ULI Chicago Property Tax Incidence Task Force Chicago’s 2021 Reassessment: How Might Taxes Shift? June 2021 Executive Summary Every property owner in Chicago wants to pay less in property taxes. They also want taxes to be fair and predictable. The real estate investment community was alarmed by the increases in proposed assessed value in the first portion of the County to be reassessed by newly elected Assessor Kaegi. The changes in assessed value and the uncertainty involved in City of Chicago reassessments due in 2021 for taxes payable in 2022 was believed to have a chilling effect on investor interest leading to a call to review the potential tax impact or incidence of the new practices when applied to the City of Chicago. This study—the result of a collaborative effort with the Chicago District Council of the Urban Land Institute, the City of Chicago, and the Cook County Assessor’s Office—constructs a hypothetical scenario of what fair assessment and taxation might have looked like and how it might impact different types of properties.

In Wisconsin, this choice is extended to employees of state government. But not in Illinois; almost all government workers – including teachers, police officers and those who serve in state government – are required to pay money to a union to keep their jobs. Because of this, government unions in Illinois have long been powerful in state politics, with the major government unions donating tens of millions of dollars to political campaigns. Since 2002, Illinois’ five major government unions have spent more than $46 million on direct political contributions alone. “The anatomy of influence: Government unions in Illinois” takes a close look at unions’ political spending and the influence afforded to government unions as a result.     Letter from David Orr Cook County Clerk Dear Friends: This March 20 Gubernatorial Primary generated great interest up and down the ballot, and we saw this result in record-breaking or near-record setting marks in the number of registered voters, voters who took part in the election, the percentage of voters who participated in Early Voting, and the overall turnout rate. Not only have we reached a record-high number of registered voters in suburban Cook County (1,549,688), the turnout for Early Voting was higher than any other Gubernatorial Primary and nearly as high as the 2016 Presidential Primary, and the number of voters who cast ballots in this election was more than had participated in a Gubernatorial Primary Election in the last 30 years. This 2018 Gubernatorial Primary Post-Election Report takes a comprehensive look at the voting totals, trends and statistics during the March primary throughout suburban Cook County. Below is a sample size of the standout primary numbers: • Voting before Election Day – by mail or during early voting and grace period voting – accounted for 29 percent of all ballots cast in this election. • Early Voting also set a new Gubernatorial Primary record with 109,811 ballots cast in-person before Election Day. That’s the highest total yet for a Gubernatorial Primary, and for Primary Elections, second only to the 2016 Presidential Primary (120,681). • Election Day Registration, offered for the first time in a Gubernatorial Primary, was popular with voters, especially younger ones. Voters between 17 and 22 years old made up 32 percent of the 4,278 who took advantage of Election Day Registration.

    Weekly Legislative Report ILLINOIS COMMUNITY COLLEGE TRUSTEES ASSOCIATION By: Jessica Nardulli & Tom Ryder March 9-10, 2018 The Governor delivered his Budget Address on February 14. Of primary importance to ICCTA members, he called for shifting the cost of pensions for teachers and university/college employees away from the state. He also proposed eliminating state funding for the Teachers’ Retirement Insurance Program (TRIP) and College Insurance Program (CIP). The response to the Governor’s proposal was cool, but the budget presented will serve as a discussion point for the coming legislative session and elections. The deadline to introduce new legislation this spring has passed. The House filed a total of 5,820 bills and the Senate filed 3,579 bills. Many of those are from last year, but they are still available for consideration this year. For the most part, the cards have been dealt and we have the hand we will be playing with for this session – meaning we have a good sense for the issues the General Assembly will consider in 2018. However, things can quickly change with an amendment. We will be watching amendments very closely. Session has started off very slow, as members are increasingly focused on the March 20 primary elections. If they don’t have a race of their own, they are helping colleagues in competitive races. Members have until April 13 to move the mounds of bills they have introduced out of committee. Rosewell v. LaSalle Nat. Bank, 450 U.S. 503 (1981). Since Rosewell, the Illinois General Assembly further streamlined that process, requiring taxpayers to demonstrate only that their property was overvalued—regardless of the reason—without the need for burdensome litigation. Here, the Seventh Circuit upended that carefully considered statutory scheme, subverting the Illinois legislature’s intent to reform the tax objection process. The court disregarded the Tax Injunction Act and unilaterally expanded federal jurisdiction by permitting ordinary property tax objections to be heard by federal district courts, despite Illinois’ courts ability and obligation to hear such claims in the first instance. Accordingly, this case presents two questions: 1. Does the Seventh Circuit’s opinion in A.F. Moore v. Pappas continue the movement, begun in Hibbs v. Winn, 542 U.S. 88 (2004), to erode the vitality of the Tax Injunction Act and undermine congressional intent by further narrowing the Act’s once-broad jurisdictional bar to litigating state taxation matters in federal court when it concluded that Illinois trial courts, as courts of general jurisdiction with concurrent jurisdiction to hear federal constitutional claims, could not hear or adequately resolve property tax objections based on federal equal protection grounds? ii 2.
