1826 Act 1996-9 (SS2) LAWS of PENNSYLVANIA 1826 Act 1996-9 (SS2) LAWS OF PENNSYLVANIA No. 1996-9 (SS2) AN ACT NB 3 Providing for the adoption of capital projects related to the repair, rehabilitation or replacement of highway bridges to be financed from current revenue of the Motor License Fund and for the adoption of specific blizzard or flood mitigation projects or flood assistance projects to be financed from current revenues or from debt incurred under clause (1) of subsection (a) of section 7 of Article VIII of the Constitution of Pennsylvania. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: CHAPTER 1 PRELIMINARY PROVISIONS Section 101. Short title. This act shall be known and may be cited as the Special Session Flood Relief Act. CHAPTER 3 BRIDGES Section 301. Short title of chapter. This chapter shall be known and may be cited as the Special Session Capital Budget Act of 1996 for Flood Damaged Highway-Railroad and Highway Bridges. Section 302. Definitions. The following words and phrases when used in thischapter shall havethe meanings given to them in this section unless the context clearly indicates otherwise: “Account.” The Highway BridgeImprovement Restricted Account within the MotorLicense Fund. “Capitalproject.” Acapital project as defined in section 1602-B of the act of April 9, 1929 (P.L.343, No.176), known as The Fiscal Code, and shall include county or municipal bridge rehabilitation, replacement or improvement projects as set forth in this chapter. “Department.” The Department of Transportation of the Commonwealth. “Secretary.” The Secretary of Transportation of the Commonwealth. Section 303. Total authorization for bridge projects. The total authorization for the projects itemized pursuant to this chapter and to be financed from current revenue is $53,817,000. Section 304. Itemization of bridge projects.     Brook Trout Outcome Management Strategy Introduction Brook Trout symbolize healthy waters because they rely on clean, cold stream habitat and are sensitive to rising stream temperatures, thereby serving as an aquatic version of a “canary in a coal mine”. Brook Trout are also highly prized by recreational anglers and have been designated as the state fish in many eastern states. They are an essential part of the headwater stream ecosystem, an important part of the upper watershed’s natural heritage and a valuable recreational resource. Land trusts in West Virginia, New York and Virginia have found that the possibility of restoring Brook Trout to local streams can act as a motivator for private landowners to take conservation actions, whether it is installing a fence that will exclude livestock from a waterway or putting their land under a conservation easement. The decline of Brook Trout serves as a warning about the health of local waterways and the lands draining to them. More than a century of declining Brook Trout populations has led to lost economic revenue and recreational fishing opportunities in the Bay’s headwaters.
