SECTION 1 DESCRIPTION OF SERVICES/GENERAL INFORMATION

1.0. DESCRIPTION OF SERVICES. The contractor shall provide all necessary labor, personnel, supervision, management, tools, equipment, transportation, materials, and any other items or services necessary to perform monitoring of Threatened and Endangered Species (TES), including Near Threatened (NT) species; monitoring of Invasive Species; and, control of Invasive Species at Camp Zama (CZ), Sagami General Depot (SGD), Sagamihara Family Housing Area (SFHA), Yokohama North Dock (YND), Kawakami Ammunition Depot (KAD), Akizuki Ammunition Depot (AAD), and Hiro Ammunition Depot (HAD) in accordance with (IAW) this Performance Work Statement (PWS), Japan Environmental Governing Standards (JEGS), Army Regulation (AR) 200-1 Chapter 4 Environmental Asset Management and Chapter 5 Pest Management, U.S. Army Garrison Japan (USAG Japan) Integrated Natural Resources Management Plan (INRMP), Japanese ordinances and laws, and other commercial, scholarly, and local standards.

1.1. MONITORING OF THREATENED AND ENDANGERED SPECIES.

1.1.1. The contractor shall monitor the target species (see Appendix A) and their habitats IAW Appendix B in order to reveal their inhabiting and growing situations/conditions. The habitat maps of the floral species identified in the past efforts is provided in Appendix G. However, it should be noted that the target area of TES monitoring is the whole installation, not limited to the habitats and home ranges identified in the past surveys. The collected data shall be compiled, evaluated, and analyzed to identify efficient methods of managing the species in addition to identifying their inhabiting and growing situations. The monitoring schedule and the annual minimum monitoring hours are listed in Appendix B.

1.1.1.1 Monitoring of the faunal species shall include, but is not limited to, quantification of adults, juveniles, eggs, and nests, identification of age, sex, habitat/nest location, inhabitation evidences, and condition of the species & habitats, such as vegetation condition, development status, water depth, water/soil/sand temperature, and water flow rate. Methods of monitoring faunal species include, but are not limited to, observation, trapping, auto photographing, line-transect method, and capturing. Appropriate methods shall be selected IAW local commercial and scholarly standards. The target areas for this monitoring are not only the habitats and home ranges identified in the past surveys but also the whole area of the installations.

1.1.1.2 Monitoring of floral species includes, but is not limited to, quantification of the species, identification of height, leaf size, leaf color, anthesis & seed setting condition, habitat condition, such as types and density of surrounding other floral species, soil condition, soil water content, insolation condition, and evaluation of plant communities condition. Appropriate monitoring methods shall be selected IAW local commercial and scholarly standards. In case the target species are not found at the habitats identified in the past surveys, the areas within 30 meters from the habitats and nearby areas suitable for them to grow shall be carefully searched for the targets and conduct monitoring if any.

1.1.2. Falco peregrinus (Hayabusa / Peregrine falcon) and Accipiter gentilis (Ootaka / Northern goshawk) shall be monitored at CZ and KAD to identify their home ranges. This includes internal structures of the home ranges if possible in terms of data being acquired and status of utilization of the installations.

1.1.2.1. The contractor shall identify at least three (3) preferable fixed observation points at CZ and at least two (2) preferable fixed observation points at KAD. Locations of the observation points can be adjusted/changed as necessary.

1.1.2.2. The contractor shall conduct approximately seven (7) hours of monitoring starting around sunrise for each of the designated periods (see Appendix C). For KAD, the monitoring shall be conducted on three (3) consecutive days for each period.

1.1.2.3. The contractor shall remain at the observation points making every possible attempt to locate the targets by using appropriate binoculars and/or telescopes. If the targets appear, the contractor shall continue to monitor to identify their sex, age, individual characteristics, behaviors, flight routes, and areas/locations of use, until they disappear or the monitoring hours end. In the event that signs of breeding activities are observed on-site, the contractor shall conduct monitoring to identify location of nest(s)/nesting ground(s), type and/or species of the nesting tree(s), environment surrounding the nesting tree(s), number of nestlings, timing of fledge, home range of new born fledglings, and so on. Information pertaining to nests and nesting grounds shall be contained in the interim and annual performance reports. However, if vigilance behaviors are observed, the contractor shall immediately stop the survey and leave the site.

