THE RENFREWSHIRE COUNCIL (PAISLEY – EAST END) (VARIOUS RESTRICTIONS) ORDER 201*

The Renfrewshire Council in exercise of the powers conferred on them by Sections 1, 2, 19, 45 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 ("the Act") and of all other enabling powers and after consultation with the Chief Constable in accordance with Part III of Schedule 9 to the Act hereby make the following Order.

1 Citation and Commencement

(a) This Order may be cited as "The Renfrewshire Council (Paisley – East End) (Various Restrictions) Order 201*" and shall come into operation on the x day of x Two Thousand and x.

2 Interpretation

(a) In this Order the following expressions have the meanings hereby assigned to them:-

“bus” means either a motor vehicle constructed or adapted to carry more than 8 passengers (exclusive of the driver) or a local bus not so constructed or adapted;

“carriageway” means the part of the road where there is a right of passage by a vehicle, other than a right by pedal cycle only;

"Chief Constable" means the Chief Constable of Police;

"Council" means The Renfrewshire Council, a council constituted under section 2 of the Local Government etc. () Act 1994;

“disabled persons’ badge” means:-

(i) The same as Regulation 2 (1) of the Disabled Persons (Badges for Motor Vehicles) (Scotland) Regulations 2000 a badge issued under section 21 of the Chronically Sick and Disabled Persons Act 1970;

(ii) a badge issued under a provision of the law of Northern Ireland corresponding to that section, or

(iii) a badge issued by any European Community member State other than the United Kingdom for purposes corresponding to the purposes for which badges under that section are issued;

“disabled persons’ vehicle” means a vehicle lawfully displaying a disabled persons’ badge;

"emergency service vehicle" means a vehicle being used by the Police, Fire and Rescue Service or Ambulance Services;

“goods vehicle” means a motor vehicle or trailer constructed or adapted for the carriage or haulage of goods or burden of any description;

“local service” has the meaning given in section 2 of the Transport Act 1985;

"motor cycle" has the same meaning as in section 185 of the Road Traffic Act 1988;

“Plan” means a map referred to in the Schedule and annexed and executed as relative to this Order, which map for the avoidance of doubt forms part of this Order;

“postal packet” has the same meaning as in the Postal Services Act 2000;

“provision of a universal postal service” has the same meaning as in the Postal Services Act 2000;

“road” has the same meaning as in section 151 of the Roads (Scotland) Act 1984;

“Schedule” means the Schedule annexed and executed as relative to this Order;

“School Days” means a day during a school term period as published by the Director of Education and Leisure of Renfrewshire Council;

"taxi" has the same meaning as in Section 23(1) of the Civic Government (Scotland) Act 1982;

"telecommunication apparatus" is as defined in Schedule 2 of the Telecommunications Act 1984;

“universal service provider” has the same meaning as in the Postal Services Act 2000; and

"vehicle" unless the context otherwise requires, means a vehicle of any description and includes a machine or implement of any kind drawn or propelled along roads whether or not by mechanical power. (b) Note;

(i) All words importing the singular also include the plural and vice versa where the context requires.

(ii) Except where the context otherwise requires, references to any enactment include any such enactment as amended, extended or applied by or under any other enactment.

(iii) All signs and carriageway and kerb markings shall comply with The Traffic Signs Regulations and General Directions 2002.

(iv) Headings are for ease of reference only and are not intended to affect the interpretation of this Order.

3 No waiting and no loading at any time

a No person shall, except upon the direction or with the permission of a police constable in uniform, cause or permit any vehicle to wait (including loading) at any time, in any of the lengths of road specified in Schedule 1 to this Order.

4 No waiting at any time

(a) Save as provided in paragraphs (b) and (c) of this Article no person shall, except upon the direction or with the permission of a police constable in uniform, cause or permit any vehicle to wait at any time, on any of the lengths of road specified in Schedule 2 to this order.

(b) Part (a) of this Article shall not apply to any disabled person's vehicle.

