0. EXECUTIVE SUMMARY

This Executive Summary selects the key aspects and status of major items of the monitoring reporting period, and does not claim to provide a complete picture of the details given in this revised Social Safeguard Monitoring Report (SSMR). The resettlement and indigenous peoples plan (RIPP) has been prepared covering both involuntary resettlement planning and indigenous peoples issues as majority of the affected people are indigenous people. This monitoring report also combines the reporting of involuntary resettlement and indigenous peoples plan implementation status.

Chapter 1 - Introduction This SSMR continues to focus on preparatory construction works of the pre-construction phase concerning access roads, camp site, sub-station as well as reservoir and dam area, as they required high attention during the 1st half-year of 2018 combined with the efforts of THL to achieve progress on land acquisition and compensation, which is partly a precondition for the Project’s construction phase.

Chapter 2 - Project Status Main features relevant for the Project implementation have the following status:

• PRE-CONSTRUCTION PHASE: Scheduled completion by end of 2018. A detailed schedule of project overall activities and specific land acquisition, resettlement and compensation (LARC) activities has been provided. • UPDATED RESETTLEMENT AND INDIGENOUS PEOPLES PLAN (UPRIPP): The preparation of UpRIPPs progressed through a Draft UpRIPP dated 15 April 2018, for which ADB provided comments on 19 and 21 June 2018, and which were considered by THL/PSC to prepare an UpRIPP dated 26 June 2018. • PRE-CONSTRUCTION WORKS, COMPENSATION AND MITIGATION MEASURES: Progress has been achieved on the previously documented components, but does include in the current reporting period also awareness and orientation training a programme has been conducting to APs and LCF on the basis of i) environment and social safeguard ii) EMP and RIPP provision and iii) gender equity and social inclusion sector. Chapter 3 - Monitoring and Evaluation The Performance Status continued making significant progress on the following items:

• CONSTRUCTION OF INFRASTRUCTURE DURING PRE-CONSTRUCTION PHASE: The camp site has progressed 20% and has a completion of 90%. • LAND ACQUISITION, RESETTLEMENT AND COMPENSATION: Another 512 payments with a total of NRs 133,079,218.61 (equivalent to USD 1,217,559.18) were made for compensation of loss assets and other extra allowances. Progress on land acquisition for the installation site (Contractor Camp) of Betini village for package -1 and Banchare for Package - 2 has been achieved. The preliminary notice has been announced on 13 April 2018. The CDC has established a committee for valuation and recommendation of private assets dated on 25 April 2018 The committee has completed field work, and results are expected during the 3rd quarter 2018

• INCOME RESTORATION AND REHABILITATION: The above-mentioned allowances and assistances to AHs are (i) related to vulnerability status, (ii) provide livelihood support and compensation, (iii) cover business displacement, (iv) extra allowance for landless AHs, and (v) include displacement allowances. A first 3 months training session composed of two courses for building electrician for 40 AHs and one for plumbing for 20 AHs with a total of 390 lesson hours for 60 AHs was completed between 02 November 2017 and 17 March 2018. The skill development training will support the APs for their livelihood restoration and enhancement. In this context shall be noted, that THL as Employer ensured that the contractor Swachchhanda-Khani JV for the THL camp hired local labour. This approach provided 176 local people work of which 22 were female and 154 male people including affected people. • COMMUNITY DEVELOPMENT: Related to the health subcomponent of the community development component (one out of 6 subcomponents), a community driven and THL supported Rohasing - Kisirdi drinking water and sanitation subproject is implemented to provide for about 300 households water for the Jhaputar settlement collecting from three sources are Rohasin, Kisirdi and Pinchhoding along the access road and the THL camp. Completion is scheduled for July 2018. • GENDER EQUALITY AND SOCIAL INCLUSION: A public GESI orientation meeting was held on 16 May 2018 in Municipality at Rising Patan in PIC office. Form 90 participants including affected people (AP) 64 were female and 26 male. The topics of this event were (i) gender, role and responsibility of women, and their project participation, (ii) legal provision of women rights in the constitution of Nepal and other national documents on gender aspects, (iii) environment impacts of the project and related impacts for women using natural resources, and (iv) cultural impacts and the proper mitigations. The details of GESI progress as per PAM has been attached in Annex 7. The Project has a Compliance Status which can be highlighted as follows:

• GRIEVANCE REDRESS MECHANISMS: They are applied in accordance with the requirements as defined in the Resettlement and Indigenous. This has been confirmed by the Due Diligence Reports prepared by an independent NGO “Rural Empowerment Society Demauli Tanahu Nepal” who verified the compensation payment made and receipt process.