1.1.3. The preservation areas for Lespedeza tomentosa (Inuhagi / Species of Bush clover), Lysimachia barystachys (Nojitoranoo / Species of Loosestrife), Ixeris tamagawaensis (Kawaranigana / Species of Aster), and Carex scabrifolia (Shiokugu / Species of Sedge) at SGD shall be maintained in addition to the regular monitoring work. The preservation areas are less than 2,000m2 in total. The maintenance consists of removing negatively affecting and/or competing species and maintenance of boundary ropes and stakes. The contractor shall dispose of the waste off-base IAW local laws and regulations. The schedule and annual minimum monitoring hours or this task are specified in Appendix D.

1.1.4. If any other species at risk, which are listed by the Government of Japan authorities in national and/or prefectural Red Lists/Red Data Books but not listed in Appendix A, are incidentally discovered, the species shall be recorded like the target species and reported to the Contracting Officer Representative (COR) in both the monthly interim report and the annual performance report.

1.2. MONITORING OF INVASIVE SPECIES.

1.2.1. The contractor shall monitor the below invasive species at CZ, SGD, KAD, AAD, and HAD to reveal their inhabiting and growth situations. The target area of invasive species monitoring is the whole installation. Timing/season of the monitoring must be carefully selected IAW the behavior and the biological cycle of each species. The annual minimum monitoring hours is indicated in Appendix F. A government concurrence in the contractor’s proposal is required.

1.2.2. The monitoring of Amorpha fructicosa (Itachihagi / Desert false indigo) shall be conducted at least once during the performance period. The community of the species growing at the agricultural lease area, HAD, is covering steep slopes and stabilizing the surface. Removal of the community is not required as it may cause soil erosion but removal of other communities and individuals is required if any. Recommendations for appropriate management of the species shall be provided in the annual performance report.

1.2.3. The monitoring of Robinia pseudoacacia (Harienju / Black locust) shall be conducted in at least two (2) seasons during the performance period. Removal of this species at the Camp Zama Golf Course (CZGC), KAD, AAD, and HAD (excluding the treating site, approximately 500 m²) is not required, but all individuals (and communities) shall be monitored and marked with a colored waterproof tape and also recorded on drawings/maps. Recommendations for appropriate management of this species shall be provided in the annual performance report.

1.2.4. The monitoring of Leiothrix lutea (Soshicho / Red-billed Leiothrix) shall be conducted at least twice during the performance period. Recommendations for appropriate management of this species shall be provided in the annual performance report.

1.2.5. The monitoring of Rana catesheiana (Ushigaeru / American bullfrog) shall be conducted at least twice during the performance period, through both daytime visual surveys and night-time audible surveys. Primary targets of daytime visual surveys include egg masses, larvae, and juvenile/adult bullfrogs, while night-time audible surveys mainly target bullfrog calls.

1.3. CONTROL OF INVASIVE SPECIES.

1.3.1. Control of Floral Species.

1.3.1.1. The contractor shall conduct removal of the below invasive floral species at designated installations and dispose of the waste off-base IAW local laws and regulations. The target area of invasive species control is the whole installation. Timing/season and frequency of this effort must be carefully selected based on a biological cycle of each plant to prevent formation and spreading of seeds, plant regeneration and germination of seeds. Use of chemicals (chemical approach) and other organisms (biological approach) are prohibited. A government concurrence in the contractor’s proposal is required. The list of target invasive species at designated installations and annual minimum control hours are indicated in Appendix E.

