Barcellos, Flavio´ Roberto Santos Abstract BitTorrent is a file sharing Peer-to-Peer (P2P) application that has achieved great popu- larity, becoming a de facto standard for swapping files in the Internet. To achieve such popularity, BitTorrent was built upon a solid scientific contribution, through the proposal of a novel swarming-based protocol, and was supported by an open and sufficiently robust implementation. This chapter collects, organizes, and presents in a top-down, structured way the inumerous advances provided by this technology since its inception, in 2001. The contents are presented in breadth, whenever possible generalizing the useful lessons to other Internet applications. The approach to the subject is top-down and combines theory and practice, analyzing how the proposed policies and mechanisms were actually implemented and to which degree they were successful. Resumo BitTorrent e´ uma aplicac¸ao˜ de compartilhamento de arquivos Peer-to-Peer (P2P) de grande popularidade, tendo se tornado um padrao˜ de facto para troca de arquivos via Internet. Opinion by Judge Berzon SUMMARY* Copyright The panel affirmed in part and vacated in part the district court’s judgment in favor of film studios, which alleged that the services offered and websites maintained by the defendants induced third parties to download infringing copies of the studios’ copyrighted works. Affirming the district court’s summary judgment, the panel held that under Metro-Goldwyn-Mayer Studios, Inc. v. Grokster Ltd., 545 U.S. 913 (2005), the defendants were liable for contributory copyright infringement on an inducement theory because the plaintiffs established (1) distribution of a device or product, (2) acts of infringement, (3) an object of promoting the product’s use to infringe copyright, and (4) causation in the defendants’ use of the peer-to-peer file sharing protocol known as BitTorrent. The panel held that the defendants were not entitled to protection from liability under any of the safe harbor provisions of the Digital Millennium Copyright Act, including safe harbors provided by 17 U.S.C.

    How much material on BitTorrent networks is infringing content? A validation study Robert Layton, Paul A. Watters, Richard Dazeley November, 2010 1 Abstract BitTorrent is a widely used protocol for peer-to-peer (P2P) file sharing, including material which is often suspected to be infringing content. However, little systematic research has been undertaken to establish to measure the true extent of illegal file sharing. In this paper, we propose a new methodology for measuring the extent of infringing content. Our initial results indicate that at least 89.9% of files shared contain infringing content. We discuss the limitations of the approach and outline proposals to further verify the results. Keywords BitTorrent, infringing content, copyright infringement, piracy 1 Introduction BitTorrent is a peer to peer (P2P) file sharing protocol which allows files to be efficiently distributed without reliance on a central server [1]. Files are distributed through clients and peers, with each peer containing different pieces of the file. Peers contact each other to download new pieces, while at the same time, allowing the pieces they currently have to be uploaded to other peers. Downloads through BitTorrent can be much faster than traditional downloads, due to the highly distributed nature of the download process. As a protocol, BitTorrent has become extremely popular on the internet – one global estimate is that BitTorrent traffic accounts for 57.19% of all Internet traffic [2]; one major ISP in Australia estimates that the figure is >50% of all traffic [26]. It has been utilised commercially, with companies such as Blizzard Entertainment using BitTorrent to release patches and updates for their popular online game World of Warcraft [3].

    On-demand audiovisual services have mushroomed in Europe. Video on demand, catch- Video on up television and video sharing are vying for the consumer’s attention but are facing the problem of internet piracy at the same time. The landscape has become very fragmented demand and is developing very rapidly. Business models are being defined and are in some cases Video on merging with one another. The crisis on the advertising market and the limits imposed and on the development of the free services offered by the public broadcasters are leading to a growing interest in paid-for services, but the development of pay models is being catch-up TV impeded by piracy and it seems these services will not come into their own until on- demand offerings can be fully accessed on a television set instead of only on a computer demand in Europe screen or mobile telephone. The provision of access to VOD on a TV is thus becoming a very important issue and galvanising manufacturers and network operators into action. This report provides a complete and up-to-date picture of the different on-demand au- diovisual services and of how they fit into the strategy of the various types of player.