• DUE DILIGENCE OF COMPENSATION: THL engaged the NGO “Rural Empowerment Society Demauli Tanahu Nepal” to verify the compensation payment made and receipt process. Two DDR has prepared. 1. The Supplementary DDR confirmed payments of additional allowance to APs concerning camp and access road, which has been approved by ADB. 2. The DDR-1 was prepared for Reservoir and Dam area to verify the compensation payment made and applied process which has send to ADB for approval.

• IMPACTS ON CURRENT LIVELIHOOD SITUATION: There are no significant impacts on the AHs’ income situation yet, as AHs did not experience a forced loss of income, access to income sources or other source of livelihood, as they are permitted to use their compensated assets as long as possible until the actual use of the acquired land along the access road and camp site by THL. This applies to a much bigger scale and extent to AHs of the reservoir area, where the APs can use the land, houses and trees, for which they have already received or will receive their preferred in- cash compensation, over the coming years in agreement with THL, so that there are no immediate adverse impacts on their livelihood. Thus, AHs have actually and individual flexibility how and when to react on the known changes. This offers a several year-long

period for planning, preparing and implementing a livelihood and income restoration program. Chapter 4 - Grievance Redress Mechanism

The Grievance Redress Mechanisms (GRMs) are applied to the satisfaction of all stakeholders. This has been confirmed through two DDRs and also public municipality meetings. The complaints are administered by THL, details recorded and status of progress monitored. In addition, LCF meetings have been conducted to build a consensus from the discussion. At reporting status, 47 are under ongoing clarification, whereas 45 cases have been solved in agreement with the complainants.

Chapter 5 - Consultation and Participation

ESMU has continuously performed regular consultative activities including informal and formal discussions and meeting with APs, district line agencies, local representative and concerned committees. There were 25 public/formal meetings held with 599 attendees (135 female and 464 male participants). Consultations are conducted with stakeholders throughout the pre-construction phase including the reporting period. It serves ESMU to understand concerns of APs and communities, and to elicit their suggestions on the Project in a regular and transparent manner. The community consultation in the Project area remain the same mainly with focus on (i) compensation (determination procedure, evaluation criteria/basis and rates, and distribution procedure) (ii) people grievance on compensation (iii) additional assistance (iv) reinstatement of affected community properties (v) livelihood restoration and enhancement provision for displaced and vulnerable people and (vi) possible community support program to affected people.

A public orientation environmental and social safeguard meeting was held on 20 March 2018 in Myagde Rural Municipality at Tharpu Bazar. From 52 participants including affected people (APs) and affected community forest groups members 25 were female and 27 male. The topics of these events were (i) tree cutting, management and compensation of tree. (ii) role and responsibility of community forest group for forest site clearance and plantation (iii) Social safeguard policy, involuntary land acquisition, compensation, and system of grievances complain, register and redress. Chapter 6 - Other Activities The THL/ESMU team continued facilitating regularly project site visits of individuals, delegations, teams and missions. The notable one during the reporting period was the EIB Mission on technical, financial, environmental and social safeguard during 24 - 29 April 2018. In general, site visits serve various purposes and include topics on land acquisition, compensation, consultation, technical coordination and grievances. Chapter 7 - Conclusion The current status of the pre-construction phase these can be summarized as follows: • The preparatory construction works show completing progress. • Social safeguard activities are following principles as agreed in the Project’s Resettlement Framework. THL puts its emphasis on acquisition of assets (land, structures, and trees) and payments of compensation to AHs for their loss of assets and other related allowances. However, first subcomponents of the Community Development and the Gender Equality and Social Inclusion components are implemented. • The appointments of the three Panels of exports (Social Expert, Environment Expert and Dam Safety Expert) are progressively underway expecting now mobilization of Panel of experts by end of 2018. Concerning ESMSP, 5 companies have been selected and have been invited by THL to prepare and submit a proposal.