1.3.1.2. For the control of Sicyos angulatus (Arechiuri / Burr cucumber), Pistia stratiotes (Botanukikusa / Water lettuce), Coreopsis lanceolata (Ookinkeigiku / Lance-leaved coreopsis), and Ambrosia trifida (Oobutakusa / Giant ragweed), the contractor shall conduct the removal in at least two (2) seasons during the performance period. The contractor shall remove all the identifiable individuals of the species by hand pulling.

1.3.1.3. For the control of Solidago altissima (Seitakaawadachiso / Canadian goldenrod), the contractor shall conduct the removal in at least two (2) seasons in the performance period. The contractor shall either remove the identifiable individuals of the species by hand pulling or cut the above-ground portion of the identifiable individuals before or during the flowering season to prevent seed setting.

1.3.1.4. For the control of Robinia pseudoacacia (Harienju / Black locust), the contractor shall conduct the removal at CZ (excluding the CZGC but the individuals are targeted for monitoring) and HAD (the treating site only, approximately 500 m2), at least once during the performance period. The trunks of all the identifiable individuals of the species shall be cut at the ground surface level. Powered equipment is not allowed at HAD due to noise concern. At HAD, the contractor shall also clear away non-native plants and the undergrowth within the target area in order to promote the growth of indigenous trees.

1.3.2. Control of Faunal Species.

1.3.2.1. The contractor shall conduct removal of the below invasive faunal species at designated installations and dispose of the carcasses off-base IAW local laws and regulations. The target area of invasive species control is the whole installation. Timing/season, frequency, methods, and locations of this effort (if not specified) must be carefully selected based on behaviors and biological cycles of the targets. Use of chemicals (chemical approach) and other organisms/preys (biological approach) are prohibited. Caught individuals of this species shall be euthanized in the woods (or other obscure areas) on-base in a manner that, for their ease, makes them swoon as quickly as possible and also with minimum levels of scaring, screaming, feeling pain, and being in the public eye. A government concurrence in the

ATTACHMENT 1 RFQ# FA520921Q0015 contractor’s proposal is required. The list of target invasive species at designated installations and annual minimum control hours are indicated in Appendix E.

1.3.2.2. For the control of Procyon lotor (Araiguma / Raccoon), the contractor shall perform in removing this species by utilizing 10 box traps and 10 motion-activated cameras with no flashing unit per attempt. All the attempts shall take place outdoors, and the traps shall be checked daily to include changing baits.

1.3.2.3. For the control of Myocastor coypus (Nutoria / Nutria), the contractor shall perform in removing this species by utilizing eight (8) box traps and eight (8) motion-activated cameras with no flashing unit per attempt. All the traps shall be checked daily to include changing baits.

1.3.2.4. For the control of Garrulax canorus (Gabicho / Hwamei), the contractor shall perform in removing this species by utilizing 500 snare traps for bird and five (5) bird calling machines/speakers per attempt. All the traps shall be checked at least hourly to avoid native species from being accidentally taken. The snare trap is usually made from a loop of string which constricts bird’s body part(s) and keeps the bird from escaping. A loop of string is counted as a trap.

1.3.2.5. For the control of Micropterus salmoides (Ookuchibasu / Largemouth bass), the contractor shall perform in removing this species by trapping, netting, fishing, and/or other means of catching. In case other non-native species such as Cyprinus carpio (Koi / Common carp) and Lepomis macrochirus (Burugiru / Bluegill) is caught, the contractor shall dispose of them as well.

1.3.2.6. For the control of Gambusia affinis (Kadayashi / Western mosquito fish), the contractor shall perform in removing this species by trapping, netting, fishing, and/or other means of catching. The contractor shall avoid native species such as Oryzias latipes (Minamimedaka / Southern medaka) from being accidentally removed.

1.3.2.7. For the control of Rana catesheiana (Ushigaeru / American bullfrog), the contractor shall perform in removing this species by utilizing 20 traps/creels per attempt. All the traps shall be checked at least daily to include changing baits. In addition, the contractor shall manually remove eggs of the species if any.

