1. CALL TO ORDER Chair Lynn Silverton called the meeting to order at 9:30 a.m.

Introduction of Peter Osinga, Police Services Adviser, Community Safety and Correctional Services, Police Quality Assurance Unit and Karen Holt who will be assuming the Secretarial position.

2. SELECTION OF CHAIR AND VICE CHAIR Under Section 4.1 of By-law #GHPSB 2005-01 2.1 Selection of Chair - Conducted by Secretary The Secretary called for nominations for the position of Chair.

Alan Coleclough nominated Lynn Silverton and seconded by Jim Murray. The Secretary called for any further nominations a second and third time. Stan Baker moved that nominations be closed and Lynn Silverton accepted the position of Chair.

2.2 Selection of Vice Chair - Conducted by Chair The Chair called for nominations for the position of Vice Chair.

Jim Murray nominated Stan Baker and was seconded by Alan Coleclough. The Chair called for any further nominations a second and third time. Brian Mullin moved that nominations be closed and Stan Baker accepted the position of Vice Chair.

8. DELEGATIONS 8.1 10:00 a.m. - Thomas Oates - Composition of Grey Highlands PSB, Past PSB Meetings and Minutes and response to Board's letter of December 18, 2008

Mr. Oates appeared before the Board and handed out a letter dated February 2, 2009 outlining that he received a copy of By-law #GHPSB 2004 - 01 which was not dated and therefore is without force. A copy of Mr. Oates written submission dated February 4, 2009 was circulated with the agenda package regarding composition of Board, past PSB meetings and minutes, and response to letter received from Board member Dr. Jim Murray.

The Board thanked Mr. Oates for his delegation.

9. DETACHMENT COMMANDER'S REPORT 9.1 Report In the absence of the Detachment Commander, Sgt. Roulston introduced Sgt. Phil Mann, S/Sgt. Rick Sinnamon and Const. Sue MacPherson and provided an overview of the Report. It was noted that Sgt. Phil Mann has been assigned to Markdale and that Const. Spires was promoted to Sgt. and will be looking after a Platoon. An increase in RIDE grant funding is playing a part in the increased RIDE checks in the area. Discussion on having some of these highlights placed on municipal website.

The Chair asked Sgt. Roulston to take back to the Detachment Commander that it's time for nominations for Officer of the Year.

ITEMS FOR DISCUSSION 10.1 Municipal Alcohol Policy Update - Adopted by Council on December 22, 2008 It was noted that the amended Policy addressed the concerns of the OPP. 10.2 Gift Certificate, Advertisement, Snack Trays Expense Authorization Discussion on Ads being placed in only two papers. This was an initiative driven by the Markdale Standard and Owen Sound Sun Times.

PSB09 - 04 Coleclough - Baker RESOLVE, That Police Services Board authorize the following expenses: Gift Certificate for Philip Allanson - Evaluations $50.00; Advertisement Sun Times and Markdale Standard for Crime Stoppers Awareness - $65.00 and Holiday Drive Safely - $65.00; Snack Trays - $53.92 and $48.37; CARRIED. 10.3 2009 - 2011 Strategic Direction A copy of the Strategic Direction was placed on the municipal website as well as being sent out to a number of organizations and Committees and Boards.

PSB09 - 05 Baker - Coleclough RESOLVE, That the Grey Highlands Police Services Board formally approve its 2009-2011 Strategic Direction and forward same to Council for information and, if deemed appropriate, endorsement. CARRIED. 10.4 Year End Financials For information purposes only, since budget has not been finalized at this time, the PSB Board budget was reduced by $3,200 for 2009.

11. CORRESPONDENCE 11.1 OAPSB - 47th Annual Meeting and Conference, April 30 to May 2, 2009 (Cornwall, ON) Discussion on content of the conference and it was noted this Board attempted, to no avail, have more Section 10 content included in the conference program. on restraints posed by Council Conference Policy for Council Board members and whether a protocol is necessary that outlines attendance of Chair or designate. 11.2 Friends of The OPP Museum - Fundraising Gala at Casino Rama - Saturday, March 28, 2009 Information only. 11.3 West Perth Police Services Board - PSB09 - 06 Mullin - Coleclough RESOLVE, That the Grey Highlands Police Services Board supports the resolution as circulated by the West Perth Police Services Board regarding petitioning the Ministry of the Attorney General to review the system of sentencing of the Province's Court System and further, that a copy of this resolution be sent to the Honourable Chris Bentley, Attorney General of Ontario and West Perth PSB. CARRIED. 11.4 Independent Police Review Director - Introduction Chair to provide a response and ask for additional information on the proposal to increase the budget, considering this Board is a Section 10. 11.5 Correspondence - Response to December 16th letter from Board. Requested information was forwarded. 11.6 Cornwall Community PSB - Conference Sponsorship Noted and Filed. 11.7 OAPSB Exec Director Position 11.8 OPP Policing Agreement Renewal The CAO and Detachment Commander will be meeting to define the process and understood that Council will solicit the views of the Board as part of the process. 11.9 OPP - Estimated 2009 Policing Costs

12. OTHER BUSINESS 12.1 Peter Osinga, Police Services Adviser, Community Safety and Correctional Services, Police Quality Assurance Unit

Mr Osinga gave an overview of his background and reason for his attendance at the Board meeting, being one of seven Advisors whose purpose is to monitor Boards and meet with Detachment Commanders. He highlighted some of the following items: Boards should have in place a Code of Conduct for its members; Chairs are the media relations officer for the Board; closed sessions are at a Page 4 of 6

______high level and anyone not sworn to secrecy should not be part of discussions. In regards to monitoring Detachment Commanders, it was noted that Grey Highlands created their own protocol to monitor and evaluate the Detachment Commander, Board Chair, the Board and the Board Secretary. The Chair to check with OAPSB on Code of Conducts. A copy of the OPP contract should also be circulated to Board members. At the request of a board member, Mr. Osinga gave the Board an "A" on its governance role and performance. 12.2 Addition - New initiative on Public Involvement Alan Coleclough spoke on the Board's past communication efforts with the public, through public meetings, newspaper bulletins, etc. and the appearance that it is not getting out to a sufficient number of homes and residents.