• The preparation of a Draft Updated UpRIPP completed in March 2018 and submitted to ADB who provided comments in June 2018, so that THL/PSC prepared and submitted the UpRIPP within one week in June 2018.

1. INTRODUCTION

1.1 Scope of Report This Social Safeguard Monitoring Report (SSMR) is the third report documenting social safeguards aspects only. It covers the period from January to June 2018, the first half of the year 2018 as the reporting period.

The focus of the social reporting remains unchanged, so that also this SSMR covers preparatory construction works of the pre-construction phase, such as access roads, camp site, sub-station as well as acquisition and compensation for reservoir area and dam site. These tasks continue requiring high attention throughout 2018 to achieve progress on land acquisition, compensation, and mitigation measures, which are partly preconditions for the Project’s construction phase. This SSMR also includes after the description of the project status chapter-wise the topics (i) monitoring & evaluation, (ii) complaints and grievance redress mechanism and (iii) consultation and participation.

1.2 Brief Project Description There is nothing new to report.

2. PROJECT STATUS

2.1 Project Implementation Phases

There is nothing new to report.

2.2 Schedule of Activities

As indicated in the previous SSMR, a detailed schedule of project overall activities and specific LARC activities has been provided under Annex 1. It represents the status of February 2018 as shown in the Draft Updated RIPP Pre-Construction Phase dated April 2018. Although this schedule is self-explanatory the status (February 2018) of the three project phases can be summarized as follows:

• Phase 1: Pre-Construction Activities in this phase include the finalization of engineering designs and bidding documents, the tendering and selection of Contractors. During Phase 1, the review and planning of environmental and social safeguard activities began. The implementation of acquisition and compensation of assets is ongoing and will be completed for the major access roads, camp site and reservoir/dam areas. Safeguard monitoring has been initiated with focus on pre-construction work. This phase has started in July 2015 and is expected to extend up to the second half of the year 2018, which is the currently envisaged start of the construction works for Packages 1 and 2.

• Phase 2: Construction This includes construction works of the major component on the THP construction site near Damauli and along the transmission line alignment. This includes also the implementation of the environmental and social safeguards activities and mitigation measures, which will be intensified during this phase. The current estimated construction time until start of operation is 62 month, but can be subject of change due to technical, design and engineering review of contractor’s designs.

• Phase 3: Operation

It covers the operation of the Tanahu power plant and related project facilities including the training of THL operating engineers. This includes also environmental and social M&E and implementation of corrective measures as required. Phase 3 is scheduled for five (5) years and should have some overlapping with the Phase 2.

2.3 Preparation of UpRIPPs

Starting since October 2017 the preparation of a Draft UpRIPP has been completed in March 2018 and finalized in April 2018 for submission to ADB. ADB submitted to THL comments on, and suggested modifications to, the Draft UpRIPP in the form of (i) 9 “screening items” received from ADB on 19 June 2018 and (ii) more than 120 specific comments received from ADB on 21 June 2018. THL and PSC prepare an UpRIPP for submission to ADB on 26. June 2018. The objective of this UpRIPP is to expedite the release, by ADB to THL before 15. July 2018, of the compensation payments already made by THL to the AHs in the reservoir area. The compensation payments by THL to the AHs have been confirmed by the DDR Reservoir Area, but ADB has now linked release of the compensation payments, not only to the DDR Reservoir Area, but also to the UpRIPP. Therefore, ADB and THL have agreed to prepare this additional UpRIPP to focus on specific topics and modifications. However, this UpRIPP will eventually be replaced by a Final UpRIPP which will address final comments expected from the ADB Social Safeguard Department, but would also incorporate latest data and information (including DDRs) to adjust IoL, SESAH, status of payments, UpRIPP budget, and other main text tables and annexes.