1.3.2.8. For the control of Hestina assimillis (Akaboshigomadara / Red ring skirt), the contractor shall perform in removing this species. This effort targets all stages of the species (adult, pupa, larva, and egg) but shall mainly targets wintering larvae.

1.4. The contractor shall not damage the species at risk which are listed by the Government of Japan authorities in national and/or prefectural Red Lists / Red Data Books, their habitats, and the wetlands located within USAG Japan facilities. Data about the wetlands will be available to the contractor for reference only at the government office upon request. It will eventually be provided to the contractor after contract award.

1.5. SUBMITTALS. All the submittals shall be prepared in both English and Japanese.

1.5.1. Annual Work Plan. The contractor shall submit an annual work plan to the COR for approval within 30 calendar days after contract award and prior to commencement of field work. The annual work plan shall be developed based on preliminary studies including literature review (external and internal documents) and preliminary site survey. Also, it shall contain, but not be limited to, work schedule, all the target species, monitoring locations, and monitoring/data collection methods accompanied with justifications. The contractor shall make necessary adjustments to the annual work plan to avoid disruptions to Army’s mission essential activities.

1.5.2. Annual Pre-performance Meeting Minutes. The contractor shall coordinate with the COR to convene an annual pre-performance meeting in order to finalize project coordination, confirm the work schedule, and resolve any issues for smooth project execution. Meeting minutes shall be submitted to the COR prior to commencement of field work.

1.5.3. Monthly Interim Reports. The contractor shall submit a monthly interim report of field work to the COR by the 15th day after the end of each month, except months in which any field work is not conducted for this project. The monthly interim report shall summarize the field work conducted in the previous month with highlights of remarkable changes on inhabiting and growing situations/conditions of target species if any. The discoveries indicated in paragraph 1.1.4 shall be included in the monthly interim report as well.

1.5.4. Annual Performance Report. The report shall be prepared and submitted at the end of each performance period. The contractor shall submit one hard copy of the draft report to the COR for review within 60 calendar days after completion of the final field work of the performance period. Two (2) hard copies and two (2) electronic copies of the final report shall be submitted to the COR within 30 calendar days after the Government provides review comments.

1.5.4.1. Monitoring of TES. This part of the annual performance report shall be an all-inclusive report to cover services required in paragraph 1.1 and its subordinate paragraphs. It shall contain, but is not limited to, monitoring results, monitoring/data collection methods, date and location of field work, site drawings/maps, contractor’s name, address, phone number, fax number, names of field workers, and name of individual(s) who authenticates monitoring results and maps. The contractor shall identify status of the target species and efficient methods of managing the species through compilation, evaluation, and analysis of the collected data. These shall be documented in the report accompanied with comprehensive comments and recommendations. The comments and recommendations shall cover interpretation of monitoring results and regulatory requirements.

1.5.4.2. Control of Invasive Species. This part of the annual performance report shall be an all-inclusive report to cover services required in paragraphs 1.2 and 1.3 and their subordinate paragraphs. It shall contain, but is not limited to, performance results, control/monitoring methods, dates of field work, locations and areas (in square meter) of field work, site drawings/maps, before and after photographs, work volumes in person-day , contractor’s name, address, phone number, fax number, names of field workers, and name of individual(s) who authenticates monitoring results and maps. The contractor shall provide recommendations for future invasive species control including frequency, timing, and methods of control efforts, and for management of other invasive alien species of concern found on installations. The contractor shall also identify status of the target species stated under paragraph 1.2. and efficient methods of managing the species through compilation, evaluation, and analysis of the collected data. These shall be documented in the report accompanied with comprehensive comments and recommendations. The comments and recommendations shall cover interpretation of monitoring results and regulatory requirements.

1.5.4.3. The annual performance report shall be single-spaced using a professional page format. Site drawings/maps shall include sufficient detail to show interrelations of major features (i.e. north arrows, legends, etc.). Pages shall be numbered and of adequate legible quality suitable for reproduction. All hard copies shall be double sided, except full-size drawings/maps, and in white clear-view three-ring binders with the title of the project on the front covers and spines. Full-size drawings/maps shall be individually folded and enclosed as part of the report but not attached. All digital document files shall be PC compatible and provided in Microsoft Word and Adobe PDF formats. Photographs shall be submitted to the Government in JPEG or BMP format.

