learned judge convicted the appellant for the olfen,:e

punishable under Section 10 of the National Accountat,ILity

Ordinance, 1999 (hereinafter referred to as the Ordinauc-,

and sentenced him to suffer R. I. for 7 years and fine (_.,1

of the appellant owned by him, in the name of his wife and

..therefore, the'properties acquired by the appellant are

has fuither argued that the appellant was required to

prove the sources of -income but has failed to do so by

leading cogent and admissible evidence; that the documents

produced- :bythe Appellant. can not be relied upon and can

not be .termed as 'evidence; that the -appellant was required

to disprove the charge which he has failed to do. He has

further stated that there is no mis-reading or non-reading•

of the evidence:by the trial Court. He has supported the

,:• impugned judgment.

• The appellant has been tried for offence as defined

makes the position' objectionable and constitute the

corruption and corrupt practices is required to be drawn.

As regards the first ingredient of the offence it is an admitted position that the appellant was member of District' Council Sanghar, in the year 1979 and onwards he • • tnen11:bedame :. MPA in the year 1985 up to 1988 when the ,Provincial ASsembly was dissolved and then he was elected as MPA in the year 1997 on wards till the assembly was dissOlved. Thus, the first ingredient has been proved.

As regards the second ingredient, the prosecution

alleged: that the. properties mentioned in the charge which

are shown in Tthe earlier part of the judgment were ; ,•,•• • . ,1•• • . acquired by • the appe.i.lant. In this connection it is

pointed out, that the learned trial judge excluded the

properties shown at Serial N(41 and 8, the prosecution did

.properties, the appellant. has admitted that he acquired

the same in the name of his. spouse and children. Thus, the •i prosecution has proved 'second ingredient of the offence to

.the above extent.

As regards the third and fourth ingredients- of the

;,..7offence,:the proSecutiop relied upon the source of income

which appellant had received from the agricultural land

situated in Taluka Sinjhoro. "Known sources of income"

must be taken to the sources known to the prosecution on

thorough investigation of the case. If the appellant

sources, of income then he is required to show

It will be noticed that the appellant claimed that he

had inherited the property from his father. In -1•,;•-• connection the prosecution also led evidence of Pw.3, • ' • Tapedar , Abdul Xhaliq of Taluka Sinjhoro and Pw. 14

legalheira. 'Thus from the evidence. of , prosecution

witnesses, the appellant inherited agricultural property

of morethan: 150 acres.

rk.f.'appellant tookplea that he took 560 acres of W' iliTalukaTando Allahyar on lease. He used to pay

land 'revenue for the said property. He produced registered

Lease Deeds executed between him, his son Mian Fakir with

'the owners of the land situated in Taluka Tando

Allahy*.; The regis,terecriease deeds have been produced as i • Exh: Qii•to Q/23, He also produced land revenue receipts

from the year 1987 of the said land as Exh: Q/24 to Q/140.

He further took plea that he had business of cattle and

owned abOUt200 heads of cattle. The. prosecution witness

Pw.3 adMitt'ed that the appellant was 'Khalifa' of Pir

Sahib Pagara, respectable person and big landlord. He

further admitted that whatever land shown in the name of

appellant was under actual cultivation and he was also

paying.land.:/.evenue; Pw. 4, Tapedar Abdul Sattar, admitted

that accused and his family members also owned heads of

cattle, cows, buffaloes and sheep s; Pw. 5 also admitted

that he had:seen herds of cattle in the land whenever he

`COttonpoda; sugarcane of lacs of rupees were sold to • themr.The witnesses produced the relevant entries of their

registers, cheques books, bank accounts, to prove the

.receipt of.produces and payment given to the appellant. , - 1 . Turther more the evidence of DW.7, Bilawal, shows that the

'appellant sold his Tractor for Rs. 3.50,000/- to him. The

tractor was obtained by the appellant from Agricultural

Development Bank in the year 1987. The registration book

ofi)the tractor Exh: 1002 shows that Fiat Tractor of Model

1986 was registered in the name of appellant on 2.4.1987.

This further'establishes. the fact that for cultivating the

land thethe appellant had purchased the tractor but he sold

.the same in the year 1993.

From the above sources of income, we are satisfied

that the appellant has satisfactory account for the

acquiring of the properties as shown above.