PSB09 - 07 Coleclough - Mullin Resolved that a two person committee be formed to investigate avenues to involve public participation in Police Service Board activities being Alan Coleclough & Stan Baker CARRIED. 12.3 Volunteer Driver Session Discussion on the number of volunteer drivers in the community and with some volunteers being seniors that they may be some benefit for a workshop to update rules and regulations of the road. The Board agreed that Stan Baker, in partnership with Const. MacPherson, look into organizing such a workshop. 12.4 Addition - Meeting Administration Review whether software allows for attachments to be numbered to correspond with agenda.

Discussion on Mr. Oates second brief to the Board. Disappointment was expressed with the admission that he knew the answers to the questions submitted to the Board and the Board's effort to address them in good faith, constitutes nuisance. Furthermore, despite a written effort to clarify the issue, Mr. Oates continues to demonstrate a poor understanding of the Board's role and confuses its mandated responsibility for "adequate and effective" policing with that of operational efficiencies. It was noted that the Board oversees a contract for services and is primarily concerned about and diligently monitors performance outcomes and results based on its pre- determined strategic priorities and benchmarks; how efficiently those results are achieved or duties executed are operational issues under the purview of the OPP and the Provincial governemnt and therfore are not, nor should not be, matters of interest to the Board.

Detachment Commander’s Comments

It is my pleasure to provide this report to the Grey Highlands Police Services Board. Detachment personnel continue to work towards addressing the initiatives identified in both the Detachment and Regional Business Plans for 2009.

Grey County OPP - Operations

Matters of January: Interest – 01 January 2009 – Traffic Enforcement – A 15 year old youth was Grey Highlands stopped in a spot check in Eugenia. The youth stated that he didn’t have a licence (as he was only 15). He also advised police that his parents had asked him to pick them up as they were intoxicated. The youth was charged.

01 January 2009 – Impaired/Over 80mgs- A vehicle was stopped on Grey County Rd 4. The officer detected an odour of alcohol on the driver’s breath. The driver registered a fail on the roadside test. The driver, 25 year old Jason Keip of Barrie was arrested and charged with Over 80mgs.

01 January 2009 – Mischief – The front window of the video store on Main St in Markdale was smashed over night. No entry was gained. Police have a suspect and the investigation is continuing.

02 January 2009 – Break and Enter – A business reported the theft of a snowmobile overnight. Unknown persons had cut through the back gate to gain entry. Officers followed up several leads but were unable to identify the suspect(s). A further break, enter and theft of snowmobiles occurred at this business on January 12th.

07 January 2009 – Threats – One vehicle backed into another at a gas station in Flesherton. This led to a death threat being uttered by one male to the other. 47 year old Robert McLaughlin of Chatsworth was charged with uttering threats.

09 January 2009 – Assault – A Grey Highlands Secondary Student punched another student in the face, causing a black eye and a laceration under the eye. The 17 year old youth was arrested and charged with assault causing bodily harm.

18 January 2009 – Liquor License Act – A spot check in Flesherton resulted in a male being charged with having open liquor in the vehicle. His girlfriend who was driving was unlicensed. 27 year old Robert Semple of Grey Highlands was charged with having open liquor. 21 year old Craigon Stauffer of Grey Highlands was charged with driving without a licence.

19 January 2009 – Liquor License Act – Police observed youths with open liquor at Main St and Toronto St. Two young persons from Grey Highlands were charged.

22 January 2009 – Weapons – Police were called to MacPhail Memorial School for a 9 year old boy who had brought a steak knife to school with him. The boy was angry at a girl at school. The boy was spoken to and given a school suspension. The Children’s Aid Society was notified by police.

20 January 2009 – Possession of Stolen Property – Grey County OPP crime unit assisted Peel Regional PS and Central RACT with a search warrant on a Grey Highlands property. $200,000 in construction equipment was recovered. 49 year old John Ian Tomasic of Grey Highlands was arrested and charged.

27 January 2009 – Threats – A Grey Highlands youth was charged with Uttering Death Threats after another youth reported received the threats via text message on his cell phone.

28 January 2009 – Assault – Police were called to a family dispute at a Grey Highlands residence. The complainant, a 74 year old man stated that his son had pushed him. 41 year old, Norman Hilliard of Grey Highlands was arrested and charged with assault.

31 January 2009 – Sudden Death – Police were dispatched to a suicide in a residence on Concession 3. The police confirmed that the deceased party had shot himself.

February: 02 February 2009 – Drug Offences – While conducting RIDE checks on Toronto St in Markdale, officers observed a vehicle approaching and the driver was not wearing a seatbelt. The officer detected an odour of marihuana coming from the vehicle. A passenger voluntarily handed over a bag containing marihuana. 53 year old Tony Gomes of West Grey was charged with possession of marihuana.

04 February 2009 – Police Assistance – Ambulance requested police attend a residence they were dispatched to in response to a

911 call where parents reported their baby was not breathing. On arrival the paramedics were transporting the child, who was breathing. Police held the scene until it was confirmed the baby would be okay.

06 February 2009 – Missing Person – An 85 year old motorist called for assistance. Her motor vehicle was stuck in the snow and she was confused about where she was. The caller was confused and lost. With the assistance of Bell Mobility who located her using her cell phone the police located her and her vehicle on a snowmobile trail. She advised she had been driving around for a couple of days lost. She was transported to hospital by ambulance and a family member was contacted.

06 February 2009 – Drug Offences – Police recognized a male driving a vehicle in the parking lot of GHSS as a person on a Trespass Notice. Investigation revealed the male had marihuana in his possession. 18 year old Aaron Redick of Maxwell was charged with marihuana possession.