2.0. GENERAL INFORMATION.

2.1. CONTRACTOR PERSONNEL.

2.1.1. Contract Manager. The contractor shall provide a contract manager who shall be responsible for all requirements in this PWS. The name of this person and an alternate(s) who shall act for the contractor when the manager is absent, shall be designated in writing to the Contracting Officer (KO). The contract manager and alternate shall have full authority to act for the contractor on all matters relating to this contract. The contractor shall provide the contract manager’s names, email addresses, and telephone numbers. The contractor shall maintain a current listing of employees, providing updates to the COR as changes occur. The contract manager or alternate shall be proficient in English and have a good understanding of the requirements pertaining to this contract for interpretation and implementation of directives (written and oral) issued in English by the KO or COR. If the contract manager or alternate do not meet these requirements, the contractor shall provide a translator for them.

2.1.2. Contractor Employees. Contractor personnel shall be easily recognizable as contractor employees. This may be accomplished by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges/armbands which contain the contractor’s company name and the employee’s name.

2.1.2.1. Personnel Qualifications.

2.1.2.1.1. Supervisory Biologist. The contractor shall appoint at least one supervisory biologist who meets qualifications a, b, c, d and e. Instead, the contractor may appoint multiple supervisory biologists who meet, in addition to qualifications d and e, one or two of qualifications a, b, and c in a manner that covers all of qualifications a, b, and c as total. The contract shall submit all required certificates/licenses/ and work experiences with offer and upon change/update/revise of certificates/licenses. Those will be reviewed and examined for validity throughout the life of the contract.

Qualifications:

a. Second Class Japanese Taxonomic Proficiency Test, Plant Category (Seibutsu Bunrui Gino Kentei 2-kyu, Shokubutsu Bumon) or higher

b. Second Class Japanese Taxonomic Proficiency Test, Category (Seibutsu Bunrui Gino Kentei 2-kyu, Dobutsu Bumon) or higher

c. Hunting License, Animal Trapping Category (Shuryo Menkyo, Wana Ryo)

d. More than 10 years of experience in conducting natural resources and endangered species surveys in Japan.

2.1.2.1.2. Survey/Field Crews. The contractor shall utilize personnel with at least three (3) years of recent experience in natural resources and endangered species surveys or conservation work. They shall be capable of accomplishing the required work under the supervision of supervisory biologists qualified for this project.

2.1.3. Removal of Contractor’s Employees. The contractor shall utilize only experienced, responsible and capable employees in the performance of this contract. The KO may require that the contractor remove any of his/her employees who endanger persons or property, or whose continued employment under this contract is inconsistent with the interests of the U.S. Government.

2.1.4. Other Country Nationals (OCN). The security forces on each base control entry to the base. Under certain circumstances, the OCN might be denied entry. It is the contractor’s responsibility to coordinate with security forces at each base when there is a question about particular entry circumstances.

2.1.5. U.S. Government and/or Master Labor Contract Employees. The contractor shall not hire employees of the U.S. Government and/or Government of Japan Master Labor Contract employees in violation of the Procurement Integrity Act. See FAR 3.104. Furthermore, the contractor shall not employ any Department of Defense employee, either military or civilian, unless such person seeks and receives approval IAW Department of Defense 5500.7-R, Joint Ethics Regulation.

2.1.6. Military Personnel. The contractor is cautioned that off-duty active military personnel hired under this contract may be subject to permanent change of station (PCS), change in duty hours, or deployment. Military Reservists and National Guard members may be subject to recall to active duty. Abrupt absence of these personnel could adversely affect contractor’s ability to perform; however, their absence at any time shall not constitute an excuse for non-performance under this contract.