The prosecution alleged that the bungalow shown at

Serial No. 11 of. the list of properties shown in the

charge !was acquired by,the appellant through his influence

and misuse of his authority. It is pointed out that the

said bungalow was auctioned in the year 1987, the highest

bidderAaas one Allah Warrio Wassan and then in the year

1993, the appellant purchased the samein the name of his

son Mian Fakir. The prosecution witnesses deposed that he

auction was conducted in accordance with the law and rules but the prosecution alleged that it was done under the influence of the appellant. It is not out of place to mention 'here that this. is not the case of misuse of authority but it is the case of acquiring properties disproportionate to the known sources of income of the appellant. Therefore, the said aspect of the case cannot be examined in this case.

As regards the burden of proof, this bench. has eXamined the said point .in Criminal Accountability Appeal

No.60/2000, Hakim All Zardar1 V State, decided

24.01,2007. The relevant portion of the said judgment as under:-

" As' regards the burden of proof the normal rule of law is that an accused is presumed to be innocent until his quilt is proved, established and .the of establishing the quilt is always on the prbsecution. But the: rule of law laid down in Section 14 (c) of the Ordinance is a departure from normal law and'under this section, a presumption of corruption and corrupt practiceS is required to he drawn, if Lhe accused or any person on his behalf is in possessin of pecuniary resources or property disproportionate to his known sources of income for which sources roc cannot satisfactorily account.. 2. The relevant facts of the prosecution

case are that complainant related to Pakistan Peoples

Party. Some days prior to incident, Pir Mohammad. Ismail

Shah son ,of Pir Syed Saddar-uddin Shah came at the

Village complainant for work-purpose and said

complainant party to caste vote to him, but his cousin

Wali Mohammad Kanhar (now deceased) had denied and said

that they have not left to Peoples party and caste vote

to it. On the day of election, complainant Mohammad

Murad, his cousin Wali Mohammad son. of Jan Mohammad

Kanhar, aged about 45 years, Noor Mohammad son of

Illahi Bakhsh Kanhar, Kareem Bakhsh son of Jan Mohammad

Kanhar and Abdul Jabbar son of Ali Murad Kanhar went together for casting the vote in the polling station

Ghoogi Mangneja. After casting the vote at polling station, returned back to their village. It was about

1400 hours, when they came-out from polling station, meanwhile, one double cabin. jeep came and saw that jeep was stopped. From jeep, accused Sarwar Shah son of

Ghulam Qadir Shah armed with K.K, Murtaza Shah son of

Ghulam Qadir Shah and Waryam Fakir Khaskheli, both armed with T.T pistols and two unknown persons, he did not know about the their names, whOse faces were opened, they have clearly seen, again saw, will be identified, both have armed with Kalashnikovs in their hands. While alighting from jeep, the accused Sarwar 3

Shah made hakal and accused Murtaza Shah made direct

fire upon Abdul Jabbar with intention to commit murder,

which hit and he fell-down on the land while crying.

Thereafter, all the accused persons made fires upon the

complainant party. The complainant party made cries and

fell-down while save their lives. Then all the accused

persons while saying that this is result of*Pir Syed

Ismail Shah while not giving the vote to him. They have

also made slogans of Pir7Pagara, sat in the same

vehicle and went away. Then complainant party saw that

cousin Wall Mohammad has sustained firearm injury and

blood was oozing and died on spot. P.W Abdul Jabbar and

Fayyaz Ahmed have also received injury and they became

injured. Thereafter, complainant appeared at police

station Pir-Jo-Goth and then lodged the FIR against the,. above named accused persons. Hence, this FIR.

3. During usual investigation,. police submitted the challan .against the accused persons in the court of law having jurisdiction.

4 . After supply necessary documents, the charge against accused Waryam Fakir was framed at

[Exh.4], under which, he pleaded not guilty and claimed for trial vide his plea at [Exh.5].

prosecution has examined P.W-1 injured Fayyaz Hussain

at [Exh.6], he produced affidavit at [Exh.6/A], P.W-2

at [Exh.1/A], post-mortem report of deceased Wa]i

Mohammad at [Exh.7/B], medical report of injured Abdul

Jabbar at [Exh.7/C] and medical report of injured

.6. The statement of accused Waryam Fakir,

under section 342 Cr.P.0 has been recorded by this

Court at [Exh.191 under which, he denied the

allegations of prosecution so leveled against him and

claimed to be innocent. He does not examine himself on

oath nor defence witness in his self. defence.

