Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report granted by the Director of Planning & Transport in accordance with the Scheme of Delegation detailed in Standing Orders.

1.0 RECOMMENDATION

1.1 The Committee is asked to note the applications, detailed in the Appendix, granted approval under delegated powers.

2.0 INTRODUCTION

2.1 In terms of the Scheme of Delegation to officers, the Director of Planning & Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance.

3.0 APPROVALS

3.1 Attached as an Appendix is a list of applications granted under delegated authority during the period 24 November 2004 to 5 January 2005.

4.0 FINANCIAL IMPLICATIONS

4.1 There are no financial implications.

5.1 There are no Human Rights issues arising directly as a result of this report.

Conditions

1 That the approval of the details of the siting, size, height, design, drainage and external appearance of the building(s) and the means of access thereto, shall be obtained from the Planning Authority before any development is commenced.

2 That the application for approval of the reserved matters specified herewith shall be made to the Planning Authority before:- (a) the expiration of three years from the date of the grant of outline planning permission; (b) the expiration of six months from the date on which an earlier application for reserved matters approval was refused; or (c) the expiration of six months from the date on which an appeal against such refusal was dismissed, whichever is the latest. Only one application for approval of reserved matters (under (b) or (c) above) may be made after the expiration of a three year period mentioned in sub-section (a).

3 That the development hereby approved must be begun not later than:- (a) the expiration of five years from the date of the grant of outline planning permission; (b) if later (under (b) or (c) in the above condition) the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last matter to be approved.

4 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority.

5 That a 1.8 metre wide footway be provided ex adverso the north and west boundaries of the site to the specification of Angus Council's Director of Roads, to the satisfaction of the Planning Authority.

6 That provision be made within the site for the parking of two private cars per dwelling.

Any measures required to de-contaminate this area of the site shall be carried out prior to the commencement of building operations and all shall be completed to the satisfaction of the Director of Environmental & Consumer Protection and this Planning Authority.

8 That prior to the commencement of the development, details of the means of site enclosure proposed to be used, shall be submitted for the prior approval of the planning authority and be erected on or before completion of the development.

9 That no development takes place until there has been submitted to and approved by the planning authority, a scheme of landscaping, including, where appropriate, an indication of all existing trees and hedgerows on the land and details of these to be retained and cleared, together with the measures for their protection in the course of development.

10 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of five years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species.

11 That the roof and external wall finishes be agreed in consultation with and be to the satisfaction of the Director of Planning & Transport prior to commencement of work.

12 That the buildings shall not exceed two storeys in height.

13 That the indicative layout with number of dwellinghouses, submitted as part of this application, is not approved by this consent.

04/00849/FUL Mr & Mrs Whitton Erection of a Dwellinghouse at:- Land North Of The Podge Angus DD11 2RE

Conditions

1 That the disposal of sewage effluent be in accordance with the standards required by the building control authority.

2 That the rainwater run-off from all surfaces be directed to a soakaway system to the satisfaction of the building control authority.

3 That visibility splays of 70 metres x 3.0 metres be provided in each direction at the junction of the proposed access or development road with the public road.

4 That no structure, wall, etc. or planting in excess of 1050mm mm in height be introduced into the sightline areas.

5 That the crossing(s) over the footpath and/or verge be constructed in accordance with the standards required by the Director of Roads to the satisfaction of the planning authority.

6 That a vehicular turning space be provided within the site to allow vehicles to enter and leave the site in a forward gear.

8 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of five years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species.

9 That this consent is only granted on the understanding that a drainage porosity test conducted under the auspices of the building control authority is successful. The test should be undertaken at an early date and certainly before the development is commenced or the site sold. Proof of successful completion must be forwarded to the Director of Planning & Transport prior to submission of a detailed application or commencement of works, whichever comes first. Failure to successfully complete a porosity test will make this consent impossible to implement unless another method of sewage disposal acceptable to the drainage authorities and approved by the Director of Planning & Transport is proposed.

Conditions

1 That the use/development hereby permitted be restricted to a limited period of two years only from the date of consent.

2 That on or before the expiration of that period, the use hereby permitted shall be discontinued, all materials associated with the temporary use hereby approved removed from the site and the land thereafter utilised for forestry. A planting schedule for Areas A and B shall be submitted to and approved by the Director of Planning and Transport prior to use of the reception building commencing. All planting shall be implemented in the first planting season following the discontinuance of the temporary use of the site or commencement of use of the reception building, whichever is the sooner.

3 That all infill material be restricted to inert materials directly resulting from the recycling process carried out within the site by D J Laing and from no other source.

4 That all works and operations associated with the infilling of the areas be restricted to between the hours of 9 a.m. to 5 p.m. Monday to Friday with no operations on Saturday or Sunday. The hours of operation for all other works be restricted to between the hours of 7 a.m. and 6 p.m. on weekdays, 8 a.m. and 1 p.m. on Saturdays and not at all on Sundays.

5 That no works shall commence on the infilling of area B until full details of the proposed culvert shown on approved drawing 3182/Planning 3/01 have been submitted to and approved in writing by the Director of Planning and Transport. Submitted details should demonstrate that the culvert is capable of operating effectively and be in accordance with the technical standards of SEPA.

8 That the new dwellinghouse hereby approved shall not be occupied until the traditional buildings within the site have converted to residential use, in accordance with drawing No. 42/003, to the satisfaction of the Director of Planning and Transport.

9 That a photographic record be taken prior to any demolition, conversion or alteration work takes place. Views should be taken of all elevations and should also include shots of any unusual internal or external features. Photographs which may be digital should be sent to the Archaeology Service at Aberdeenshire Council.