2.1.7. Roster. The contractor shall provide a complete roster of all personnel (including the contract manager and alternate contract manager) to the COR prior to start of performance. The roster must include all employee names, and telephone numbers. The contractor shall maintain a current listing of employees, providing updates as changes occur.

2.2. QUALITY CONTROL. The contractor shall develop and maintain a quality control program to ensure the services are performed IAW commonly accepted commercial practices. The contractor shall develop and implement procedures to identify, prevent and ensure non-recurrence of defective services. At a minimum, the contractor shall develop quality control procedures addressing the areas identified in Section 2, Services Summary.

2.3. QUALITY ASSURANCE. The Government will evaluate the contractor’s performance IAW the Quality Assurance Surveillance Plan (QASP) by appointing a COR to monitor performance to ensure services are received and satisfactory.

2.4. GOVERNMENT REMEDIES. The KO will follow FAR 52.212-4, Contract Terms and Conditions- Commercial Items, for the contractor’s failure to perform satisfactory services or failure to correct non- conforming services.

2.5. CONTRACTING OFFICER (KO) AUTHORITY. Only the KO has authority to enter into, administer, terminate or modify the terms and conditions herein. Any changes made by persons other than the KO will be considered an unauthorized commitment and subject to ratification actions IAW FAR 1.602-3.

2.6. CONTRACTING OFFICER’S REPRESENTATIVE (COR). The contractor shall coordinate all aspects of this requirement with the COR. Completed work shall be subject to inspection and acceptance by COR. This designation will be made in writing by the KO at the time of contract award, or prior to commencement of COR duty. The COR shall NOT direct or redirect any contractor action(s). This can only be done by the KO

2.7. AVAILABILITY OF FACILITY.

2.7.1. Hours of Service. The contractor personnel will perform the required services basically on weekdays, Monday through Friday (exclusive of the U.S. legal and other designated holidays listed below), during 0400-2200 hours, unless prior arrangements have been made with the COR. The contractor may face a need of performing the required services on Saturdays, Sundays, and Japanese and US legal holidays.

2.7.2. Legal American Holidays and Other Designated Holidays.

*Holidays falling on a Saturday will be observed on the preceding Friday, and holidays falling on a Sunday will be observed on the following Monday.

2.7.3. Arrangements of the Performance Time. Should the contractor decide to perform any of the required services before or after 0400-2200 hours, the contractor shall request approval prior to performance from the COR and shall do so at no additional cost to the Government.

2.8. SECURITY AND SAFETY REQUIREMENTS.

2.8.1. Installation Base Passes. The U.S. Government will issue all required Installation/Base Passes and Controlled Area Badges to contractor personnel at no cost to the contractor. Vehicle insurance certificates are required to obtain Base Passes and must cover the automobile liability insurance in the types and minimum amounts of (a) Bodily Injury - ¥30,000,000 per person per occurrence, in addition to the Japanese Compulsory Insurance (JCI), and (b) Property Damage - ¥3,000,000 per occurrence. The prime contractor shall be responsible for all passes issued to his/her own or subcontractor’s employees under this contract. The contractor shall return all applicable passes upon termination of employment or completion of this contract to the Japanese Pass Section, and a certificate of receipt shall be obtained.

NOTE: Contractor personnel are required to comply with U.S. Army Regulation 190-5 for personnel pass requirements. Contractors are also required to comply with U.S. Army Garrison Japan Regulation 190-13 for vehicle pass requirements. These regulations are available for the selected contractor’s review upon personnel and/or vehicle pass issuance.

2.8.2 Security Requirements. The contractor shall ensure each employee obtains all the required passes and identification items for access to U.S. Government’s installations. These items are issued by the Security Forces Pass and Registration Section. The contractor and employees shall return identification cards to Security Forces within 24 hours of termination or completion of this contract. All other Government identification for terminated employees shall be returned to the COR within 24 hours of termination.

2.8.3. Off Limit Signs. The contractor shall provide warning and/or ”OFF LIMITS” signs in both English and Japanese and post them at the entrances of jobsite, and barricades around the jobsite while the equipment and/or systems are being serviced, as necessary. The contractor shall control all personnel desiring access into jobsite areas when work is in progress.

