to the generally free practice of religion. A law prohibiting the wearing of conspicuous religious symbols in public schools by employees and students entered into force in September 2004. Despite significant efforts by the Government to combat anti-Semitism and an overall decline in the number of incidents, anti-Semitic attacks persisted. The Government has a stated policy of monitoring potentially "dangerous" cult activity through the Inter-ministerial Monitoring Mission against Sectarian Abuses (MIVILUDES). Some groups expressed concern that MIVILUDES publications contributed to public mistrust of minority religions, and that public statements from the new president indicated the organization would take a harder line against minority religions. The UN Special Rapporteur on Freedom of Religion or Belief issued a report indicating that the Government generally respected the right to freedom of religion or belief, but expressed concern about the application of the 1905 law, the treatment of cult groups and certain new religious movements, and the 2004 legislation regarding religious symbols in schools. The generally amicable relationship among religious groups in society contributed to freedom of religion.

There were reports of societal abuses or discrimination based on religious affiliation, belief, or practice; however, prominent societal leaders took positive steps to promote religious freedom.

    CHRISTIANE KÖNIGSTEDT New religious movements and alternative religions in France The use of digital media as a counter-strategy against social and legal exclusion Introduction In comparison to TV, radio and newspapers the combination of digital and ‘new’ media such as the internet provide a relatively democratic means of distributing information and express opinions in a variety of forms, all hav- ing a potentially worldwide coverage. There is also the capability also to use pictures, video and audio files increases the range of impressions which may be mediated to the addressee, and thus to present information in a more vivid and intuitively accessible way. There are plentiful examples of this, ranging from reports of fan behaviour in Poland at the 2012 UEFA European Football Championship, to unofficial reports from of the ‘Arab Spring’ (for further reading, see Hänska-Ahy and Shapour 2013). The internet is widely used in- ternationally by individuals and groups who otherwise perceive and experi- ence a lack of influence and even repression by authorities and whose opin- ions remain invisible in or are ignored by the mass media. The new media are a frequently-used means of expression in the political struggles of social and religious movements, especially as part of attempts to increase the number of supporters and to mobilise public opinion. The extent, of the usage as well as its degree of success, does vary and because of this variety, a compara- tive analysis can illuminate parts of the whole conflictuous configuration as well as the chances and limits of resistance and opposition via these media channels.

We welcome the launch of ODIHR’s hate crimes website late last year. Thirty-two participating States have fulfilled the commitment to provide hate crimes data to ODIHR; we encourage the remaining participating States to do so without delay. • We urge the EU and individual governments to ensure sustained attention to anti-Semitism by appointing envoys for that purpose. We also agree with the closing statement of the Swiss Chair-in- Office at last year’s Berlin Conference that the Working Definition of Anti-Semitism disseminated by the EU Monitoring Center remains a useful tool for governments and civil society in explaining how anti-Zionism is frequently a mask for anti-Semitism.

But if religious freedoms were frequently overlooked in the policy arena in the 1990s, they were often completely ignored in the study of social conflict. Prior to 2000 there were virtually no systematic data collections on religious freedoms and few studies attempted to understand the relationship between religious freedoms and social conflict. Indeed, even the more general topic of religion was surprisingly ignored in most studies of social conflict.

    WEBINAR Freedom of Religion From the USCIRF Report on Persecutions in Russia to Violations in Europe held on January 29, 2021 The webinar presents and discusses the recent annual USCIRF report, by the Policy Analyst Jason Morton, on the violations of religious freedom worldwide. The report has confirmed the concerns of LIREC, and other NGOs, for the persecution against religious minorities as Jehovah’s Witnesses, in Russia and elsewhere, carried out by some controversial anti-cult organizations. This is a problem that LIREC formerly brought to the attention of OSCE/ODIHR in 2013, when Italy was the object of recommendations due, precisely, to these associations’ legal and media-related activism. On the one hand, the USCIRF Report will hopefully allow for a greater international engagement in support of human rights in those areas; on the other hand, however, some anti-cult organizations like FECRIS (European Federation of Centers for Research and Information on Sectarianism), whose methods and purposes have been censured by the US commission, keep on carrying out its activities undisturbed in Europe. Pendant les dix années écoulées, le gouvernement français a considéré de son devoir de garantir la sûreté des citoyens en faisant preuve d’une grande vigilance, en alertant le public sur les risques sectaires et en luttant contre les agissements délictueux.