3. MONITORING AND EVALUATION

The monitoring and evaluation (M&E) of social safeguard activities continues through internal and external monitoring:

• Internal Monitoring: Compared with the previous report, there are no specific items new to report about the monitoring by THL staff and ESMU of valuation of the land and distribution of the compensation to the APs. • External Monitoring: In general, the external monitoring can be carried out in two corresponding ways. Firstly, regular independent reviews through a social safeguard expert as member of a Panel of Expert. The notice has been published on 1st June 2018 for appointing three panels of expert on dam safety, social expert and environment expert. Secondly, through an on-request contracting of independent monitoring organizations. The latter has been performed through the independent NGO “Rural Empowerment Society Damauli Tanahu Nepal (RESDTN)” on verification of compensation payment and applied procedures both concerning the reservoir area. It concerns the due diligence, which has been completed during the reporting period (see Chapter 3.2.4). 3.1 Performance Monitoring The Project’s verification on scheduled activities and comparing them with actually performed activities is termed performance monitoring. The Project currently documents the social safeguard activities and mitigation measures, in a descriptive way so that corrective planning can be considered in the next revised schedule of social safeguard activities followed by their implementation. Individual progress of components is documented below, whereas the overall context is given through the UP-RIPP implementation schedule in Annex 1.

3.1.1 Construction of Infrastructure during Pre-construction Phase

This chapter provides an overview about the performed activities of THL on pre-construction activities as well as land acquisition and compensation (LAC) and other allowance distribution.

A. Construction of 5.5 km Right Bank Access Roads Completed, as reported before.

B. Construction Power Sub-Station 33/11 kV Completed, as reported before.

C. Construction of Camp Facilities As of June 2018, the construction has progressed up to 90 %. All together 33 buildings (2 office buildings for employer and consultants are completed, 2 residential building of type A, 12 residential building of type B, 10 residential building of type C, 2 dormitories, 1 guest house, 1 health post, 2 restaurants and 1 guard house) are to be constructed as camp facilities. C. Surveys • For site installation area of packages 1 and 2 the DMS for land, structure, trees and crops has been completed by the CDC’s sub-committee. This includes 9 meetings of THP, the sub-committee and/or other stakeholders with the owners and users of potentially affected assets. At current stage fixation of compensation rates and costs are under preparation, discussions with the Betini AHs ongoing, so that decisions are expected in July 2018. CONSULTATION MEETING. 3.1.3 Income Restoration and Rehabilitation

The income restoration and rehabilitation is a very important component for the livelihood support to AHS. Therefore the preparation of a detailed Income Restoration and Rehabilitation Plan will be among the first tasks of the ESMSP. Although this component is at its very initial stage, following achievements have been managed. A. Vocational Training Based on the Board Approval THL contracted the Rural Training Centre (RCT), a training wing of the Council for Technical Education and Vocational Training (CTEVT) Bhimad for conducting certified level-1 skill development training to APs. The training has its focus on following areas on (a) building electricity, (b) masonry, (c) plumbing, (d) off-season vegetable production, and (e) community livestock assistance. It was composed of two courses for building electrician for 40 AHs and one for plumbing for 20 AHs with a total of 390 lesson hours. This is the first Project’s support to AHs through training, which will also serve as lesson learnt for next training sessions, about which the next SSMR will report.

The skill development training will support the APs for their livelihood restoration and enhancement. The area of training can be modified to other fields such as masonry, off-season vegetable production and community livestock assistance after reacting on demands of participating APs. The priority for placement in training will be given to AHs in general and in particular to permanently displaced people, vulnerable and indigenous people during selection of participants. B. Labour for Pre-Construction Works Independent from the vocational training, there was already one demand for construction work. THL as Employer ensured that the contractor Swachchhanda-Khani JV for the THL camp hires local labour. This approach provided 176 local people work of which 22 were female and 154 male people including affected people. C. Livelihood Support This component is expected to get more attention in the next reporting period, but certainly during the construction phase of THP. Any livelihood support will be embedded in the income restoration and rehabilitation as well as the Community Development (CD) and Gender Equality and Social Inclusion (GESI) components. However, as part of the compensation and mitigation measures, livelihood support payments were made to AHs as documented in Chapter 3.1.2.

3.1.4 Community Development:

The Community Development Strategy (CDS) from August 2012 was also prepared during the PPTA for ADB by THL. It will serve as basis for the preparation of the Community Development Plan (CDP) for the 6 community development program areas. This is one priority task for the Environmental and Social Management Service Provider (ESMSP). The CDP will not be limited to the THP affected households only, but also include non-affected households, aiming at rehabilitation and complementary/new livelihood support measures. The six areas are not limited to the UpRIPP defined mitigation measures for AHs, but extend its support for local socio-economic development to all villages in wards located in the THP area, so that all residents would have the opportunity to actively participate in the CDP defined interventions for:

(1) Education. (2) Health (and water supply, sanitation, hygiene). (3) Gender. (4) Social inclusion (ethnic and vulnerable groups). (5) Local economic development. (6) Livelihood promotion (through farm and forest related activities). Related to the health subcomponent of the community development component (one out of 6 subcomponents), a community driven and THL supported Rohasing - Kisirdi drinking water and sanitation subproject is implemented. It covers both the Jhaputar settlement along the access road and the THL camp site. From the subproject’s total cost of NRs 4,153,976.86, the community contribution is NRs 1,289,876.76 of which 20% (NRs 257,975.35) are in form of labour. An agreement (see Annex 5) was signed on 16 February 2018 between THL and entire community group. This water was collected from the sources Rohasin, Kisirdi and Pinchhoding of quantity are 1.0, 0.91 and 0.83 m3/s respectively. The number of benefiting users has been estimated with 300 households in Jhaputar. Constrictions of intake tank, reservoir tank and main pipeline laying works have been completed. The community will operate the water supply system and use a meter reading system for calculating water fees.

Constructed rural water supply infrastructure 3.1.5 Gender Equality and Social Inclusion A Gender Equality and Social Inclusion Action Plan (GESIAP) were prepared during the PPTA in tabled form and being orientated towards ADB report requirements (see Project Administration Manual (PAM) dated 28 January 2013). This GESIAP is related to both social and environmental ADB safeguard areas and will require detailed planning review for preparation and implementation. This is one priority task for the ESMSP. As the THP has been classified as effective gender mainstream project, this plan seeks to empower women including: • Participating in THP and rural development projects at planning and implementing stages (Jobs, livelihood measures, etc.). • Increasing their awareness of their rights, knowledge and economic development. • Roles and status in their families and communities Similarly, a public GESI orientation meeting was held on 16 May 2018 in Bhimad Municipality at Rising Patan in PIC office. This event has been inaugurated by Bhimad Mayor as well as LCF Chairperson. The participants were LCF members, especially women members of APs and affected areas peoples. Form 90 participants 65 were female and 26 male. The following topics were presented: • ADB-LRM representatives Suman Subba and Lachchhana Shresthacharye made presentation about gender, its disparity, role and responsibility of women, their participation and education, and also provided ADB guidelines. • Similarly, ESMU through its head Mr. Tulasi Sapokata provided introduction to the participants on legal provision of women rights in the constitution of Nepal and other national documents on gender aspects. • The environment bridging specialist has facilitated about the environment impacts on the project and effect on women using natural resources. • The social safeguard bridging specialist has facilitated about the cultural impact and proper mitigation measures.

3.2 Compliance Monitoring The Project needs to confirm the satisfactory implementation of agreed activities termed Compliance Monitoring. Routine-wise collected information showing non-compliance would be expected to result into clarification among the project partners for further implementation of agreed activities and measures. There is nothing new to report about (i) legal and policy requirements, (ii) social safeguards, (iii) resettlement planning requirements, and (iv) the approach of independent compensation verification through NGO.

3.2.1 GRM

Concerning the applied steps there is nothing new to describe. In this context, however, it should be noted that the Due Diligence Reports confirmed that the GRM are applied to the satisfaction of both AHs and THL in connection with compensation fixation and payments.

3.2.2 LARC

Similarly, the LARC activities are conforming to ADB requirements and the Nepali laws. In addition, the 21-Points Agreements covers items THL and APs reached joint understanding. The CDC defined compensation rates are based land quality, productivity, locations, access to road and local market rate. Their rates are up to 45 times higher than the prevailing Government rate, which reflects current market rates and therefore cover any cost escalations since 2012 when the Draft RIPP was prepared. The CDC has decided to provide additional allowance as provisioned in the RIPP for restoration of income and livelihood. To restore the livelihood of affected non-title AHs, the CDC has decided to provide additional NRs 400,000 to each household to purchase the land on top of other allowances. Additionally, the CDC also decided to provide additional NRs 250,000 onetime cash support to AHs losing entire land of their ownership.

3.2.3 Others Topics

Nothing to report. 3.3 Impact and Mitigation Monitoring

3.3.1 Need for Data and Information Collection

Beside continuing collecting and administering LARC data with focus on AHs and their entitled payments of compensation an mitigation support, THL started to prepare data on the project components CD and GESI. All are the basis for the details on impacts provided in the report. However, as more systematic data management approach is required, THL will start preparing standardized table for better use and updating.