06 February 2009 – Break and Enter – A local veterinary clinic was broken into and a quantity of drugs were stolen. Evidence seized for prints failed to identify a suspect.

06 February 2009 – Assault – A complaint of a student throwing nails on other children on a school bus resulted in his arrest for assault with a weapon and possession of stolen property under.

12 February 2009 – Traffic Enforcement – Police received a complaint of street racing on Grey County Rd 4 in Grey Highlands. 21 year old Corey Pink of Durham was charged with stunt driving. The vehicle was towed and impounded for 7 days.

13 February 2009 – Domestic Dispute – Police were called to a Markdale residence in response to a domestic dispute. A male showed up at his ex-wife’s residence where a physical altercation took place. 35 year old Jon Paul McArthur of Markdale was arrested and charged with domestic assault.

13 February 2009 – Drug Offences – While on patrol an officer noticed a vehicle parked at GHSS in the evening. The investigation led to two males being arrested for drug possession. 20 year old Andrew Hill and 20 year old Devon Irwin, both of Grey Highlands were charged with possession of marihuana.

14 February 2009 – Break and Enter – A complainant attended the Markdale detachment to report his lawn tractor and a few other

miscellaneous items stolen from his shed.

14 February 2009 – A female was found committing mischief to property at a church. She was arrested and charged with mischief under $5,000.

14 February 2009 – Assault – Police responded to a call of a male beating a female on the street. The female was reportedly curled up in a ball to protect herself. 26 year old Douglas Peterson of Grey Highlands was charged with domestic assault.

18 February 2009 – Assault – Police were notified of an incident at Beavercrest Community School whereby a student was pushed by another student during an argument. The student fell and cut his head. He was taken to the hospital for stitches and was told he may have a slight concussion. The suspect was dealt with through the YCJA diversion program.

26 February 2009 – Bail Violations – While at a dance at GHSS a paid duty officer arrested a youth for public intoxication. Further investigation revealed that the youth had outstanding conditions in relation to another charged and had an imposed curfew of 7pm. The youth was released on an Undertaking and issued a summons for the intoxication.

27 February 2009 – Theft – A report of videos stolen from a parked vehicle was received. Youth and adult suspects were identified and the videos were recovered. The young offender was dealt with through YCJA diversion and 18 year old Aaron Zaitz was charged with theft under $5,000.

28 February 2009 – Bail Violations – Officers observed two males who appeared to be intoxicated walking down Toronto St in Markdale. There was liquid leaking out of one of the males’ pockets. Investigation revealed that the wine had been stolen from Steven’s Restaurant. 19 year old David Gelyk of Owen Sound and 25 year old Devin Furlong of Guelph were charged with public intoxication and held for bail.

Grey County OPP - Administration

Personnel A new recruit completed his initial training and arrived at the Issues detachment in January. Rodney Lindsay has been assigned to the Markdale detachment working with his coach officer Matt Coghlin.

February – Detective Constable Hodgin transferred to Central Region in early February. Her position was posted and filled internally. We

now have a Constable vacancy to fill.

Constable Brad Olsen, who graduated from Ontario Police College in April 2008, was recently awarded the Colonel A.A. Wallace Award. This award is presented annually to the OPC recruit student of the year. Brad graduated with the highest percentage of more than 1,100 students. Constable Olsen reports to our Markdale office.

Three additional officers, including a Sergeant, all failed to prove the weapon safe upon seizure and were collectively responsible for storing an unsafe weapon. All four officers accepted informal corrective action resulting in the deduction of banked overtime hours. This matter is closed.

Tributes 2007 2008 January February Y-T-D 2009 2009 2009 21 23 4 1 5 Summary of January: Tributes A letter was received from a property owner commending Constable Hunter for expediting a resolution in an ongoing neighbour dispute. He was able to achieve this in a positive non-confrontational manner and enable the parties to resume a friendly relationship.

Constable Ringrose recently gave assistance to the family members of a person involved in a motor vehicle collision. He transported the stranded passengers from the vehicle to Markdale where they could obtain a ride home. All of this transpired in the middle of a snowstorm. A relative of those involved wrote a letter to express there thanks for his consideration.

The administrator at Osprey Central School wrote a letter of thanks for the fine work that Constable MacPherson does at their school. She constantly provides assistance and support to the school and addresses these problems with students and parents alike in a calm but authoritative manner.

Constable Nuttall’s professionalism and compassion at a recent motor vehicle collision was appreciated by the victim’s parents. They

expressed this appreciation in The Sun Times.

February: Constable Nuttall recently assisted some motorists who had to wait for assistance to change a flat tire. She ensured that assistance was on the way, offered a ride if necessary and stayed with the motorists until they could proceed on their way. This helpfulness impressed them enough that they brought it to the attention of the Operations Manager. Community Services Detachment January: Initiatives Crime Initiative: Since Grey County O.P.P. has experienced a higher then normal number of motorized snow vehicle thefts thus far in the 2008-2009 winter season, Constable Starr issued a release dealing with theft prevention tips. These tips included locking the vehicle, disabling the vehicle, parking it in a well lit area and ensuring that the proper identification is engraved on the machine.

Traffic Initiative: The severe weather conditions we saw in January prompted Constable Starr to publish a reminder to the public about the dangers and consequences of driving on closed highways.

February: Crime Initiative: A media release in January referred to charges being laid against a local youth after threatening text messages were sent. The release prompted questions from some members of the media regarding the circumstances where police would charge a person who has “uttered threats”. The current Criminal Code section, 264.1, that deals with someone uttering threats is much more simplified and is as follows:

264.1 (1) Every one commits an offence who, in any manner, knowingly utters, conveys or causes any person to receive a threat (a) to cause death or bodily harm to any person; (b) to burn, destroy or damage real or personal property; or (c) to kill, poison or injure an animal or bird that is the property of any person.

