EMERGENCY SERVICE — DUTY OFFICERS'ROTA

66. The Chief Executive explained that the Council operated an after hours emergency service from 5.00 p.m. — 7.30 a.m. Monday to Friday, with 24 hour cover at weekends using one of seven officers on a weekly rota basis. The public who telephoned the emergency number were given the Duty Officerts home number to telephone by an answering machine. The Duty Officer processed the calls and directed the appropriate Work Group or Contractor to take the necessary action.

It was becoming increasingly difficult to attract staff to take on this duty and maintain the present call—out rota since the Officers involved must, during their week of duty, remain at home for the whole of the week outside normal working hours, including the weekend. For this, the Duty Off icer received a supplement of £19.50 for that week plus a contribution towards telephone rental and call charges. The annual cost of this Duty Officer arrangement was estimated to be in excess of £1,500 p.a.

The Chief Executive reported on preliminary discussions with local alarm/security companies with a view to them assuming responsibility for the emergency call—out service, from which it would appear that the arrangements could be put out to contract at comparable cost.

The Staff Side expressed their appreciation to the Chief Executive for the initiative he had taken to resolve the difficulties. They welcomed the proposal, especially since the present situation had been aggravated by staff sickness in recent months, with fewer officers available and, more frequent duty. It was further complicated by the fact that certain Duty Officers were also Standby Officers who were required to attend in the event of an emergency.

RECOMMENDED (1) That subject to the Chief Executive completing his investigations as to the best possible service, the Council enter into contract with an alarm/security company to carry out the Councilts emergency call—out service using the existing emergency telephone number.

Making the Rate 1982/83 (Minute 139)

The Chairman of the Policy and Resources Committee said he was delighted to be able to report that, for the seventh year in succession, the District Rate increase had been held at less than 10%. At 5.9% the rise was less than half the current rate of inflation and this despite a significant drop in Block Grant and without harmful cuts to services.

There were questions but Members thought the budget realistic and prudent. Chairmen of Standing Committees were congratulated on their efforts in meeting targets and officers thanked for their hard work.

Resolved that the Minutes be received and the recommendations contained therein adopted.

147. The Chief Executive reported a request from the Association for permission to raise a loan from their brewers to finance an extension to the existing bar. Officers were satisfied that the repayments could be supported satisfactorily.

REGAL CINEMA SITE, BELLINGHAN LANE

148. The Director of Town Planning reported on negotiations to a secure a "set—back" of the development to allow some view of w Mill Hall and the Mill itself. However, in achieving this, the access for car parking was nade more difficult and the developers requested access to :he rear of their site through the Mill Hall car park. There 'iould be 32 private parking spaces of which 24 would be made available for public parking at weekends to compensate for the loss of 2 parking spaces in the Council car park which loss would be caused by the entrance arrangements. Subject to all legal, technical and planning processes, the proposal was felt generally acceptable but the developers asked for an indication from the Council that it would be prepared to make the access available on a "No Charge" basis.

RECOMMENDED That the Director of Town Planning be authorised to negotiate access along the above lines but that the District Valuer's opinion be first sought in relation

RAYLEIGH HIGH STREET (Minute 736/81)

149. In a full report) the Director of Technical Services reminded the Committee of earlier Council recommendations for dealing with the "tail—back" from the free parking area, provision for the disabled and taxi—ranks. Alternatives had been discussed with the Police and the County Council as Highway Authority. The latter did not believe that the Traffic Signs Regulations allowed for yellow bx markings at the Crown Hill/High Street junction and both considered that white paint markings would be ineifective and unenforceable.

A suggested experiment for the removal of the free parking area to Websters Way found no favour with the Committee which also thought that two bays in ti e High Street free parking area should be designated for tie disabled.

RECOMMENDED (1) That the existing temporary taxi—rank be appointed for six taxis

(2) That the layby outside Berry's Arcade be designated as a taxi—rank for four taxis outside normal shopping hours

(3) That, in the High Street free parking area, two bays be designated for the exclusive use of the disabled. (7024 & 897) (DTP& DLS)

"ALTERNATIVES TO DOMESTIC RATES" — CONSULTATION DOCUMENT

150. The Director of Finance submitttid a report sutnmartsing a Green Paper, exploring the alternatives to Rates, commenting on the issues raised and making recommendations. The report went into the pros and cons of a reformed domestic rating system, a local sales tax, local income tax and a poll tax. it was obvious that there was no one solution that met all criteria. The view was expressed that, inefficient as was the present system, it was the most efficient known.

RECOMMENDED That the following ob8ervations he submitted to the Government in response to t'e Green Paper;—

1. The Council strongly suppots the retention of independent local government which should have a wide measure of autonomy over its budgets anT priorities) whilst recognising the Government's strategic role in relation to the management of the national economy.

2. Local authorities should be accountable to their own electorates for their decisions rather than to central Government.