7. Now the points for determination in this

case before me are as under:-

1. Whether the deceased Wali Mohammad Kanhar had died due to unnatural death?

2. Whether on 18.2.2008 at 1400 hours, at outside the polling station Ghooghi, above.

REASONS

POINT NO.01:-

10. To prove the point No.1, burden lies upon prosecution. The prosecution has examined P.W-2

Medical Officer Dr. Chettan Das at [Exh.7], wherein, he has deposed in his examination-in-chief as under:-

"On 18.2.2008, I was posted at RHC Pir-

Jo-Goth being Medical Officer. On the

above date, it' was about 3:30 pm, one

PC/123 Javed Ahmed Panhyar brought the

dead body of. deceased Wali Mohammad son

of Jan MohamMad Kanhar for its post-

mortem and report. The said P.0 has

served the police letter, upon me, which

I produce the same at Exh.7/A and say it

is same. I have started the post-mortem

of deceased Wali Mohammad at about: 3:30

pm and ended the same at 4:30 pm on same

date.. During post-mortem of the above

named deceased; I found following

external as-well-as internal injuries on

his person:-

A lacerated firearm wound measuring 1.5

cm x 1.75 cm at the right side of lower

lateral side of chest making wound

through and through to the exist below

the left nipple of chest measuring 3 cm

DAMAGES:-

Walls ruptured at the site of injury,

right as well as left lung ruptured,

pericardium and heart ruptured, blood

vessels ruptured at the site of injury.

Other organs of the deceased remained

healthy and normal.

OPINION/REMARKS:-

By external as-well-as internal examination of deceased Wali Mohammad son of Jan Mohammad bycaste Kanhar, I am of the opinion that injury No:1 :caused by discharge from firearm, injury as ante-mortem in nature. The death of deceased has occurred due to injury No.1 which causes shock and hemorrhage and 0-1r. s RETUR • 4/

ruptured the heart. The probable time

between injury and death was

instantaneously and probable time

between .death and Post-Mortem 01-3

hours. After completing the post-mortem,

I handed over the dead body to same PC.

Then, I issued 'such post-mortem report

alongwith my opinion, 'which, I produce

the same at Exh.7/B and say it is same,

correct & bears my signature.

11. From his opinion, the death of deceased

Wali Moha ad has occurred due to unnatural death.

Hence, in view of perusal of evidence of Medical

Officer so- lsO his opinion, the point No.1 answered as

in affirmat ve.

Kanhar. Formal charge against accused Waryam Fakir

Khaskheli has been framed on 11-06-2011 and thereafter,

repeatedly summons were issued upon the complainant

Mohammad . Murad. The process-server has submitted

summons duly un-served upon the complainant on every

time. The NBWs were also issued against the complainant

but the same was also returned duly un-served upon the

complainant. So-many hettic efforts were made by this

court for procuring the evidence of complainant but.

complainant has failed to attain the Court for his

evidence. Lastly, on 04.10.2011 statement of procnss

server ASI Barkat Ali at [Exh.10] has been recorded.

The process-server A.S.I Barkat Ali has deposed that

for compliance of order of this court, he made hectic.

efforts to serve the NBWs upon the complainant but did

not succeed. However, he has recorded statement of two

local persons which he produced at [Exh.10/B & 10/C].

He has also attached photo-state copy of CNIC of the witnesses whose statements recorded by him. He has produced NBWs, issued by this court against complainant at [Exh.10/D]. The process-server has further deposed that there is no possibility .for service of summons/NBWs upon the complainant Mohammad Murad because he has shifted to unknown place and whereabouts he will not know. In view of the statement of process

servei. A.S.I Barkat Ali, it appears that there is no

possibility for service of summons upon the complainanL

Mohammad Murad Kanhar.

14. Theprosecution has examined three eye-

witnesses. Out of which; two were injured and one was

the brother of deceased and cousin of complainant. The

prosecution has examined injured P.W Fayyaz Hussain as

P.W-1 at [Exh.6], injured Abdul Jabbar. P.W-8 at

[Exh.14] and P.W Karim Bakhsh. at [Exh.12].

15. P.W Karim Bakhsh at [Exh.12] is brother

of deceased. He deposed that the incident has taken

place on 18-2-2008. On the day of incident he,

complainant Mohammad Murad, deceased Wali Mohammad,

injured Abdul Jabbar, Fayyaz Hussain and Noor Mohammad

and another person whose names he does not know were

present at Mangneja Ghoogi polling station. He deposed

that after casting the vote he was returned-back and

saw that one double cabin vehicle came there. The said

vehicle was stopped, from which Sarwar. Shah, Murtaza

Shah and Waryam Fakir (present accused) alighted. He

deposed that first fire was opened by. Sarwar Shah from

his which was hit to Wali Mohammad. Waryam Fakir

and Murtaza Shah armed with T.T pistols, they also

opened. fire-shot which hit to other persons. They

raised commotions. After hearing the commotion,

villagers were came there. Thereafter, accused persons ran-away.