Although words spoken in jest or with an innocent meaning do not meet the criteria of the offence it crosses the line when the person making the threat intends it to be taken seriously or used to intimidate.

Traffic Initiative: Drivers were reminded to take the necessary time to ensure that the frost and snow is clear from their windshields before attempting to drive their vehicle. Failure to do so could result in a charge or maybe even a collision. This problem is most commonly encountered during the winter months, but the same law applies year round if stickers, stuffed toys or other objects are placed or hung in such a way that they interfere with a driver’s view as required by law. For those of you that know Inspector Steve Walsh detachment commander of Wellington County OPP, he is retiring effective the end of June 2009. His last official day of work is Fri 27 Feb 09.

Headquarters has asked that I assume command of Wellington detachment until a replacement has been selected. I have agreed to assist. I commence that assignment on Mon 02 Mar 09.

Inspector John Periversoff will assume command of Grey County until my return. I expect the assignment to last approx 3 months. Circumstances could extend or reduce this time frame so I will keep you posted.

Shared Business Meeting – Chiefs and Boards

Guest Speaker - Gary Stuart, Superintendent/Officer in Charge of Protective Operations Branch of the RCMP. Shared information and the process involved in security plans for the 2010 winter Vancouver Olympics.

- has been 8 years in preparing for the event - seeking assistance from Police Services from all across the country - response has been tremendous – 27 police functions that require security - uniform officers to perform venue security duties in home uniforms to represent and showcase their respective community – uniforms will be conducive to specific weather conditions and venue - security services will be performed during the competition and for 48 hours after the last venue is completed – 18 days – length of deployment (average 30 – 32 days) – specific to venue - officers from the same Detachment will work at different venues - request sent out in October 2008 with a great response to date - salary/benefits/meals/travel will be the responsibility of the RCMP, however they will not cover the cost of the backfill required for officer replacement when away - accommodations have been secured at both the Whistler area and Vancouver site - commitment and numbers required by the end of 2008 or early 2009 - specific officer names needed by September 2009

This process is greatly appreciated. - Note: Executive membership questioned responsibility of room and meal costs for the Zone meetings. Zone 5 Board membership is responsible for $900.00 of the meal cost and the host Municipality pays the remainder. - Grey Highlands Police Services Board addressed correspondence to Greg Skinner, Superintendent, A/Regional Commander of Western Region OPP Headquarters regarding criminal checks for volunteer groups - suggested that police checks be conducted at no charge for non-profit groups and for volunteers – costly for groups/individuals and may deter them from volunteering their services - was explained that the process takes considerable time to conduct these searches and causes increased financial burden on Police Services - should be considered a cost of volunteering in a community – protects individual - lengthy discussion took place regarding this matter - many Police Services Boards have struggled with this issue

6. Zone Director’s Report

- Report presented by Director, Kevin Eccles - As per attached report - Len Mikulich questioned the matter of One Board/One Vote – Board has not come to a conclusive feeling – Mike Fenchuk reported that at the December 8, 2008 meeting of Zone 4 the motion was not support. The general feeling was that any member in good standing should be entitled to a vote. Zone 6 received our request letter and it was noted and filed. 2008 membership consisted of 100 Section 10 Boards – 62 Section 31 Board and 3 First Nation Boards. Was suggested that if only allow one board, one vote, the Section 31 Boards will not join the OAPSB. - A lengthy discussion centred around this matter. Charlie Reidl, Brockton Board and Roger Black from the Stratford Board reiterated their respective Board feelings and comments against this motion. Suggested this issued be dealt with and move forward.

Grey Highlands

- As reported by Lynn Silverton - Grey Highlands Board issued, for the second year, a newspaper type insert of information for each municipal household - At the last board meeting, concern about the delivery, or lack of delivery was discussed and at this time, it has not yet been decided to continue this annual event - important to note that this is a very useful tool in so far as, if properly delivered it will make the board and the reason for its existence, the contract between the municipality and the OPP and the police personnel familiar to the tax payers - paying for mail drop is being considered. - In the hands of board members at this time are four assessments these being the Detachment Commander; the Board Chair; the Board and the Board Secretary - project has been carried out annually and the tabulated results have been found to be very useful by those being assessed - the Police Services Act states that an annual assessment be done by the board and we have had a more effective set of questions produced and used for all groups - It was also surprising to be told by our Grey County Detachment Commander that Grey Highlands Police Services Board is the only Grey County board at this time to forward to his senior officer our assessment - This odd weather has kept our officers very busy as I am sure is the same for us all in Zone 5 - Sadness spread fast at the news of the loss of an OPP officer and her family. Our sorrow at the loss of one of their colleagues being passed on to our detachment. - Every year Board sends goodies to our local detachment in Markdale both on Christmas and New Year - our gratitude being expressed that we are able to relax and enjoy these seasons knowing that we are protected - To all of you, Merry Christmas and a Happy, safe New Year

Guelph

Hanover

- Report presented by Chair, Warren Dickert - Have completed a successful raid and removal of residents from known drug house in the municipality - home has been a known problem for drugs and stolen property for some time and it has been a great boost to the morale of the service and municipality to see this action completed - home is currently vacant and efforts are in the works to seize the premise under the asset forfeiter program - Contract negotiations have started and at this time we have had one meeting and exchanged proposals - Have hired our 15th officer and she will be attending the OPC starting in January - hire was made possible through the Federal Recruitment Program - Sick time continues to plaque our service with what we feel is extremely high absentee rates - are attempting to deal with this issue in our upcoming contract renewal - estimated annual cost is in excess of $100,000.00 annually - Have completed our Business Plan rewrite and had an exceptional response from our survey work – last meeting I reported a 15% return rate but the final numbers are in and we actually exceeded 30% participation rate from the community