3. The domestic rating system should continue to act as the major source of local taxation, but the basis of valuation should be changed from rental to capital, given that there is insufficient evidence to suppot t a revaluatioii using market rentals. Regular revaJuations should become statutory rather than at the discretion of the Eecretary of State for the Environment.

4. The tax base should be broadened by abolishing the de— rating of agricultural land and buildings.

5. The propcrtion of local authority current expenditure which is financed through national taxation should be reduced significantly by being used only for resource equalisatiort as between relatively rich and poor authorities. In this way the former needs element of the Rate Support Grant could be eliminated.

6. In order to make up for thn reduction in Government grant, local euthoritis should be allowed to levy a poii tax in their areas on all earning non—householders. This tax should be administered on a self—assessment basis with heavy penalties for non—compliance in order to discourage evasion.

7. Local authorities should be given wider powers to make charges for services to lessen the burden on the general body of ratepayers. (760) (1W)

REPORT OF TRE HIGHWAYS AGENCIES PANEL

1. ELECTION OF CHAIRMAN

Resolved that Councillor A.J. Harvey be elected Chairman of the Panel.

2. HIGHWAYS AGENCY (Minute 73/82)

The Chairman opened the debate saying that circumstances changed constantly and that it was proper that a Panel should undertake a further detailed study of a subject which had such importance and wide—ranging implications for the well—being of the whole of the District.

The Chief Executive reminded the Panel that the subject had occupied the minds of Members and Of ficers over a very long period and that, in recent years, there had been reports to the Policy and Resources Committee on the 8th October, 1980, 10th November, 1981 and again on the 4th February, 1982. Except on the last occasion when the present Panel had been appointed, the Council had always decided to press for a full Highways Agency. The Chief Executive went through the options shown diagramatically in appendix A.

The Director of Finance said that the budget provision (fully reimburseable) on the present limited agency was £400,000 but that this was likely to rise to the order of £1 million if there was a full Highways Agency. This larger figure should allow for economies in scale giving more flexibility in the allocation of resources. Despite this, great care would be needed to resist the temptation to top—up the County allocation and to ensure that administrative costs were restricted to the 10% allowance. The Director submitted a summary, appendix B, of replies from the thirteen other Councils in Essex. The administrative allowance was seen to be adequate in all but three cases. However it had to be noted that the administration allowance was 10% of approved costs. If, for reasons of Government policy or any other cause, the County Council cut expenditure then there would need to be tough decisions and possible redundancies among Highways Agency staff.

The Director of Technical Services confirmed that the Council would be seeking an Agency for Minor Capital Works only.

The Director of Legal Services was satisfied that, if Council house sales and other conveyancing work reduced and if no new projects were added, the legal work arising from a Highways Agency could be accommodated. However, it was not possible to give an unequivocal undertaking that there would never come a time when more staff might be needed.

Having further considered the previous reports and the advice of the Officers the unanimous decision was that, provided there was careful and continuous attention to contain administrative costs within the allowance given by the County Council, the District would benefit by being responsible for its own programmes and priorities and by taking control of 000268 matters within its own boundaries. The prospect was interesting and challenging and the Panel believed that there would be the choice between giving the same service at lower cost or a better service for the same cost as at present.

58. The Panel approved the Minutes of the Meeting held on 7th January, 1982.

As regards Minute 49 — Safety Reversing Equipment on Council Vehicles, the Works Side noted that the Director of Technical Services had ordered the equipment and that delivery was awaited.

On Minute 50 — Depot Telephones, the Works Side were advised that it was not possible to provide an additional telephone for the exclusive use of the carpenters workshop but that officers would investigate the provision of a telephone on a shared basis.

REVIEW OF BONUS ARRANGEMENTS

59. The Chief Executive reported receipt of N.U.P.E.'s claim in this respect.

Resolved that consideration of the claim be deferred for discussion between the Works Side/Area Officer of N.U.P.E. and the Chief Executive and that a report thereon be made to the Finance and Personnel Committee on 8th April.

NOREDIJNDANCY AGREEMENT

60. The Works Side sought a no redundancy Agreement from the Council so that employees could be assured that they had secure jobs with a certain future.

CLEANSING SUPERINTENDENT

61. The Chief Executive read a letter from the refuse operatives expressing their regret at the impending resignation of the holder of this post to join another local authority and advised the Corutmittee that he would investigate the situation.

DEPOT CLEANSING STANDARDS

62. The Works Side reported that the standard of contract cleaning at the Depot still left a lot to be desired although there had been a marked improvement that evening. They hoped the standard would be n3aintained.

The Director of Technical Services agreed to monitor the situation.

HEALTH AND SAFETY AT WORX — DEPOT YARD

63. At the request of the Works Side the Director of Technical Services agreed to remove to storage the kerbstones left on the footpath in the Depot yard.

INCLEMENT WEATHER CONDITIONS

64. The Chief Executive reported that at a number of Committee Meetings during the winter months Members had commended the Works Staff on their efforts during the recent inclement weather and thanked the Works Side on their behalf.

