In addition to those conditions specifically noted on the reports contained within this Committee Agenda, all decision notices issued (unless expressly noted as being an exception to this practice) will include a condition relating to the duration of the permission. These conditions are expressly imposed in accordance with Sections 91 and 92 of the Town and Country Planning Act 1990. All applications will be granted subject to a standard condition which requires that the development approved must commence within five years of the date of the permission (unless the Local Planning Authority stipulates an alternative time period). Outline planning permissions will be issued subject to a condition requiring “reserved matters” to be submitted within three years of the date of the outline permission. It is predominantly flat in profile although some surface undulation exists. The eastern boundary of the application site skirts the perimeter of the western boundary of the former Merthyr Vale colliery site which divides the two settlements. The southern extremity of the site is formed by the playground at the end of Taff Street which is bounded by the River Taff to the west. The most northern point of the application site is formed by the new Ynysowen Primary School at the Grove fields. The western boundary of the application site runs along the bank of the River Taff from the civic amenity site to Aberfan Crescent and then along the front of Nixonville and continuing along the dismantled railway between Tudor Close and Taff Street/Crescent Street. PROPOSED DEVELOPMENT Full planning consent is sought for the provision of new infrastructure to support the mixed use development known as Project Riverside, which was granted Outline planning consent by the Welsh Assembly Government in March 2008, following a “Call-in” Public Inquiry held in September 2007. The infrastructure will comprise a new highway travelling in a north to south direction between the new Ynysowen Primary School and Taff Street, and will include the following elements:- • Two new roundabouts at the southern end, one at the entrance into Crescent Street and the second to the north east; • A new road bridge across the River Taff at the northern end adjacent to the new Ynysowen Primary School; • A footbridge adjacent to Bridge Street; • Four new bus stops with shelters (two south bound and two north bound); • A car park and “Homezone” at Nixonville; • Footpaths and cyclepaths between the homezone and the realigned B4285; • Underground services and utilities, including sewers and a pumping station towards the southern end adjacent to the disused colliery site; • Flood protection walls, general infrastructure and landscape works. The application was supported by a Design and Access Statement, a Transport Statement, Flood Consequences Assessment, plans and drawings, tree survey and ecological reports. The Design and Access Statement submitted with the application states: “The proposed realigned B4285 spine road forms the core of the current application, which also includes a proposal to replace the existing weak road bridge at Bridge Street with a new footbridge. The B4285 will be reconfigured to create a bypass that will circumvent a multitude of traffic safety problems in both Nixonville and Aberfan Road”. “The new road bridge will provide a direct vehicular link to the new school for buses and vehicles travelling from the south of the Merthyr Vale ward, and a new footbridge proposed at Bridge Street will offer an alternative route to the school for pedestrians”. PLANNING HISTORY The application site has a fairly extensive planning history, most of which is not directly relevant to the consideration of this application. The details of the previous (consented) application relating to the site is summarised below:- 04/0641 (Outline) – Project Riverside mixed use development comprising - 230 dwellings, primary school, nursing home/residential home, two shops, office complex, pub/restaurant and demolition of Taff Street and Crescent Street - Secretary of State Call-in – Approved subject to conditions 11 th March 2008. CONSULTATION Internal Engineering Manager – No objection subject to conditions. With particular regard to flooding, the Engineering Manager provided a detailed response which concludes