Mulmur

- Report presented by Peter Stinson - The last quarter, UCR occurrences for Mulmur highlights - B&E - 5, alarms - 20, impaired driving - 2, 911 – 11 calls, hang ups – 22 and hwy traffic offences - New detachment completed by the Spring 2009 (or later) - New Commander Staff Sergeant Steve Sills appointed - PSB Mulmur asked for a new short term, long term plan from him - One vacancy since October for a Provincial Appointment - names not submitted as of yet - Major policing needs for Mulmur are traffic enforcement - The training in Grand valley Oct 3rd, brought to our attention to “have rules in place before things happen” - Mark Tatz OPP trainer, suggested having a copy of the Police Act for all members and be prepared for offences or criminal charges of members – process is not likely to happen, however we should follow what Mark suggested - Feedback of the new OPP Community publication for Dufferin was very well received - produced at a reasonable cost and the postal code mail drop used for distribution - there are some minor issues to be corrected in next years publication

Orangeville

- Report presented by Cynthia Rayburn - Summer of 2008 Peter Osinga and his partners conducted an audit - Orangeville has been working on covering their concerns - We are updating our policy and procedures - We have also been working on our new business plan - December marks 12 months with our new Chief Joe Tomei - Through arbitration we have finalized the Uniform and Civilian Contracts - The Board negotiated our Senior Officer contract - In January we’ll commence contract negotiations for the Uniform and Civilian contracts - The Board has one vacancy

Shelborne

- Report presented by Len Mikulich - Following the provincial review (Peter Osinga) of Shelborne PSB, the department is updating our policy directives - Started 2009-2011 Business – held a public meeting with 15 – 20 persons from the community groups – input and plan – had a 25% return on survey – used consultants to collate the statistics - Attended the OAPSB workshop in November 2008 in Richmond Hill re: Labour Relations/Negotiations - Shelborne has started its 2009 Police Services Budget draft - The current OPP detachment in Shelborne will move to a new location at Primrose (Hwy 89 & 10)

Southgate

- Report presented by Chair, Jim Frew - The loss of valuables from vehicles that are left unattended and unlocked continues to remain a problem in the municipality - Detachment Commander suggests that all vehicles be locked when left unattended, reminding citizens to ‘Lock it or Lose it’. - Update on Homicide Investigation (excerpt from release by Community Services/Media Relations Constable Steven Starr, 12-Nov-08) - Chatsworth, Ontario – Grey County OPP is now releasing the identity of a man found dead in his Dundalk apartment shortly before 3 pm yesterday (11-Nov-08). Early in this investigation information provided to responding officers caused concern that there may have been someone active with a firearm in the area where the deceased man was located. Concern for public safety caused officers to take precautions which included a lockdown at two public schools in the vicinity. That situation changed when it was confirmed that the report of a man in the area with a firearm was unfounded and the lockdown was lifted. Grey County OPP wants to reassure the citizens of Dundalk and area that there is no concern for public safety in relation to this incident. The matter is now being investigated as a homicide. During the course of the investigation overnight, an 18 year-old male suspect was identified and taken into police custody. The identity of the suspect will not be revealed until formal charges are laid. - Southgate Chair suggests caution when inviting guests to stay for a closed meeting as they are not restricted to confidentiality. - Matter of One Board – One Vote – decision made … let’s put this matter behind us and move forward

South Huron

- Al Quinn presented report - Contract negotiations are continuing – researching possibility of a county contract - Presentation made to community members, Aubrey and Wendy Bedard – provided evidence that playing a critical role in apprehending those responsible for the robbery at Four Seasons last summer - Imeson pleaded guilty to double homicide in South Huron last summer - Ride programs are in full operation for the festive season

Stratford

- Report presented by Roger Black - 5.1 Contract - 2009 budget - 93% is wages and benefits - Costing is still below the average of communities of similar size

West Grey

DECEMBER 2008 DIRECTORS’ UPDATE FOR ZONE MEETINGS

The following provides a high level overview of the recent and planned activities for your Association.

Meeting with Minister Bartolucci

On November 19th, OAPSB’s Executive Committee had an excellent meeting with the Minister and his senior staff that covered a range of priority issues for association members. Throughout the meeting, the Minister reinforced the importance of OAPSB and PSBs as “an equal partner” in addressing policing issues in the province. As just one example of “OAPSB’s advocacy in action” he credited the Association for presenting him with the evidence and compelling reasons to increase funding to the RIDE program.

Topics addressed included court security, suspension without pay, special constables, pawnbrokers legislation, the police costing formula, and the appeals process. A brief discussion of OAPSB’s 2008 resolutions concluded the meeting.

The Minister acknowledged the need to ensure that OAPSB and its members are informed on decisions and initiatives on a timely basis, and should be included in any announcements as these occur. In particular, the Minister committed to providing an automatic briefing to OAPSB on new costing formulas when these are released.

Minister Bartolucci confirmed that he will attend the 2009 Annual Conference and provide an opening address to the membership (see below).

Section 10 OAPSB/OPP Working Group:

The Working Group met on November 20 to address a range of ongoing issues of importance to Section 10 Boards. The OPP Costing Formula was presented by Bert McDonald. OAPSB’s concerns with the delay in releasing the formula were discussed, and the Minister’s commitment to inform OAPSB of new formulas in a more timely way, was noted.

Other items discussed included looking at the potential of including GPS in patrol cars, guidelines for performance evaluation of the Detachment Commander, ideas for Section 10 sessions at the Annual Conference, and feedback on the Labour Relations Seminar.

The next meeting of the Working Group will be held February 19, 2009.

Policing Standards Advisory Committee:

The PSAC group met on October 30. The agenda covered a broad range of topics including an overview of the MCSCS strategic plan, updates on going initiatives including cross-border policing, body armour guidelines, and the conducted energy weapons working group to name a few. It was confirmed that the police costing guide will be updated. OAPSB representatives are involved in all of the working groups established to deal with the individual issues. 1

Board of Directors Meeting

The Board met in Brampton, on November 20. The agenda included review and approval of the association budget for 2009, conference program suggestions and reports on policing issues of importance to the membership.