TOWN AND COUNTRY PLANNING ACT - CONTRAVENTION

22 ,_Elm_Grove, Hullbridge 164. The Director of Legal Services reported the erection of a length of fencing between 1.2 metres and 1.5 metres high. As it flanked the highway, planning permission was required but would not be granted in this case because of the crude construction and the extremely unsightly appearance when viewed from the neighbouring house.

Resolved that the Director of Legal Services be authorised to take all necessary action, including the issuing and service of Notices and action in the Courts, to secure the remedying of the breach of planning control now reported. (1093) (OLS) DEVELOPMENT AT WICI&ORD (Minute 717/81) 165. The Director of Town Planning reported that the Developers had withdrawn their kppeal concerning the Shot Farm site because they wanted a Joint Inquiry into their schemes at Shot Farm and Shotgate and the Shotgate Community Association proposal covering parts of both the sites and additional land.

The Developers plans for Shotgate were of concern to Rochford only because the landscape belt at the eastern boundary was narrow in parts and broken at one point. Continents covering Planning Services

these issues were set out on the Agenda.

In a supplementary report, the Director explained the Community Association proposals which, although acceptable at first sight, could cause traffic problems and, because they left part of the "Shotgate" site undeveloped, could lead to even more development later. The Committee judged the application premature, contrary to Metropolitan Green Belt policies, likely to result in pressure for further development and not providing for landscaping of the eastern boundary with Rochford.

Resolved that Basildon District Council be informed of the views of this Authority as set out on the Agenda and Supplementary Report. (TP25E) (DTP)

PLANNING INQUIRIES — THE AWARD OP COSTS

166. The Director of Legal Services reminded Members of the power of the Secretary of State to award costs in an inquiry case if the behaviour of either party had been unreasonable and had caused the other party unnecessary expense. A recent Circular indicated a hardening attitude and the award of coats was expected to become somewhat more usual. A full report would be made to the Development Services Committee. (158) (DLS)

1. The proposed site is considered to be unsuitable for residential develop- ment having access from a supermarket service road adjoining a small industrial estate. Furthermore, if allowed, the proposal would result in an undesirable form of backland development.

2, In the opinion of the local planning authority this site should be utilised to provide for vehicle parking and servicing associated with the existing industrial premises or any future extension thereto.

3. The proposed development of this site with a house would result in overlooking and loss of privacy to the adjoining occupiers of Eritton S Court and to the proposed occupiers of a bungalow planned to the east w of the site. 4, No provision has been made for vehicles to enter and leave the site in forward gear. This would result in vehicles having to carry out turning movements on the existing service road to the detriment of highway safety. I

NOTE: The proposed site lies at the rear of 26 and 28 Eastwood Road and adjoins the existing group of factory premises. Access to the site is gained from the service road, (referred to as The Driveway), which serves the existing factories, two residential units and the International supermarket.

The proposed house is required by Mr. B.T. Moore (factory owner) who at present resides in a first floor flat above garages on the industrial estate. His main reason for requiring the house is that he is suffering from noise nuisance and from continuous humming from generators.

Whilst the site is zoned for residential purposes on the Development Plan I consider that it would be inappropriate to erect a new residential dwelling in this location. I An application to develop this sit with a factor3i unit was refused planning permission on 1st July 1981, application 'No.ROC/297/81, as the factory was located in close proximity to Britton Court. However, whilst that application was unacceptable, in my view this site should be used in assoc- iation with the existing factories to provide for adequate parking and servicing facilities on what is at present a somewhat restricted estate, or to allow for greater flexibility when considering possible future extensions to the existing factory premises.

The Director of Health and Housing is concerned about the possibility of noise nuisance affecting this site and has recommended that if planning permission is granted the property be conditioned to require the fitting of acoustic double glazing to the front elevation.

a) Although he has no objection to a residential property on the site if this is far enough away, the property is undesirable and would spoil the privacy of several neighbours;

b) If permission is granted can the Council make it a condition that all windows now and in the future facing Eastwood Road be fixed windows with obscure glass?

The residents in Bull Lane and Louise Road object on the grounds of over- shadowing and loss of privacy.

Planning permission was granted in July 1980 to redevelop the complete cu,rtilage of No.125 by the erection of two detached chalets fronting Bull Lane, application reference ROC/485/80. This application originally included a third dwelling fronting Bracken Dell but this was deleted from the appli— cation prior to decision.

NOTE: This application is being processed in accordance with the procedure set out in Circular 49/63 wherein Government Departments can seek an indication as to the kind of development likely to be granted planning permission on land currently under their control.

The application was considered by the Committee on 5th January 1982 and it was agreed that residential development would be appropriate.