3.3.2 Impacts on Current Livelihood Situations

As explained in the previous reporting period it should again be noted that this situation will remain the same for the current pre-construction but also for most of the construction phase. It can be confirmed that no AH has experienced a forced loss of income, access to income sources or other source of livelihood, as they were permitted to use their compensated assets as long as possible until the actual use of the acquired land along the access road and camp site by THL. This applies to a much bigger scale and extent to AHs of the reservoir area, where the APs can use the land, houses and trees, for which they have already received or will receive their preferred in-cash compensation, over the coming years in agreement with THL, so that there are no immediate adverse impacts on their livelihood. Thus, AHs actually have individual flexibility on how and when to react on the known changes. This offers a year-long period for planning, preparing and implementing a livelihood and income restoration program.

4. COMPLAINTS AND GRIEVANCE REDESS MECHANISM

4.1 Key Steps

Nothing new to report as the applied steps remain unchanged.

4.2 Implementation Status

4.2.1 Complaints from two AP Representing Committees

Complaints are continuously brought forward by villagers to THL. Complaints are also receiving high attention by the financing agencies of the THP, as done by EIB during their mission from 24 to 29 April 2018, similar to the ADB Review mission in previous reporting period. The complaint is requesting better and effective information dissemination, grievance redress and further verification on potential losses of assets.

4.2.2 Elected Local Level Representatives

During the reporting period, the direct communication with the local authorities continued. LCF meetings at and Bhimad Municipality were conducted on 8 February 2018 and 22 February 2018 respectively in the presence of respective mayors and/or deputed mayors. Similarly LCF meetings at Rising Rural Municipality and Myagde Rural Municipality were conducted on 27 February 2018, 02 March and 26 June 2018 respectively in the presence of respective chairperson and vice chairperson of those rural municipalities. In general, THL emphasized for the supportive and active involvement of LCFc to solve grievances, in particularly, concerning compensation issues. The meetings are documented in Annex 3.

4.2.3 Established Committees

Committees were established at district and local level to facilitate the mechanisms of AHs and Non- AHs for complaints. Taking into consideration their roles for the AHs, the ethnical feature and their sex features are of high importance, as shown in Table 4.

4.2.4 Local People’s Complaints

The THL Project site office registered 58 new complaints from AHs. Adding them to the 34 cases from the previous reporting period, they add up to 92 cases as shown in Table 4, which also includes the topics and status of complaints. ESMU with the support of LCFs is making efforts to address them as far as possible. Further, THL and/or ESMU staff regularly consulted the district line agencies (District Administrative Office, District Forest Office, District Education Office, District Land Revenue Office, District Land Measurement Office, Office of Vyas Municipality etc.) regarding those issues.

In general, the raised grievances will be discussed during meetings of the Local Consultative Forums (LCFs). After reviewing the grievances, LCFs forward them with recommendations for actions to be taken in order to address them. The 21-Points Agreement is for most complaints the basis to find mutual agreements, which led to the following achievements:

• Livelihood support assistance and identity card have been distributed to 256 AHs. • Vulnerable assistance has been distributed to 214 AHs. • Compensation was distributed to 23 AHs. Currently 85% of AHs received these payments. • Counting of missing tree structure and land areas have been applied • Others.

5. CONSULTATION AND PARTICIPATION

5.1 Stakeholder Engagement Process

There is nothing new to report.

5.2 APs’ Communication and Involvement

THL continues to implement LARC activities in close consultation with the key stakeholders. It is ensured that women and other vulnerable groups participate in public consultations at various levels and stages of project preparation, which enhances their ability to attend such meetings. any AP related to the resettlement process are taken into account duly for addressing them. The applied communication techniques (individual, family and focus group meetings) remain the same.

5.3 Information Disclosure

The information is being disseminated through the Information Centers of THL, local media (newspaper and FM radio) as well as national media. The topics include mainly entitlements, project impact, compensation payment schedule and process. During the reporting period, it became more obvious that APs appreciate the establishments of the two Public Information Centers (PICs), one integrated into the THL Project site office and one in Rising Patan as physical points of contact for information dissemination of the project including safeguard aspects.