The Board accepted the resignation of Christina Bisanz as Executive Director, effective December 31, 2008. Christina has been offered the lead on a special project in the healthcare industry, and tendered her resignation with regret. The Board has developed a plan to conduct a search for a new Executive Director.

Member Services and Communications:

Program planning for the 47th Annual Conference “Policing: The Art of Navigating Challenging Rivers” is well underway. As noted above, the Honourable Rick Bartolucci, Minister of Community Safety and Correctional Services (MCSCS) will address the delegates at the opening luncheon.

The conference is being held April 30 – May 2, 2009 at the NAV Centre in Cornwall. Accommodation information is available on the OAPSB website, and complete conference and registration information will be available in early January.

Program highlights include: • Keynote speaker Dr. Linda Duxbury, Carleton University will address managing a workforce with generational differences; • MCSCS Assistant Deputy Minister Glenn Murray and key members of his staff will lead a “bear pit” discussion fielding questions from the membership; • Chief Daniel Parkinson will highlight successful initiatives for reducing community crime; • Senior policing experts will discuss a range of topics of interest to PSBs, including cross- border and jurisdictional policing challenges, guns, drugs and gangs, emerging technologies to name a few; • PSB training on board governance, communications and advocacy.

Invited speakers include: OPP Commissioner Julian Fantino, and other federal and provincial cabinet ministers in Ministries of interest to policing services.

Over 115 delegates attended this year’s Labour Relations Seminar in Richmond Hill. Evaluation of the seminar was highly positive, with many delegates noting the value of hearing first-hand experiences of senior police leaders and experts. The 2009 Seminar will be held once again, at the Sheraton Hotel in Richmond Hill, October 22- 23.

The final issue of the Bulletin Board newsletter for 2008 was mailed to the membership at the end of November. Reports on a number of issues mentioned in this Zone Directors’ update are reported in the newsletter, and members are strongly encouraged to review their recent copies.

Celebrating Police Week, May 10-16, 2009 Fri, February 27, 2009

Plans for celebrating Police Week are already underway at many Ontario police services. This annual event is dedicated to the promotion of crime prevention, recognition, and awareness of policing across the province.

Since 1970, Police Week has been observed in May to coincide with Peace Officers Memorial Day, recognized internationally on May 15. Police Week is scheduled for a full week containing May 15, beginning with a Sunday and ending on a Saturday. This year, Police Week will take place from May 10- 16.

Under the theme Policing Possibilities: Inspiration for the Future, police services and their Boards are encouraged to commemorate this special week through a variety of activities within their communities. Recognizing the professional, sacrifice, and dedication of all police personnel in Ontario honours the work of our people day and inspires us to look forward to a positive policing future.

The Ministry of Community Safety and Correctional Services provides access to a Media Relations plan to assist Ontario police services during Police Week. This plan is available through the OACP’s website at www.oacp.on.ca.

The Ministry will also provide a Police Week poster as well as products circulated during last year’s Police and Crime Prevention Weeks. Please contact Sandra Williams at 416-212-1888 if your service would like to request such products.

The OACP encourages all our member services to mark Police Week within their communities. We invite services to share what they are doing with our office so that we can highlight the many positive events and activities planned for Police week. RULES OF PROCEDURE FOR RESOLUTIONS SESSIONS AT OAPSB ANNUAL GENERAL MEETINGS

The By-laws for the Ontario Association of Police Services Boards (OAPSB) respecting the disposition of Resolutions made by membership state the following:

SUBMISSION OF RESOLUTIONS All resolutions from Police Services Board members or Zones/Sections concerning matters within the purview of the Association shall be forwarded to the Executive Director of the Association at least 45 days before the opening of an annual or special general meeting. The Executive Director shall provide copies of all resolutions to regular members attending a general meeting.

RESOLUTIONS COMMITTEE The President of the Association shall appoint a Resolutions Committee and shall designate the Chair of such Committee. The Resolutions Committee shall consider all resolutions and the Chair of the Resolutions Committee shall report the recommendations of his/her committee to the Board of Directors and to the Annual General Meeting.

EMERGENCY RESOLUTIONS Resolutions submitted after 45 days before the opening of a general meeting may be considered if such consideration is approved by a vote of two-thirds (2/3) of those regular members present at such meeting.

RULES OF PROCEDURE FOR CONSIDERATION OF RESOLUTIONS

In concert with the above By-laws, the following procedure shall be utilized at General Meetings where resolutions shall be considered by the membership:

A resolution circulated to the membership prior to the conduct of a General Meeting shall be deemed to be properly before the meeting, and therefore, a mover and a seconder shall not be required to place the resolution before the meeting.

Except where otherwise provided, the generally accepted rules applicable to the conduct of meetings shall prevail.

The Chair of the Resolutions Committee, in presenting a resolution, may introduce the matter by reading the number and title, and if deemed desirable, may provide a brief explanation as to the intent or purpose of a resolution or an amendment submitted by the Resolutions Committee.

After the Chair has introduced a resolution and presented the recommendation of the Resolutions Committee, a representative from the Police Services Board, Zone/Section or Board of Directors submitting the resolution shall be given the first opportunity to speak.

Delegates participating in discussion on a resolution shall announce their name and Police Services Board each time they rise to speak – delegate shall confine their remarks to a maximum of three (3) minutes.

No delegate shall be permitted to speak more than once on any one resolution or amendment, except in the case of a mover of an amendment who shall have the additional opportunity to conclude debate on the amendment.

All motions submitted from the floor of the meeting shall be seconded before being discussed.

The Chair of the Resolutions Committee shall have the right to conclude the debate on each resolution, amendment, or motion of referral.

When a motion is made to refer, the mover shall introduce the motion by these words: “I move to refer the matter to….because…”.

The Chair shall then allow one speaker, preferably a representative from the Board or Zone/Section submitting the resolution, to address the motion of referral.