The land is however within the Green Belt and residential development would represent a departure from the provisions of the County Development Plan. As a result public notice of the application has been published in the local press and comments invited from any interested persons. Arising from this one letter of representation has been received from the I-Lullbridge Parish Cxmcil who object to the land being used for residential purposes because it is within the Green Belt. They explain that whilst the land is outside the Parish some protection of the Green Belt must be made wherever the location may be.

Notwithstanding this objection I still consider that the use of the land for residential purposes is appropriate and I would recommend that the Property Services Agency be informed accordingly.

The local p anning authority considers that retail continuity at ground floor level should be provided along the Bellingham Lane frontage.

2. The scale and bulk of the proposed building is considered excessive and totally cut of sympathy with the existing buildings in the immediate vicinity and would unduly dominate and detract from the character, setting and appearance of this important location within the Rayleigh Conservation Area.

NOTE: Preliminary consideration was given to this application by the Committee on let December 1.181 and Members considered that the design was unattractive, too bulky and that shopping floorspace should be included. Arising from these comments revised plans have now been received which provide a set back at The junction of Bellingham Lane with the access to Mill Hall and a better relationship to the adjoining buildings in Bellingham Lane. To achieve the set back access into the site is shown off the adjacent public car park and this idea is being considered by the Policy and Resources Committee on 9th March.

The revised scheme does not include any shopping floorspace and the bulk of' the building ad1 oining the Mill Hall complex is too great.

This application was refused for three reasons which are summarised as follows —

1. Excessive in depth.

2. Adverse impact from the height and siting of the proposed garage to the occupiers of 40 Park] ands.

3. The dormers appear unbalanced and visually weak.

A revised application has now been submitted which substantially overcomes the reasons for refusal and which satisfactorily relates with the existing development in the area.

The following observations have been received from the adjoining occupiers:—

Mr. L.H. Moore— 34 Parkiands — no objections.

Mr. H. Taylor — 40 Parklands — no objections.

Mr. & Mrs. J. Valentine — 32 Parkiands — state that "the proposed chalets should be of the ;ame design as the rest of the road, i.e. properties with separate garages."

Whilst the propofed development is not identical to the existing chalets in this road, (hiving semi—integral garages), they are however compatible in terms of height, depth, mass and materials with the existing development and would not in my opinion detract from the appearance of the estate.

ROC/894/8l HAWKWELL

00 238 The proposal, if' permitted, could not fall to cause an unacceptable degree of noise and general disturbance, especially in the late evening, to the occupiers of dwellings whose curtilages directly abut the appli- cation site, by reason of the passage Of car drivers and passengers between the site and public house, and by the ingress and egress and manoeuvring of vehicles between the application site and Ashingdnn Road.

NOTE: The Victry Public House is situated at the north—west junction of Albert Road ani Ashingdon Road, having a frontage to Ashingdon Road of about l8.3m. (6Oft.) and a flank frontage ta Albert Road of about 55.Em. (ls2ft.). The public house has a rear garden area which abuts the west bomdary of No.2 Albert Road. At the front of the building is a car park having two vehicular accesses, one to Albert Road and one to Ashingdon Road. About 18 cars can be accommodated in the car parW.

A 3..7m. (l2ft.) wide driveway at present exists along the northern boundary of the site, leading to a double garage at the rear of the public house. Abutting this northern boundar'y fenced aft by l.8m. (Sft.) high wooden fencing, are two residential properties erected in recent years, 1405.489 and 489a Ashingc!on Road, whose cdrtilages extend only about 36.6m. (122ft. The remaining land at the rear of these two properties, measuring about l8.Sm. (6lft.) wide by 18.2m. (6Oft.) deep, is at present waste land and is owned by S . Georges Taverns, the owners of the public house.

The present application seeks permissibr1 to use this area of waste land as a car park for customers of the public house, access being gained via the existing driveway alongside the boundary of No.489 Ashingdon Road. The exLsting double garage would bd demolished and replace by a repositironed single garage. The proposed car park wduld provide space for a further l7cars.

The proposed car park abuts the rear gaiden Of No.2 Albert Road, Nos.489, 489a and 491 Ashingdon Road. All these occupiers together with that of No.4?3 Ashingdon oad, object to the proposal on the grounds of unacceptable noise, and disturbance from customers and cars using the car park, especially late at night. Some of the objections relate to possible floodlighting of the car park but the application does not include this.

Whilst the provision of etra car parking within the curtilages of public houses clearly are desirable in order to reduce the inconvenience caused by on—street parcing in residentla]i roads, nevertheless the advantages gained by such additional car parking must be balanced against any detriment caused to the occupiers of dwellings abutting the car parks.

In this case, ample car parkinvis available in'th existing front forecourt and there is no doubt that considerable disturbance to the amenities of those adjoining dwellings if the comings arid goings of up to 17 'additional cars were to be permitted in such close proximity to the dwellings. In the case of No.489 Ashingdon Road the proximity to the flank wall of the house would be 1.2m. (4ft.).