(c) Paragraph (a) of this Article shall not prohibit any person from causing or permitting a vehicle to wait at the kerb in any of the lengths of road specified in Schedule 2 to this Order so long as may be necessary for the purpose of delivering or collecting goods or merchandise or loading or unloading the vehicle at premises adjoining the particular road being one of the roads specified in Schedule 2 to this Order provided that:-

(i) no vehicle engaged in delivering or collecting goods or merchandise or being loaded or unloaded shall wait for a longer period than thirty minutes in the same place and further, no such vehicle shall wait for a longer period than ten minutes in the same place without goods being loaded on to or unloaded from the vehicle.

(ii) notwithstanding the foregoing terms of paragraph (c) of this Article the driver of a vehicle who is waiting for the purpose of delivering or collecting goods or merchandise or loading or unloading the vehicle shall move the vehicle on the instruction of a police constable in uniform whenever such moving may be reasonably necessary for the purpose of preventing an obstruction.

5 No waiting within stated times

(a) Save as provided in paragraphs (b) and (c) of this Article no person shall, except upon the direction or with the permission of a police constable in uniform, cause or permit any vehicle to wait between the hours of 8.00am and 6.00pm Monday to Saturday inclusive, on any of the lengths of road specified in Schedule 3 to this Order.

(b) Paragraph (a) of this Article shall not apply to any disabled person's vehicle.

(c) Paragraph (a) of this Article shall not prohibit any person from causing or permitting a vehicle to wait at the kerb in any of the lengths of road specified in Schedule 3 to this Order so long as may be necessary for the purpose of delivering or collecting goods or merchandise or loading or unloading the vehicle at premises adjoining the particular road being one of the roads specified in Schedule 3 to this Order provided that:-

(i) no vehicle engaged in delivering or collecting goods or merchandise or being loaded or unloaded shall wait for a longer period than thirty minutes in the same place and further, no such vehicle shall wait for a longer period than ten minutes in the same place without goods being loaded on to or unloaded from the vehicle.

(ii) notwithstanding the foregoing terms of paragraph (c) of this Article the driver of a vehicle who is waiting for the purpose of delivering or collecting goods or merchandise or loading or unloading the vehicle shall move the vehicle on the instruction of a police constable in uniform whenever such moving may be reasonably necessary for the purpose of preventing an obstruction.

6 No waiting within stated times

(a) Save as provided in paragraphs (b) and (c) of this Article no person shall, except upon the direction or with the permission of a police constable in uniform, cause or permit any vehicle to wait between the hours of 8.00am and 5.00pm Monday to Friday inclusive, on any of the lengths of road specified in Schedule 3 to this Order.

(b) Paragraph (a) of this Article shall not apply to any disabled person's vehicle.

(c) Paragraph (a) of this Article shall not prohibit any person from causing or permitting a vehicle to wait at the kerb in any of the lengths of road specified in Schedule 4 to this Order so long as may be necessary for the purpose of delivering or collecting goods or merchandise or loading or unloading the vehicle at premises adjoining the particular road being one of the roads specified in Schedule 4 to this Order provided that:-

(i) no vehicle engaged in delivering or collecting goods or merchandise or being loaded or unloaded shall wait for a longer period than thirty minutes in the same place and further, no such vehicle shall wait for a longer period than ten minutes in the same place without goods being loaded on to or unloaded from the vehicle.

(ii) notwithstanding the foregoing terms of paragraph (c) of this Article the driver of a vehicle who is waiting for the purpose of delivering or collecting goods or merchandise or loading or unloading the vehicle shall move the vehicle on the instruction of a police constable in uniform whenever such moving may be reasonably necessary for the purpose of preventing an obstruction.

7 Limited Waiting

(a) Save as provided in paragraph (b) of this Article no person shall, except upon the direction of with the permission of a police constable in uniform, cause or permit any vehicle to wait between the hours of 8.00am and 6.00pm inclusive, on the days Monday to Saturday inclusive and in any lengths of the road specified in Schedule 5 to this Order:-

(i) for a period longer than 30 minutes; or

(ii) if a period of less than that specified in 1 hour has elapsed since the last period of waiting of the vehicle in any of the specified area of road

(b) Paragraph (a) of this Article shall not apply to any disabled person's vehicle.