16. In the cross-examination, this witness has recorded contradictory statement with his chief. He also admitted. that the complainant is absconder because he was also involved in the murder case. He has admitted that where the incident has .taken place the said polling station was a female polling staLion.

However, in the cross-examination, he has given following admissions:-

"It is correct to say that polling

station GhOogi Mangnejo was the lady

polling station where .only the ladies

have casted the vote. It is correct to

say .that I have not cast my vote at

Ghoogi Mangnejo polling station and

have wrongly stated in my-chief. It is

correct to say that dispute was arisen

in the boundary of polling station. I

have ocasted vote at other polling

station situated at village Khand. The

polling station Khand was away fOr one

kilometer from the polling station of

Mangneja. Complainant is a nekmard of our village It is' correct to say that complainant Mohammad Murad is a worker of 13 P.p. It is correct to say that on the day of polling station, the p01.1c° officials were performed their duties in polling station. It is correct to say that near polling station, the big village of Ghoogi Mangneja- is situated.

It is correct to say that during incident - Hone person of Mahgneja community also caused. injuries 02/3 persons of Mangneja community were also present in. polling station. It is

complainant Mohammad Murad is absconder

in murder case.

17. The Prosecution has examined injured P.W

Fayyaz Hussain at [Exh,- 61, he in his examination-in- chief-has fully exonerated to accused. He has also sworn his affidavit which he produced' at [Exh.6/A]. He deposed that the day of incident was election-day and during polling for costing of the Vote, the dispute was arisen. The firing was made due to dispute but he does not know who have fired. He also received firearm injury and Abdul Jabbar has also received firearth injury. He deposed that Wali Mohammad after receiving firearm injury had died. Ghulam Sarwar Shah and Syed Murtaza Shah

and on the day of incident they were

fired. It is correct to say that accused

Fakir Waryam, Ghulam .Sarwar Shah and

Ghulam Murtaza Shah are innocent and

complainant has falsely implicated to

them in thiS Case:!'

18. Injured P.W Fayyaz Hussain at [Exh-6] in

'his affidavit atlExh.6/A1 his also supported his above

version.

19. The prosecution has examined another

injured witness Abdul Jabbar as P.W-8 at LExh.14). He

has also fully exonerated to accused in his

examination-in-chief. He deposed that he and P.W Fayyaz

sustained firearm injury. He does not know persons who

have fired. However, in the cross-examination he

deposed that he knows very well Waryam Fakir, Syed

Ghulam Sarwar Shah and Ghulam Murtaza Shah and they

were not present at the time of place of incident

neither they have fired.

officer Dr.. Cheetan Das as P.W-2 at [Exh.7] he has

supported the post-mortem report. The prosecution has

examined S.I.P Imdad Hussain as P.W-3 at [Exh.8], he

produced copy of F.I.R at. [Exh.8/AJ. He in his cross

examination has deposed that. he was posted being SHO at

. P.S Pir-Jo-Goth during election. No any other person

.alongwith the complainant came at police station at the

time of registration of F.I.R.

21. The • prosecution has 'examined . P.W-4•

Inspector Ghulam Hyder at [Exh.9] he deposed that on

29.2.2008:he received police papers of this case from

STO Sarfraz Mangi or .invesLigation. On 22.-3.2008 no

recorded 161 Cr. P.0 statements of. witnesses nomoly

Karim- Bux, Abdul Jabbar, Fayyaz and Noor Mohammad. On

23.3.2008 he recorded the statements of defence

witnesses namely Abdul Manan, Manzoor and Nadeem Ahmed.

On 24.3.2008 he released accused Syed Mohammad Ismail

Shah, under section 169 Cr.P.C. On 7.5.2008 Syed Ghulam

Sarwar Rashidi and Syed Ghulam Murtaza Rashidi came at

police station and produced their bail order, granted ti by Honou'rable High Court, Karachi. Thereafter, Fakir

.Waryam involved in this case and then Honourable High

Court, Karachi called him. On 18.6.2008 he was G4//4V7y

transferred and then handed over police papers to SIO

Rizwan Narejo for further investigation.