Even the provision of a high brick wall around the car park would not, in my opinion, reduce the noise and disturbance that would be caused and I cannot therefore recommend approvar to this application.

NOTE: The property is situated within a block of 8 purpose—built shops with residential accommodation over, built about 1953. A service road exists along the front of these shops for customer parking, and between the service road and London Road a wide grasE verge exists. At the rear of the shops open yards lead onto an access road which extends between Danbury Road and Grange Gardens. This access road provides access to the open yards and on many occasions is blocked by cars. However, this road is net of sufficient width to permit large delivery vehicles to unload at the rear of the shops and most unloading is undertaken at the front in the main service road. Occasionally, even this service road has been observed to be blocked and it is therefore important that adequate off—street parking/garaging facilities are provided within the curtilage of each shop to prevent on—street parking with possible obstruction to the free flow of traffic.

Most of the eight properties have either parking space or a garage, or both, available in the yards at the rear of the shops. The application site, No.105, has an open yard, free of structures except a small single storey extension built in 1958.

There are no planning objections to increasing the size of this extension and providing a garage, but it is important for the reasons given above that the garage and parking space is reserved for those purposes only and condition Nos. 3 and 4 are therefore included.

The development will not affect the amenities of any nearby dwellings. Although the premises are currently used as a newsagent and confectioner, the agent has inLicated that there is a possibility that a sub—post office may be created within the shop if this extension is approved.

"1. I understand that your Council's Planning Committee has deferred making a decision on the above application and has asked that you approach British Telecommunications to see if we would consider again the site at the rear of Oxford Parade. I have to tell you that the short answer is no.

2. As you know, B,T. have looked at a succession of possible sites over the years in consultation with your Council. Even after we had acquired the Golden Cross site with the benefit of planning approval we considered further sites, again in consultation with your Council. This culminated in our application ROC/482/8O to develop a site near Oxford Parade, this application was refused. Time is now of the essence in our plans to replace Rochford Telephone Exchange and I see little point in taking up the quest for the site at Oxford Parade again."

Two letters of objection have also been received from occupiers in Oxford Road to the suggested resiting.

12. Prior to commencement of the development a scheme for the disposal of surface ater from the site shall be submitted to and approved and shall be carried out to the satisfaction of the local planning authority.

13, Prior to th occupation of any dwelling hereby approved the upper levels of t}e site shall be so treated that these shall be provided not less than 600mm. (2ft.) depth good quality imported soil as the final layer and details of the intended treatment including details of the finished site levels relative to surrounding levels of adjacent curtilages shall be submitted to and approved by the local planning authority prior to the commencement of the development.

14. The pond and its margins shall be totally enclosed by fencing prior to the occupation of any of the proposed dwellings and details of the means of enclosure shall be submitted to and approved by the loca'. planning authority prior to the commencement of the development.

15. Screen fencing of a height and type which shall previously have been agreed in writing by the local planning authority shall be provided along the southern and western boundaries of the site bordering existing residential curtilages end in the positions indicated in brown on the plan returned herewith prior to the occupation of the proposed dwellings.

16. The siting of the two dwellings marked 'A' shall be as outlined in red on the plan returned herewith.

17. The siting )f the dwelling and its garden boundary marked 'B' shall be as outlined in red on the plan returned herewith.

18 The aspect and elevation of the property marked 'C' on the plan returned herewith shall have regard to the siting of the property relative to existing curtilages and the disposition of its private garden area and specific details of the elevation of this property shall be submitted to and approved by the local planning authority prior to its commencement.

NOTE: This application is a detailed submission following the grant of outline permis5ion for the development of the land in October 1980 (ROC/496/80).

When first submitted the application proposed the erection of 39 houses both semi—detached and detached and included filling in and building over the existing pond.

— 16 — continued..... Following discussions however the scheme has been amended and now proposes a total of 36 dwellings together with the retention of the pond. The pond is expected to be utilised to "tank" surface water because of the capacity of surface water sewers in the area. I am currently investigating the possibility of the pond area being managed by the Essex Naturalists Trust and my recommendation includes a condition calling for the pond to be totally enclosed by fencing with perhaps a seat provided outside the enclosure for residents and the public to simply view the pond area.

My recommendation has been produced in advance of the receipt of replies to certain consultations on the revised plan. I anticipate receiving the replies prior to the meeting and will report any changes in my recommendation should they be necessary verbally at the meeting.

Local residents have been notified of the application and the receipt t1 an amended plan.