5.4 Public Consultation

During the reporting period 25 public meetings were conducted which were attended by 135 female and 464 male participants (see Annex 4). These meetings include a public orientation meeting held on 20 March 2018 in Myagde Rural municipality for APs and the affected community forest groups. About 52 villagers attended this meeting of which nearly half (47%) were female participants. The event was inaugurated by Myagde Rural Municipality chairperson as well as LCF chairperson. The consultation meetings were facilitated by the THL and covered the topics (i) project components, (ii) technical features, (iii) environment safeguard, and (iv) social safeguard. Bhimad Municipality

Myagde Municipality

A public environmental and social safeguard orientation meeting was held on 20 March 2018 in Myagde Rural Municipality at Tharpu Bazar. Out of 52 participants, including affected people (APs) and affected community forest groups members, 25 were female and 27 were male. The topics were presented • Tree cutting, management and compensation of tree. • Role and responsibility of community forest group for forest site clearance and plantation. • Social safeguard policy, involuntary land acquisition and compensation. • Grievances register mechanism and process redress. 15

6. OTHER ACTIVITIES

6.1 Project Site Visits

THL and its ESMU continued, during the reporting period, its facilitation of site visit and field work for different teams including officials, EIB, PSC, and others. The notable one during the reporting period was the EIB Mission on environmental and social safeguard during 24-29 April 2018. These visits cover in general same thematic areas as mentioned in the previous report: • Compensation determination procedure. • Compensation evaluation criteria/basis. • Compensation rate. • Compensation distribution procedure. • People grievance on compensation. • Additional assistance. • Reinstate of affected community properties. • Livelihood restoration and enhancement provision for displaced and vulnerable people. • Possible community support program to affected people.

6.2 Engagement of ESMSP

Based on the notice for Expression of Interest (EoI), which was published on 08 November 2017, for the engagement of Environment and Social Management Service Provider (ESMSP), a total of 11 international firms had submitted their EoIs. Their evaluation has been completed during the reporting period, and THL has put 5 companies on a short list dated 21 June 2018 inviting them by an RfP (Request for Proposal).

6.3 Engagement of NGO for Preparation of DDR

The same Rural Empowerment Society NGOI, who prepared the DDR for the campsite, was contracted by THL to prepare:

• A Supplementary DDR covering vulnerable allowances in access road and camp sites. Field work was carried out between 24 and 30 January 2018 followed by submission to THL in April 2018. • DDR for compensation and allowances distribution in Reservoir area. Field work was carried out between 26 January 2018 and 28 February 2018 followed by submission to THL in May 2018.

7. CONCLUSION

7.1 Current Status

The Project is in its pre-construction phase. The current status can be summarized as follows:

• The preparatory construction works is further progressing, as the sub-station and access roads were completed already in the last reporting period, and the camp construction shows a progress of 10% leading to an 80% completion status. • Social safeguard activities are following principles as agreed in the Project’s Resettlement Framework. THL puts its emphasis now not only anymore on (i) acquisition of assets (land, structures, trees) and payments of compensation to APs for their loss of assets and related

allowances, but (ii) also first activities of the CD and GESI components. Social safeguards remain a topic of high importance and priority throughout 2018. • It is now expected that the ESMSP will be mobilized by end of the year 2018. The important tasks of ESMSP with unchanged priorities will be the preparation of (i) an Income Restoration and Rehabilitation Plan (ii) a Stakeholder Engagement Plan including communication strategies (iii) a Community Development Plan and (iv) thematic and map- based preparation of baseline and impact survey data.

7.2 Updating Resettlement Data/Information and Document

In general, the situation did not change in 2017. The currently applied resettlement plan document is the Draft RIPP prepared as part of the PPTA and based on a land requirement assessment and socio-economic surveys conducted in 2011 and 2012. As the Project is in its pre-construction phase and THL has already started the land acquisition and compensation payments since 2012, there was still the need to prepare a pre-construction phase related Up RIPP.

The verification of data from surveys (DMS, Socio-economic survey of affected households, consultation, others) started in the 4th quarter 2017 and was completed in March 2018 including completeness and quality controlled, before the use of such data for specific formatted tables required as standards for ADB resettlement plans. The preparation of the Draft Updated RIPP Pre- Construction Phase was completed in March 2018 by PSC/THL, and the verified by THL for submission to ADB in April 2018. ADB comments received by HL on 19 and 21 June 2018 were reviewed and considered by PSC to prepare the Updated RIPP dated 26 June 2018.

