County Line Road Bridge Update

As you can tell, the landscaping for the bridge has been completed. We are still waiting for the electricity to be energized by Commonwealth Edison so that the lights that shine on the columns and terraced landscaping can be activated. Once that occurs, a final punch list will be prepared.

IDOT Rejects Village Request for Burr Ridge Sign on Landscape Terrace Walls

As you are aware, in the spring of last year, IDOT informed the Village that a sign with the name "Burr Ridge" would not be allowed to be placed on the terrace walls, as originally planned. Since that time, we have made several attempts to request that IDOT change

Miscellaneous Memo 7/10/2015 Page 2 of 4 its position and allow the sign to be installed. Unfortunately, we have not been successful. Attached is a letter we received this week from Randall Blankenhorn, Secretary of the Illinois Department of Transportation, once again denying our request for this sign.

Update on County Line Road Sidewalk - East side from Longwood Drive to Katherine Legge Park

After staff receipt of the engineering plans and cost estimates for the County Line Road sidewalk project, the Pathway Commission held a public hearing on July 9 to review the details of the sidewalk plan. Several residents, most from Woodgate Court, attended the public hearing. A representative from the Village's consulting engineer, Burns and McDonnel, was also present. Those residents in attendance all supported the project and the Pathway Commission unanimously recommends that the Village proceed with this project.

The cost estimate for the project was substantially higher than the previous cost estimates and the amount budgeted for this project. The 2015-15 budget set aside $115,000 for our local match (25%) based on a total anticipated project cost of approximately $460,000 (plus $45,000 set aside for construction engineering). The revised cost estimate is approximately $797,376. To proceed with this project with the current grant funding, the Village would have to make up the difference which means the Village would have to pay approximately $452,376 plus construction engineering. Based on the additional cost, staff will recommend that the Village apply for additional grant funding. The grant applications are due in August and are awarded by the end of the year. It is possible that if the additional grant funding is made available, that the project could still be done in 2016 (although there is also a chance for delay).

The Pathway Commission recommendation to proceed with this project and staff's recommendation to seek additional grant funding will be on the July 27 Board of Trustees agenda. In the meantime, our engineering consultant has agreed that they will prepare a grant application at no additional charge to the Village. Given the early August deadline, staff has asked the consultant to proceed with the application for additional grant funding in anticipation of the Board's concurrence. If there are any questions, or concerns, please contact Community Development Director Doug Pollock.

Letter to Bob Garber Regarding County Line Square Parking

Attached please find a letter that was sent this week to County Line Square Shopping Center owner Bob Garber outlining the Village's concerns regarding parking at the Center. We are putting him on notice regarding the potential parking issues that may arise if additional restaurants are added to the Center and also concerns regarding blocking parking spaces to store snow in the wintertime.

Thank you for your letter submitting follow-up comments from the recent Illinois Department of Transportation (IDOT) Listening Session held in Countryside.

The department previously responded to a Village of Burr Ridge letter dated April 28, 2014 requesting the installation of Burr Ridge Monument signs. As stated in our May 19, 2014 response letter (attached), the proposed Burr Ridge signs would be in violation of IDOT's Division of Highway's Bureau of Operation's, Traffic Policies and Procedures Manual, which supplement 625 ILCS 5/11-310. Unfortunately, the Burr Ridge Monument signs should not have been included in the contract and cannot be installed because they are in violation of the policy.

The department will review the available five-year crash records along with a review of existing field conditions for 1-55 near the 1-294 and County Line Road interchanges to identify possible crash reduction countermeasures. Our Region One/District One office will follow up with you regarding their findings upon completion of this review.

Thank you for your submittal regarding Illinois marketing or branding. The department may further investigate opportunities to install branding of infrastructure elements similar to those utilized by the State of Texas. This would require coordination with other state agencies to develop a uniform marketing or branding plan. We would also need to consider the economic impact of such a program to justify the additional expense of branding infrastructure elements and also receive concurrence from the Federal Highway Administration to ensure the branding does not violate any federal rules or regulations.

In reference to the bridge mounted "Bus on Shoulder" signs, please refer to our previous letters dated November 6, 2014 and March 12, 2015 (attached). Relocating these signs to other existing locations is not possible due to the distance away from where the shoulder riding begins. Installing these signs on separate overhead sign structures would be cost prohibitive. Placing the signs on ground mounted sign posts is not consistent with the development report that required these signs to be placed in an overhead installation. Line Road bridge will be relocated off the bridge and onto a new overhead sign structure located just south of County Line Road. The work is included in a roadway construction contract scheduled to be let this fall, and should be completed in 2016.

Thank you for the letter regarding Bus on Shoulder Use signs on the County Line Road bridge over 1-55. A field inspection was performed in the area on Tuesday, November 18, 2014 to examine options to accommodate this request. At that time, the "Bus on Shoulder Use Ends" sign had already been installed on the County Line Road bridge over northbound 1-55.

During the field inspection several options for relocating the sign were considered. Moving the sign to the east proved not possible due to the narrowing left shoulder width and left side Joliet Road exit ramp. Likewise, moving the sign to the west proved difficult as it would reduce the limits the PACE bus is allowed to travel on the left shoulder. Providin g a standalone overhead sign structure would be cost prohibitive, and the overhead sign structure would be located adjacent to the County Line Road bridge further obstructing the bridge.