2.8.4. Photography Permission. If the service requires photographing, the contractor shall request and obtain photo permit(s) from Physical Security Section, Directorate of Emergency Services, through the COR prior to commencing photography.

2.8.5. Reports of Damages, Destruction, Injury, or Death

2.8.5.1. The contractor shall report all incidents of damage or destruction to property, or personal injury or death to any person, arising out of and during the performance of this contract. The term “property” includes equipment, freight, or property of any type, whether Government owned or not. The term “Contractor” includes the contractor, its agents, servants or employees.

2.8.5.2. The contractor shall submit these reports to the KO through the COR as follows:

(a) A preliminary report shall be made as soon as practicable after the time the incident occurs. The report may be either verbal or facsimile.

(b) A complete written report shall be submitted within 4 days (96 hours) after occurrence of the incident. A copy of this report shall be furnished to the COR.

2.8.6. Security Danger Warning, Accident Prevention, Fire Prevention and Fire Protection Requirements. The contractor shall comply with all pertinent requirements of the U.S. Army and USAG Japan Fire Protection and Safety Regulations or Laws of Japan, whichever is more stringent, to ensure compliance by all subcontractors.

2.8.7. Accident Prevention Plan and Job Hazard Analysis. The contractor shall not commence work at the job site until an Accident Prevention Plan and a Job Hazard Analysis are submitted for review and approved by the COR. The contractor is responsible for reviewing section 01 and 33 of EM 385-1-1, the US Army Corps of Engineers’ Safety and Health Requirements Manual, https://www.publications.usace.army.mil/Portals/76/Publications/EngineerManuals/EM_385-1-1.pdf

2.9. ENVIRONMENTAL REQUIREMENTS. The contractor shall comply with the JEGS and other applicable U.S. and Japanese environmental laws and regulations to preserve, protect, and conserve the quality of the environment.

2.9.1. Environmental Management System (EMS). All personnel are required to complete the EMS awareness training (approximately 1 hour) prior to the commencement of work on USAG Japan facilities. The training record shall be retained and a copy submitted to the EMS Program Manager (Environmental Division, DPW) through the COR. This requirement will be waived when the training is not available to the contractor due to the Government circumstances.

2.9.2. Spill Prevention and Response. The contractor shall follow the USAG Japan Spill Prevention and Response Plan (SPRP) in addition to the JEGS and applicable environmental laws and regulations. In the event of a spill or release of Petroleum, Oil and Lubricants (POL) and hazardous substances occurred on USAG Japan facilities, the contractor shall immediately notify the Directorate of Emergency Services (911 or 046-407-2911) and the COR of the incident. The contractor will be liable for containment and clean-up of the spill/release.

2.9.3. Work Site Maintenance and Waste Disposal. The contractor is responsible for cleanliness of the work sites. Wastes and unserviceable materials generated under this contract shall be removed from the work sites at the end of each day and recycled/disposed of at off-base facilities IAW applicable Japanese environmental laws and regulations.

2.10. RESPONSIBILITIES FOR DAMAGES. Any damages caused to U.S. Government property during the course of performing this contract shall be restored, replaced and/or repaired to its original condition at no additional cost to the U.S. Government.

2.11. COMMERCIAL WARRANTY. The contractor shall provide the Government with their commercial warranty. The Government shall receive the same warranty service as the contractor’s most favored customers. If the services fail to be performed or otherwise fail due to workmanship or materials, the contractor shall correct the affected area(s) at no additional cost to the U.S. Government. The Government reserves the right to reject any unserviceable or substandard item and to require replacement with a serviceable like item or acceptable quality item or to require full credit for the item.

2.12. CONSERVATION OF UTILITIES. The contractor shall instruct employees in utility conservation practices. The contractor shall be responsible for operating under conditions, which preclude the waste of utilities. The contractor shall comply with additional energy policies upon notification by the KO.