22. In the cross-examination, this witness

has adtitted that during investigation, he has not

visited the place of wardat neither recorded the

statements of presiding officer of the polling station

and other polling staffs. He admitted that he also not

recorded the statements of other persons who were

present at polling station.

23. The prosecution has examined P.W-5

inspector Sarfraz Hussain Mangi at [Exh.11]. He depoSed

that on 18.2.2008 hereceived copy of FIR of this crime

for investigation complainant also alongwith him. After

receiving copy of FIR he and complainant going to

civil Hospital Pir-Jo-Goth. His subordinate staffs were

also alongwith him. In Hospital, ho inspected Lnjuli(m

injured Abdul Jabbar and. Fayyaz Hussain at about

1545 hours and then prepared memo of injuries of both injured. He produced memo of injuries at [Exh.11/A]. He deposed that it was about 1630 hours he inspected the dead body and then prepared such mashirnama. He produded memo of inspection of dead body at [Exh.11/11].

He also produced. inquest report at [Exh.11/C] He produced receipt at [Exh.11/D] under.which P.0 Javed /

returned the dead body to parent. He produced memo of

cloths at [Exh.11/E], carbon copy of *notice under

section 160 at [Exh.11/F], memo of place of wardat at

[Exh.11/G], carbon copy of letter, addressed to chemical examiner at [Exh.11/H], carbon copy of letter addressed to Mukhtiarkar at [Exh.11/iJ, carbon copy or letter under which he inspected injuries of injured persons at [Exh.11/J].

24. In the cross-examination, inspector

Sarfraz Mangi has recorded total contradictory statement. with 'his chief: He has given following admissions:-

It is correct to say that I have not

prepared memo of inspection of dead body

on spot. It is correct to say that it is

not mentioned in memo of inspection 01

dead body that holes/marks of bullet

were on the cloths of deceased. It .is

correct to say that it is not mentioned

in memo of cloths about. bullets holes.

It is correct to say that survey number

of place of wardat is not mentioned in

the place of wardat. It is correct to

sway that place of wardat comes under

the jurisdiction of village Ghoogi

Mangneja. I have not entered inside the

polling station and I have only

inspected the place of incident which is

situated outside the polling station.

The mashirs were available at the place

of wardat and .complainant gives the

names of mashirs therefore, I appointed

them as mashir. It is correct to say

that I have not: secured blood stained

dust of the injured. persons from the

. place of wardat. It is correct to say .

that mashirs are same in all

mashirnamas. I have not sent empties to

ballfstic expert for opinion and report.

It is correct to say that I have not

inquired about the incident from injured

persons but I have prepared only

mashirnama of injuries. It is correct to

say . that during investigation, I have

not inquired . about polling station

whether the same is male or ladies. It

is correct to say that neither I have

inquired about . the incident from

independent witnesses of locality at the

place of incident, nor recorded 161

27. Again this Court has issued'sUmmons upon

the above-named witnesses, out of which, Ex-SIP Rizwan

Ahmed Narejo appeared in court and has recorded his

evidence at [Exh.17j. He deposed that he received

police papers for investigation on 18..6.2008. The

Honourable High Court Karachi called him and inquired

about the submiSsion•of challan. He deposed that on the

directions of Honourable. High Court, he has informed to

their lordship that still he has not collected the

proofS of the evidence against the accused persons,

therefore, he has not submitted the challan befOre

court having jurisdiction. He further deposed that on

the directions of the Honourable High Court, he has

submitted interim 'challan before the court having

jurisdiction.

28. the cross-examination, he has

admitted that it was came to his knowledge that crime.

branch Sukkur after conducting further investigation

has reported that all the three accused i.e Ghulam

Sarwar Shah, Ghulam Murtaza Shah and Waryam Fakir were

declared as innocent. He admitted that during

investigation period, no any proof/evidence come on the _.,': , '-.:'-5- ,' ' ' ', • ..,"

29. Mr. Saeed Ahmed Memon, A.D.P.P vide

statement at [Exh.18] has closed the .side on behalf of

prosecution and then the statement of accused Fakir.

Waryam Fakir has been recorded. He has denied the

allegation leveled against him and has deposed that he

has been implicated due to political enmity, he prayed

for justice.

30. I have heard learned counsel for the

accused, ADPP on behalf of state and have gone through

the evidence and documents brought on the record by the

prosecution witnesses. It. is matter of record that

prosecution has failed to examine the complainant.