To date representations have been received from the occupiers of:—

26, 36 Hilltop Close 70, 74, 76 Castle Road 3, 21, 23, 25, 27, 29, 31, 33, 39 Roach Avenue 23, 25, 31, 33 Chelmer Avenue

Their comments may be summarised as follows:—

1. Over—development of the site. 2. Loss of privacy — provision of fencing/wall on site boundaries? 3. Creation of a traffic hazard. 4. Increase in traffic noise. 5. Destruction of wildlife. 6. Concern about the future of the badgers currently resident on the land. 7. Loss of outlook. 6. Devaluation of property. 9. Site unsuitable for residential use. 10. Existing natural screening will be lost. 11. Concern about satisfactory surface water drainage arrangements being a provided. Two or three residents appear not to be against the principle of the land being developed provided due account is taken of certain aspects particularly privacy b3 the provision of screen walls/fences on the site boundaries. My recommendation does include a condition covering this point and some of the other issues raised, notably the production of a scheme for the disposal of surface water.

Representations have also been received from the Essex County Council Fire Brigade and Group Engineer Refuse Disposal.

Both are concerned about the proximity of houses to the Fire Station and the Civic Amenity Site and the fact that the occupiers of the pmpertaes could be affected by the various activities carried out within these sites. Since these comments were made the scheme has been amended so that for the most part houses are now sited further away.

— 17 — continued..,.. 009295 The Essex Naturalists Trust are very much concerned about the effect on wildlife particularly the future of the badgers. Notwithstanding discussiofls on the latter there does not seem to be a practical solution. It is very doubtful that the badgers could be transferred elsewhere and so their future is threatened. The only effeciive solution to safeguard the badgers would be to exclude their setts and Lit area of foraging land from the development site but clearly the developer is not attracted to the idea. I understand that the Trust bLlcome the revision to retain the pond and would welcome the opportunity of entering into arrangements for them to manage it.

D.T.P. — REFIIFE PERMISSION FOR THE FOLLOWING REASONS:—

1, The proposal would give rise to an undesirable intensification and I expansion of industrial activities within the site to the detriment of the character and amenities of the residential properties both adjoining the site and on the approach to the site in Alexandra Road.

2. Due to the close proximity of residential properties and all accss being via Alexandra Road the local planning authority considers that the use of the site for any industrial purpose needs to be strictly controlled and that this can only be achieved satisfactorily where the precise nature of any use, including its traffic and parking impli- cations, is previously known.

3' There is inadequate space within the curtilage of the site for car parking and the loading and unloading of vehicles to serve the proposed development.

The existing buildings within the site because of their design and appearance are not considered suitable for permanent retention or more intensive use.

NOTE: The site has an industrial notation within the Approved Review DeveloP— ment Plan 1976 and has been used for light industrial use but subject to specific restrictions Imposed by planning conditions since 6th September 1957 (EEC/ROC/224/57 refers). The site is located at the southern end of Alexandra Road which has residential development on both sides for its entire length.

Planning permission was given on 10th September 1964 (ROC/T/174/64 refers) for light industrial use within the specified buildings at the above site, subject to a condition stating that "the buildings to which this permission relates shall be used only for the marnifacture and assembly of cabinets, boxes and general woodwork". The reason for this condition was as follows; "while industrial use is not opposed on the site the trade is restricted to ensure that the amenities of the houses in Alexandra Road are not injured".

A subsequent outline application (T/ROC/283/64 refers) to erect a new indust- rial building in the south—western corner of he site was granted on the 9th February 1965 but was also subject to the above conditicn and reason.

The current applicant has applied to have the above condition lifted and to extend the light industrial use class to all the buildings within the site. It is the applicant's in ention to let all the buildings to individual businesses.

For Members information 'light industrial use' is defined in the Town and Coustry Plannng (Use Classes) Order 1972 as follows:—

"A process win h may be carr2ed on or machinery installed in any residential area without detriment to the amenity of that area by reason of noise, vibration, smell, fumes, smoke, soot, ash, dust or grit."

The land fronting Lower Road, Hulibridge, is allocated for residential purposes in the approved Review County Development Plan and this fact was communicated to the Ministry. As a result Ministry Land was auctioned off in lots to individual purchasers. The applicants proposed purchasing lots 6 and 7 from Messrs. Ayres, Williams and Bennett, who are at present the legal owners of the land.

This application was submitted in December 1981 but the location address given was incorrect and the type of development Øroposed was not considered suitable for that site and the agent was asked to sulmit revised drawings showing differ Lng house types.

Revised drawings, which also indicate the correct location, have been received and are acceptable from a planning point of view. I

Several comments have been received regarding this application:—

The Hullbridge Parish Council wished to knoi how the proposed density of the development compares with adjoining development. They have been informed that the development of 16 houses is punctuated between Plots 4 and 5 by an access road to the new Hullbridge Sports and Social Club. Plots 1 to 4 will have a density of 10.4 dwellings per acre compared to the density of Nos. 1 and 2 Coventry Cottages (138 Lower Road), which is 8.5 dwellings per acre.

The density of plots 5 to 16 will be 11 dwellings per acre compared to the density of 190 Lower Road, of 5.5 dwellings per acre. The density of the existing ceve-lopment on the north side of Lower Road is 13.5 dwellings per acre.

