Flood* Our dead never forget the beautiful world that gave them being.... At night, when the streets of your cities and villages are silent and you think them deserted, they will throng with the returning hosts that once filled and still love this beautiful land.1 INTRODUCTION In the summer of 1996, two young men watching hydroplane races from the banks of the Columbia River near Kennewick, Washington, stumbled across what would turn out to be one of the most complete and well-preserved set of ancient, human skeletal remains ever discovered in this country.2 As * Visiting Associate Professor of Law, University of Idaho College of Law. 1. Published by The Scholarly Forum @ Montana Law, 2002 1 40 MontanaMONTANA Law Review, Vol.LAW 63 [2002], REVIEW Iss. 1, Art. 2 Vol. 63 soon as radiocarbon dating determined these remains to be between 9,200 and 9,600 years old, legal wrangling over access to them began.3 Scientists want to study and test the remains; Native American tribes want to rebury the remains; and the federal government wants to ensure that the remains are treated in accordance with the Native American Graves Protection and Repatriation Act (NAGPRA). 4 The legal wrangling continues in Bonnichsen v. U.S., 5 an action commenced by eight anthropologists seeking to study the ancient remains. These plaintiffs, the news media, and most of America know the remains by the name of "Kennewick Man," a name based on the area in which the remains were discovered.6 They were so named by James Chatters, the anthropologist who examined the remains for the local sheriff when they were first discovered, and who announced that discovery to the world. 7 These remains also have another name, the name of "Ancient One," which was conferred upon them by the tribes that have 8 claimed them. The authority to name something or someone is, and always has been, a significant power.9 The act of naming the remains is Chatters, Ancient Encounters: Kennewick Man and the FirstAmericans, 55 (2001). 3. England anglicized all Gaelic names after conquering the peoples of Ireland, Scotland and Wales; Spain imposed Spanish names on the peoples it found already residing in the Americas; and the United States required Indians to take on English names in order to qualify for land allotments and other benefits. "ANCIENT - A Matter of Interpretation ONE" an exercise of such power, an assertion of the right to claim such power. These opposing claims of the scientists and the tribes are grounded in fundamental beliefs: on the one hand, a belief in the supreme importance of scientific knowledge and investigation; on the other hand, a belief in the supreme importance of cultural history, practices and values. The scientists believe that Kennewick Man may reveal information about the development of mankind and the peopling of the Americas, and that this information may be lost forever if the remains are not made available for extensive study and testing. 10 The tribes believe that the remains of the Ancient One must be treated with respect, that testing of the bones is a desecration, that the spiritual journey of the Ancient One has been disrupted by his removal from the earth, and that he must be reburied as soon as possible." These contrasting beliefs of the scientists and the tribes are so diametrically opposed as to 12 have no common ground between them. The battle over these fragile, ancient bones has given rise to several significant issues, relating to constitutional rights, administrative law, the meaning of NAGPRA, and the unique relationship between the federal government and American Indian tribes. This statute is facing its first significant court challenge - its first opportunity for full interpretation - in Bonnichsen v. U.S. The court's interpretation of NAGPRA will be the key to the resolution of this case and, undoubtedly, of other cases yet to come. For this reason, the "dynamic"' 3 or comprehensive method of statutory interpretation should be used, because it will lead to the most honest and accurate interpretation of NAGPRA. Rogers Evolving a Genre: Doctor Strange Comics as Post-Fantasy Jessie L. Rogers (ABSTRACT) This thesis demonstrates that Doctor Strange comics incorporate established tropes of the fantastic canon while also incorporating postmodern techniques that modernize the genre. Strange’s debut series, Strange Tales, begins this development of stylistic changes, but it still relies heavily on standard uses of the fantastic. The 2015 series, Doctor Strange, builds on the evolution of the fantastic apparent in its predecessor while evidencing an even stronger presence of the postmodern. Such use of postmodern strategies disrupts the suspension of disbelief on which popular fantasy often relies. To show this disruption and its effects, this thesis examines Strange Tales and Doctor Strange (2015) as they relate to the fantastic cornerstones of Tolkien’s The Hobbit and The Lord of the Rings and Rowling’s Harry Potter series. It begins by defining the genre of fantasy and the tenets of postmodernism, then it combines these definitions to explain the new genre of postmodern fantasy, or post-fantasy, which Doctor Strange comics develop. To show how these comics evolve the fantasy genre through applications of postmodernism, this thesis examines their use of otherworldliness and supernaturalism, as well as their characterization and narrative strategies, examining how these facets subvert our expectations of fantasy texts.

