A 31-YEAR-OLD man with “mental issues” kicked a 68- year-old man in the stomach for no apparent reason while the two were attending an open-mic event at the Henry Miller Memorial Library last month, according to Monterey County Sheriff’s Cmdr. Tracy Brown. Alexander Winters was gone by the time authorities arrived at the scene of the alleged attack June 30, but deputy Shaun Moran tracked him down and took him to Monterey County Jail on charges of assault with a deadly weapon, elder abuse and battery on an elderly person Sunday afternoon. “The victim is 5 foot 6, weighs less than 110 pounds and uses a walking stick,” Brown said. “The suspect is 6 foot 4 and 185 pounds.” Both men told deputies they live in Big Sur, and they know each other. While they have exchanged words on occasion, Brown said they had not been involved in physical fights before, as far as he knows. Neither the victim, nor a witness to the attack, could identify anything that might have provoked Winters. “The victim was sitting there minding his own business, and this guy comes up and starts having words with him, and without provocation kicks him in the chest,” he said. The older man was standing when Winters allegedly kicked him, and the blow knocked him to the ground. An ambulance crew responded and offered aid, but the victim refused medical attention.

POT GROWERS who wanted to get rid of three useless plants decided to use them to play a practical joke last week. Rather than destroy the male plants, which don’t produce the sought-after buds that earn drug dealers their cash, the sus- pects planted them in the outfield of the Carmel Valley Village Little League park, where they were discovered by a groundskeeper Friday morning. The three nearly 6-foot-tall marijuana plants were trans- planted into the positions of center field, left field and right field, and a maintenance man hired to tend to the baseball diamonds at Dampierre Park alerted the Monterey County Sheriff’s Office after discovering them around 10 a.m. July 23, according to Cmdr. Tracy Brown. “The suspects in this case needed to ditch the plants,” he said. “They did so in a comical manner by placing them in outfield positions in a baseball diamond.” But the joker did not badly damage the playing surface when he left the plants in the ballpark. “The grass had been removed in a minimal way, so as to not cause too much damage,” Brown said. Lawsuits are not the answer

WHILE SIGNIFICANT parts of Arizona’s anti-illegal-immigrant statute were put on hold this week pending further review by the courts, the federal judge who issued the injunction against portions of SB 1070 somehow missed one of the worst parts of the law, and one which could do the most damage to law-abiding citizens. Perhaps Judge Susan Bolton missed it because suing peo- ple on the slightest pretense has become such an accepted part of American life, and so encouraged by state legislatures and Congress for so long, that it never occurred to her honor to stand in the way. But it’s time that tradition was called to a halt. We’re referring, of course, to the clause of SB 1070 that permits any legal res- ident to sue “any official or agency of this state” (including a police officer) for failing to enforce federal immigration law. Time was you could only sue somebody for inflicting some specific and clearly definable damage on you. Did someone break your leg by hitting you with his car, let a campfire go wild and burn down your house, or make you ill by serving you contaminated food? Then you could ask a judge or jury to order the offending entity to pay you money in an amount commensurate with the damage you suffered. But as the decades went by, interest groups and the lawyers who serve them discovered how much fun it could be, and how much money could be made, if the courts were thrown wide open to lawsuits without the bother of a plaintiff

Currently, the city’s zon- ing code is limited to an all- or-nothing review process, which means projects are either exempt from any review or need a full review. Planners want to draw up new “middle ground” permit paths to avoid too much or too little oversight. Planners, who also include senior planner Karen Vaughn, want to make it eas- ier for residents to get per- mits for repairs that will remedy issues that threaten health and safety or where repairs will rectify an immi- nent danger to property.