Please be advised that a "Bus on Shoulder Use Begins" sign is planned to be installed on the County Line Road bridge over southbound 1-55. The field inspection also considered options for relocating this sign. Relocating to the overhead sign truss near the southbound 1-55 to northbound County Line Road exit proved not feasible due to the limited shoulder width at the location. Similar to the northbound side, relocating the sign further west would reduce the limits the PACE bus is permitted to drive on the shoulder. A standalone overhead sign structure would again be cost prohibitive.

Unfortunately, the Department is unable to accommodate this request at this time due to the reasons listed above. The Department is currently preparing plans to rep lace the overhead sign structure over northbound 1-55 at the exit to southbound County Line Road, and structure replacement is planned in the next 1 to 2 years. Thank you for your letter of April 28, 2014 regarding Contract #60K77 involving construction at the interchange of 1-55 and County Line Road.

In your letter. you have requested the department to allow construction of monuments in the infield of the entering loop ramps. There are several enhancement elements included in this project. but the infield monuments that spell out Burr Ridge are of the most critical concern. The Illinois Department of Transportation's (IDOT) Division of Highway·s Bureau of Operation's, Traffic Policies and Procedures preclude any type of special town name signing along limited access facilities such as 1-55; therefore. the monuments cannot be installed as designed {see attached policy). Additionally, this and other traffic policies supplement 6251LCS 5/11-310 prohibiting unauthorized signs within highway right of way. This type of sign is allowable off state right-of-way.

Other enhancement elements, such as landscaping and identifying leaf and logos could be considered decorative appurtenances that do not specifically spell out the town name and could be allowed. Unfortunately, the "Burr Ridge" monuments in the infield are in violation of policy and should not have been approved. Please note, this was discussed at a meeting during Phase I on November 20. 2009 (see attached). Signage in the plans currently limits the visibility of the monument sign. This is part of the reason for our policy. The landscaping is allowable.

There are over 270 communities in IOOT Region One alone and 102 counties statewide where this situation creates precedent. We appreciate that these monuments were allowed to move through the plan preparation and the department's Illinois Transportation Enhancement Program process without the city being advised to remove them from the plans; however, now that this has been recognized we cannot allow this element to move forward as designed.

RE: County Line Square Parking

Dear Bob:

At its June 8, 2015 meeting, the Village Board granted a parking variation for the County Line Square shopping center to accommodate the expansion of the Capri Restaurant. The parking variation allowed Capri to expand into the tenant space known as 322 Burr Ridge Parkway without the required number of parking spaces available in the shopping center.

Please be aware that the existing number of parking spaces in County Line Square is less than the number of spaces required for the existing businesses. As a result, there can be no new businesses or business expansions that require more parking spaces than the tenant which is being replaced. For example, a restaurant that required I 0 spaces per 1,000 square feet cannot replace a retail tenant that only required 4 spaces per 1,000 square feet.

Additionally, no actions may be taken that would reduce the number of parking spaces available. This means that during and after snowstorm events, snow cannot be stored on parking spaces. Such actions would be deemed a violation of the off-street parking requirements of the Burr Ridge Zoning Ordinance.

I would also like to suggest that you hire a professional parking consultant to review the existing parking configuration and determine if the parking may be reconfigured to make better use of the space or if there are other parking management practices that may be implemented to alleviate the current parking shortage. I am happy to provide any advice or assistance in this regard.

OVERTIME CONTINUES The Senate did not meet this week, but the House returned to session yesterday and this morning. The standoff between the Governor and Democratic caucus continues.

Yesterday, the House Executive Committee approved the one-month emergency appropriations bill, SB 2040, by a vote of 7-4. An amendment to the bill was filed and approved by the House today. The amendment appropriates funds to the Offices of the Comptroller, Secretary of State, Attorney General, and State Treasurer for the payment of state employees. The amended bill was approved by the House by a vote of 71-13-19. The bill required a 3/5 majority (71 votes) to pass. Governor Rauner has said he will veto the bill.

The House also approved Senate Joint Resolution 5, which designates the bridge at Illinois Route 38 and Illinois Route 53 as the "Jerome F. "JR" McBride, Jr. Memorial Bridge." The resolution has now been approved by both chambers.

NEW LEGISLATION During a press conference yesterday, Governor Rauner introduced new legislation, including a proposal for pension reform. The almost 500-page pension reform bill includes PSEBA reform and bankruptcy language and addresses retirement benefits for suburban teachers, Cook County employees, and downstate police officers and firefighters. The Conference lobbyist reports that this proposal faces a number of political hurdles and is unlikely to advance.

House Republican Leader (R-Burr Ridge) also filed three bills and two resolutions for the Governor, including: • HB 4246 - Implements several provisions for tort reform, including limiting venue for actions against corporations, partnerships, and insurance companies, and increasing the threshold at which joint and several liability attaches. • HB 4247 - Enacts a two-year property tax freeze, but provides some labor relief and exempts units of local government and school districts from the Prevailing Wage Act. • HB 4248 - Makes several changes to the Workers' Compensation Act. Provides that an employee bears the burden of showing that he/she has sustained accidental injuries arising out of and in the course of employment and that the accidental injuries are the major contributing cause of the medical condition or injury for which compensation is sought. • HJRCA 41 - Implements term limits. • HJ RCA 42 - Provides for redistricting reform.