This study focuses on categorization and function of the characters in the movie and conflicts in the main character (external and internal conflicts). The data of this study were taken from a movie entitled Doctor Strange. The data were collected through documentation method. In analyzing the data, the study used qualitative method. The categorization and function were analyzed based on the theory proposed by Wellek and Warren (1955:227), supported by the theory of literature proposed by Kathleen Morner (1991:31). The conflict was analyzed based on the theory of literature proposed by Kenney (1966:5). The findings show that the categorization and function of the characters in the movie are as follows: Stephen Strange (dynamic protagonist character), Kaecilius (static antagonist character). Secondary characters are The Ancient One (static protagonist character), Mordo (static protagonist character) and Christine (dynamic protagonist character). The supporting character is Wong (static protagonist character). Then there are two types of conflicts found in this movie, internal and external conflicts. Dunn From the standpoint of modern medicine, death is a failure—and one of the first things that we learn in the 2016 movie Doctor Strange is that Stephen Strange does not like to fail. In fact, at the time of the automobile accident that brought his brilliant career as a neurosur- geon to a tragic end, Stephen Strange and failure had apparently never yet crossed paths. He had a “perfect record,” as he casually reminded Nurse Billy in an offhand boast when Billy proposed that he help a “68‐year‐old female with an advanced brain stem glioma.” Such a diagnosis predicted a poor outcome that he would prefer not to have sully his résumé. At the same time, though, he doesn’t want to build his reputation on easy victories. He declines to help “a 35‐year‐old Air Force colonel who crushed his spine in some sort of experimental armor,” dismissing it as the surgical equivalent of child’s play: “I could help but so can fifty other people.”1 So it’s no surprise that after Stephen’s catastrophic accident that crushes his hands, his world collapses. Physical therapy alone can never restore his hands to what they were before and—ironically, in light of his own practice of rejecting patients who might ruin his perfect record—another doctor rejects him as a candidate for a cutting‐ edge experimentalCOPYRIGHTED treatment lest it fail and ruin MATERIAL the doctor’s reputation.

Also, you’ll be seeing that there Gallifreyan symbol (a ha’penny to the first person who can tell me what it means!) from the wonderful Jesi Pershing a bunch! It’s awesome, no? Plus, Teddy Harvia, and words from good folks, including Hugo-nominee (and Future Supremem Court Justice!) Steve Stiles. But mostly, this issue is about Chuck Serface’s piece leading in to our MASSIVELY AWESOME Marvel Comics edition of Nerdvana Podcast (JC Arkham and JoshBot do a GREAT job with it! You can listen to it at http://nerdvanapodcast.com/ and it’s all over the place and a lot of fun (start with the Batman episode at http:// www.nerdvanapodcast.com/Episodes/Nerdvana-S01E03a.mp3) and keep on going! I’ve got a lot of thoughts about Marvel, it’s a comic line I’ve only been into at times, but largely I’m not a fan. I love The Flash, Batman, Plastic Man, Elongated Man, Johnny Thunder, Wildcat, and especially The Justice Soci- ety. Always my favorite. Marvel had The Hulk, who was awesome at times, and Daredevil. When I was growing up, there was the X-Men, at the time the biggest thing in comics. I liked the X-Men to a degree, but always into the DC stuff far more. On the plus side, there were stories back in the day that were awesome. There was a X-Men issue where it was Kitty telling a bedtime story about Pirates! But mostly, it passed over me while I was reading about Barry Allen and Crisis On Infinite Earths.