Should the membership vote to consider one or more Emergency Resolutions, such Emergency Resolution(s) will be circulated in written form to all delegates, at the expense of the Board or Zone/Section submitting same, and ample time provided for consideration prior to voting on the resolutions(s).

Only regular members of the Association (i.e. members of Police Services Boards) who have registered for the General Meeting will be permitted to vote on questions.

Delegates will vote on the resolution, not on the recommendation of the Resolutions Committee.

Voting shall be made by a show of hands or an alternative method of identification if provided. A standing vote may be requested. The ruling of the Chair of the session as to whether a vote was won or lost shall be final. In the case of a tie vote, a standing vote shall be taken. In the further case of a tie, the motions shall be deemed lost.

Appeals for ruling shall be made to the Chair of the Session.

2009-01 AMENDMENT TO THE EQUIPMENT AND USE OF FORCE REGULATION

FROM: OAPSB ZONE 1A

WHEREAS S.14.3(1)(a) of the Equipment and Use of Force Regulation requires that every police force shall ensure that at least once every twelve months, every member of the police force who may be required to use force on another person receives a training course on the use of force; and

WHEREAS S.14.3(1)(b) of the Equipment and Use of Force Regulation requires that every police force shall ensure that at least once every twelve months, every member of the police force who is authorized to carry a firearm receives a training course on the use of firearms; and

WHEREAS mandated training requirements are increasing every year; and

WHEREAS the current twelve month timeframe required for re-qualification in both the use of force and firearms is onerous and challenging for police services to achieve and remain complaint;

THEREFORE BE IT RESOLVED that Zone 1A requests the Ontario Association of Police Services Boards to call upon the Minister of Community Safety and Correctional Services to amend the Equipment and Use of Force Regulation so that the timeframe for re-qualification in the use of force and firearms be modified to annually.

2009-02 FEDERAL FUNDING – 2500 POLICE OFFICERS

FROM: REGIONAL MUNICIPALITY OF PEEL POLICE SERVICES BOARD

WHEREAS during the 2006 federal election campaign, the federal Conservative Party of Canada committed to sustainable funding for the hire of 2,500 new municipal police officers, recognizing the need for additional front line police resources in communities across Canada;

AND WHEREAS once elected, the federal Conservative Party, as part of its 2008 federal budget, committee $400 million in a trust fund for five years to fulfill its commitment;

AND WHEREAS it is well recognized by the police community, and by the federal government itself, that this does not meet the commitment made in 2006, an example being funding provided for the Peel Regional Police for the hire of 13 additional police officers for a five year period only, with costs beyond that point to be borne by municipal taxpayers solely through an increase in property taxes;

AND WHEREAS police leaders recognize the need for additional police resources is even more vital and urgent in 2009, given the increase in violent crime, and as evidenced by recent statements made by the Prime Minister of Canada and the Minister of Public Safety in response to gang violence in the Vancouver area;

THEREFORE BE IT RESOLVED that the Regional Municipality of Peel Police Services Board put forward a resolution to the Canadian Association of Police Boards, with endorsement sought by the Canadian Association of Chiefs of Police, the Canadian Police Association and the Ontario Association of Police Services Boards, urging the federal government to fulfill its commitment made in 2006 for sustainable funding for the permanent hire of 2,500 additional municipal police officers.

2009-03 TAXABLE STATUS OF MUNICIPAL POLICE VEHICLES

FROM: REGIONAL MUNICIPALITY OF PEEL POLICE SERVICES BOARD

WHEREAS provincial police vehicles, fire service vehicles, and the repair and licensing of such vehicles is exempt from payment of provincial sales tax;

AND WHEREAS municipal police services are required to pay provincial sales tax and license fees for municipal police vehicles;

AND WHEREAS this is an inexplicable and unexplainable anomaly that penalizes municipal police services boards who are equally and directly engaged in the delivery of primary emergency services;

AND WHEREAS this issue has been raised repeatedly by various police organizations such as the Ontario Association of Police Services Boards and the Ontario Association of Chiefs of Police since 2006;

AND WHEREAS if the provincial government had acted in 2006 to correct the situation and afforded the same tax treatment to municipal police services as provided the Ontario Provincial Police and fire services, it would have freed up millions of dollars for municipal police services to fund needed front line programs, the Peel Regional Police alone having an additional $1.2 million over that four year period;

THEREFORE BE IT RESOLVED that the Regional Municipality of Peel Police Services Board request that the provincial government afford municipal police services the same tax treatment as provided the Ontario Provincial Police and fire services and exempt the purchase of municipal police vehicles, and the repair and licensing of such vehicles form the provincial sales tax;

AND FURTHER BE IT RESOLVED that the Regional Municipality of Peel Police Services Board seek the support of area members of provincial parliament; the Regional Council of Peel, the Ontario Association of Police Services Boards, and through the OAPSB, the support of the Association of Municipalities of Ontario, the Ontario Association of Chiefs of Police and the Police Association of Ontario for this resolution.

2009-04 PROVINCIAL ANTI-VIOLENCE INTERVENTION STRATEGY (P.A.V.I.S). GRANT for 2009/2010

FROM: REGIONAL MUNICIPALITY OF PEEL POLICE SERVICES BOARD

WHEREAS the provincial government in 2006 committed $51 million to combat gun and gang violence;

AND WHEREAS based on a successful pilot project with the Toronto Police Service, the provincial government in 2007 expanded the program with a funding commitment of $6 million through the Provincial Anti-Violence Intervention Strategy to police services in the Greater Toronto area;

AND WHEREAS this program has been extremely successful, with the funding delivering tangible and meaningful results as evidenced by the Peel Regional Police, who with approximately $1 million in funding, resulting in a 78 total days of targeted enforcement over a 14 month period achieved the following:

• 560 criminal Code charges • 199 Provincial offences • 39 Warrants executed • 46 Weapons seized • Nine firearms seized • Four stolen cars recovered • 171 compliance checks on known gang members • And Considerable intelligence-gathering;