8 Limited Waiting Mon – Fri 8am – 6pm 30mins No return within 1 hour

(a) Save as provided in paragraph (b) of this Article no person shall, except upon the direction of with the permission of a police constable in uniform, cause or permit any vehicle to wait between the hours of 8.00am and 6.00pm inclusive, on the school days only and in any lengths of the road specified in Schedule 5 to this Order:-

(i) for a period longer than 30 minutes; or

(ii) if a period of less than that 1 hour has elapsed since the last period of waiting of the vehicle in any of the specified area of road

(b) Paragraph (a) of this Article shall not apply to any disabled person's vehicle.

9 Exceptions to Articles 3, 4, 5, 6, 7 and 8

Nothing in Articles 3, 4, 5, 6, 7 and 8 of this Order shall:-

(a) Prevent any person from causing or permitting a vehicle to wait in any of the lengths of the roads referred to in those Articles:-

(i) for so long as may be necessary to enable a person to board or alight from the vehicle or load thereon or unload there from his personal luggage;

(ii) for so long as may be necessary to enable the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in connection with any building operation or demolition, the removal of any obstruction to traffic, the maintenance, improvement or reconstruction of any of the lengths of the roads so referred to, or the laying, erection, alteration or repair in or near to any of the said lengths of the roads, of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any telecommunication apparatus;

(iii) for so long as it may be necessary to enable the vehicle, if it cannot conveniently be used for such purpose in any other road, to be used in pursuance of statutory powers and duties and in particular, but without prejudice to the generality of the foregoing to be used as an emergency service vehicle;

(iv) if the vehicle is waiting owing to the driver being prevented from proceeding by circumstances beyond his control or if such waiting is necessary in order to avoid an accident;

(v) if the vehicle is in the service of or employed by the Post Office and is waiting in any of the lengths of the roads while postal packets addressed to premises adjacent thereto are being unloaded from the vehicle or having been unloaded there from are being delivered or while postal packets are being collected from premises or pillar boxes adjacent thereto;

(vi) for the purpose of loading or unloading the vehicle while the vehicle is standing at the kerb and is in actual use in connection with the removal of furniture from one office or dwelling house to another office or dwelling house or the removal of furniture from such premises to a depository or to such premises from a depository;

(vii) to enable the vehicle to be used wholly and necessarily by the principal participants in connection with funeral operations and weddings;

(viii) to enable the vehicle to be used by a qualified medical practitioner engaged on a house call; and

(ix) for so long as is necessary for any vehicle to deliver to or uplift cash from any bank or post office premises.

10 Designated Motorcycle Parking Place

(a) Each area of road which is specified in Schedule 7 to this Order is authorised for use as a parking place between the hours of 8.00am and 6.15pm Monday to Saturday inclusive for motorcycles only and that in accordance with the following provisions:-

(i) The limits of each allocated parking place specified in Schedule 7 to this Order and the limits of each parking bay in each parking place shall be indicated on the carriageway in such a manner as the Council may determine by signs, carriageway markings, lines or other indications.

(ii) Every motorcycle left in a parking place specified in Schedule 7 to this Order shall so stand such that every part of the motorcycle is within the limits of a parking bay.

(iii) Any person duly authorised by the Council or a Police Constable in uniform or a parking attendant may move or cause to be moved in case of an emergency, to any place he or she thinks fit, any motorcycle left in any parking place.

(iv) Any person duly authorised by the Council may suspend the use of any parking place or any part thereof whenever such suspension is considered reasonably necessary:-

(i) for the purpose of facilitating the movement of traffic or promoting its safety;

(ii) for the purpose of any building operation, demolition, or excavation in or adjacent to the parking place or the maintenance, improvement or reconstruction of the parking place or the laying, erection, alteration, removal or repair in or adjacent to the parking place of any sewer or of any main, pipe, apparatus for the supply of gas, water or electricity or of any telecommunication apparatus, traffic sign or parking ticket machine;

(iii) for the convenience of occupiers of premises adjacent to the parking place on any occasion of the removal of furniture from one office or dwelling house to another office or dwelling house or the removal of furniture from an office or dwelling house to a depository or to an office or dwelling house from a depository;

(iv) on any occasion on which it is likely by reason of some special attraction that any street will be thronged or obstructed; or

(v) for the convenience of occupiers of premises adjacent to the parking place at times of weddings or funerals or on other special occasions.

