Amazon's Antitrust Paradox
LINA M. KHAN Amazon’s Antitrust Paradox abstract. Amazon is the titan of twenty-first century commerce. In addition to being a re- tailer, it is now a marketing platform, a delivery and logistics network, a payment service, a credit lender, an auction house, a major book publisher, a producer of television and films, a fashion designer, a hardware manufacturer, and a leading host of cloud server space. Although Amazon has clocked staggering growth, it generates meager profits, choosing to price below-cost and ex- pand widely instead. Through this strategy, the company has positioned itself at the center of e- commerce and now serves as essential infrastructure for a host of other businesses that depend upon it. Elements of the firm’s structure and conduct pose anticompetitive concerns—yet it has escaped antitrust scrutiny. This Note argues that the current framework in antitrust—specifically its pegging competi- tion to “consumer welfare,” defined as short-term price effects—is unequipped to capture the ar- chitecture of market power in the modern economy. We cannot cognize the potential harms to competition posed by Amazon’s dominance if we measure competition primarily through price and output. Specifically, current doctrine underappreciates the risk of predatory pricing and how integration across distinct business lines may prove anticompetitive. These concerns are height- ened in the context of online platforms for two reasons. First, the economics of platform markets create incentives for a company to pursue growth over profits, a strategy that investors have re- warded. Under these conditions, predatory pricing becomes highly rational—even as existing doctrine treats it as irrational and therefore implausible. -

INSIGHTi Amazon’s HQ2 and Economic Development: Perspectives and Policy Options March 8, 2019 In February 2019, facing political and public opposition, Amazon canceled the New York portion of its planned second headquarters (HQ2). Originally announced in November 2018, HQ2 was going to be split between the Northern Virginia suburbs of Washington, DC, and Long Island City, NY, which Amazon claimed would each gain as many as 25,000 direct jobs as a result. According to its cancelation announcement, Amazon plans to proceed with its Virginia site, along with a smaller third site in Nashville also announced last November that Amazon suggested would generate 5,000 additional jobs. Amazon’s announcement followed an approximately year-long process in which over 238 localities competed to attract HQ2. Overall, reactions to Amazon’s initial announcement were mixed, reflecting contrasting views of economic development prioritizing economic growth on the one hand, and social welfare on the other. While proponents of the Virginia and New York bids celebrated the expected economic and job growth, detractors claimed the value of robust economic incentives—nearly $3 billion in New York, about $750 million in Virginia, and hundreds of millions in additional indirect incentives—would be better used to address poverty and economic inequality. Amazon’s selections also reinforced concerns over “mega- regions” like New York City and Washington, DC, attracting outsized economic gains while other regions plateaued or declined. The debate over HQ2 has led to questions over the justifiability of economic incentives for large corporations like Amazon, how those incentives play out in competition between states and localities, and the role of economic development policies in general. -

Book Review: Delivering Happiness by Tony Hsieh I have been learning about Tony Hsieh and his enthusiastic embrace of new ideas for the past few years, but I had never really considered reading this book until it was recently recommended to me. What I did know about his life—that he is an advocate of a flat organizational hierarchy called Holacracy and is dedicated to the creation of a vibrant and dynamic Las Vegas downtown—certainly piqued my curiosity, and made me want to learn more about his philosophy and how he thinks about business. Delivering Happiness does just that. The Making of an Entrepreneur Like a lot of business books written by people that run or have run companies, the author walks us through his early life and first business experiences. These stories set the tone very early with the three characteristics that define Hsieh. One, he is very intelligent, and was put in a position to succeed via traditional path. He went to excellent schools growing up in the Bay Area, studied Computer Science at Harvard, and excelled in these settings. Two, he nevertheless has a real drive for experimentation and has no desire for safety. A prototype of the entrepreneur, Tony was selling a variety of products all throughout his childhood. Worms, buttons, pizza, since pre‐adolescence he’s been creating businesses and making sales, and he has walked away from stability multiple times in favor of the next engaging opportunity. Three, he is radically people‐focused. He has a great curiosity about others, and this combines with his intelligence and entrepreneurial inclinations for a fascinating set of motivations for a business person. -
Comixology and the Future of the Digital Comic Book
ComiXology and the Future of the Digital Comic Book Hannah Johnston Abstract Since its launch in 2007, comiXology has been a key player in the digital comic book industry. ComiXology acts as a mediator between readers and texts, offering unique features with a profound effect on the reading experience in a digital environment. The Guided View interface alters the relationship between content and form, and introduces a level of editing distinct from the physical comic book. Similarly, comiXology’s DRM-free backups and subscription service provide different models for ownership of digital content. ComiXology’s model can also be understood through analysis of e-book distribution; Amazon’s Kindle provides a salient counterpoint. This paper incorporates the theories of multiple digital humanities scholars in order to explore how comiXology is influencing the future of the comic book. Keywords: Comic books, digital humanities, distribution platforms, comiXology The digital comic book distribution platform comiXology is a valuable generative example in comparing various theoretical approaches to the medium. In this paper, I will analyze what reading experiences the comiXology interface inspires, and what relationship to the text it generates. By examining the digital comic book as a specific genre within wider discourse on the future of the book, this paper will engage with multiple salient topics: interface theory, e-commerce, and ownership of digital content. This holistic approach to digital comic books both examines how the medium is theorized in the digital humanities, and facilitates an exploration of its marketing and consumption as a mass-market product. ComiXology is an online distribution platform for digital comic books and graphic novels. -

Drawing on two years of participant observation with the Milwaukee Fight for 15; participant observation of public meetings and days of action; semi-structured interviews with City officials, business leaders, non-profit professionals, and community organizers; and media and document analysis, I find that normative discourses of race underpin economic development in Milwaukee even as City officials and boosters give nominal recognition to racial inequality and purport to embrace diversity and colourblindness. -

Amazon HQ2 and the Northern Virginia and D.C. markets Amazon plans to split its new HQ2 headquarters between Crystal City in Arlington, Virginia and Long Island City in Queens, New York. It anticipates creating 25,000 jobs and occupying 4 million sq. ft. of office space in each city over the next 10 years. This is a watershed development for the Washington, D.C. and Northern Virginia markets and it indicates the importance of walkable environments, quality access to transit and infrastructure for major employers. More importantly, it confirms the strength of the D.C. region’s talent. 19 NOVEMBER 2018 CBRE Research © 2018 CBRE Inc.| 1 VIEWPOINT WASHINGTON-BALTIMORE RESEARCH EXECUTIVE SUMMARY The key impacts on the Northern Virginia and D.C. markets are as follows: • Amazon’s 4 million-sq.-ft. requirement would account for 33% of Crystal City’s existing office inventory, and its 25,000 employees would comprise 11% of the D.C. region’s tech1 labor market. • The average annual wage for tech employees in the D.C. region is $106,500, which Amazon has announced it will well exceed at $150,000. • Amazon’s 25,000 employees would generate about 50,000 additional jobs in indirect industries and in retail, housing and services. This could jump to as many as 125,000 indirect jobs depending on the composition of Amazon employees, Amazon’s local spending and its employee spending patterns. • Office demand totaling 7 million sq. ft. could occur from indirect job growth. In 2017, Northern Virginia’s annual net absorption totaled 2.3 million sq.