AND WHEREAS the provincial government has opted to expand this program on a ‘one-time’ basis across Ontario without the certainty of continued funding for those agencies already receiving P.A.V.I.S. funding, despite its proven success in suppressing gang and gun violence;

AND WHEREAS it is well recognized that a continuous, coordinated and targeted effort is required to combat the insidious effects of gang and gun violence, and P.A.V.I.S. is a proven, successful provincial government program that has served to make communities safer across the Greater Toronto area;

THEREFORE BE IT RESOLVED that the Regional Municipality of Peel Police Services Board apply now for a P.A.V.I.S. grant or 2009/2010 in the amount previously provided to the Peel Regional Police in anticipation of a continuation or expansion of the P.A.V.I.S. program in the provincial government’s budget to be delivered in March 2009;

AND FURTHER BE IT RESOLVED that the Regional Municipality of Peel Police Services Board urge police services boards in the Greater Toronto Area to take similar action,, and that it

2009-05 POLICE RECORDS CHECKS

FROM: OAPSB ZONE 2 AND OTTAWA POLICE SERVICES BOARD

WHEREAS organizations that utilize volunteers have become increasingly concerned with risk and unwilling to accept background checks done for work with previous organizations even a year earlier;

AND WHEREAS the nature of volunteer work has shifted from volunteers who stayed with the same organization for long periods of time to more episodic volunteering in which individuals volunteer for one-time only events and move frequently from one organization to another;

AND WHEREAS these trends have resulted in a significant increase in the volume of requests for records checks and unacceptable delays in processing them;

THEREFORE BE IT RESOLVED THAT the Ontario Association of Police Services Boards strongly urge the Provincial Government to investigate the feasibility of:

1. Establishing province-wide standards for the information considered relevant and subject to disclosure in response to a request for a police records check, which will also set the standard for databanks to be searched and how far back searches should go;

2. Establishing a province-wide standard Form for requesting police records checks, which will set the standard as to what information and documents have to be provided when requesting a police records check;

3. Establishing a province-wide process and/or databank through which volunteer applicants can be checked, similar to the fingerprint-based security clearance process.

WHEREAS it has been estimated in a report issued by the Federation of Canadian Municipalities (see Towards Equity and Efficiency in Policing Released May 29th, 2008) that Provincial police forces spend between 10-30% of their time enforcing federal laws for which they are not compensated;

NOW THEREFORE BE IT RESOLVED THAT the OAPSB Zone 2 recommends that the OAPSB support making a request to the Government of Canada immediately to address this issue by compensating Municipal Governments for all their associated costs resulting from the enforcement of Federal laws.

WHEREAS the Regional Municipality of York Police Services Board recognizes that criminal organizations perpetrate crimes largely for financial gain, and that Proceeds of Crime, Offence- Related Property and Civil Remedies for Illicit Activities legislation provides policing organizations with effective tools to disrupt and combat organized crime; and

WHEREAS the seizure and subsequent forfeiture of offence-related property and proceeds of crime is an effective means of disrupting organized crime, limiting the profits associated to criminal acts and discouraging recidivist impaired drivers from re-offending; and

WHEREAS the enhancement of police resources to apply asset forfeiture legislation will reduce crime, increase returns to the government, and ultimately make our communities safer; and

WHEREAS the Regional Municipality of York Police Services Board supports the Canadian Association of Chiefs of Police and Ontario Association of Chiefs of Police positions with respect to the use of forfeited asset;

THEREFORE BE IT RESOLVED that the Regional Municipality of York Police Services Board call upon the Government of Ontario to provide appropriate annual funding from the Province’s Proceeds of Crime Fund that will ensure the ongoing development of asset forfeiture amongst Ontario police services;

AND BE IT FURTHER RESOLVED that the Regional Municipality of York Police Services Board calls upon the Federal Government to amend the Forfeited Property Sharing Regulations to include a cost recovery component to local jurisdictions or municipalities;

AND BE IT FURTHER RESOLVED that the Regional Municipality of York Police Services Board calls upon the Federal Government to revisit the Provincial Memoranda of Understanding to incorporate a cost recovery clause mandating reimbursement of costs to local jurisdictions or municipalities;

AND BE IT FURTHER RESOLVED that the Regional Municipality of York Police Services Board calls upon the Ontario Association of Police Services Boards and the Canadian Association of Police Boards to express their support of this resolution.

WHEREAS the West Perth Police Services Board strongly values a positive working relationship with the men and women of the Ontario Police Services;

AND WHEREAS the West Perth Police Services Board desires to maintain the highest possible quality of police services for our citizens;

AND WHEREAS the West Perth Police Services Board has some concerns regarding the level of sentencing at the Ontario Court of Justice, the Superior Court of Justice and the Court of Appeal that it does not reflect the wishes of the community and can, in some cases, be counterproductive to the work of the personnel of the Ontario Police Services;

Protocol re: Officer of the Year Award

In furthering its strategic priorities and its objective of recognizing excellence in policing services, the Grey Highlands Police Services Board will annually select one officer from the Grey County Detachment of the Ontario Provincial Police for special recognition.

The individual selected to receive this honour will be an officer of any rank who has worked within the boundaries of Grey Highlands during the preceding year and who, in the performance of his or her duties, exemplifies the criteria (values and ethics) outlined in “The Promise of the OPP.”

The Grey County Detachment Commander will recommend deserving candidates to a three-person panel consisting of the Detachment Commander and two members of the Grey Highlands Police Services Board. This panel will be chaired by Lynn Silverton, the first chair of the Police Services Board, whether she be a member of said Board or not at the time. The panel may convene its meeting(s) to determine a deserving recipient either in person, via telephone or electronically.

The award will be presented annually by Lynn Silverton or her designate at a regular meeting of the Grey Highlands Municipal Council on or about the annual “Police Week” as determined by the Province of Ontario.