The occupiers of 190 Lower Road, 1 and 2 Coventry Cottages and all occupiers on the south side of Lower Road and Burnham Road between 153 and 185 have been consulted.

000300 — 22 — continued..... To date, one reply has been received, from the occupier of 181 Lower Road, who is concerned about the existing sewerage system being overloaded and says that at present blockages constantly occur. The letter also queries the apparent absence of a footpath along the fronts of the plots in Lower Road. The third point raised suggested that the number of dwellings be reduced. As isv as this third point is concerned! the matter of ders1ty has been covered and the reason for reducing the density would be on grounds of sewerage pipe overload. Therefore, the above points 1 and 2 are covdred in the following comments from the Director of Technical Services.

The Director of Technical Services has no particular observations to make unon the proposed development as far as drainage is concerned. More detailed discussions with that directorate have revealed that a foul sewer exists in Burnham Road, extending as far as the junction with Lower Road. Another foul sewer exists at the junction of Hilltop Avenue and Coventry Hill and taking into account the gradient of the land across the application s:ite, falling from Plot 16 to Plot 21, there should be no difficulty in obtiining adequate foul drainage connections ad any existing problems are not associated with overloading and the directorate is satisfied that such problems can be solved. It is not recommended that any embargo be imposed regarding drainage in the vicinity of this site.

The County Surveyor has made several recommendations. Lower Road is a classified road and the application site is affected by a New Street Order Line which red iced the depth of every plot by several metres. Condition No.4 is imposed to ensure that a wall or fence is erected in front of each dwelling to permit adequate sight visibility splays and also to indicate a demarcation line between the curtilage of each dwelling and the higlway. The County Surveyor is empowered to include any land within the New Street Order Line into the highway and immediately any development is commenced on the application site the developer will be required by the County Surveyor to clear all land in front of the New Street Order Line from trees, obstruc- tions etc. The access road to the Sports and Social Club has been constructed.

Thus there will e cleared vacant land between the carriageway and the front walls of t te dwellings which can be used by the public at large as a footpath until such time as the Essex County Council decide to hardsurface it or improve the highway.

The Director of Health and Housing states that any noise emanating from the Hullbridge Sports and Social Club under construction is unlikely to be a problem and therefore no special measures regarding the insulation of tie houses from external noise seems necessary. Landscaping The site has already been cleared of what little existed in the way of trees, hedges etc., 'ut a condition has been iwposed requiring suitable landscaping of the site to enhance the appearance and avoid a row of dwellings devoid of trees or shrubs etc.

The agent for the applicant has confirmed in writing that existing trees on the eastern boundary of the site will be retained and any necessary landscaping required by this authority carried out.

The whole site of No.4 Daws Heath Road has now been acquired by Mr. W. Hubbard of No.6 Daws Heath Road.

The- current application in my opinion overcomes the previous refusal reasons.

NOTE: This application was originally considered by this Committee on 3rd March 1981 (Item 20) when it was resolved that the County Council be informed that this Council objects to the proposal and that determination should be deferred for further consultation with a view to access being obtained through Bosworth Close. That decision was conveyed to the County Council.

The County Council subsequently submitted a revised layout which was considered by thin Committee on 3rd November 1981 (Item 19). The County Council pointed out at this time that it was not possible to obtain access from Bosworth Close without the acquisition of at least one privately owned house. The revised scheme showed a rearrangement of the disposition of the proposed houses such that the private drive access was sited some 13.71m. (4Sft.) to the west of the original position. Four other points of access were shown to Main Road, serving three pairs of linked houses and one detached house. The County Surveyor was satisfied with this revised scheme.

Members determined to maintain their objection to the vehicular access to Main Road and requested a site visit to enable County Members to discws the matter with Listrict Members.

The revised application was considered by the Essex County Council Development Control Sub—Committee on 18th December 1981. The Chairman of Planning Services Committee and Councillor T. Fawel]. explained the District Council's reservations to County Members who resolved to defer the matter pending an examination of alternative means of developing the site regarding access thereto.

An amended scheme was received from the County Planning Officer on 25th February 1982 together with the following comments:—

In February, 1981, an offer of financial assistance towards roof arid window repairs was made in the sum of £1,040. plus LAST. To date £778. has been expended. When that offer was made I was discussing with agents the stability of the east wall and investigations as to the condition of that wall which appears out of both vertical and horizontal alignment have continued.

There is no doubt that defects have been apparent for many years since some underpinning was carried out about 10 years ago and. an external buttress added prior to that time. There is clearly an outward movement which has reduced the bearing available to the first floor joists !whioh have already been strapped and tied. The only remedy is a rebuild of the wall on adequate foundations. COUNTY SOCIAL SERVICES/DISTRICT COUNCILS DAY CON RENCE ON HOUSING MATTERS

174. The Committee received a delegates report on the above Conference. Members' attention was drawn to a paper on "Projects in the Braintree District" describing one system of providing 24 hour cover in sheltered accommodation. Another was the "Piper" talk—back system currently being studied in the Directorate and installed by Southend Borough.