(v) For the purpose of this Article and Schedule 7 to this Order "parking place" means a place where vehicles may wait and "parking bay" means such part of a parking place as is allocated for use by one vehicle.

(vi) A police constable in uniform may suspend for not longer than twenty-four hours the use of a parking place or part thereof whenever such suspension is considered reasonably necessary for the purpose of facilitating the movement of traffic or promoting its safety.

11 Designated Disabled Parking Place

(a) Each area of road which is specified in Schedule 8 to this Order is authorised for use as a parking place for disabled persons vehicles only and that in accordance with the following provisions:-

(i) The limits of each allocated parking place specified in Schedule 8 to this Order and the limits of each parking bay in each parking place shall be indicated on the carriageway in such a manner as the Council may determine by signs, carriageway markings, lines or other indications.

(ii) Every disabled persons vehicle left in a parking place specified in Schedule 8 to this Order shall so stand such that every part of the vehicle is within the limits of a parking bay.

(iii) Any person duly authorised by the Council or a Police Constable in uniform or a parking attendant may move or cause to be moved in case of an emergency, to any place he or she thinks fit, any motorcycle left in any parking place.

(iv) Any person duly authorised by the Council may suspend the use of any parking place or any part thereof whenever such suspension is considered reasonably necessary:-

(i) for the purpose of facilitating the movement of traffic or promoting its safety;

(ii) for the purpose of any building operation, demolition, or excavation in or adjacent to the parking place or the maintenance, improvement or reconstruction of the parking place or the laying, erection, alteration, removal or repair in or adjacent to the parking place of any sewer or of any main, pipe, apparatus for the supply of gas, water or electricity or of any telecommunication apparatus, traffic sign or parking ticket machine;

(iii) for the convenience of occupiers of premises adjacent to the parking place on any occasion of the removal of furniture from one office or dwelling house to another office or dwelling house or the removal of furniture from an office or dwelling house to a depository or to an office or dwelling house from a depository;

12 Designated Loading Bay (Goods Vehicle Loading Only)

(a) Save as provided in paragraphs (b) and (c) of this Article no person shall, except upon the direction or with the permission of a police constable in uniform, cause or permit any vehicle to wait on any of the lengths of road specified in Schedule 9 to this Order.

(b) Paragraph (a) of this Article shall not prohibit any person from causing or permitting any goods vehicle to wait at the kerb in any of the lengths of road specified in Schedule 9 to this Order so long as may be necessary for the purpose of delivering or collecting goods or merchandise or loading or unloading the vehicle at premises adjoining the particular road being one of the roads specified in Schedule 9 to this Order provided that:-

(i) no vehicle engaged in delivering or collecting goods or merchandise or being loaded or unloaded shall wait for a longer period than thirty minutes in the same place and further, no such vehicle shall wait for a longer period than ten minutes in the same place without goods being loaded on to or unloaded from the vehicle.

(ii) notwithstanding the foregoing terms of paragraph (c) of this Article the driver of a vehicle who is waiting for the purpose of delivering or collecting goods or merchandise or loading or unloading the vehicle shall move the vehicle on the instruction of a police constable in uniform whenever such moving may be reasonably necessary for the purpose of preventing an obstruction.

13 Bus Stop Clearway

(a) Save as provided in paragraph (b) of this Article no person shall, except upon the direction or with the permission of a police constable in uniform, cause or permit any vehicle, other than a bus providing a local service to stop between the hours of 7.00am and 7.00pm, in any of the lengths of roads specified in Schedule 10 to this Order:-

(b) Paragraph (a) of this Article shall not apply:-

(i) so as to prevent any vehicle waiting in the lengths of roads specified in Schedule 9 to this Order for so long as may be necessary to enable the vehicle, if it cannot be used for the following purposes without so waiting, to be used in connection with:-

(i) any operation involving building, demolition or excavation;

(ii) the removal of any obstruction to traffic;

(iii) the maintenance, improvement or reconstruction of a road;

(iv) constructing, improving, maintaining or cleaning any street furniture including bus stop infrastructure; or

(v) the laying, erection, alteration, repair or cleaning of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any telecommunications apparatus kept installed for the purposes of a telecommunications code system or of any other telecommunications apparatus lawfully kept installed in any position.