7.3 Expected Major Items for Next Reporting Period

Beside the above chapters, the expected major items for the next reporting period are as follows:

• Preparation of Final UpRIPP Pre-Construction Phase. • Documentation about LARC activities of the Betini access/site installation area. • Other topics, such as livelihood restoration planning, community development strategy, communication planning, rural development and others will require first verification and updating, before actions can be defined and only then reporting is possible.

ANNEX 6-1.4: Agreement of Rohasing - Kisirdi Drinking Water and Sanitation (Translation) Tanahu Hydropower Limited Tanahu Hydropower Project

Tanahu Hydropower Project and the Rohasing Kirsidi Water Supply and Sanitation User's Committee, then Kahu Shivapur VDC No. 01, Tanahu have made an agreement to construct a Jhaputar Drinking Water Project. Agreement Paper This agreement has been made to construct the Jhaputar Drinking Water Supply Project in order to supply the drinking water to the project affected people by the Tanahu Hydropower Project (thereafter called project). As the THL's 51st Board Meeting held on 4 January 2018, THL approved the estimated cost of the project the amount NRS 4,153,976.86. Regarding this, NRS 1,289,876 has been borne by User's Committee calculating the unskilled labor wages fixed by Tanahu District for Unskilled labor. According to the agreement with User's Committee, the total 20% of unskilled labor's amount that is to say NRS 257,975.35 should be borne by beneficiary, after the deduction of this amount total will be equal to NRS 3,896,001.51. Further 10% will be added as a contingency amount, the total of NRS. 4,285,601.66 (In words NRS Forty-two lakh eighty-five thousand six hundred one rupee and sixty-six paisa inclusive VAT) will be invested by the project. Under the consideration of approved specification and estimation, followings are the conditions to complete the community water supply project which has been finalized from the meeting between User's committee and THL. Agreements Conditions 1. As per agreement User's Committee should complete the work under the estimation. The THP will provide the total amount of NRS. 3,896,001.51 (In words Thirty-eight lakhs Ninety-six thousand One rupee and fifty-one paisa inclusive VAT) after deducting 20% (i.e. NRS 257,975.35 ) of estimate amount from total of Nrs.4,153,976.35 to complete the water supply project. The responsibility of User's group is to complete the work in estimated amount in provided specification applied by Nepal Drinking Water Corporation/District Drinking Water Office.

2. Supervision and Control of the work as per required will be in the hand of project's technicians. The User's committee should follow and work according to the provision of Public Procurement Rule, 2064.

3. Drinking Water Distribution System should supply a ¾ tap to the Camp Site of the project.

4. The project will provide the Interim Payment as per the requirement after the technical evaluation of all documents. The remaining payment (deducing tax according to prevailing Tax law) will be provided after the completion of the all work.

5. The Drinking Water Project should be complete within six months. If the User's Committee submits the application for extension of time with reasonable causes, it can be extended.

6. As prescribed in Cost Estimation, involvement of the participants (Unskilled labor Cost) and maintaining the quality of work will be the full responsibility and accountability of User's group.

7. The User's Committee should submit the original copy of all bills, receipt, daily attendance sheet, the detail account information of assets and a copy of minutes for the final payment. The User's should keep the copy record of each document by themselves.

8. After the completion of the work, the User's group should submit the Income and Expenditure Record conducting Public Audit in the representation and witness of representative from Municipality/Rural Municipality, concerned Ward chairperson, representative of the project.

9. The User's Committee should compulsory submit the Project Completion Recommendation letter from the Municipality/Rural Municipality after the completion of the Drinking Water Project.

10. The Operation and Maintenance works of the Drinking Water project should be conducted by the User's Committee itself as per prevailing law of Nepal Government.

11. The terms of the Agreement may be extended or amended as mutually agreed upon between the sides.

12. Any dispute in connection with this Agreement, including any issue regarding its interpretation or application, shall be settled amicably by the sides through the mutual consultation.

13. The Specification, Drawing and Technical Cost Estimation prescribe by Nepal Drinking Water Project/District Drinking Water Office will be main part of this agreement.

14. All the activities undertaken pursuant to this agreement shall be subject to the prevailing laws and procedures.