HOME SAFETY — GLAZING IN DLLINCS

175. The Director of Health and Housing reported that the Essex Home Safety Liaison Committee was concerned over accidents in the home involving glass.

The Royal Society for the Prevention of Accidents (ROSPA) considered that for high risk areas legislation was necessary to require the use of toughened or laminated glass in place of the ordinary annealed glass.

RECOMMENDED That the Council supports the Royal Society for the Prevention of Accidents seeking new legislation in respect of the wider use of safety glass in dwellings and so informs the Associatthn of District Councils and the local Members of Parliament. (935) (DElI)

Resolved (1) that the Director of Legal Services be authorised to make an Order under the provisions of Section 3 of the Scrap Metal Dealers Act 1964, to exempt Mr. M.J. Smith of 40, Ferndale Road, Rayleigh from the provisions of Section 2 of the Act, such an Order to run concurrently with the Certificate of Registration) and

178. The Committee noted a report from the Local Steering Committee and were delighted with the response to the scheme.

ANGLIAN WATER AUTHORITY - LOCAL AUTHORITY LIAISON MEETING

179. The Chief Executive reported that the Anglian Water Authority was holding a local liaison Meeting for the Essex Sewage area at Braxted Park, Witham on 13th May 1982 at 10.30 a.m. and that the Council had been invited to send representatives.

RINCSMANS FARM DITCH FLOOD ALLEVIATION SCREME (Minute 603/81)

180. The Director of Technical Services reported that there had been discussions with the AngJ.ian Water Authority about the possibility of a joint contract for this and the Council's Pooles Lane Foul Water Sewer Scheme but the AWA did not see the need and wished to keep the contracts separate.

In order to avoid delay and overcome legal difficulties it was suggested that the Council promote the Kingsman Farm Ditch scheme under the Land Drainage Act 1976, Section 98 and appoint the AWA to act as its agent. This arrangement would not affect the financial apportionment of the cost of the scheme between the contributing Authorities.

The Director of Health and Housing reported that the rear elevation to the above premises was not provided with rainwater goods and consequently whenever it rained the adjoining properties were affected. RECOMMENDED (1) That the Director of Health and Housing be authorised to serve notice under Section 39 of the Public Health Act 1936 on the owner and tenant of the Western Building, factory site, rear of 8, St. Johns Road, Great Wakering requiring the provision of a satisfactory means of collection and disposal of surface water.

CONTROL OF POLLUTiON ACT 1974 - NOISE NUISANCE RYE THERMOPLASTICS, SWAINES INDUSTRIAL ESTATE, ROCHFORI)

183. The Committee received a report from the DIrector of Health and Housing of noise nuisance from the above premises caused by the operation of waste plastic processing machinery and a fork—lift truck. The noise was interfering with the neighbouring residents' enjoyment of their property. Notice had been served on the occupier of the premises under the Control of Pollution Act 1974 Section 58, requiring the abatement of the nuisance within 6 weeks and prohibiting its recur reuce.

Resolved that if the occupier of the premises fails to comply with the terms of the Notice, the Director of Legal Services be authorised to instigate legal proceedings under Section 58 of the Control of Pollution Act 1974. (20466) (DIrn & DLS)

MAGNOLIA ROAD OPEN SPACE

188. The Director of Technical Services reported on the misuse of this informal open space by horseriders and motor cyclists, the poor site drainage and the possibility of involving a local club in carrying out ground improvements, maintenance and the provision of organised activities. It was suggested that the availability of the site might be advertised on this basis. a Members thought that, bearing in mind the size of the site, it might be suitable for a junior football pitch and that such a use might have local appeal. However, before inviting offers the Committee called for a further report on the cost of the drainage requirements, the arrangements which might be made to prevent continued misuse of the area once improvements had been effected and whether insurance cover could be obtained against damage to the playing surface in this respect.

FAIRVIEW PLAYING FIELD PAVILION - USE BY FAIRVIEW PLAYGROUP

189. The Director of Technical Services reported that this playgroup had requested permission to build its own storage by the roofing of an enclosure off the kitchen at the pavilion and alterations to kithhen furniture to convert existing shelves into cupboards. The method of construction would be examined and approved by the Council.

SPORTS GIFT TOKENS

190. The Director of Technical Services reported that it was proposed to make available gift tokens. Tickets of various values would be available which could then be exchanged for normal use of sports facilities.

SNOOKER EXHIBITION AND DEMONSTRATION EVENING

191. The Director of Technical Services reported that a provisional booking had been made for Steve Davis, World Snooker Champion, to play Tony Meo at Clements Hall Sports Centre on 12th November, 1982. Although sponsorships were being sought for the event the initial costs were in the region of £3,300.

There had already been over ZOO enquiries for tickets and Members considered a charge of £7 inclusive of V.A.T. to be very reasonable.