(ii) to an emergency service vehicle;

(iii) to a vehicle being used in the service of the local authority or with the permission of the local authority in exercise of statutory powers and duties if it is necessary for the vehicle while being so used to wait in the said lengths of roads;

(iv) to a vehicle waiting in any case where the person in control of the vehicle:-

(i) which is required by law to stop;

(ii) which is prevented from proceeding by circumstances beyond the driver’s control or which has to be stopped in order to avoid injury or damage to persons or property;

(iii) which is prevented from proceeding by circumstances outwith his control and it is not reasonably practicable for him to drive or move the vehicle to a place outwith the said lengths of roads.

(v) to enable the vehicle to be used by a qualified medical practitioner engaged on a house call;

(vi) to a taxi which is stationary only for so long as may be reasonably necessary for a passenger to board or alight and to load or unload any luggage of the passenger;

(vii) a marked vehicle which, whilst used by a universal service provider in the course of the provision of a universal postal service, is stationary only for so long as may be reasonably necessary for postal packets to be collected;

(viii) a vehicle driven by a person whilst being trained to drive a bus operating local services who, as part of his training, stops the vehicle within a clearway for no longer than necessary to simulate the stopping of a bus at a bus stop for the purpose of picking up and setting down passengers; and

(ix) a vehicle stopping with the permission of a constable in uniform or a parking attendant.

14 Bus Stop Clearway (School Days Only)

(a) Save as provided in paragraph (b) of this Article no person shall, except upon the direction or with the permission of a police constable in uniform, cause or permit any vehicle, other than a bus to stop between the hours of 8.30am and 4.30pm Monday to Friday inclusive, in any of the lengths of roads specified in Schedule 11 to this Order:-

(b) Paragraph (a) of this Article shall not apply:-

(i) so as to prevent any vehicle waiting in the lengths of roads specified in Schedule 9 to this Order for so long as may be necessary to enable the vehicle, if it cannot be used for the following purposes without so waiting, to be used in connection with:-

(i) any operation involving building, demolition or excavation;

(ii) the removal of any obstruction to traffic;

(iii) the maintenance, improvement or reconstruction of a road;

(iv) constructing, improving, maintaining or cleaning any street furniture including bus stop infrastructure; or

(v) the laying, erection, alteration, repair or cleaning of any sewer or of any main, pipe or apparatus for the supply of gas, water or electricity, or of any telecommunications apparatus kept installed for the purposes of a telecommunications code system or of any other telecommunications apparatus lawfully kept installed in any position.

(ii) to an emergency service vehicle;

(iii) to a vehicle being used in the service of the local authority or with the permission of the local authority in exercise of statutory powers and duties if it is necessary for the vehicle while being so used to wait in the said lengths of roads;

(iv) to a vehicle waiting in any case where the person in control of the vehicle:-

(i) which is required by law to stop;

(ii) which is prevented from proceeding by circumstances beyond the driver’s control or which has to be stopped in order to avoid injury or damage to persons or property;

(iii) which is prevented from proceeding by circumstances outwith his control and it is not reasonably practicable for him to drive or move the vehicle to a place outwith the said lengths of roads.

(v) to enable the vehicle to be used by a qualified medical practitioner engaged on a house call;

(vi) to a taxi which is stationary only for so long as may be reasonably necessary for a passenger to board or alight and to load or unload any luggage of the passenger;

(vii) a marked vehicle which, whilst used by a universal service provider in the course of the provision of a universal postal service, is stationary only for so long as may be reasonably necessary for postal packets to be collected;

(viii) a vehicle driven by a person whilst being trained to drive a bus operating local services who, as part of his training, stops the vehicle within a clearway for no longer than necessary to simulate the stopping of a bus at a bus stop for the purpose of picking up and setting down passengers; and

(ix) a vehicle stopping with the permission of a constable in uniform or a parking attendant.

15 Orders to be revoked

The Orders specified in Schedule 12 to this Order are hereby revoked.

1 Anchor Drive
