The Sale Office is located directly across from the Appaloosa Show Office off the lobby of the John Justin Arena. Sale Office hours will be available at the Show Office. Announcements Buyers, please pay attention to announcements made from the auction stand. If you are not sure about an announcement, please ask the ring men for clarifica- tion immediately. All announcements from the Auction block shall take prece- dence over any printed or other-wise announced statements. If you have any other questions regarding the horse you are bidding on, please ask the ring men taking your bid immediately while the horse is still in the sale ring. HYPP Definitions Hyperkalemic Periodic Paralysis Disease (HYPP) is a muscular disease. The results of horses that have been tested for the disease, if known, will be noted as follows in this catalog: N/N: Negative for HYPP H/H or H/N: Positive Heterozygous for HYPP H/H: Positive Homozygous for HYPP The Appaloosa Horse Club and Superior Productions neither warrants nor guarantees the authenticity or validity of an HYPP certificate of statement by the consignor. If HYPP test results have been received by the ApHC, those test results may be noted in the catalog. Breeding Soundness All stallions over the age of 36 months that have not sired any registered foals within the 12 months prior to the sale have been required to provide sale man- agement with a veterinarian certificate of breeding soundness. Hip Numbers Hip Numbers for the sale begin at #1. Horses will be sold in catalog order. PAGE 3 N-Registered Appaloosas Beginning in January 2007, N-Registered (non-characteristic) Appaloosas are eligible for a Performance Permit, which does not alter the registration of the horse, but allows the horse to perform in ApHC approved races, shows and rides. Contact the Appaloosa Horse Club for more information on this program. Tote Board The bid amount displayed on the tote board during the auction represents the last bid received on that particular horse. Bidders must listen to the auctioneer for the amount of the next bid to be accepted. Telephone and Internet Bidding Real-Time bidding is available via the Internet for this sale. Live audio and live video will allow buyers to bid on horses as if they were present at the sale. Bidder Verification The identity of all bidders will be verified by the auctioneer or sale management. Bidding rights are provisional, and if complete verification is not possible, registration and bid- ding activity will be terminated. Buyer Premium There is no buyer’s premium. Each bidder must conduct and rely solely upon their own investigation and inspection. *BY REGISTERING AND BIDDING, BIDDERS AGREE TO THESE TERMS AND CONDITIONS* PAGE 4 BUYERS TERMS AND CONDITIONS Please read and familiarize yourself with the TERMS AND CONDITIONS of this sale. You will be bound by these Terms and Conditions whether you read them or not. 1. LAW. The horses are offered for sale according to the laws of the State of Texas. 2. ApHC. Although this sale is held in conjunction with the Appaloosa Horse Club’s 2016 World Championship Appaloosa Show, purchaser hereby acknowledges that the Appaloosa Horse Club, Inc. is not responsible for the warranties of the consignor(s). ApHC makes no representation or warranty with respect to any animal and the buyer must look solely to the designated consignor(s) for recovery of any damage by reason of the failure of any representation or limited warranty. 3. BIDS. The highest bidder will be the buyer, and if dispute arises between two or more bidders, the horse(s) in dispute shall immediately be put up again for advance bids. If there is no advance, the horse(s) shall go to the person from whom the auctioneer recog- nized the last bid. The auctioneer will decline any bids made by parties who have default- ed in former purchases, or by persons who, in his/her best judgment, are not responsible bidders. Immediately after horse(s) is sold, the buyer shall sign confirmation of purchase and security agreement forthwith. The right to bid is reserved by all sellers. 4. NON-QUALIFYING BIDDER. Sale Management is authorized by the consignor(s) of each horse(s) to decline any bid made by a non-qualifying bidder. A non-qualifying bid- der is a person who, in the judgment of Sale Management, does not qualify to purchase the horse(s) and to complete the transaction for any of the following reasons: a) lack of financial responsibility including default in payment on former purchases; b) falsifying information to the Sale Management and/or consignor(s) in any way relating to a pur- chase, including any former purchase, c) intoxication, unruliness or other conduct which interferes with the progress of the sale; d) lack of contractual capacity; e) repudiation or refusal to comply with purchase requirements; or f) other unacceptable conduct which causes Sale Management to conclude that the bidder is not reliable and responsible. 5. BUYER’S PAYMENT. Terms of sale are cash (U.S. funds only) to be paid on the day of the sale. Method of payment shall be cash, overnight check, or pre-approved credit card. There will be a credit card processing fee of 3.8% on all credit card payments. No bank drafts will be accepted. Foreign buyers must pay with money order, U.S. cash currency or credit card. (SEE CHECK LIABILITY) clause (#20). All registration papers will be withheld a minimum of twenty (20) banking days from the date of the sale. Any payments made by the buyer to the consignor(s) or any other party will not be regarded as valid or entitle the buyer to delivery or title of the horse(s). All horses must be paid for in this manner regardless of whether they sell in the auction ring or on the grounds prior to the sale or following the sale. 6. ACKNOWLEDGEMENT OF PURCHASE. Upon the auctioneer’s declaration the horse is “sold” a purchaser shall forthwith sign the “Acknowledgement of Purchase” pre- sented by Sale Management. If a consignor(s) repurchases a horse(s) by right of reserve, PAGE 5 i.e., the reserve is not achieved; Consignor(s) (or Consignor’s Designee) shall execute an acknowledgement affirmatively stating “No Sale.” Sale Management reserves the right to void a sale and to re-present the horse(s) for sale at auction if: a) the high bidder refuses to execute the “Acknowledgement of Purchase” or otherwise repudiates or fails to per- form according to the TERMS AND CONDITIONS, b) auctioneer or Sale Management identifies a material mistake, or c) the bid is declined by Sale Management due to a non- qualifying bidder. 7. RESALE. In the event a Buyer defaults on accepting or paying for a horse(s) sold to the Buyer, the Sale Management reserves the right to accept the same purchase amount from another person, accept the next highest bid, put the horse(s) up for sale a second time or retain it for the Consignor(s) as unsold; however nothing shall prevent Sale Management and/or Consignor(s) from pursuing whatever legal remedy available to compel the Buyer to perform as set out herein.