However, it is come on the record in the evidence of

P.W Karim Bux at (Exh.12) that complainant is his

cousin and he is absconding away in the murder. case. No

any evidence came on the record to implicate an the

three accused in commission of offence.

31. P.W Injured Fayyaz Hussain at rExh.61

and P.W-8 Abdul Jabbar at [Exh.14] who have also

received injuries, have clearly deposed that accused

Waryam Fakir, accused Ghulam Muitaza Shah and Ghulam

Sarwar Shah were not present on spot the time of incident and they have not fired upon them. the words of the above-naMed witnesses has also confirmed by

S.I.P Imdad Hussain at [Exh.8]. The SIP Imdad Hussain

PS-79 Saitakag-18 23

at [Exh.8] has confirmed the version of P.W injured

Fayyaz and P.W injured Abdul Jabbar in 'following

manner.. "It is correct to say that no any person has

informed me at the place of incident that Fakir Waryam,

. Ghulam Murtaza Shah Rashidi and GhUlam Sarwar Shah were

present on spot and they have committed the incident".

32. The evidence of P.W-6 Karim Bux at

[Exh.12] is also doubtful, because in his chief, he

deposed that after casting the vote he was returned

back from polling station, thensaw accused Waryam

Fakir, Ghulam Sarwar and Ghulam Murtaza Shah Rashidi.

He deposed that Sarwar Shah fired upon Wali Mohammad

and Waryam • Fakir and . Murtaza Shah fired to another

persons. In the cross-examination, he admitted that he

has not casted his vote in the polling station and the

polling station was a female polling station. He haS

further admitted that male polling station• was for away

for one kilometer from polling station Gjoogi Mangneja.

33. The evidence of P.W-6 Karim Bux at

[Exh.12] is unreliable and not conspiracy. In view of the above reasons, the whole evidence appears to be doubtful.

34. As the injured persons have not implicated to the accused persons and in view of the

evidence of SIP Imdad Hussain, that no any material

come on the record to connect the applicant/accused in

the commission of offence. Ex-SIP Rizwan Narejo has

also confirmed that the investigation of this case was

conducted by crime branch Sukkur and they in their

report declared all accused are innocent.

35. Keeping in view of this, no any material

come on the record to• implicate all the three accused

persons in the commission of offence. P.W injured

Fayyaz Hussain and Abdul Jabber have fully exonerated

to accused persons by deposing that they very well

known to the above-named accused and they were riot

present on spot. .Even otherwise, P.W. Karim Bux at

[Exh.12] has admitted that the accused Waryam Fakir

•belonged to taluka Sinjoro District Sanghar he was

contested. election at Sanghar. From the .evidence of P.W

Karin Bux, the smell of enmity is come on the record.

It is .impossible that a candidate who contested

election in .another 4istribt and on the day of election

he was present in another. district. Hence, the-presence

of accused Waryam Fakir in Pir-Jo-Goth is also

doubtful.

'36. From perusal of the evidence of the

/prosecution witnesses, the ocular account or

circumstantial -vidence is not come on the record to

implicate the accused persons in the commission of

present offence. The evidence of P.W Karim Bakhsh is

also doubtful and from perusal of, the evidence of P.W

Karim Bakhsh, it appears that he was not present on

spot at the time of incident hence, his ocular account

is doubtful. It .is well settled provision of law that

benefit of doubt ever goes to favour of the accused.

However, in the. present case, the motive is not proved

by the prosecution witnesses.

37. In view, what has been discussed above,

I am of the opinion that the day Of incident was a

election day and might be dispute was arose in local

persolls. From the evidence of the prosecution

witnesses, I am of the. opinion that the allegaLiomi

made against the accused persons are to be false. In

view Of the above, the point No.2 is not proved aguinsL

all the accused persons.

POINT NO.03:-

38. In view of above discussion and finding

on point No.2, .I am of the affirmed view that the

proseCution has miserably failed to prove the charge

'against the accused persons beyond reasonable shadow of

'doubt; ther fore, I - acquit accused Waryam Fakir

alongwith absconding accused Ghulam Sarwar Shah and

GhulaM Murtaza Shah, under section 265-H(i) Cr.P.0 by

giving benefit' of doubt. Accused Waryam Fakir is

present in court on bail, his bail bond stands

cancelled and surety discharged. Let the intimation be

sent to concerned police station accordingly.
